The label describes the loan’s classification, not a single product or a promise of easy approval. For most covered mortgage transactions, the lender must still make a reasonable, good-faith determination that you can repay the loan under its actual terms.
Non-QM loans can use underwriting methods, documentation, pricing or loan features that do not fit a QM definition. Because there is no standard Non-QM rate, fee schedule or eligibility threshold, evaluate each offer by its payment changes, annual percentage rate (APR), fees, documentation requirements and the lender’s ability-to-repay analysis.

What “Non-QM” means
The Consumer Financial Protection Bureau (CFPB) defines a Qualified Mortgage as a loan that satisfies prescribed requirements under Regulation Z. A mortgage that does not meet those requirements is generally classified as Non-QM. Non-QM is therefore a regulatory category, not one standardized mortgage program.
Recommended Free Tools
QM criteria can address the loan’s risky features, price, upfront points and fees, and the lender’s consideration and verification of income or assets and debt. The exact requirements depend on which QM category applies. The CFPB’s consumer explanation is available in What is a Qualified Mortgage?

A Non-QM designation does not mean that a lender can ignore repayment ability. It also does not tell you whether the loan is affordable, what documentation will be accepted, or how the payment will change later. Those details must be established from the individual loan offer.
Non-QM versus Qualified Mortgage
The key distinction is between the general ability-to-repay (ATR) duty and the additional criteria for QM status. For most covered transactions, the lender must make a reasonable, good-faith determination that the borrower can repay. A lender may satisfy that duty through a method that does not result in a QM loan, provided the transaction is covered and the lender follows applicable requirements.
QM status is tied to a defined set of criteria and gives the lender certain regulatory protections. A Non-QM loan does not receive those QM-specific protections merely because it was originated. The following comparison describes the concepts without implying that every loan in either category has identical terms.
| Issue | Qualified Mortgage | Non-QM mortgage |
|---|---|---|
| Classification | Meets the requirements of an applicable QM category. | Does not meet the definition of a QM. |
| Ability-to-repay review | Underwritten under QM requirements, which include prescribed consideration and verification rules. | For most covered loans, the lender still must make a reasonable, good-faith ATR determination, but the underwriting method may differ from QM requirements. |
| Loan features | QM rules address features such as certain interest-only structures, negative amortization, balloon payments and terms longer than 30 years. | Some features that would prevent QM status may appear, but their presence and legal effects depend on the actual contract and applicable law. |
| Price and fees | QM rules include requirements concerning loan price and upfront points and fees. | There is no universal Non-QM price or fee limit; review the actual APR, points and charges. |
| Regulatory protections | QM loans receive certain protections associated with QM status. | Non-QM loans do not receive those QM-specific protections simply because they are Non-QM. |
The CFPB describes the broader ATR framework in What is the ability-to-repay rule? and in its Ability-to-Repay/Qualified Mortgage Rule. The operative regulatory text is in Regulation Z § 1026.43 (2024-01-01 edition).
How ability-to-repay underwriting works
The ATR rule generally prohibits a lender from making a covered mortgage without first determining that the borrower has the ability to repay. Regulation Z requires a reasonable, good-faith determination; it does not prescribe one universal underwriting formula for every borrower and loan.

In general, the lender considers and documents information such as:
- Income and the sources of that income.
- Assets that may support repayment.
- Employment or another source of ongoing earnings.
- Credit history.
- Monthly debts and other expenses.
The lender’s process can differ from a QM process, but it still needs to address whether the borrower can meet the scheduled obligations. A low introductory or “teaser” rate by itself is not enough to establish repayment ability. The analysis should account for the payment required under the loan’s terms, including a later rate or payment change when the contract provides for one.
How a Non-QM mortgage works from application to closing
Although programs vary, the path below shows what a borrower should expect and verify.
-
1. Define the income and assets the lender will use
Before applying, ask which income sources, assets or other repayment sources the lender will consider. Ask for a written list of required documentation and whether the lender will verify each source in a particular way. The acceptable evidence is lender- and program-specific; the Non-QM label does not create a standard document package.
-
2. Provide financial and credit information
Supply the information the lender requests about income, assets, employment, credit history, debts and monthly expenses. Keep the figures consistent across the application and supporting records. If a source of repayment is unusual or variable, ask how the lender will evaluate its reliability and what conditions could cause it to be excluded.

3. Review the proposed payment under the actual terms
Identify the payment due at closing and every scheduled change afterward. For an adjustable-rate loan, ask when the rate can change, the index and margin used to calculate it, adjustment caps, and the resulting payment scenarios. For an interest-only period, determine when principal payments begin. Do not judge affordability from the initial payment alone.

4. Examine the lender’s ability-to-repay explanation
Ask the lender to explain how the payment, income or assets, debts and expenses were evaluated. The lender’s explanation should correspond to the loan you are actually receiving, not a different product or a temporary rate illustration. If the explanation does not show how later payment obligations were considered, request clarification before proceeding.
-
5. Compare the required disclosures and competing offers
Review the APR, interest rate, points, lender fees, other closing costs, payment schedule and total obligations in the official disclosures. Compare those figures with at least one alternative when available. Two Non-QM offers can have materially different costs or payment risks even if both carry the same classification.
-
6. Confirm the final contract before closing
Check that the final note and closing disclosures match the features you evaluated. Verify the initial payment, future adjustments, any balloon amount, prepayment terms and the documents that define your obligations. A last-minute change in rate, fees or payment structure warrants a new comparison and affordability review.
Loan features that deserve close attention
Some loan features are relevant to whether a mortgage can qualify as a QM. Their presence does not, by itself, establish every legal consequence for a particular Non-QM loan. Read the contract and ask how each feature affects your cash flow.

Interest-only periods
During an interest-only period, scheduled payments may not reduce principal. When principal payments begin, the required payment can rise even if the interest rate does not change. Ask for the exact date of the transition and the payment calculated for the remaining amortization period.
Adjustable rates and payment changes
An adjustable-rate structure can change the interest rate and payment according to the contract. Request the first possible adjustment date, adjustment frequency, caps, floor, index and margin. Have the lender show the payment after each material adjustment rather than relying on the introductory rate.
Negative amortization
Negative amortization occurs when scheduled payments do not cover all accrued interest, causing the balance to grow. Ask whether the balance can increase, what triggers a payment reset, and how the larger balance affects later payments and total interest.
Balloon payments
A balloon structure leaves a large balance due at a specified date. Do not assume that refinancing will be available when the balloon comes due. Evaluate whether your resources could cover the amount under adverse market or personal circumstances.

Costs and documentation: what is and is not standardized
There is no single Non-QM rate, APR, fee schedule or approval threshold established by the classification. Rates and costs depend on the lender, borrower, property, location, product and date. Documentation practices also vary.
| Comparison point | What to obtain from each lender | Why it matters |
|---|---|---|
| Income and asset treatment | Which sources count, how they are verified and what documents are required. | Different methods can produce different qualifying amounts and conditions. |
| Initial and later payments | Payment at closing, every scheduled change, and the assumptions behind each figure. | A low initial payment may not represent the obligation over the full term. |
| Rate and APR | Note rate, APR, fixed or adjustable status, adjustment dates, index, margin and caps. | APR incorporates specified finance charges and helps compare offers with different fees. |
| Points and fees | Origination charges, discount points, lender fees and other disclosed costs. | Upfront charges affect the cash needed to close and the loan’s overall cost. |
| Special features | Interest-only period, negative amortization, balloon payment, prepayment terms and maturity. | These provisions can change payment timing, balance growth or refinancing risk. |
| Repayment-ability analysis | The lender’s explanation of how income, assets, debts, expenses and future payments were considered. | It shows whether the analysis addresses the actual contract rather than only an introductory illustration. |
Questions to ask before accepting an offer
- Which income, assets or other repayment sources are you using, and what documentation is required for each?
- How did you evaluate the payment under the loan’s actual terms, including any later rate or payment adjustment?
- What are the note rate, APR, points, lender fees and other closing costs?
- What payment is due initially, and what payment is due after each scheduled change?
- Does the loan include an interest-only period, negative amortization, a balloon payment or a term longer than 30 years?
- What index, margin, caps and adjustment dates apply if the rate can change?
- How much principal will remain at key dates and at maturity?
- What other loan options can I compare, and how do their payments and total costs differ over time?
- Which terms are estimates and which are fixed in the final contract?
Potential advantages and trade-offs
Why a borrower might examine a Non-QM option
A Non-QM structure may be worth evaluating when a borrower’s financial information or preferred loan design does not fit a particular QM definition. The relevant question is not whether the label sounds flexible, but whether the lender can document a reasonable repayment analysis and whether the resulting payment fits the borrower’s budget under realistic future scenarios.
What the borrower gives up or must manage
Because the loan is outside the QM category, it does not receive QM-specific protections merely by being made. A Non-QM loan may also involve higher costs, unusual documentation requirements or payment features that require more careful monitoring, although none of those outcomes is automatic. The actual disclosures and contract control.

Use the same assumptions for each offer and compare the complete obligations, not just the amount you can borrow.
- Place the initial payment and every scheduled future payment side by side.
- Compare APR, points, lender fees and other cash-to-close charges.
- List the income and asset documentation each lender requires and any conditions attached to it.
- Mark every rate-adjustment date, payment reset, interest-only expiration, balloon date and maturity date.
- Ask each lender to explain its ability-to-repay determination using the same income, debts and expense information.
- Test whether the payment remains manageable if the rate rises as permitted, the interest-only period ends or the balloon becomes due.
- Read the final disclosures and note for differences before signing.
Scope of the rules and practical limits
This explanation concerns U.S. residential mortgage regulation. Whether a transaction is covered, which QM category could apply, and what exceptions or protections are available depend on the loan, property, parties and current law. Rates, fees, eligibility standards and documentation practices are also lender-, borrower-, property-, location- and date-specific.
The CFPB pages cited above were last reviewed on January 2, 2025, for the Qualified Mortgage consumer explanation and April 3, 2024, for the ability-to-repay consumer explanation. Regulation Z § 1026.43 is linked in the 2024-01-01 edition. For a particular transaction, read the current disclosures and obtain advice from a qualified mortgage professional or attorney who can assess your facts.
The practical takeaway
Non-QM means the mortgage does not fit a Qualified Mortgage definition; it does not mean there is no ability-to-repay review and it does not describe one standard set of terms. Treat the classification as a starting point. The decision should rest on the documented repayment analysis, the payment path over the entire term, APR and fees, special features, and the protections and obligations written into the actual contract.
