Do not rely on a verbal promise or a recommendation that skips alternatives.
Debt-solution names, eligibility rules, creditor protections, fees, tax treatment, credit reporting and cancellation rights differ by country. The UK and US examples below illustrate questions to ask, not rules that automatically apply everywhere. Obtain independent advice from an appropriately regulated local service before committing.

Start with the recommendation: why this solution?
A suitable recommendation should follow a review of your income, essential spending, debts, assets and goals. Ask the adviser to explain the recommendation in plain language and compare it with every realistic alternative, including free or fee-free help.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsQuestions to ask
- What other options could fit my circumstances?
- Why is this option better for me than each alternative?
- What are the main disadvantages, and who might be unsuitable for it?
- Is your firm paid more for recommending one option?
The UK Financial Conduct Authority (FCA) identifies steering people toward fee-charging solutions without properly explaining alternatives as a warning sign. Alison Walters, the FCA’s Director of Consumer Finance, said on 22 September 2026: “Anyone struggling with debt deserves advice that puts their interests first. Free, impartial debt advice is available to everyone, and no one should be pressured or misled into paying for a debt solution that may not be right for them.”

Check that the payment is sustainable
Do not judge affordability by the proposed monthly figure alone. Ask for the calculation behind it and check every assumption against your bank statements and bills.
Ask how the budget was built
- Which income sources were included, and what happens if one ends?
- Which essential costs were allowed for, including housing, utilities, food, transport, insurance, childcare, healthcare and irregular annual bills?
- How were assets and household contributions treated?
- What amount is expected to remain for emergencies?
Then ask: “What happens if my income falls or an essential cost rises?” A workable arrangement should have a documented review process, not an assumption that your budget will remain unchanged. UK IVA guidance says payments should be comfortably affordable, sustainable and reviewed when circumstances change; the IVA Protocol says they should not cause hardship.
Test the budget yourself
- List your reliable monthly income after tax and benefits.
- Separate essential spending from optional spending, and include non-monthly costs by converting them to monthly amounts.
- List every debt, interest rate, arrears balance, secured borrowing and joint liability.
- Compare the proposed payment with the amount genuinely left after essentials.
- Ask the adviser to show how the payment changes under a job loss, benefit reduction, rent increase or major repair bill.
If the plan leaves no realistic buffer, pause. A payment that is technically possible for one month may be unsustainable over several years.
Get the total cost and payment allocation in writing
Request a complete fee schedule before signing. It should identify setup, ongoing, administration, review, variation, termination and any other charges, together with when each charge is taken.

Questions about money
- What is the total amount I am expected to pay if the arrangement runs as planned?
- How much of each payment goes to fees, and how much reaches creditors?
- When does each creditor receive money?
- Are fees deducted before distributions, and can fees increase?
- What happens to fees already paid if I cancel or the arrangement fails?
- Are there charges for missed payments, changing the plan, early completion or ending it?
UK IVA guidance says fees must be explained before agreement and that early payments typically cover more fees than debt. The 2025 IVA Protocol calls for a schedule showing how payments are divided between practitioner fees and creditor distributions. Those provisions are UK-specific; ask for the equivalent disclosure under your local law.
Do not accept “the creditors will get most of it” as an answer. Ask for currency amounts and a payment-by-payment illustration. If the provider will not put the figures in writing, do not sign.
Identify the debts included and the creditors’ powers
Make an account-by-account list and have the provider confirm exactly what is covered. Ask whether secured debts, taxes, student loans, joint debts, debts owed to family members or new borrowing are treated differently. The answer depends on the product and jurisdiction.

Creditor participation
- Must every creditor agree, or can the arrangement proceed without unanimous consent?
- When is an agreement legally binding?
- Which creditors have accepted, and how will that acceptance be documented?
- Can a creditor reject the proposal or later withdraw?
Under UK government guidance for debt management plans (DMPs), creditors do not have to accept a plan and may retain recovery rights unless the agreement says otherwise. A DMP is therefore not automatically a shield from collection. Do not generalise that UK example to an IVA, a US debt-settlement program or another country’s product.

Collection and legal action
Ask whether creditors can continue calls, letters, default notices, repossession action, wage garnishment, court proceedings or other enforcement while the proposal is being considered or after it starts. Ask who will notify creditors and what evidence you will receive. If a court deadline is approaching, tell the adviser immediately; a proposal does not necessarily stop a deadline.
Understand what changes when you stop paying directly
Some debt-settlement programs instruct consumers to stop paying creditors and place money into a separate account until enough accumulates for negotiations. Before following such instructions, ask:
- Will interest, late fees or penalty charges continue?
- Can creditors sue, obtain a judgment or take other collection action?
- Who controls the account holding my money, and can I withdraw it?
- What happens if a creditor refuses the proposed settlement?
- Are settlement fees charged before or after a creditor accepts?
US Consumer Financial Protection Bureau and Federal Trade Commission guidance warns that stopping payments can lead to additional fees and interest, collection activity, lawsuits, credit damage and possible tax consequences. These are US warnings, not universal legal outcomes. Check the rules where you live before withholding any payment.
Ask what failure, default or cancellation means
Every proposal should define failure in practical terms. Ask for the exact trigger, the notice period and the remedy.

Questions about missed payments
- How many missed or late payments constitute a breach?
- Is there a grace period or a formal variation process?
- Can the payment be reduced temporarily after a documented income shock?
- Will missed payments be reported to credit-reference agencies?
- What fees, interest or charges can be added?
Questions about ending the arrangement
- Can I cancel voluntarily, and how must I give notice?
- Can the provider terminate it, and for what reasons?
- How much of what I have paid is returned, retained as fees or distributed?
- What balances remain, and who can pursue them?
- Could I face tax, insolvency or legal consequences after termination?
Under the UK IVA Protocol, once an IVA terminates, creditors may again pursue outstanding balances directly and the consumer may be liable for interest and charges accrued during the IVA. The precise effect of termination elsewhere can be different, so obtain the contractual wording and local legal advice.
Compare options on the points that actually change your outcome
Use one written comparison for every option offered. If a value is not known, mark it as “not stated” and ask for an answer before proceeding.
| Comparison point | Question to put to the adviser | Why it matters |
|---|---|---|
| Total amount paid | What is the expected total, including every fee and possible charge? | A lower monthly payment can still cost more overall. |
| Payment allocation | How much goes to fees versus each creditor, and when? | Early distributions may be small where fees are taken first. |
| Duration | How long will payments last, and what could extend the term? | Longer arrangements affect cash flow and exposure to change. |
| Creditor consent | Is participation voluntary, voted on, or imposed by law? | Consent affects whether collection can continue. |
| Interest and charges | Are they frozen, reduced or allowed to accrue? | Accruing charges can increase the balance. |
| Collection and legal action | What can creditors do before acceptance, during the plan and after failure? | Protection may begin only at a specific legal stage. |
| Debts and assets affected | Which accounts, co-borrowers, property and other assets are included or excluded? | An excluded debt may still require separate payments. |
| Credit record | What entries or reporting consequences are likely, and for how long under local rules? | Credit effects vary by country and product. |
| Tax | Could forgiven or settled debt create a tax liability? | Tax treatment is jurisdiction-specific. |
| Change or exit | Can the plan be varied, completed early or cancelled, and at what cost? | Flexibility matters when income or household needs change. |
Know the jurisdiction-specific features before relying on an example
UK individual voluntary arrangements
An IVA is a legally binding arrangement administered under UK insolvency law. UK IVA key facts describe regular payments commonly lasting five or six years. The same guidance says an IVA may be unsuitable for some people with low debt, low disposable income or mainly benefit income. Those are UK-specific suitability considerations, not universal eligibility rules. Ask which debts and assets are affected, how equity or windfalls are treated, and what formal approval is required.

UK debt management plans
A UK DMP is generally an informal repayment arrangement. Government guidance says creditors do not have to accept it and can retain recovery rights unless the agreement provides otherwise. Confirm whether interest and charges are being stopped, whether all creditors have agreed and what happens if one refuses.

US debt-management and debt-settlement arrangements
The FTC says a DMP can take 48 months or more, while CFPB and FTC guidance describe risks associated with debt settlement, including fees, accumulating interest, lawsuits, credit effects and possible tax consequences. These figures and warnings describe US guidance and should not be transplanted to another country without checking local rules.
Verify who is advising you
Before sharing money or documents, obtain the firm’s full legal name, physical and postal address, the adviser’s role and qualifications, and the regulator or licensing body that oversees the service.
- Use the relevant regulator’s official checker to confirm the firm’s authorization and contact details.
- Call a number obtained independently, rather than relying only on a link or number in an unsolicited message.
- Ask whether the adviser is an employee, contractor or introducer.
- Ask whether staff receive commissions, bonuses or referral payments for selecting a particular solution.
- Confirm who holds client money and who handles complaints.
The FCA flags unclear firm identity as a concern. CFPB guidance recommends asking about counselor qualifications and compensation incentives. A legitimate adviser should answer directly and give you time to verify the information.

Take time to review the documents
Ask for the complete proposal, contract, terms and fee schedule in a format you can keep. Check that every verbal promise appears in writing, including payment reviews, creditor contact, cancellation rights and treatment of windfalls or extra income.
A pre-signing checklist
- Read the entire agreement, not only the summary page.
- Circle undefined terms and ask for plain-language explanations.
- Match every debt and balance against your own records.
- Check the first payment date and whether you must continue paying creditors directly.
- Look for automatic-renewal, variation, termination and complaint clauses.
- Ask an independent debt adviser or qualified lawyer to review unfamiliar legal terms.
- Do not sign under a same-day deadline or after being coached to give answers that are not true.
Pressure to agree quickly, promises of guaranteed results, coached answers, unexplained fees or refusal to discuss alternatives are reasons to stop and verify the advice. Free, impartial debt advice or nonprofit credit counselling may help you understand your choices before you pay a commercial provider.
What to do if the proposal no longer fits
Contact the provider as soon as your circumstances change; do not wait for a missed payment. Keep copies of payslips, bills, correspondence and payment confirmations. Ask for a written variation or hardship process and its effect on the term, fees and creditor distributions. If the provider will not explain your options, use the relevant complaints procedure and seek independent local advice about urgent collection or court action.
