What Mortgage Servicers Must Do When They Receive a Payment Dispute

By TheFinanceBase Team 9 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A properly delivered written notice of error can require a mortgage servicer to acknowledge your dispute, investigate the account, correct any servicing mistake, or explain in writing why its records show no error. The process applies to covered closed-end mortgages when the notice identifies you, the loan, and the specific servicing problem and is sent to the servicer’s designated address for error notices or information requests.

During the review, the servicer cannot charge a fee or demand a payment as the price of investigating. You generally must keep making the payments required by your loan, however, and the dispute does not automatically stop interest, collection activity, or foreclosure. The sections below explain the deadlines, required contents of the response, credit-reporting protection, and the safest way to send your notice.

When Regulation X dispute duties apply

Federal Regulation X creates a formal error-resolution process for a closed-end mortgage loan secured by a dwelling. A borrower can use either a notice of error or a servicing-related Qualified Written Request (QWR). A QWR is a written correspondence that identifies the borrower and account and requests information relating to the servicing of that loan; when it describes a servicing error, it functions as an error notice for the relevant rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

These federal notice-of-error and QWR provisions are not required for a home-equity line of credit. Loan type matters, so confirm whether the account is a closed-end mortgage before relying on the Regulation X timetable. State law, the mortgage contract, and other federal rules may provide additional rights.

Information your writing must contain

  • Your full name and the property address.
  • The mortgage account number, or enough information for the servicer to locate the account.
  • A concise, specific description of the servicing error. Examples include a payment that was not credited, an incorrect allocation between principal and interest, an improper fee, an escrow disbursement problem, or an inaccurate payoff amount.
  • The correction or information you want the servicer to provide.

A general expression of dissatisfaction is less useful than a factual description tied to a date, amount, statement, or transaction. A telephone call alone is not a guaranteed Regulation X notice because it is neither written nor readily traceable.

Use the designated address

Send the notice to the special address the servicer designates for notices of error or information requests. It may be different from the address used for monthly payments. Look for it on the periodic statement, coupon book, servicing-transfer notice, or the servicer’s website. A letter mailed to the payment address can fail to receive the special protections if that is not the designated address.

Do not write the dispute on a payment coupon or other payment form. A servicer does not have to treat a payment coupon as a notice of error, even if you add a paragraph describing the problem.

The servicer’s required timetable

Regulation X uses days that exclude Saturdays, Sundays, and legal public holidays. The current federal timing is:

Required action Deadline What the servicer must do
Written acknowledgment Within five qualifying days after receipt Send written acknowledgment that it received the notice.
Ordinary substantive response Within 30 qualifying days after receipt Complete a reasonable investigation and send a compliant written determination.
Permitted extension Up to 15 additional qualifying days Before the first 30-day period ends, give written notice of the extension and the reason it is needed.
Documents relied on for a no-error decision Within 15 qualifying days after your request Provide the documents without charge, subject to confidentiality, proprietary-information, and privilege limits.
Adverse credit reporting about the disputed payment Protected for 60 days after receipt Do not furnish adverse information to a consumer-reporting agency about the payment that is the subject of the notice.

The 15-day extension is not automatic. The servicer must notify you in writing before the original 30-day period expires and state why the extra time is necessary. Keep the date the servicer received your notice, not merely the date you mailed it, because that date starts the clock.

What a compliant written response must say

If the servicer finds an error

The servicer must correct the mistake and identify what it changed. The response should state the effective date of the correction so you can match the adjustment to your payment history, statement, escrow account, balance, or payoff figure. If the investigation uncovers additional servicing errors beyond the one you described, those errors must be corrected and described as well.

If the servicer finds no error

A bare statement such as “our records are correct” is not the complete response required by the rule. After a reasonable investigation, the servicer must explain why it determined that no error occurred, tell you how to request the documents it relied on, and provide a telephone number for further contact. The explanation should address the transaction or account history you identified rather than simply repeat the current balance.

Getting the relied-on records

If you request the documents used for a no-error determination, the servicer generally must provide them without charge within 15 qualifying days. The rule permits withholding material that is confidential, proprietary, or privileged. Ask for the records in writing and keep your request with the original notice and the response.

Protections while the dispute is pending

No fee or payment as a condition of investigating

Regulation X states: “A servicer shall not charge a fee, or require a borrower to make any payment that may be owed on a borrower’s account, as a condition of responding to a notice of error.” The Consumer Financial Protection Bureau gives the same guidance in consumer terms: a servicer is not allowed to charge a fee or require a payment for responding.

This protection concerns the investigation and response. It does not cancel amounts due under your note. Continue making scheduled payments, using the normal payment instructions, unless a qualified attorney advises you otherwise. Marking a payment as “disputed” does not by itself excuse a missed installment.

Temporary credit-reporting protection

For 60 days after receiving the notice, the servicer may not furnish adverse information to a consumer-reporting agency about the payment that is the subject of the notice. This is a targeted reporting restriction; it does not erase the debt, change the contractual due date, or prevent reporting about unrelated obligations.

What the rule does not automatically stop

A dispute does not automatically pause interest accrual, collection communications, foreclosure, or other remedies. Regulation X preserves those remedies except for the special foreclosure-error situations addressed in the rule. If a foreclosure sale or another deadline is approaching, do not rely on the notice process alone; obtain individualized advice promptly.

How to prepare and send the notice

  1. Confirm the loan and address. Verify that the account is a covered closed-end mortgage and locate the servicer’s designated address for notices of error or information requests. Use the current address shown on the statement, coupon book, transfer notice, or official servicer website.
  2. Describe one or more specific errors. State the date and amount of the disputed payment or charge, what the servicer did or failed to do, and why your records show a problem. Avoid unrelated complaints that make the transaction difficult to identify.
  3. State the requested correction. Ask for a particular action, such as crediting a payment as received, reallocating it correctly, removing an improper fee, correcting escrow accounting, or supplying the calculation supporting a payoff amount.
  4. Attach copies. Include statements, payment confirmations, cancelled-check images, escrow notices, payoff quotes, or correspondence that supports the facts. Keep the originals.
  5. Send it in a traceable manner. Use a delivery method that records when the designated address received the letter. Retain the mailing receipt, delivery confirmation, a complete copy of the letter, every enclosure, and the date of receipt.
  6. Continue ordinary payments. Make payments on schedule through the normal channel while the servicer investigates, unless a court or attorney gives different instructions.

Put the account number and property address on every page. A clear subject line such as “Notice of Error under Regulation X” helps route the correspondence, but the substance and correct address are what matter. Send a separate payment through the regular payment channel rather than combining the notice with a coupon.

How payments may be applied during a dispute

Servicers generally must apply a full periodic payment as of the date it is received. A partial payment may be credited, returned, or held in a suspense account until enough money accumulates to make a full periodic payment, subject to applicable rules and required disclosures. A suspense balance can make an account statement look unfamiliar, so compare the servicer’s transaction history with your bank records and identify the exact entry in your notice.

If your complaint concerns payment allocation, identify the total amount sent, the date received, and how you believe the money should have been divided among principal, interest, escrow, fees, or other permitted charges. That detail gives the investigator a transaction to test rather than a general balance dispute.

Notice of error, QWR, phone call, or CFPB complaint?

Communication Written and traceable? Where it goes What it is best for Federal timing or effect
Notice of error Yes, if mailed or delivered in writing Servicer’s designated error-notice address Asserting a specific servicing mistake and requesting correction Five-day acknowledgment; generally 30 days for the written determination, with a properly noticed 15-day extension; 60-day protection against adverse reporting about the disputed payment
Servicing-related QWR Yes Servicer’s designated QWR or information-request address Requesting servicing information or describing an error in a written, account-specific way Use the applicable Regulation X response rule; an error-focused QWR should clearly identify the servicing error and requested correction
Telephone call No reliable written record unless you create one afterward Customer-service number Getting immediate clarification or a status update Does not by itself guarantee the notice-of-error duties or statutory written timetable
Consumer Financial Protection Bureau complaint Yes, through the complaint system Submitted to the Bureau for referral to the company Escalating a missed response or unresolved servicing problem Creates an escalation record; it does not replace the designated-address notice or change the loan’s payment obligations

You can telephone the servicer for practical information, but send the formal dispute in writing if you need the Regulation X process and its evidence trail. A CFPB complaint is a useful escalation when the servicer does not acknowledge or answer, but it is not a substitute for preserving proof that your original notice reached the designated address.

Examples of disputes that should be stated precisely

Payment not credited

Identify the payment date, amount, method, and confirmation number, then attach the bank or processor record showing delivery. Ask the servicer to credit the payment as received and provide the effective date of the correction.

Incorrect allocation

Compare the payment breakdown on the statement with the loan terms and your records. State the amount you believe was misapplied and request a corrected transaction history.

Improper fee

Name the fee, the date it appeared, and why it is not authorized under the note, servicing agreement, or applicable rule. Request removal and a revised balance if the fee affected later calculations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Escrow problem

Identify the tax or insurance disbursement, the amount, and the statement or notice that conflicts with it. Request the ledger entry and correction of any resulting shortage, surplus, or payment change.

Payoff amount

Include the payoff quote date, the amount demanded, and the transaction or charge you believe makes it inaccurate. Ask for the calculation and correction rather than simply requesting a new quote without identifying the disputed item.

What to do if the servicer misses a deadline

  1. Preserve the delivery confirmation, the complete notice, attachments, account statements, payment records, and every response or lack of response.
  2. Write down the date the servicer received the notice and calculate the five-day acknowledgment and 30-day response periods using only days that exclude weekends and legal public holidays. Check whether a written 15-day extension arrived before the original period expired.
  3. If the response is late or incomplete, submit a complaint to the Consumer Financial Protection Bureau and attach the delivery proof and correspondence.
  4. Contact a HUD-approved housing counselor for help organizing the account history and communicating with the servicer.
  5. If foreclosure, damages, or a state-law claim is involved, consult a qualified attorney. The notice process does not provide individualized legal advice or automatically preserve every defense.

Keep making the payments required by the loan while an escalation is pending. If the servicer reports the disputed payment adversely during the protected 60-day period, preserve the credit report and the date of the furnishing so a counselor or attorney can evaluate the issue.

Practical checklist before mailing

  • Closed-end mortgage confirmed; if it is a home-equity line of credit, obtain advice on a different procedure.
  • Borrower name, property address, and account number included.
  • Specific servicing error tied to dates and amounts.
  • Requested correction or information stated clearly.
  • Copies of supporting records attached; originals retained.
  • Correct designated address used, not merely the payment address.
  • Delivery proof and a complete copy saved.
  • Regular payments scheduled separately from the dispute.
  • Calendar created for acknowledgment, substantive response, extension notice, and document-request deadlines.
