Temu is a real online marketplace, but it is not a traditional retailer where one company manufactures, stocks and quality-checks every product. It connects shoppers with third-party sellers, manufacturers and brands, which means prices, shipping, seller information and product quality can vary significantly from one listing to another.
That distinction matters financially. A low price is only a good deal if the item arrives as described, is safe to use and can be returned or refunded without a prolonged dispute. Temu offers purchase protection and a formal returns process, but regulators and product-safety agencies have also identified serious weaknesses involving seller disclosures, unsafe products and marketplace controls.
What is Temu?
Temu is an online marketplace launched in the United States in 2022. It says it was founded in Boston, Massachusetts, and its platform offers a large catalog of low-priced goods, including clothing, household products, electronics, toys, accessories and more.
Temu generally does not manufacture or directly stock every product shown in its app or website. Instead, it operates a marketplace that brings shoppers together with third-party sellers, manufacturers, merchandise partners and brands. Products may ship from different locations depending on the seller and the item.

That model helps explain both Temu’s low prices and its uneven shopping experience. Two products that look similar may come from different sellers and have very different materials, quality, shipping times, warranties or safety compliance. Temu also uses coupons, discounts, games and rewards to encourage purchases. Those promotions can reduce the final price, but they can also make it harder to compare the actual cost of an order.
Who owns Temu?
Temu is owned by PDD Holdings Inc., a Cayman Islands–registered parent company that also operates the Chinese e-commerce platform Pinduoduo. PDD Holdings’ 2025 annual report says Temu began commercial operations in September 2022.
For U.S. customers, the service is operated by Whaleco, Inc., the company identified in Temu’s U.S. privacy policy and in Federal Trade Commission proceedings. In practical terms:

Is Temu legitimate?
Yes. Temu is a legitimate operating marketplace with an official website and app, customer support, ordinary retail-order processing, a returns policy and a purchase-protection program. It is not a nonexistent storefront or a payment scam by definition.
However, “legitimate marketplace” does not mean that every seller is trustworthy or that every product is safe. The marketplace model places more responsibility on the shopper to assess the listing, seller and product. The Federal Trade Commission has described Temu as a marketplace containing listings from high-volume third-party sellers.
In September 2025, the FTC announced a settlement requiring Temu to pay a $2 million civil penalty over alleged violations of the INFORM Consumers Act. The FTC alleged that Temu did not always provide required seller-identifying information clearly, failed to provide a required telephone reporting mechanism and lacked certain reporting tools on some gamified product listings until November 2024. The settlement required Temu to provide the required reporting and seller information.
Those allegations are important for buyers because it can be harder to identify who is responsible when a product is counterfeit, unsafe or materially different from its listing.

Is it safe to buy from Temu?
The answer depends heavily on what you are buying. A decorative accessory or inexpensive household item presents a different risk from a helmet, baby carrier, charger or medical device.

Product-safety concerns
On May 28, 2026, the European Commission fined Temu €200 million for breaching the Digital Services Act. The Commission said Temu failed to properly assess and reduce the risk that consumers would encounter illegal products on the platform. Its mystery-shopping investigation found that a very high percentage of selected chargers failed basic safety tests, while a high percentage of tested baby toys presented medium- to high-severity risks. Some toys contained chemicals above legal limits or had detachable parts that created choking hazards.
The findings relate to the EU market and do not mean that every Temu product is unsafe. They do show that regulators found systemic shortcomings in Temu’s marketplace risk assessment and product controls.
U.S. recalls have also involved products sold on Temu. Examples include:

Before buying or using a product that could cause serious injury, search the U.S. Consumer Product Safety Commission’s recall database. Pay particular attention to helmets, child restraints, toys, chargers, power supplies, smoke alarms, fire-protection equipment and anything used for medical or health purposes.

Temu’s controls have not prevented all prohibited, counterfeit or unsafe listings from appearing. The FTC’s 2025 enforcement action alleged that the platform did not give consumers all the required tools and information for identifying or reporting stolen, counterfeit or unsafe goods.
Do not assume that a familiar brand name in a product title proves authenticity. Before paying, look for a verifiable manufacturer, model number, warranty information and seller details. A price that is dramatically below the normal market price may reflect lower quality, a counterfeit item, missing certification or a listing that does not include everything shown in the photos.

Is the Temu app spyware or malware?
The claim that Temu has been proven to be spyware is not established by the cited public evidence. It is also important not to confuse Temu with Pinduoduo, another PDD Holdings shopping platform. Google suspended Pinduoduo from Google Play in 2023 amid security concerns after malware was found in some versions distributed outside Google Play. That incident is relevant background, but it is not proof that the current Temu app contains the same malware.
Temu should nevertheless be treated as a data-collecting shopping app. Its privacy policy says it collects information such as account details, device information, location information, browsing and search activity, shopping-cart activity, purchases, customer-support communications and transaction information. Google Play’s data-safety disclosure lists data collection that can include approximate location, name, email address, user IDs, address and phone number. Practices can vary by app version, region and use.

How Temu refunds and purchase protection work
Temu says almost all eligible items can be returned for a refund within 90 days of the purchase date, subject to exclusions. Depending on the market and product, excluded items can include worn or washed clothing, food and groceries, health and personal-care products, some underwear, customized goods, certain free gifts and other non-returnable items.
After filing a return request, customers generally have 14 days to send the package back. Temu says the first return for every order is generally free, although available options can vary by order and region.
Temu’s Purchase Protection Program says it offers full refunds when an item:
- Does not arrive.
- Arrives damaged.
- Is materially different from the listing description.
This is a platform policy, not an automatic guarantee that every dispute will be resolved immediately. Keep the order details, listing screenshots, seller information, delivery records and photographs if you need to make a claim.

How to request a Temu return or refund
- Sign in to Temu.
- Open Your orders.
- Select the relevant order.
- Click Return/Refund.
- Confirm that you received the package.
- Select the item and choose the reason for the request.
- Add photographs or comments when applicable.
- Confirm the return information.
- Click Next.
- Select the refund method, or select a return method if Temu requires the product to be sent back.
If the seller or platform does not resolve a valid problem, a payment method with dispute protections may provide another route. Keep payment and communication on Temu: Temu says it cannot verify or assist with transactions made outside its platform.

- Separate low-risk purchases from safety-critical purchases. Cheap decorations and basic accessories are not equivalent to helmets, car seats, child restraints, electrical-safety equipment, medical devices or smoke alarms. For high-consequence products, use an established retailer and an identifiable manufacturer.
- Check the total price. Compare shipping, taxes, minimum-order requirements and any conditions attached to coupons or rewards. A headline discount is not the same as a lower final cost.
- Research the seller and model. Look for a real manufacturer, model number, warranty and consistent product specifications. Be cautious when a listing uses professional brand photos but provides little seller information.
- Read the listing for what is actually included. Check dimensions, quantity, materials, compatibility and age grading. Many “deals” are inexpensive because the package contains one small component rather than the complete product shown in the marketing image.
- Check recalls. Search the CPSC recall database after buying children’s products, protective equipment, electronics or other products where failure could cause injury.
- Document problems immediately. Photograph the unopened package, shipping label, product, packaging and any defect. Do not discard evidence before the refund process is complete.
- Use a payment method with dispute protections. Avoid sending money directly to a seller or moving the transaction to another messaging service.
- Watch for repeated impulse purchases. Games, countdowns, coupons and rewards can encourage spending more than intended. Set a fixed order budget and do not buy an item merely to unlock a promotion.

For inexpensive, non-safety-critical goods, a careful shopper may reasonably use Temu. Keep the purchase on-platform, use a payment method with dispute protections and save evidence of the order. For children’s products, electrical equipment, medical or health items, food-contact products and protective gear, the documented recalls and regulatory findings make an established retailer and identifiable manufacturer the better financial and safety choice.
