A mortgage-risk transfer can change who owns your loan, who collects your payments, or both. It does not, by itself, let a new company rewrite the promissory note or mortgage. Your interest rate, payment formula, maturity date, and other contractual terms generally remain in force unless you separately agree to a lawful modification.
Federal rules give homeowners notice rights, a temporary payment safe period, procedures for correcting servicing errors, limits on negative credit reporting after a documented dispute, and continuity protections for pending loss-mitigation applications. The most urgent practical task is making sure payments, escrow records, and any modification or forbearance file move to the correct company without a missed deadline.

Two different transfers can affect your mortgage
“Mortgage risk transfer” is not one legal event. A loan owner can sell or assign the debt, while a mortgage servicer can transfer the right to collect payments and administer escrow. The owner and servicer may be separate companies. A bank can sell the loan but retain servicing, transfer servicing while keeping ownership, or transfer both.

| Loan ownership | The company that owns the note and receives the economic benefit of the debt changes. A covered owner must identify itself and provide contact information in an ownership-transfer notice. | Your signed note and mortgage terms, including the stated rate, payment formula, and maturity, remain the governing contract. |
| Loan servicing | The company that accepts payments, manages escrow, sends statements, and handles payoff or loss-mitigation requests changes. | The transfer does not authorize a new servicer to impose a different contract rate or payment formula. |
| Both | You may receive ownership and servicing information from different entities and must route payments to the servicer named for the effective date. | Existing contractual rights and obligations continue unless a separate agreement or applicable law changes them. |
The Consumer Financial Protection Bureau has cautioned that a sold loan does not necessarily have a new servicer. Read each notice for the effective date and the exact payment address rather than assuming that the owner is the payment recipient.

Notices you should receive and the deadlines they trigger
Federal notice rules are designed to give you a verifiable transition point. Keep every letter, envelope, email, and online message; the dates can determine whether a payment was protected or a foreclosure safeguard applies.
| Event | Federal timing or protection | Information to check |
|---|---|---|
| Ownership transfer | For covered owners, Regulation Z requires notice within 30 days after the effective transfer. | New owner’s name, address, telephone number, and instructions for questions or payments if applicable. |
| Servicing transfer | The old servicer generally sends notice at least 15 days before the effective date; the new servicer generally sends notice within 15 days after. A combined notice may be sent at least 15 days before. | Effective date, old and new payment addresses, account numbers, contact details, optional-insurance treatment, and a statement that other loan terms are unchanged. |
| Payment sent to the old servicer after servicing changes | For 60 days after the effective servicing-transfer date, an on-time payment sent to the old servicer cannot be treated as late or charged a late fee. | Proof of when you sent the payment, the address used, the due date, and any returned-payment instructions. |
| Written error notice or information request | The servicer generally has 30 business days to respond or resolve, subject to limited extensions. | Use the servicer’s designated address and identify the disputed payment, amount, date, and correction or records requested. |
| Credit reporting after a servicing-error notice | For 60 days after receiving your notice of a mortgage-payment error, the servicer may not furnish negative information about that payment to a credit-reporting company. | Delivery confirmation, a copy of the notice, and the date the servicer received it. |
| Complete loss-mitigation application pending at transfer | A complete application pending on the transfer date generally must be evaluated within 30 days after transfer, with transferred deadlines and procedures preserved. | Completeness date, documents transferred, next deadline, and the new servicer’s submission instructions. |
| Complete application submitted before a scheduled foreclosure sale | An application submitted more than 37 days before the sale receives the principal Regulation X evaluation protections; the exact restrictions depend on timing and status. | Scheduled sale date, date submitted, proof of completeness, and all notices received. |
Your loan terms usually survive a sale
The transfer of ownership changes the creditor, not the text of your signed agreement. A new owner or servicer generally cannot unilaterally raise the contract interest rate, change a fixed-rate payment formula, shorten the maturity, or add a fee that the note and mortgage do not authorize. Escrow amounts can change when taxes, insurance premiums, or an escrow analysis changes, but that is different from rewriting the loan’s underlying terms.
Compare the first statement from the new servicer with your prior statement and closing documents. A different account number, statement layout, or payment address is normal. A different principal balance, rate, contractual payment, or unexplained fee requires written clarification and, if inaccurate, a formal error notice.

Use the 60-day payment safe period correctly
During the protected period after a servicing transfer, send any scheduled payment according to the old instructions if that is where the payment was directed before the effective date, unless the notices clearly establish an earlier change. If the old servicer receives an on-time payment, it must forward the money to the new servicer or return it with directions. The new servicer cannot treat that payment as late or impose a late fee merely because it went to the old company.
The protection does not erase the obligation to pay. Keep bank records, electronic confirmations, canceled checks, postal tracking, and screenshots showing the address and date used. If an automatic debit is active, verify whether it will terminate or continue; do not create duplicate debits by enrolling with the new servicer before confirming the effective date.
How to challenge a misapplied payment or missing record
A phone call can alert a servicer, but a written notice sent to the designated address creates the clearest record. The address is often different from the payment address and may appear in the transfer notice or monthly statement.

- Identify the account. Include your name, property address, loan number, and contact information.
- Describe the error precisely. State the payment date, amount, method, destination, and why it was misapplied, returned, or labeled late.
- Request a specific correction. Ask the servicer to apply the payment to the correct account and remove any late fee or inaccurate delinquency status.
- Request supporting information. Ask for the payment history, transaction ledger, escrow accounting, owner identity, servicing-transfer records, and any document needed to reconcile the account.
- Attach copies, not originals. Include statements, receipts, confirmation numbers, and delivery proof while retaining the originals.
- Track the response deadline. The servicer generally has 30 business days to respond or resolve, with limited extensions allowed by the applicable rule.
Send the notice in a way that proves delivery and keep a complete copy. If the response does not correct the account, send a focused follow-up identifying what remains wrong and attach the earlier notice and response.
Protect your credit file while the dispute is pending
When the servicer receives a written notice of a mortgage-payment error, federal rules bar it from furnishing negative information about that payment to a credit-reporting company for the following 60 days. This is a reporting restriction, not a permanent deletion of accurate history. It is therefore important to state exactly which payment is disputed and to prove when the servicer received your notice.
Review all three major credit reports after the servicer responds. If a delinquency appears, dispute it with the credit-reporting company and the furnisher, attach the payment and delivery evidence, and explain that the account was in a servicing-transfer dispute. Continue monitoring statements; a separate, undisputed payment may still be due.

Pending forbearance, modification, or other loss mitigation
A servicing transfer should not force you to restart a properly submitted loss-mitigation file. When a complete application is pending on the transfer date, the new servicer generally inherits the applicable procedures and deadlines. It must use reasonable diligence to obtain documents transferred by the former servicer, determine what is missing, and explain any new submission process.
Immediately ask the new servicer, in writing, to confirm:
- Whether it received the application and every supporting document;
- The date the application became complete, or the precise item it says is missing;
- The status of underwriting or review;
- The next borrower deadline and the date a decision is due; and
- Whether a previously approved forbearance, trial plan, or modification remains active and where payments should be sent.
Resubmit a document only after preserving proof of the original delivery. Mark the cover page with the loan number, property address, document name, and the earlier submission date. Keep a chronological log of calls, names, confirmation numbers, uploads, and fax or overnight-delivery receipts.

Foreclosure timing makes every date significant
For a complete loss-mitigation application submitted more than 37 days before a scheduled foreclosure sale, Regulation X provides the principal evaluation and notice protections. Those rules require the servicer to evaluate the application and communicate a decision or available options; they do not guarantee approval of a modification, forbearance, or other alternative.
The protection depends on the application being complete and on the timing of the scheduled sale. A transfer can create confusion about both facts, so obtain a written completeness determination and preserve the sale notice. State foreclosure procedures, court orders, bankruptcy stays, military protections, reverse-mortgage rules, and loan-program requirements can add or alter deadlines. If a sale is scheduled soon, contact a qualified attorney or HUD-approved housing counselor immediately rather than relying on a general federal timeline.
What to do when the transfer notice arrives
- Build a side-by-side comparison. Check the old and new notices for the effective date, payment address, account number, escrow balance, telephone numbers, owner identity, and optional-insurance instructions.
- Verify independently. Use a trusted prior statement or the verified website of the loan owner to confirm the new servicer. Do not rely on an unexpected email, text, or caller demanding a wire transfer.
- Update payment systems at the right time. Change online bill pay, bank bill-pay instructions, or automatic debit only after confirming when the new instructions take effect. Schedule early enough to avoid processing delays.
- Reconcile the first statement. Compare principal, interest, escrow, fees, payment credits, and any outstanding suspense balance with your last statement.
- Secure your records. Save transfer notices, statements, payment confirmations, escrow analyses, tax and insurance evidence, and every loss-mitigation submission in one dated folder.
- Escalate a mismatch promptly. Send a written notice of error and information request to the designated address, naming the disputed amount, date, and requested correction.
- Confirm a pending workout. Ask the new servicer for written confirmation of application status, documents received, completeness date, and the next deadline.
Choosing help when the servicer does not fix the problem
The right escalation depends on the problem, the time remaining, and the quality of your records. A housing counselor can help organize statements, budgets, and loss-mitigation options. An attorney may be necessary for litigation, an imminent foreclosure, bankruptcy, or a state-specific claim.
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Clear out junk files and repair common Windows errorsFree Scan →- Ownership question: seek the owner’s identity and transfer records; the owner and servicer may be different.
- Payment error: prioritize the written error notice, delivery proof, transaction ledger, and credit-report review.
- Loss-mitigation problem: establish completeness, transferred documents, and the next decision deadline.
- Foreclosure urgency: calculate days to the scheduled sale and obtain state-specific advice immediately.
- Federal complaint: if the servicer fails to resolve the issue, a complaint to the Consumer Financial Protection Bureau can create an additional documented channel, but it does not automatically stop a foreclosure or extend a court deadline.
State law may provide remedies beyond the federal rules summarized here. The federal protections described above are a baseline, not a promise that every dispute will be decided in the homeowner’s favor.
