What Rights Do You Have During a DGGI Arrest and Interrogation in India?

If India’s Directorate General of GST Intelligence (DGGI) arrests you, the arrest must fit the conditions in section 69 of the Central Goods and Services Tax Act, 2017 (CGST Act). You must be told why you are being arrested and produced before a Magistrate within 24 hours. A section 70 summons is different: it is an inquiry demand for evidence or documents, not an arrest order.

The practical response depends on your legal status, the alleged offence and the document you received. Preserve every paper, record the timeline, obtain advice from an Indian criminal-tax lawyer and do not assume that either total silence or answering everything is automatically lawful or safe.

First identify what DGGI has done

DGGI investigations commonly involve searches, requests for records, summonses and, in some cases, arrest. Those actions have different legal foundations. A summons or search should not be described as an arrest authorization, and an investigation does not by itself give DGGI an unlimited power to take someone into custody.

Check the document and the officer’s words for your status. If you have been physically deprived of liberty, ask whether you are under arrest and from what time. If you were handed a section 70 summons, you are ordinarily an inquiry participant who is being required to attend or produce material. The legal consequences of those two positions are not interchangeable.

When can DGGI arrest you?

Section 69(1) of the CGST Act permits the Commissioner, when there are reasons to believe that a person committed specified offences in section 132(1)(a)–(d), to authorise an officer to arrest that person. The alleged offence and the statutory conditions matter. The provision is not a general authority to arrest every person questioned in a GST investigation.

The arrest authority therefore has two linked elements: a qualifying section 132 offence and the Commissioner’s “reasons to believe.” Whether those elements existed in a particular case is fact-specific. A person should not try to decide the issue at the scene; record what happened and have counsel examine the authorization, the alleged offence and the investigation record.

The CGST Act does not make a separate warrant requirement the test for every DGGI arrest. The relevant question is whether the statutory arrest power was properly invoked and exercised. Ask for the arrest-related paperwork and the grounds rather than relying on an assumption that the absence of a conventional warrant proves legality or illegality.

Rights immediately after an arrest

You must be told the grounds

Section 69(2) requires that an arrested person be informed of the grounds of arrest. Ask the officer to state the grounds clearly and request them in writing. Keep the written grounds, arrest memo, authorization and any accompanying papers. If the grounds are provided electronically, preserve the original message, attachment and metadata without editing the files.

In December 2024, the Delhi High Court addressed written communication of grounds in Kshitij Ghildiyal v. Director General of GST Intelligence, a DGGI arrest case. That decision is important practical guidance for asking for written grounds, but it is a decision of the Delhi High Court on the facts before it. It should not be presented as resolving every later procedural question or as a substitute for checking binding developments in the jurisdiction handling your case.

Production before a Magistrate within 24 hours

Section 69(2) also requires production before a Magistrate within 24 hours of arrest, excluding the time needed for the journey to the court. Note two times independently: when your liberty was actually restrained and when you were taken before the Magistrate. Keep travel and waiting details, because counsel can raise an apparent delay promptly at the first production.

At the production hearing, tell your lawyer about the timing, the grounds supplied, any force or pressure, medical needs and property taken from you. The Magistrate decides the immediate custody or bail request under the applicable law; DGGI does not decide that hearing unilaterally.

Access to legal advice

Article 22 of the Constitution protects consultation with and defence by a legal practitioner. Tell the officer that you want to contact a lawyer of your choice and make the request clearly on the record. Do not sign a statement, acknowledgment or inventory that you do not understand merely because you feel pressured.

India’s former Code of Criminal Procedure (CrPC) materials include a provision concerning a person’s ability to meet an advocate during interrogation. The current procedural framework is the Bharatiya Nagarik Suraksha Sanhita (BNSS), and the precise application to a DGGI inquiry depends on the proceeding and the facts. Counsel should confirm the current rule and whether the lawyer may be present for particular questions; do not assume that a lawyer can sit through every question, and do not assume that you must face the process without legal consultation.

Arrest versus a section 70 summons

Section 70(1) empowers the proper officer to summon a person whose attendance is considered necessary to give evidence or produce a document or other thing. The inquiry is treated as a judicial proceeding for specified purposes. A summons is an evidence-gathering mechanism; it is not itself an arrest under section 69.

Issue Section 70 summons Section 69 arrest
Legal source CGST Act section 70(1) CGST Act section 69(1) and (2)
Person’s status Person whose attendance or evidence is considered necessary Person whom the Commissioner authorised an officer to arrest for specified section 132 offences
Immediate legal effect Attend and respond or produce the requested material as lawfully required Loss of liberty, communication of grounds and production before a Magistrate within 24 hours
What the document should explain Issuing officer, date, attendance requirement and requested evidence or documents Arrest and the grounds for it, together with arrest-related records
Main legal concern Failure to attend or careless answers can create separate legal risk; the questions may expose you to criminal allegations Legality of the statutory authorization, grounds, timing, custody and bail
Next procedural step Prepare for the inquiry, preserve records and obtain advice Magistrate production, custody or bail decision and possible challenge to the arrest

Because the positions differ, advice for a summoned person cannot simply be copied from an arrested person’s checklist. Conversely, being called for questioning does not mean you have already been arrested.

How to respond to a DGGI summons

Authenticate it first

DGGI publishes verification routes for official communications. Depending on the platform used, verification may require a Document Identification Number (DIN), an eOffice Issue Number or a GSTN Reference Number (RFN). Use the identifier and the official verification facility specified for that communication before sending sensitive records or appearing at an unfamiliar location. If the message appears suspicious, preserve it and obtain advice rather than paying anyone or following an unverified link.

Read the scope and deadline

Write down the issuing officer, office address, appearance date and time, statutory provision, subject matter and each document requested. Separate documents you possess from those held by another entity. Ask counsel whether a written request for additional time or clarification is appropriate; do not simply ignore the date.

Prepare a controlled record set

  • Preserve original invoices, ledgers, returns, e-way bills, contracts, emails and relevant device data.
  • Make a copy or index of anything you hand over, including file names and dates.
  • Do not delete, alter or backdate records after receiving the summons.
  • Take identification and the summons, and tell a trusted person where you are going.
  • Arrange legal advice before the appearance if an answer could suggest tax evasion, fraudulent input tax credit or another section 132 offence.

A summons carries a duty to attend and respond as lawfully required. At the same time, the fact that an officer asks a question does not mean that every answer is risk-free. Counsel can help distinguish a request for an existing document from a question that calls for speculation, an admission or a legal conclusion.

Answering questions during interrogation

Know your status at each stage

Ask whether you are attending as a summoned witness, a person whose records are being examined, or an arrested person. Status can change during an investigation. If officers say that you are under arrest, ask for the time of arrest and the grounds, and switch immediately to the arrest safeguards described above.

Do not guess

Answer from your own knowledge. If you do not remember, say so and offer to check a record. Do not adopt a document you have not read, speculate about another person’s intent or sign a prepared narrative merely to end the questioning. Request an opportunity to read any statement or inventory carefully and correct factual errors before signing.

Self-incrimination is not a simple yes-or-no rule

Article 20(3) protects against compelled self-incrimination, but its application during a section 70 inquiry is legally sensitive. A 2026 Bombay High Court decision discussed the separate status of a person summoned under section 70 and explained that the protection does not automatically extend to every inquiry-stage question. The effect depends on the person’s status, the question, the manner of compulsion and later procedural developments.

That means two common pieces of advice are both unsafe: “you have no protection, so answer anything,” and “you may refuse every question.” Tell counsel what is being asked, especially where the answer could be used in a prosecution, and follow advice on objections, documents and the form of any response.

Record the process lawfully

Keep a contemporaneous note of arrival and departure, officers present, breaks, documents shown, questions that caused confusion and any threat, promise or physical pressure. Preserve notices, emails and receipts. Do not obstruct the inquiry or secretly alter records. If you believe coercion, ill-treatment or an unlawful demand occurred, tell your lawyer and the Magistrate at the earliest opportunity.

Bail and custody categories under section 69(3)

Section 69(3) does not give every DGGI arrestee an automatic right to immediate release. It sets different treatment for specified categories. For an offence specified under section 132(4), the arrested person is to be admitted to bail or, on default, forwarded to the Magistrate’s custody. For non-cognizable and bailable offences, the Deputy Commissioner or Assistant Commissioner has specified bail powers.

The alleged offence, its classification and the facts control which route applies. Ask counsel to identify the exact section 132 allegation and the applicable bail category before making assumptions about release. If bail is not granted at the departmental level, the Magistrate considers custody and bail at production.

If you believe the arrest or questioning was unlawful

Do not argue the entire case at the doorway. Preserve the authorization, grounds, summonses, statements, medical records and timeline. Tell the Magistrate promptly about missing grounds, an apparent breach of the 24-hour requirement, coercion or a medical problem. Counsel can evaluate appropriate applications or constitutional remedies, including a challenge to the arrest, custody or procedure.

The strength of a challenge depends on the documents and facts: the offence alleged, what the Commissioner recorded, when liberty was restrained, what grounds were supplied, how the questioning occurred and what the Magistrate ordered. A court’s ruling in one DGGI case should not be treated as a guaranteed result in another.

A practical checklist

  1. Ask whether you are being summoned, searched or arrested, and note the exact time.
  2. Request and preserve the written grounds if you are arrested.
  3. Request a lawyer of your choice and avoid signing anything you do not understand.
  4. For a summons, authenticate the communication and record its scope and deadline.
  5. Preserve originals and make an index of every document supplied.
  6. Answer accurately; do not guess, speculate or destroy records.
  7. Track the 24-hour production deadline and tell the Magistrate about any apparent delay or coercion.
  8. Obtain case-specific advice on bail, self-incrimination and any challenge to the procedure.

Limits of general information

This article concerns India’s CGST Act and DGGI procedures as understood on 13 October 2026. Arrest and interrogation law can change, and the BNSS framework and later court decisions may affect the advice applicable to a particular inquiry. A person facing a live summons, search or arrest should contact an Indian lawyer promptly rather than relying on a general checklist.
