OCC permission to conduct crypto-related banking activities is not deposit insurance. National banks and federal savings associations may, within specified limits, custody crypto-assets, hold dollar deposits that serve as stablecoin reserves, use distributed-ledger or stablecoin systems for permissible payments, and execute customer-directed crypto trades. Those permissions concern what a bank may do. They do not turn crypto into a bank deposit, guarantee its price, promise redemption, or make it FDIC-insured.
Your protection depends on the legal claim you actually hold. A checking account, savings account, money-market deposit or certificate of deposit at an FDIC-insured bank is ordinarily an insured deposit, subject to ownership-category limits. Crypto held in custody, a stablecoin issued by another company, and a balance owed by a nonbank intermediary are different claims with different risks.

What changed in the OCC’s 2025 crypto interpretations
The Office of the Comptroller of the Currency (OCC) addressed crypto banking in two interpretations issued in 2025. They clarified existing authority and removed a procedural hurdle; they did not create a new category of insured crypto account.
Interpretive Letter 1183: custody, reserves and payment activity
On March 7, 2025, OCC Interpretive Letter 1183 reaffirmed that national banks and federal savings associations may provide crypto-asset custody. It also addressed banks holding dollar deposits that serve as reserves for stablecoins in certain circumstances, and using distributed-ledger technology and stablecoin activities to facilitate permissible payments.

The same letter rescinded Interpretive Letter 1179’s supervisory non-objection process. A bank no longer has to use that specific non-objection pathway for the activities covered by the interpretation, but it still must operate within its legal authority and manage the associated risks. Acting Comptroller Rodney E. Hood described the standard this way: “The OCC expects banks to have the same strong risk management controls in place to support novel bank activities as they do for traditional ones.”
Interpretive Letter 1184: customer-directed trading and outsourcing
On May 7, 2025, Interpretive Letter 1184 confirmed that a bank may buy and sell crypto-assets held in custody when the customer directs the transaction. The letter also confirmed that a bank may outsource permissible custody or execution functions, provided it manages the risks of the third party.
For customers, that can mean a bank-branded interface uses a specialist custodian, trading venue, technology provider or other contractor. The outsourcing decision does not transfer responsibility for safe and sound operations away from the bank. It also does not change what you own: a trade executed from a custodial crypto account does not become a deposit simply because a bank arranged it.

What OCC authority does—and does not—promise
An OCC interpretation answers an authority question: whether a national bank or federal savings association may conduct a specified activity under banking law. It is not a product endorsement, solvency guarantee or insurance certificate.
- It can permit a service. The bank may be allowed to custody crypto, execute a customer’s order, hold certain reserve deposits or use a distributed ledger for an otherwise permissible payment.
- It does not insure the asset. FDIC insurance generally covers qualifying deposits at an FDIC-insured bank, not crypto-assets, tokens or claims on a crypto issuer.
- It does not fix market risk. A permitted crypto service can still expose you to price volatility, liquidity limits, network failures, fraud, private-key loss or a counterparty default.
- It does not guarantee redemption. Neither OCC authority nor a bank’s participation alone promises that a stablecoin can always be redeemed for one dollar.
- It does not make every balance at a bank a deposit. The account agreement and the way funds are recorded determine whether you hold a deposit, a custodial asset or another claim.
The July 14, 2025 joint statement from the OCC, Federal Reserve and FDIC says banks providing crypto safekeeping must operate safely and soundly and comply with applicable law. It created no new supervisory expectations. The agencies also recognized “the evolving nature of the crypto-asset market, including the technology underlying crypto-assets, its benefits, and the importance of a risk management framework to manage the associated risks.”

Identify what you actually hold
Before asking whether a balance is insured, identify its legal category and the party that owes you money. Similar-looking balances in one app can have very different protections.
| What the customer holds | Who owes the customer value | Insurance or protection described by the rules | How OCC authority relates |
|---|---|---|---|
| Checking, savings, money-market deposit or CD at an FDIC-insured bank | The insured depository institution | FDIC deposit insurance, subject to ownership-category limits | Crypto permissions do not change the ordinary deposit rules |
| Crypto-assets held in bank custody | The customer owns the crypto; the custodian owes safekeeping and performance under its agreement | Crypto-assets are not FDIC-insured deposits | Letters 1183 and 1184 describe custody and customer-directed execution authority |
| Stablecoin issued by a stablecoin issuer | The issuer, under the token’s terms | OCC authority does not provide FDIC insurance to the token holder | A bank may hold certain dollar reserves or support permissible payments |
| Balance owed by a nonbank intermediary | The nonbank platform or program operator | Coverage depends on whether funds are actually held as qualifying deposits; the nonbank’s bankruptcy is not covered | A bank partnership or banking-as-a-service arrangement does not by itself create insurance |
“Held at a bank” can therefore mean several things. A bank may be the depository institution for your dollars, the custodian of your crypto, a reserve bank for an issuer, or merely a participant behind a nonbank interface. Those roles should be stated separately in the contract and disclosures.
How FDIC insurance applies to deposits
The FDIC’s consumer guidance states: “The FDIC only insures your money if it is in a deposit account at an FDIC-insured bank.” The standard maximum is $250,000 per depositor, per insured bank, per ownership category. The amount is not a blanket limit for everything a customer owns through one financial app.
What usually qualifies
Qualifying deposit accounts include ordinary checking and savings accounts, money-market deposit accounts and certificates of deposit when held at an FDIC-insured bank. The ownership category—such as an individual account, joint account or certain retirement-account categories—affects how the limit is calculated. Deposits in different ownership categories can receive separate coverage, while accounts in the same category at the same insured bank are generally aggregated for the limit.
What does not qualify merely because a bank is involved
Crypto held for you is not converted into an insured deposit by being kept in a bank-controlled wallet or ledger. A token, stablecoin, fund share, security or other investment is not a deposit simply because its issuer uses a bank for reserve accounts. A contractual claim on a nonbank is not automatically insured because the nonbank advertises a “bank partner.”

If a provider fails, deposit insurance protects qualifying deposits at the insured bank; it does not insure the provider’s operating company, cover a shortfall in a crypto wallet, or reimburse a loss caused by a token’s price decline. The relevant question is where your money is legally deposited, not which logo appears on the application.

Stablecoin reserves and the 2026 FDIC proposal
Stablecoins are tokens designed to maintain a reference value, often one U.S. dollar. A holder usually has a claim governed by the issuer’s terms, not a traditional bank account. A bank’s role in holding reserve dollars does not by itself give the token holder a direct insured-deposit claim.
On April 7, 2026, the FDIC approved a proposed rule to implement the GENIUS Act. The proposal would provide that deposits backing payment stablecoins are not insured to stablecoin holders on a pass-through basis. It would treat qualifying tokenized deposits like other deposits. This is a proposal, not a final rule, and its text may change before adoption.
Why the distinction matters
Suppose an issuer places reserve dollars in an FDIC-insured bank. The bank’s account may be a deposit belonging to the issuer or another eligible account holder. That fact does not necessarily give each token holder an insured claim against the bank. Under the proposed approach, payment-stablecoin holders would not receive pass-through FDIC coverage merely because reserve deposits exist.
A tokenized deposit is different: it is a digital representation of a deposit claim that meets the applicable requirements. If it qualifies as a deposit, the ordinary insurance framework—including the $250,000 limit and ownership-category rules—would apply to the depositor’s claim, not automatically to every person who can transfer the token.

Because the proposal is not final, customers should read the current product terms and disclosures rather than relying on a future rule. Look for the named depositor, the insured bank, the redemption obligation and any statement about whether the balance is a deposit or a token issued by another company.
Why a nonbank “bank partner” claim is not enough
Many fintech and crypto services present one interface for spending, saving and trading while separate companies perform the legal functions. A nonbank may receive your money, transmit it to a partner bank, or maintain an internal ledger that shows your balance. The FDIC has warned that insurance depends on funds actually being held as qualifying deposits at an FDIC-insured bank.
Even when a deposit is correctly placed at an insured bank, FDIC insurance does not cover the nonbank’s bankruptcy, recordkeeping failure or other obligations. Recovering funds from a failed intermediary can involve the intermediary’s records, contract and insolvency process. A “bank partner” statement should therefore be treated as a prompt to investigate, not as proof that every balance is insured.

How to check a crypto-enabled bank product before depositing money
- Read the account agreement. Find the exact legal description of your balance: deposit account, custodial crypto, stablecoin, tokenized deposit or claim on a nonbank.
- Identify the party that owes you money. Record the legal name of the insured bank, custodian, stablecoin issuer and any intermediary. Do not rely on a trade name alone.
- Confirm the insured-depository institution. Determine whether the named bank is FDIC-insured and whether your particular dollars are deposited there, rather than merely routed through it.
- Map the insurance limit. Add your qualifying deposits at that bank within the same ownership category and compare the total with the $250,000 standard maximum.
- Separate dollars from tokens. A cash balance may be a deposit while a stablecoin or crypto balance in the same app is not. Check whether conversions move funds between different legal accounts.
- Review custody and withdrawal terms. Look for segregation language, loss allocation, withdrawal timing, network fees, supported chains and what happens if the custodian or provider fails.
- Check the rule’s status. Distinguish a final OCC interpretation, interagency supervisory statement and proposed FDIC rule. A proposal is not an enforceable final protection.
- Ask for written answers. Request confirmation of where cash is held, who controls crypto keys, whether the bank may rehypothecate assets, and which losses are excluded. Keep the response with your records.
Common customer situations
You have $40,000 in a checking account and $40,000 in crypto custody at the same bank
The checking balance may be an insured deposit, assuming the bank is FDIC-insured and the account fits within the applicable ownership-category limit. The crypto remains a custodial asset and is not added to the deposit-insurance calculation as though it were cash.
You buy a stablecoin through a bank-branded application
The application’s branding does not decide the legal status. If you receive a token issued by a stablecoin issuer, your claim is governed by that issuer’s terms. Reserve dollars held at a bank do not automatically give you pass-through FDIC coverage, and the 2026 FDIC treatment described above is still proposed.
You keep dollars with a crypto company that advertises an insured bank partner
Find out whether your dollars are recorded as a deposit at the named bank, who the depositor is, and whether the intermediary can access or commingle the funds. If the company itself owes you the balance, FDIC insurance does not cover the company’s bankruptcy merely because a partner bank is involved.

Interpretive Letter 1184 supports that activity for crypto-assets held in custody, subject to the bank’s controls and applicable law. The resulting crypto position is still not a deposit, and a loss from market movement is not an insured-deposit loss.
Timeline of the key actions
| Date | Action | Customer significance |

| May 7, 2025 | OCC Interpretive Letter 1184 | Confirmed customer-directed buying and selling of crypto held in custody and permissible outsourcing with third-party risk management |
| July 14, 2025 | Joint OCC, Federal Reserve and FDIC crypto-asset safekeeping statement | Restated safe-and-sound and legal-compliance expectations without creating new supervisory expectations |
| April 7, 2026 | FDIC approval of proposed GENIUS Act implementation rule | Proposed no pass-through insurance to payment-stablecoin holders for backing deposits; qualifying tokenized deposits would be treated like other deposits |
The practical rule for customers
Judge the protection by the asset and the legal claimant, not by the bank’s technology or marketing. A qualifying deposit at an FDIC-insured bank can receive deposit insurance up to the applicable limit. Crypto in custody remains exposed to crypto-market, custody and operational risks. A stablecoin remains a claim on its issuer unless the terms and applicable law establish something different. A nonbank balance depends on the intermediary’s structure and contract.
State-chartered banks, broker-dealers, crypto exchanges and individual product agreements can involve additional regulators and protections. Before moving money, identify every entity in the chain and the precise event that would make you whole: bank failure, custodian loss, issuer default, unauthorized transfer or market decline. Those are different events, and no OCC interpretation makes them interchangeable.
