What Ontario’s Mortgage Broker Licence Rules Mean for Borrowers

In Ontario, mortgage brokers, agents and brokerages that conduct regulated mortgage-brokering work generally must be licensed by the Financial Services Regulatory Authority of Ontario (FSRA). That licence gives borrowers a way to verify regulatory status, understand an agent’s permitted lender access and use a formal complaint route. It does not promise the lowest rate, approval, a suitable mortgage or flawless conduct.

The rules sit under the Mortgage Brokerages, Lenders and Administrators Act, 2006 (MBLAA) and its regulations. Here is what a borrower should check before sharing documents or signing a mortgage commitment.

What Ontario’s mortgage licence requirement covers

FSRA’s consumer guidance says: “All individuals and businesses who conduct mortgage brokering activities in Ontario must be licensed with the Financial Services Regulatory Authority of Ontario (FSRA).” In practical terms, regulated activities include soliciting a loan secured by real property, giving a prospective lender information about a borrower, assessing a borrower, and negotiating or arranging a mortgage for someone else for compensation.

The requirement usually applies to both the individual dealing with you and the brokerage employing or sponsoring that person. A brokerage is also responsible for supervising its agents and maintaining the controls required by the MBLAA and regulations.

What licensing protects—and what it does not

FSRA licensing involves education, experience and suitability requirements. It creates accountability: the regulator can maintain public records, impose conditions or enforcement action, and provide a path for complaints about possible legal breaches. It is not an endorsement of a particular deal. A licensed person may still present an expensive product, misunderstand your circumstances or fail to find the mortgage you want. You must evaluate the actual recommendation and documents.

Exemptions can explain a missing record

Some organizations and professionals are exempt from Ontario’s mortgage-broker licensing requirement in specified circumstances. Banks and credit unions are common examples. Lawyers may also fall within an exemption for particular activities. Consequently, a provider who does not appear in FSRA’s records is not automatically operating illegally. Ask the provider to identify the exemption and explain why it applies to the service being offered. For a specific situation, confirm the current rule with FSRA or a qualified lawyer.

Level 1 and Level 2 mortgage agents

Ontario’s two agent classes took effect on April 1, 2023. The level matters because it limits the types of lenders an agent may deal with.

Licence class Permitted lender access described by FSRA What it can mean for a borrower
Level 1 mortgage agent Can deal with specified traditional or qualifying institutional lenders. Generally suited to applications placed with the institutional lenders covered by the rules. It may not be able to arrange an alternative or private mortgage.
Level 2 mortgage agent Can deal with the lenders available to Level 1 agents and with other mortgage lenders, including alternative and private lenders. Relevant when your circumstances or goals require access beyond qualifying institutional lenders.

A Level 2 designation is not a quality rating and does not mean a private mortgage is appropriate. It indicates a broader permitted lender range. Ask which lenders the agent can legally approach for your case and whether the proposed lender falls within that scope. The brokerage’s licence and the individual’s current status should both be checked.

How to check whether a mortgage provider is licensed

FSRA maintains public licensing records for mortgage brokerages, brokers and agents. Use the records before sending sensitive documents or paying a fee.

  1. Search the individual’s name. Check the spelling, current status and licence class. A business card or website description is not a substitute for the regulator’s record.
  2. Search the brokerage separately. Confirm that the person is connected to the brokerage shown in the record. A valid individual licence does not establish that an unrelated company is authorized to receive your application or money.
  3. Compare the details with your contact. Ask for the legal name of the brokerage, the agent’s level and the name of the responsible principal broker. Resolve differences before proceeding.
  4. Ask about an exemption if no record appears. Banks, credit unions and certain lawyers may be exempt in defined circumstances. Request the basis for the exemption and the exact entity providing the service.
  5. Save evidence. Keep a dated copy or note of the FSRA search, the licence information supplied to you and all written explanations. Status can change during a transaction.

A record confirms regulatory status, not the suitability of a loan. Continue with the disclosure and document review even when the search is clear.

Disclosures you should receive before agreeing to a mortgage

Ontario’s disclosure rules are designed to show who is involved, how the transaction is paid for and what risks and costs you are accepting. The information must be clear, understandable and provided at the earliest opportunity. For specified transaction events, FSRA states that the general timing is no later than two business days before the event, subject to regulatory exceptions and a valid waiver. A written-consent waiver process can reduce the period to one business day in the circumstances allowed by the rules. Treat these as timing requirements, not as a reason to rush a decision.

Representation and relationships

Ask, in writing, “Are you representing me, the lender, or both?” The brokerage should explain its role and relationships. If it can act for more than one side, the disclosure should identify the potential conflict and how the relationship will be managed. Do not assume that the word “broker” means the person is acting exclusively for you.

Compensation, fees and the total cost of borrowing

Request a written explanation of every fee you may pay, compensation the brokerage may receive from a lender or another party, and any other amount connected with arranging the mortgage. Compare the total cost of borrowing rather than the interest rate alone. Ask which figures are estimates, what assumptions were used and whether a fee is refundable if the mortgage does not close.

Conflicts and material risks

The disclosure should identify conflicts that could influence the recommendation and material risks of the mortgage. Depending on the product, those risks can include payment changes, penalties for prepayment, enforcement consequences after default, a short maturity requiring refinancing, or conditions attached to an alternative or private loan. The precise risks depend on the contract and your circumstances; insist on a plain-language explanation of the terms that affect you.

When the paperwork arrives late

If you receive required information only shortly before signing, ask the brokerage to identify the applicable exception or obtain the permitted written waiver. You can request more time to review the mortgage and obtain independent advice. A deadline set by a seller, lender or intermediary does not remove your need to understand the documents.

Questions about lender concentration and the brokerage’s own lending

A brokerage must disclose the number of lenders it acted for in the previous fiscal year and whether it was itself a lender. This helps you judge how broad its practical market access is, but a large lender count does not prove that the available mortgages are suitable or competitive.

On request, the brokerage must also disclose whether it or any lender represented more than 50 per cent of the number of new mortgages and renewals it arranged. The threshold is measured by the number of deals, not by the dollar value of those mortgages. For example, a brokerage could arrange a majority of its transactions with one lender even if another lender supplied a larger share of the total dollars.

Ask for the period covered, the calculation by deal count and whether the disclosure includes renewals as well as new mortgages. Use the answer to probe the recommendation: “What other lender types did you consider, and why was this one selected for me?”

Reverse mortgages have an additional legal-advice requirement

For a reverse mortgage, FSRA says a brokerage cannot arrange or enter into the mortgage unless the borrower gives it a statement signed by a lawyer confirming that independent legal advice was provided. The advice must be independent; it is not simply an explanation from the broker or the lender.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The lawyer’s statement does not transfer the broker’s responsibilities. The brokerage still must address suitability and disclose material risks and costs. Before signing, confirm how interest accumulates, how the balance can affect home equity, what happens if you move or die, whether taxes and insurance remain your responsibility, and what events can require repayment. Those terms are contract-specific, so read the offer and obtain advice on the actual document.

How to compare brokers, agents and mortgage routes

Use the same questions for each option so that a low advertised rate does not hide a higher total cost or narrower service. The following framework keeps the comparison focused on information the Ontario rules make relevant.

Comparison point What to ask Why it matters
Licence status and class Are the individual and brokerage current in FSRA’s records? Is the agent Level 1 or Level 2? The level determines whether the agent can approach alternative and private lenders.
Representation Does the brokerage act for me, the lender or both? Conflicts and duties can differ depending on the relationship.
Market access How many lenders did the brokerage act for last fiscal year? Was it a lender itself? Will it provide the greater-than-50-per-cent disclosure if requested? Shows concentration and whether the brokerage has its own lending interest.
Compensation and cost What will I pay, what will the lender or another party pay, and what is the total cost of borrowing? A rate comparison alone can miss fees, penalties and other charges.
Suitability and risk Which terms create the greatest risk for my income, timeline and exit plan? A mortgage that works at closing may become unaffordable at renewal, payment reset or sale.

Read the mortgage itself, not just the licence disclosure

Licensing and disclosure rules do not replace a careful review of the commitment, statement of cost of borrowing and final mortgage. Check the interest calculation, payment schedule, term and amortization, renewal process, prepayment privileges and penalties, default remedies, collateral-security wording, fees added to the balance, and any conditions that must be met before funding.

Ask the broker to explain every estimate and assumption, including income used for qualification, property value, down payment, closing costs and the rate used for a stress test. If the mortgage depends on refinancing or selling the property later, identify what happens if that plan fails. Standard terms may not fully describe a material risk in your particular situation; request clarification in writing and consider independent legal or financial advice for complex documents.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to do when something seems wrong

Start with the brokerage. Put the concern in writing, describe the transaction and identify the document, statement or conduct you believe is wrong. Include dates and copies rather than sending originals. Ask for a written proposed resolution.

  1. Preserve your file. Keep applications, disclosures, emails, text messages, commitments, fee receipts and signed mortgage documents.
  2. Write to the brokerage’s complaint contact. State the outcome you want, such as a correction, explanation or refund review.
  3. Allow a reasonable response period. FSRA requires a written proposed resolution and notice that an unsatisfactory complaint about a breach of the MBLAA or regulations can be referred to FSRA. The regulator does not set one universal number of days for every brokerage response.
  4. Escalate an unresolved legal-conduct concern to FSRA. Follow FSRA’s current complaint instructions and provide the written record.
  5. Keep the brokerage’s response. Brokerages must retain written complaint records for at least six years, and your own file can be important if another dispute process is available.

FSRA’s role is regulatory. It may examine possible non-compliance, but it does not guarantee that a lender will approve you, rewrite a contract or award compensation in every dispute. For urgent legal deadlines, foreclosure risk or advice about signing, obtain independent professional advice promptly.

Borrower checklist before you commit

  • Search the individual and brokerage in FSRA’s public records.
  • If no record appears, ask which exemption applies and who is legally providing the service.
  • Confirm the agent’s Level 1 or Level 2 class and whether it covers the lender types under consideration.
  • Ask whether the brokerage represents you, the lender or both.
  • Obtain written fees, compensation, conflicts, material risks and total cost-of-borrowing information.
  • Ask how many lenders the brokerage acted for last fiscal year and whether it was a lender itself.
  • Request the more-than-50-per-cent lender disclosure when concentration would affect your decision.
  • For a reverse mortgage, arrange independent legal advice and provide the required lawyer-signed statement.
  • Keep every disclosure and signed document; do not rely on a verbal promise that is absent from the paperwork.
  • If a concern remains, complain to the brokerage in writing and retain its response.

Ontario’s licence system is most useful when you treat it as a verification and accountability tool. Confirm the status and permitted role, test the brokerage’s incentives and lender access, insist on timely plain-language disclosures, and judge the mortgage by its complete costs and risks—not by the licence or headline rate alone.
