Keep a complete, issue-by-issue GST dispute file: the source documents behind each disputed transaction or calculation, the entire notice-and-hearing record, proof of every submission, the adjudication order, and the appeal papers. Under section 36 of the Central Goods and Services Tax Act, books and records ordinarily must be retained for 72 months from the due date for the annual return for the relevant year. If the records relate to an appeal, revision, other proceeding or investigation, retain them until one year after final disposal or the ordinary period, whichever is later.
The right documents depend on what the notice alleges—such as a return mismatch, classification, valuation, exemption or input-tax-credit issue. A generic bundle is less useful than evidence that lets a reviewer trace each allegation to the accounting entry, underlying transaction, calculation and filing history.

Start with an allegation-to-evidence map
Read the show-cause notice (SCN) paragraph by paragraph and create an index before collecting documents. For every allegation, record:
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →- the department’s assertion and the tax period or transaction concerned;
- your response and the accounting or GST-return entry involved;
- the source documents that support your position;
- the reconciliation or calculation that connects those documents to the disputed amount; and
- when and how each item was submitted, including the portal acknowledgment or other filing proof.
This map prevents two common failures: sending a large unstructured bundle that does not answer the notice, and relying on a summary spreadsheet that cannot be traced back to original records. It also makes it easier to check whether the eventual order dealt with every material contention. The CGST Act requires an adjudication order to set out the relevant facts and the basis of the decision.

Transaction and computation records
Preserve the original paper records or reliably reproducible electronic versions, together with relevant audit-trail and inter-linkage information. Keep only material that relates to a disputed issue, but keep that material completely.
Invoices, notes and registers
- Tax invoices, bills of supply, debit notes and credit notes for the transactions in dispute.
- Purchase and sales registers for the relevant tax periods.
- General-ledger and subsidiary-ledger extracts showing how entries were posted.
- GST returns and working papers that show how the figures reached the filed return.
For an input tax credit dispute, link each credit to the supplier invoice, purchase register, ledger posting, return disclosure and payment or receipt evidence that is relevant to the allegation. For an output-tax dispute, show the sales invoice, customer account, tax calculation and the corresponding return line.
Contracts, orders and commercial terms
Keep contracts, purchase orders, amendments, statements of work and correspondence that establish what was supplied, to whom, when and on what terms. These records can be decisive where the notice concerns classification, place of supply, valuation, exemption or whether a transaction occurred at all. Preserve the version that governed the disputed period, not only a later template.
Delivery, receipt and movement evidence
- Goods-receipt notes, delivery challans, proof of delivery and acceptance records.
- E-way bills, lorry receipts, transport documentation and other movement records.
- Stock registers, inventory reports, inward and outward logs, and warehouse records.
- Service-completion certificates, timesheets or other performance evidence where the supply was a service.
Movement and receipt records should reconcile with invoice dates, quantities, value and the ledger. If quantities or dates differ, preserve the explanation and the corrected reconciliation rather than silently replacing the original file.
Payment and banking evidence
Retain bank statements, payment advices, remittance records, customer or supplier account statements and other proof of settlement that bears on the issue. Payment evidence may help establish that a supply or purchase was genuine, identify the recipient or supplier, and explain timing differences between books, returns and invoices.

Calculations and reconciliations
Keep the working papers used to calculate tax, interest, penalty exposure, reversals, eligible credit or any proposed adjustment. A useful reconciliation identifies the population tested, the source report, filters or assumptions, excluded items, formulae, reviewer and date. Preserve the underlying data export as well as the final spreadsheet so that a calculation can be reproduced.
Electronic records and audit trails
Save native files where possible, together with stable PDF copies for review. Retain system-generated timestamps, version history, access or change logs and the export method when those details bear on authenticity or sequence. Keep email headers and attachments, portal-generated files and digitally signed documents in a form that preserves their metadata. The Accounts and Records Rules contemplate paper or electronic source documents and information about audit trails and inter-linkages.

Build the complete adjudication record
Do not keep only the notice and your reply. Preserve the procedural history that shows what was alleged, what you supplied, whether a hearing was requested and how the decision was communicated.
| File component | Records to retain | Purpose in a dispute |
|---|---|---|
| Notice package | Show-cause notice, annexures, relied-upon documents and service proof | Defines the allegations, periods, amounts and material the department relies on |
| Taxpayer response | Reply, every enclosure, schedules and filing acknowledgment | Shows the defence and the evidence submitted at adjudication |
| Hearing record | Written hearing request, hearing notice, attendance proof, minutes or notes and additional submissions | Shows that the opportunity to be heard was requested or used and records oral or later written points |
| Decision record | Adjudication order, demand calculation and proof of communication | Identifies the findings, reasoning, tax, interest and penalty confirmed, and the date from which procedural deadlines may run |
| Appeal record | Appeal form, grounds, annexures, certified order, fee or payment records and acknowledgments | Proves what was filed and preserves the record for the appellate forum |
Notice, annexures and relied-upon material
Keep the exact SCN served, all annexures, the relied-upon documents supplied or identified by the department, and proof of service. If a document was available through a portal, save the downloaded copy and the download or communication details. The amount and grounds in the order matter because the Act provides that a demand should not exceed the amount stated in the notice or be confirmed on grounds outside the notice.
Replies and submission proof
Retain the signed or digitally filed reply exactly as submitted, each enclosure in the submitted order, portal submission receipts, acknowledgment numbers, email delivery records and any follow-up correspondence. If a file was rejected, resubmitted or corrected, keep every version and the reason for the change. A local copy without proof of filing may not establish that the authority received the material.

Hearing material
Keep a written request for a hearing, hearing notices, attendance or authorization records, contemporaneous notes, written arguments handed up at the hearing and any post-hearing submission. The Act provides for a hearing when one is requested in writing or when an adverse decision is contemplated. Record the date, participants, issues discussed and documents referred to while the events are fresh.
Records for a section 107 appeal
For an appeal under section 107, the CBIC appeal rules describe filing FORM GST APL-01 with the relevant documents. Under the stated procedure, a certified copy of the appealed decision or order is submitted within seven days, followed by an acknowledgment in FORM GST APL-02. Preserve the complete filed package, not just the form.
- FORM GST APL-01 and the final grounds of appeal.
- The certified copy of the appealed order and proof of its submission.
- All annexures, evidence indexes, reconciliations and written arguments relied on in the appeal.
- Fee or payment records where relevant, provisional and final acknowledgments, and correspondence about defects or resubmission.
- Later appellate orders and summaries, including FORM GST APL-04 where issued as the summary showing the final amount of demand confirmed.
Forms, filing modes, notifications and forum-specific procedures can change. Before filing a live appeal, verify the current requirements on the GST portal and with the applicable appellate authority.
Why first-stage evidence matters
Appeal rules generally restrict an appellant from introducing evidence that was not produced before the adjudicating authority or first appellate authority, as applicable. Additional evidence may be admitted in specified circumstances—for example, where evidence was refused, a party was prevented by sufficient cause from producing it, or there was not enough opportunity to present it. The appellate body must record reasons for admitting additional evidence and give the other side an opportunity to examine or rebut it.
Therefore, submit the important source documents, reconciliations and explanations during adjudication and keep proof of submission. If something genuinely could not be filed, document when it became available, why it was unavailable earlier, when you requested permission to file it and how the authority responded. Do not treat the appeal as a routine second chance to assemble a missing file.

How long to keep GST dispute records
Section 36 of the CGST Act states that required books and records are kept until the expiry of 72 months from the due date of furnishing the annual return for the year to which they relate. The period is measured from the annual-return due date, not simply from the end of the financial year.
Where a registered person is a party to an appeal, revision, other proceeding or investigation, records pertaining to that matter must be retained until one year after final disposal or the ordinary 72-month period, whichever is later. “Final disposal” should be tied to the actual proceeding and its later orders, not assumed from the date of the original adjudication order. Track the relevant annual-return due date, the date each proceeding is finally disposed of and the later retention endpoint in a schedule.
A practical dispute-file structure
Use a numbered folder structure and an index that a new adviser can understand without relying on the preparer’s memory:
- Notice: SCN, annexures, relied-upon material and service proof.
- Chronology: issue-by-issue index, tax periods, service dates, response deadlines, hearing dates and communication dates.
- Issue evidence: separate subfolders for each allegation, containing returns, ledgers, invoices, contracts, delivery or service proof, payments and reconciliations.
- Reply: filed reply, enclosure list, final attachments and portal receipts.
- Hearing: requests, notices, attendance proof, notes and post-hearing submissions.
- Order: adjudication order, calculation schedules, communication proof and any rectification correspondence.
- Appeal: APL-01, grounds, certified order, evidence, payment or fee records, APL-02 and subsequent acknowledgments.
- Later decisions: appellate orders, demand summaries, including APL-04 where applicable, and proof of communication.
Use consistent file names that include the issue, tax period, document date and version. Keep an unaltered source copy and a working copy. Restrict editing rights, back up the folder and record who prepared each reconciliation. A document organizer or scanner can help with indexing, but the GST rules do not require a particular software product.
Quality checks before submission
- Completeness: every notice paragraph has a response, evidence reference and calculation.
- Traceability: totals in schedules reconcile to the ledger and the relevant GST return.
- Authenticity: native files, signatures, metadata and audit trails are preserved where material.
- Consistency: invoice numbers, dates, values, tax rates, quantities and party details agree across records or differences are explained.
- Procedural proof: each filing has an acknowledgment, receipt, email record or other evidence of delivery.
- Deadline control: service and communication dates are recorded so reply and appeal periods can be calculated from the correct event.
- Retention control: no dispute folder is deleted under an ordinary retention schedule while a related appeal, investigation or other proceeding remains open.
Common record-keeping mistakes and fixes
Sending only a spreadsheet
A summary does not prove the underlying transactions. Attach or identify the invoices, ledgers, contracts, movement or receipt records, payment evidence and return extracts from which each figure was calculated.

Keeping a revised file but not the original
Replacing an invoice register or reconciliation destroys the chronology that may explain a discrepancy. Preserve the original export, the revised version, the change date and a short explanation of the correction.
Ignoring the submission trail
A reply saved on a computer is not the same as a reply shown to have been filed. Keep portal receipts, acknowledgment numbers, certified-copy delivery proof and correspondence about rejected or resubmitted documents.
Waiting until appeal to collect evidence
Because additional evidence is restricted, identify missing documents during adjudication, request time or permission where necessary, and put the reason for any unavoidable delay in writing.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteDeleting records after the original order
The proceeding may continue through appeal or revision. Apply the longer section 36 period whenever a record is connected to an ongoing matter, and keep later orders and communication proof with the original file.
When professional help is warranted
A live demand can involve limitation, jurisdiction, classification, valuation, exemption, input-tax-credit conditions, interest and penalty consequences that are not resolved merely by having documents. A GST tax professional or lawyer can help map evidence to the notice, test the calculation, preserve objections and comply with the forum’s current filing procedure. Give the adviser the indexed file, not an unsorted document dump, and keep a copy of everything delivered.
