You may be able to claim House Rent Allowance (HRA) for rent genuinely paid to a parent, but the Income Tax Department’s published material does not expressly decide parent-landlord cases. The defensible approach is to document a real rental arrangement: you occupied residential accommodation you do not own, paid rent for the period claimed, and can reconcile the premises, landlord, dates and amounts across your records.
HRA exemption under section 10(13A) is available only under the old tax regime. The Department says it is not available under the new regime. Before claiming, assemble the evidence below and check your employer’s proof process and the tax regime you will use.

What the HRA rule requires
The Department’s general guidance describes HRA exemption for an employee who receives HRA, occupies residential accommodation that the employee does not own and actually pays rent for it. The allowance is governed by section 10(13A). See the Department’s explanation of allowances allowed to a salaried employee and its employee benefits guidance.

Those pages state the general actual-rent condition, not a parent-specific approval. They do not expressly say that rent paid to a mother, father or other parent is always accepted, and they do not prescribe a separate parent-landlord document set. A parent relationship therefore cannot, by itself, guarantee exemption. Your claim should reflect a genuine landlord–tenant arrangement, actual payment and accurate reporting.

- Two-Part Carbonless Receipt Book: Each receipt book has 50 sets of receipts, each with a white/light yellow section and the yellow section is kept in the receipt book to maintain detailed records.
- Consecutive Numbering: Pre-printed numbers on each receipt help you quickly navigate through your order.
- Wraparound Divider: A thick folded cardboard divider is integrated into the back of each receipt book to be used between each two-part sales order to prevent written content from rubbing on subsequent copies of receipts, which can lead to wasted receipts.
- 2 Packs/50 Sets (100 Sets Total): 50 sets of sequentially numbered carbonless receipt books are supplied with each receipt book. You can easily tear off each page of customer receipts and save the yellow part in the receipt book.
- Versatile Use: These receipt books with carbon copies are perfect for offices, businesses, homes, other cash transactions and more.
Do not claim an amount that was merely recorded on paper, paid back to you, or never paid. A receipt without a credible payment trail and occupancy facts can be challenged as inconsistent with the actual arrangement.
Proof to keep for a parent-landlord claim
Keep the records together for every month or period claimed. The documents are evidence of one transaction, not independent substitutes for one another.
1. Rent receipts for the claimed period
Obtain a dated receipt whenever rent is paid, covering the same months for which you claim HRA. The Department’s sample house-rent receipt shows the core fields to record:
Recommended Free Tools
- amount of rent received;
- period for which the rent was paid;
- full address of the rented premises;
- owner’s name and address;
- owner’s signature; and
- the owner’s PAN.
Use the parent’s legal name consistently. If the property has more than one owner, identify the person who is actually receiving rent and keep ownership details consistent with the arrangement. The sample is a practical format, not a statement that a particular commercial receipt book is mandatory.
2. A payment trail
Preserve bank statements, transfer confirmations, standing-instruction records or other payment records that corroborate each receipt. The official material identifies rent receipts, but it does not state that a bank transfer is universally mandatory. Treat electronic or other payment records as prudent corroboration rather than an inflexible statutory formality.

Make the payment description intelligible where your bank permits it, for example by identifying the month or rental period. Do not manufacture a backdated transfer after deciding to claim HRA. If rent was paid in cash, retain the signed receipt and be prepared to explain the timing and source of the cash; a receipt alone is weaker evidence than a receipt supported by a contemporaneous payment record.
3. Written rental terms
A written agreement can clarify the tenant, parent-landlord, premises, start date, rent, payment date and other terms. It is especially useful where the family shares an address or where the property contains separate portions. The sources reviewed do not establish that a written agreement is invariably mandatory for an HRA claim, so do not describe it as a universal legal prerequisite. It is supporting evidence that helps explain what the receipts and payments represent.

Keep the parent’s full name, address and PAN where available, and provide the information requested by your employer’s proof process. The Department’s sample receipt includes these fields. Do not rely on an assumed PAN threshold unless you have checked the rule applicable to the relevant tax year; the material cited here does not establish one.
5. Occupancy and ownership records
The address on your receipts and agreement should be the residential accommodation you actually occupied during the claimed period. Keep records that make the timeline credible, such as the address used in employer records or other ordinary correspondence. Most importantly, the accommodation must not be owned by you for the period in which you claim the exemption. If you own the home, paying rent to a parent does not turn it into accommodation “not owned” by you.
6. Employer declarations and payroll records
Employers set their own proof deadlines and may ask for a declaration, rent receipts, landlord details or a copy of the agreement. Follow the employer’s portal or payroll instructions and retain the submission confirmation. Employer acceptance is useful evidence of what you declared, but it does not replace the underlying requirement that rent was actually paid for accommodation you did not own.

7. Tax-return working papers
Income-tax returns are generally annexure-less: documents are not normally uploaded with the return. The Department’s ITR-1 FAQ says taxpayers should retain proof documents. Its ITR-2 filing guidance says rent-paid receipts are needed for HRA calculation when they were not submitted to the employer. Keep the receipts, payment records and calculation available even when no attachment is requested at filing.
How the evidence should match
| Check | What to reconcile | Practical question |
|---|---|---|
| Amount | Rent receipts and payment records | Does each claimed amount correspond to a payment actually made? |
| Period | Receipts, agreement, occupancy and payroll claim | Do the dates cover the same months you lived there and claimed HRA? |
| Premises | Agreement, receipts and address records | Is the address the home you actually occupied? |
| Landlord | Parent’s name, address, signature and PAN where available | Do the owner details identify the person receiving the rent? |
| Ownership | Your property and ownership facts | Was the claimed accommodation not owned by you? |
| Regime | Tax-regime selection and HRA computation | Are you using the old regime, where this exemption is available? |
These are consistency checks for a credible claim. They should not be read as six separate statutory forms that every employee must submit.
Step-by-step: prepare and submit your claim
- Confirm the regime first. HRA exemption is relevant only if you use the old tax regime. The Department’s new-tax-versus-old-tax-regime FAQ says HRA exemption is unavailable in the new regime.
- Define the claim period. List the months in which you occupied the parent-owned accommodation and actually paid rent. Exclude months with no occupancy or no payment.
- Write down the rental terms. Record the tenant, landlord, complete premises address, rent, payment frequency and start date in a written agreement or other clear contemporaneous document.
- Collect a receipt for each payment period. Make sure the receipt states the amount, period, premises, owner details, signature and PAN where available, following the Department’s sample.
- Match the payment record. Save the bank statement or other corroboration with the corresponding receipt. Investigate differences in dates or amounts before submitting the claim.
- Submit what payroll requests. Use your employer’s HRA-proof workflow and retain a copy of every document and the submission acknowledgement. If the employer does not request a document, keep it with your tax records.
- Compute the exemption using your actual salary data. Do not use the rent amount as the exemption automatically. Apply the statutory least-of-three calculation described below.
- Retain the file after filing. Because the return is annexure-less, you generally keep the evidence rather than upload it. The records should remain available if the Department asks how the figure was calculated.
How much HRA can be exempt
The Department describes the exemption as the least of these three amounts:
| Limit | How it is determined |
|---|---|
| Actual HRA received | The HRA component actually received for the relevant period. |
| Rent-based limit | Rent paid minus 10% of salary. |
| Salary-percentage limit | 50% of salary for the specified metropolitan locations or 40% of salary for other locations, according to the applicable rules. |
“Salary” for this calculation has a defined meaning in the Department’s guidance. Use the salary figures and location classification applicable to the relevant tax year, not a generic percentage of your total compensation. The result cannot exceed the actual HRA received, and a rent payment that was not actually made cannot be used to create an exemption.
Keep a worksheet showing each input: HRA received, rent paid by period, the 10% salary figure, the applicable 40% or 50% limit, and the least amount selected. This makes the return figure traceable to the receipts and payroll records.

Old regime versus new regime
The Department’s current regime FAQ states that HRA exemption is available under the old regime and unavailable under the new regime. Therefore, complete documentation cannot make an HRA claim allowable under the new regime. Choose a regime only after comparing your full tax position, including other deductions and allowances; HRA by itself may not determine the better result.
If your employer’s payroll estimate used the old regime but your final return uses the new regime, the HRA exemption must not be carried into the new-regime computation. Reconcile the regime shown in payroll records with the regime selected in the return.
What is different when the landlord is your parent?
The available official guidance does not expressly confirm or reject rent paid to a parent. It states the general requirements: actual rent for residential accommodation that the employee does not own. That leaves the factual authenticity of the arrangement central.
- The parent should have a genuine right or ownership interest consistent with being the landlord.
- The rent should be commercially and factually real for the accommodation, not a paper entry created only to obtain an exemption.
- The parent should report the rental income as required by the parent’s own tax circumstances; your HRA claim does not decide the parent’s separate tax treatment.
- Receipts, payment records, agreement and occupancy details should tell the same story.
- Do not claim rent for a home you own, for a period you did not occupy, or for amounts returned to you.
These safeguards do not convert an unresolved parent-specific issue into a guarantee. They reduce avoidable questions by showing the facts on which the general HRA rule depends.

Receipts were created only at year-end
Year-end preparation can leave missing months, inconsistent dates or unexplained cash payments. Reconstruct the records from contemporaneous bank statements and occupancy information, ask the landlord to sign accurate receipts, and claim only amounts that can be supported.

The receipt has no landlord PAN or signature
Use the Department’s sample as a checklist and obtain the missing information where available. Do not insert a guessed PAN or alter a document. If a field genuinely cannot be supplied, keep other corroborating records and follow the employer’s instructions rather than inventing details.
The address changes during the year
Separate the periods and prepare receipts and payment records for each premises. Do not use one address for months spent elsewhere. Your agreement, payroll declaration and occupancy records should show when the change occurred.
Rent was paid in cash
Retain signed receipts and a clear explanation of the payment dates and amounts. Cash is not automatically disallowed by the guidance cited here, but without a bank record you should expect the receipt and surrounding facts to carry more weight.
Employer rejected the proof
Ask payroll which field or period is missing, correct the submission and keep the rejection and resubmission records. Employer withholding treatment and the final tax return are related but separate; if HRA was not considered in payroll, retain the receipts for the return calculation and obtain professional advice if the figures are material or disputed.
The return was filed without attachments
That is normal for an annexure-less return. Do not send unsolicited documents with the return. Keep the complete evidence file and the calculation in case the Department requests support later.
A final pre-filing checklist
- You used the old tax regime for the HRA exemption.
- You occupied the stated residential premises during every claimed period.
- You did not own that accommodation.
- Rent was actually paid, not merely recorded.
- Receipts identify the amount, period, premises, owner details, signature and PAN where available.
- Payment records corroborate the receipts wherever possible.
- The agreement, receipts, payroll claim and address records agree.
- Your HRA figure is the least of actual HRA, rent minus 10% of salary, and the applicable 40% or 50% salary limit.
- You retained the documents even if neither the employer nor the return portal required an upload.
For a parent-landlord arrangement, this file is the practical answer to “what proof is needed”: evidence of a genuine tenancy and actual payment, prepared consistently and used only under the regime that permits HRA exemption.
