What Is a Non-QM Mortgage and Who Can Qualify?

A non-qualified mortgage (non-QM) is a residential loan that falls outside the Consumer Financial Protection Bureau’s Qualified Mortgage definition. It is not a “no-doc” loan and does not let a lender skip the ability-to-repay review. Instead, the lender may verify repayment capacity with bank deposits, 1099 income, a profit-and-loss statement, assets or rental-property cash flow when standard W-2 and tax-return underwriting does not fit.

Self-employed borrowers, real-estate investors, retirees with substantial liquid assets and people recovering from unusual credit events are common candidates. Approval, however, depends on the lender, property, documentation, credit profile, reserves and state rules. Non-QM pricing is usually higher than conventional pricing, so compare complete Loan Estimates rather than assuming that alternative documentation automatically makes a loan cheaper or easier.

What “non-QM” means

The CFPB describes a Qualified Mortgage as “a loan with less risky features and protections that make it more likely that you’ll be able to afford your loan.” A non-QM mortgage is simply a loan that does not satisfy those QM criteria. The label describes regulatory status, not a guaranteed approval, a particular interest rate or a promise of minimal paperwork.

The Ability-to-Repay (ATR) rule still generally applies. The CFPB says, “A lender must make a good-faith effort to determine that you have the ability to repay your mortgage before giving it to you.” Its rule description says a creditor must make a “reasonable, good faith determination” that a consumer can repay the residential mortgage according to its terms. A lender therefore still has to review income or assets, debts, the proposed payment and other relevant information; it may use methods that differ from conventional underwriting.

How QM rules differ

QM rules limit features considered riskier for consumers, including extended interest-only periods, negative amortization, certain balloon payments and terms longer than 30 years. They also apply points-and-fees and pricing tests. A non-QM loan can use a feature or structure outside those limits, but the feature must be disclosed and you must be able to make the scheduled payments.

Do not use the often-quoted 43% debt-to-income (DTI) figure as a universal current QM cutoff. The CFPB’s current General QM framework replaced the former 43% definition with price-based thresholds. A Federal Register adjustment effective January 1, 2025 lists loan-amount thresholds of $134,841 and $80,905 in its price-spread table. Those are regulatory calculation thresholds, not a borrower’s required income, DTI limit or promised interest rate.

Who commonly qualifies

There is no nationwide non-QM scorecard. Each lender sets its own overlays, and a program available for an investment property may not be available for an owner-occupied home. The following borrower profiles are commonly served.

Self-employed owners and independent contractors

Business owners may have strong cash flow but low taxable income after legitimate deductions. A bank-statement program can average eligible deposits in personal or business accounts over a stated period, while a 1099 program uses contractor income. Some lenders accept a CPA-prepared profit-and-loss statement to document current earnings when older tax returns do not show the present business trend. Underwriters may remove transfers, one-time deposits, borrowed funds or other ineligible items, so the gross deposits shown on a statement are not automatically qualifying income.

Real-estate investors

A debt-service-coverage-ratio (DSCR) loan evaluates the subject rental property’s income against its proposed debt service. The property’s cash flow can carry more weight than the investor’s personal W-2 income. DSCR programs are generally designed for business-purpose investment property, not a consumer mortgage for the borrower’s primary residence. Lease terms, market rent, taxes, insurance, association dues, vacancy assumptions and the property’s use can all affect the ratio.

Retirees and high-asset borrowers

Asset-depletion or asset-utilization programs convert eligible liquid assets into qualifying monthly income under the lender’s formula. They may fit a retiree whose portfolio is substantial but whose recurring wages are low. Lenders usually distinguish accounts that can be verified and readily liquidated from restricted, volatile or retirement funds subject to withdrawal penalties. The formula, allowable assets and required reserves vary by program.

Borrowers with credit events or unusual documentation

Some lenders offer programs for a recent bankruptcy, foreclosure, short sale, foreign national borrower or applicant using an Individual Taxpayer Identification Number (ITIN). These products can have seasoning periods, property restrictions, documentation rules and state-availability limits. A prior event does not create an entitlement to approval; the lender will still assess the current credit profile, equity and repayment ability.

How non-QM underwriting works

Instead of applying one conventional income formula, the underwriter selects an acceptable way to establish stable repayment capacity and then layers credit, collateral and liquidity requirements on top of it.

Bank-statement underwriting

You provide personal or business bank statements for the period requested by the lender. The lender calculates an eligible-deposit average, applies an expense factor when required, and excludes deposits that cannot be tied to business or personal income. Expect questions about large or irregular deposits and transfers between accounts. Keep statements complete, with all pages, and preserve a clear trail for transfers.

1099 and profit-and-loss underwriting

A 1099 program may use gross contractor receipts with an underwriting adjustment, while a P&L program relies on a current statement prepared or signed by an accepted professional. The lender may verify the business, deposits, contracts and year-to-date performance. A P&L is not a waiver of income verification; it is an alternative document that must be credible and consistent with account activity.

DSCR underwriting

The lender estimates the property’s qualifying rent and divides it by the proposed principal, interest, taxes, insurance and applicable housing expenses. A ratio at or above 1.00 indicates the modeled rent covers the modeled debt service, but a lender may require a higher ratio, additional reserves or a larger down payment. Short-term rentals, vacant properties and properties under renovation can receive different treatment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Asset-depletion underwriting

The lender verifies balances, ownership and liquidity, then applies its conversion formula over a specified period. It may haircut certain assets or exclude funds needed for closing and reserves. The resulting monthly figure is qualifying income for underwriting purposes, not a promise that the account will earn that amount.

Credit, down payment and reserve expectations

Credit score, loan-to-value (LTV), DTI or DSCR, down payment, loan size, occupancy, property type, transaction type and documentation quality all influence eligibility and pricing. Non-QM lenders may ask for more equity or reserves than a conventional lender because the alternative income method or property profile carries additional uncertainty.

Published lender examples illustrate the range but are not industry rules. NASB’s page, checked October 15, 2026, lists a 700 minimum FICO and a $200,000 minimum loan amount for its bank-statement, 1099, DSCR and asset-depletion examples. Its bank-statement example shows 10% down with mortgage insurance, while its DSCR example shows 25% down. The same page gives a 620 FICO example for a credit-event product. ABS Mortgage described typical scores around 660 or higher as of September 20, 2026, with selected programs down to 620 when compensating factors such as a larger down payment or stronger reserves apply.

Published example Minimum or typical FICO Minimum loan amount Illustrated equity requirement
NASB bank-statement example (page checked October 15, 2026) 700 $200,000 10% down with mortgage insurance
NASB DSCR example (page checked October 15, 2026) 700 $200,000 25% down
NASB credit-event example (page checked October 15, 2026) 620 Not provided in the example Program-specific
ABS Mortgage program description (terms as of September 20, 2026) Typically 660+; select programs to 620 with compensating factors Program-specific May increase when the score is lower

These figures describe the named lenders’ examples on the dates shown. They do not establish a national minimum. Ask each lender for its current matrix, including minimum reserves, maximum LTV, required seasoning after a credit event and whether mortgage insurance is available.

Rates, fees and payment structures

Non-QM rates are typically higher than those for a conventional 30-year fixed mortgage. There is no authoritative nationwide average non-QM rate for October 15, 2026; a reliable quote requires your specific scenario. FICO, LTV, DTI, down payment, loan amount and whether the transaction is a purchase or cash-out refinance are major pricing inputs. Reserves, occupancy, property type, DSCR, documentation strength and state eligibility can change the offer as well.

Compare the annual percentage rate (APR), interest rate, points, lender credits and total cash to close. A loan with a lower note rate can cost more if it requires substantial points or a large prepayment charge. Request a Loan Estimate from several licensed lenders and compare the same loan amount, term and property assumptions.

Payment features that need special scrutiny

  • Fixed versus adjustable rate: Confirm the fixed period, index, margin, adjustment frequency, caps and the highest possible payment.
  • Interest-only period: Determine when principal payments begin and calculate the payment after the interest-only period ends.
  • Balloon payment: Identify the date and amount of any final lump-sum payment; refinancing may not be available then.
  • Prepayment penalty: Check the duration, formula and events that trigger it, including a sale or refinance.
  • Reserve requirement: Learn how many months of principal, interest, taxes and insurance must remain after closing and which accounts qualify.

Owner-occupied versus investment-property DSCR loans

An owner-occupied consumer mortgage is underwritten for your ability to repay a home loan. A DSCR product is commonly a business-purpose loan secured by an investment property and may emphasize the property’s rent rather than your personal income. The legal disclosures, eligible properties, documentation and consumer protections can differ. Do not assume that a DSCR loan can be used for your primary residence, or that a lender will treat rent from your home as qualifying DSCR income.

Before applying, tell the lender how you will occupy the property. Misstating occupancy can violate the loan documents and jeopardize funding or servicing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Application process: a practical sequence

  1. Define the scenario. State whether the property is a primary residence, second home or investment; identify purchase, refinance or cash-out; and estimate the loan amount and down payment.
  2. Choose the income method. Ask whether bank statements, 1099s, a P&L, asset depletion or DSCR best reflects your finances. Confirm the lender’s required statement period and calculation method.
  3. Assemble a complete file. Prepare identification, housing history, credit authorization, asset statements, business records, leases or rent schedules, tax documents when requested, and explanations for large deposits or credit events.
  4. Verify program fit before paying fees. Confirm minimum FICO, maximum LTV, reserves, loan-size limits, property type, occupancy, seasoning and state licensing. Get these conditions in writing.
  5. Review multiple Loan Estimates. Compare APR, points, credits, payment schedule, adjustment caps, prepayment terms, reserves and cash to close using identical assumptions.
  6. Underwrite and respond quickly. Supply requested documents in full and explain inconsistencies once. New debt, unexplained deposits or a job change can require recalculation.
  7. Read closing documents against the estimate. Verify the final rate, payment, escrow, fees, prepayment language and any balloon or interest-only provision before signing.

Common pitfalls and how to avoid them

Assuming “non-QM” means no documentation

Alternative documentation still has to establish a reasonable ability to repay. Ask exactly which deposits, assets or rents count and what deductions the lender applies.

Using a lender example as a universal rule

The 700 FICO, $200,000 loan and 10% or 25% down figures above are examples from one lender, not federal requirements. Obtain current, written criteria for your state and property.

Focusing on the rate alone

Compare APR, points, cash to close, reserves and the complete payment schedule. A low introductory payment may rise sharply after an interest-only or adjustable period.

Ignoring state and property limits

Foreign-national, ITIN, credit-event and DSCR programs can exclude particular states, condominiums, rural properties, short-term rentals or buildings with commercial use. Verify eligibility before ordering an appraisal.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Failing to plan an exit from a risky structure

If the loan has a balloon, adjustable payment or prepayment penalty, document how you will hold, sell or refinance the property under conservative assumptions. Future approval and property values are not guaranteed.

How to decide whether a non-QM loan fits

A non-QM mortgage can be useful when conventional underwriting understates stable cash flow or when an investment property’s income is the strongest repayment evidence. It is less attractive when you already qualify for a comparable conventional loan with a lower APR, fewer restrictions and a simpler payment schedule.

Use the written offers to test three questions: Does the qualifying method accurately reflect sustainable income? Can you meet the down payment and post-closing reserve requirement without weakening your emergency fund? Can you afford the highest scheduled payment and any penalty or balloon under a realistic exit plan? If the answers are unclear, delay the application and obtain clarification from a licensed mortgage professional and, when appropriate, a housing counselor or attorney.
