A campaign loan is money advanced to an election campaign with an expectation of repayment. A gift with no repayment expectation is a political contribution or donation. For federal elections, a loan from a friend, relative, or other individual is generally treated as that lender’s contribution while the balance remains unpaid, so it is reported and subject to contribution limits. A qualifying commercial bank loan is treated differently: the bank generally is not making a contribution, but the campaign must report the loan and repayments. Political contributions are not charitable tax deductions.
What a campaign loan means
A campaign loan is financing provided to a candidate committee or other political committee under terms that create an obligation to repay. The lender may be an individual, the candidate, a family member, a supporter, or a bank. The defining feature is not the label on the paperwork; it is the expectation that the campaign will return the money.

Federal election law uses a broad definition of contribution. The Federal Election Commission (FEC) defines a contribution as a gift, subscription, loan, advance, or deposit of money or anything of value given to influence a federal election. The definition also covers compensation paid by someone for another person’s services when those services are provided without charge to a political committee. Consequently, calling an advance a loan does not by itself keep it outside contribution rules.

Is a loan to a political campaign considered a donation?
For a personal lender, generally yes, at least while the loan is outstanding. The FEC says that when any person, including a relative or friend, gives or loans money for the purpose of influencing a federal election, the funds are not the candidate’s personal funds. The gift or loan is treated as a contribution from the donor, is subject to the applicable per-election limit, and must be reported by the campaign.
This does not mean the lender loses the right to repayment. It means the unpaid balance is counted as the lender’s contribution for campaign-finance purposes until the campaign pays it back. Repayments reduce the amount treated as an outstanding contribution. Under FEC loan guidance, once the loan is repaid in full, it no longer counts against that contributor’s contribution limit.
| Feature | Personal or family loan | Qualifying bank loan | Political donation |
|---|---|---|---|
| Repayment obligation | Yes, under the loan agreement | Yes, under commercial lending terms | No; it is a gift |
| Who is treated as the contributor | The individual lender, to the extent the balance is unpaid | Generally not the bank when the loan complies with FEC rules | The donor |
| Contribution-limit effect | Outstanding balance counts toward the lender’s applicable limit; repayments reduce it | Not generally a bank contribution, although the campaign’s reporting duties remain | The donated amount counts toward the donor’s applicable limit |
| Reporting | Loan and repayments must be reported by the campaign | Loan and repayments must be reported by the campaign | Contribution must be reported |
| Source of funds | Personal funds from a supporter, relative, friend, or other individual | Commercial financing from a bank acting in the ordinary course of business | Donor’s funds or anything else of value given as a gift |
| Federal charitable deduction | Not a charitable contribution; political payments are nondeductible | Not a charitable contribution | Not deductible as a charitable contribution |
How the outstanding balance affects contribution limits
The practical rule is to look at the unpaid principal, not merely the original loan amount. If an individual lends $1,000 and the campaign has repaid $250, the amount still treated as that individual’s outstanding contribution is generally $750. If the campaign repays the remaining $750, the loan no longer counts against that contributor’s limit under the cited FEC guidance.

For the 2025–2026 federal election cycle, the FEC lists an individual contribution limit of $3,500 per election to a candidate committee. Because the limit is stated per election, the relevant election and the committee’s reporting period matter. A primary and a general election are separate elections for limit purposes when the contribution is properly designated and otherwise eligible.
A personal loan that would cause the lender to exceed an applicable limit can create a prohibited excess contribution even if the parties intend to repay it later. Before accepting money from an individual, the committee should calculate the lender’s contributions and outstanding loan balances for that election and apply the rules in force for the relevant cycle. Limits can change, and state and local limits are different.

Example: a loan repaid in installments
- A supporter lends a federal campaign $1,000 under a written repayment agreement.
- The campaign reports the loan. While the full $1,000 is unpaid, that amount is treated as the supporter’s contribution for limit purposes.
- The campaign later repays $400. The outstanding amount treated as a contribution falls to $600.
- After the final $600 repayment, the loan no longer counts against that supporter’s contribution limit under the FEC’s loan guidance.
Can a campaign repay a loan from the candidate?
Yes. A campaign can repay a properly documented loan from the candidate, provided the committee follows the applicable FEC reporting and payment rules and has legally available campaign funds. The repayment should be recorded as repayment of a loan rather than as a new donation.
The committee should establish the transaction before or when the money is advanced. Its records should identify the lender, amount, date, repayment terms, and each payment. The campaign then reports the loan and repayments in the manner required for its federal filings. A candidate who advances personal money should not assume that calling the advance a loan eliminates reporting; the obligation and its payment history still need to be reflected in the committee’s records and reports.
If a campaign never repays an individual loan, the unpaid amount remains an outstanding contribution under the FEC treatment described above. A lender who voluntarily cancels a balance has not received repayment of that amount, so the committee should obtain compliance advice before treating the cancellation as anything other than an unpaid contribution. The key compliance question is whether the balance was actually repaid and properly documented.
Why a bank loan is treated differently
The FEC distinguishes a loan made by a bank in the ordinary course of business from a personal loan by a supporter. When a candidate obtains a bank loan for campaign use and the financing complies with FEC regulations, the bank is generally not making a contribution. The campaign still has to report the loan and later repayments under FEC reporting rules.
Commercial terms matter. A genuine bank loan normally has an obligation to repay and terms assuring repayment, rather than a side agreement that the bank will forgive the debt. A bank cannot use an artificially favorable arrangement to provide something of value outside the campaign-finance rules. If a lender is not acting as a normal commercial bank, the transaction may be analyzed as an individual or organizational contribution instead.

What the campaign should document
- The lender’s legal name and address.
- The principal advanced and the date the campaign received it.
- The written repayment obligation and applicable terms.
- Any security or other conditions required by the lender.
- Each repayment, including date and amount, with matching bank records.
- The committee report on which the loan and each repayment appear.
These records help distinguish a repayable loan from a gift and allow the committee to calculate the outstanding amount correctly. They also provide an audit trail if a filing is amended or a regulator asks how the campaign financed an expense.

Loan versus donation: the decision points
Is repayment expected?
If the money is a gift and no repayment is expected, treat it as a contribution. If repayment is genuinely expected, document a loan. An informal promise to repay later is risky because the FEC looks at the substance of the transaction, not only its label.
Who supplied the money?
An individual supporter, relative, or friend is treated as the contributor while the personal loan is unpaid. A bank loan that meets FEC requirements is generally not a contribution from the bank. The source therefore changes both the limit analysis and the reporting treatment.
How much remains unpaid?
For an individual loan, track the outstanding balance after every repayment. That balance is the amount relevant to the contribution-limit calculation described by the FEC. Do not continue counting the original principal after it has been repaid.
What does the filing show?
The campaign must report contributions, loans, and repayments accurately. A payment back to a lender is not a new contribution from the campaign; it is a reduction of the reported obligation. Missing or late entries can make the committee’s cash-on-hand and debt figures inaccurate.

Are political donations tax deductible?
No. The IRS states in its Schedule A instructions that political contributions are amounts taxpayers cannot deduct. IRS Publication 526 also lists political organizations and candidates among recipients for which charitable contributions are not deductible.
This rule applies to a political donation regardless of whether the donor is an individual, business, or other entity. A personal loan to a campaign is not transformed into a charitable donation merely because the lender later decides not to seek repayment. A repayment of principal is also not a charitable deduction; it is the return of money advanced under the loan.
Keep the campaign-finance and tax questions separate. The FEC determines whether a payment is a contribution, loan, or repayment for federal election purposes. The IRS determines whether a payment qualifies for a tax deduction. For ordinary political giving, the IRS answer is no charitable deduction.
Three common scenarios
A $1,000 gift
A supporter gives a campaign $1,000 with no expectation of repayment. The full amount is a contribution, must be reported, and counts toward the supporter’s applicable contribution limit. The supporter cannot claim it as a charitable deduction.
A $1,000 personal loan
A supporter lends the campaign $1,000 under a repayment agreement. The campaign reports the loan. Until repayment, the unpaid balance is treated as that supporter’s contribution for federal-limit purposes. If the campaign repays $600, the remaining amount treated as outstanding falls to $400. Full repayment removes the loan from the contributor’s limit calculation under the cited FEC guidance.

A commercial bank loan
A bank lends the campaign money in the ordinary course of business on terms that require repayment. The bank generally is not treated as making a contribution, but the campaign reports the loan and every repayment under FEC rules. The committee must retain the loan documents and payment records.
Federal rules do not automatically control state and local campaigns
The rules above concern federal elections and the authorities of the FEC and IRS. State and local jurisdictions may define contributions differently, set different limits, require different forms, or impose separate rules on candidate loans and bank financing. A transaction that is permissible for a federal committee may require a different analysis for a state, county, or municipal campaign.
Before a nonfederal committee accepts a loan, check the jurisdiction’s election agency, contribution limits, reporting calendar, and loan rules. When money crosses jurisdictions or a lender is a company rather than an individual, obtain advice tailored to that jurisdiction instead of relying on the federal treatment.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsA compliance checklist before accepting campaign financing
- Identify whether the money is intended as a gift or must be repaid.
- Identify the lender: individual, candidate, bank, or another organization.
- Put the repayment obligation and material terms in writing.
- Calculate the lender’s current contributions and outstanding loan balances for the relevant election.
- Confirm that accepting the advance will not exceed the applicable limit.
- Record the receipt promptly in the committee’s accounting system.
- Report the loan using the required FEC filing category and schedule.
- Record every repayment and reduce the outstanding balance by the amount actually paid.
- Keep agreements, bank statements, canceled checks, and amended filings together.
- For a state or local race, verify that jurisdiction’s rules separately.
The bottom line
A campaign loan is financing that is supposed to be repaid, while a political donation is a gift. For federal campaigns, a loan from an individual supporter, relative, or friend is generally treated as that person’s contribution for as long as the balance is unpaid. Repayments reduce the amount counted, and full repayment removes it from the contributor’s limit calculation under FEC guidance. A qualifying bank loan is generally not a contribution from the bank, but it still must be reported and documented. Neither loans used for political giving nor political donations qualify as charitable tax deductions.
