What IRDAI Regulates—and What Policyholders Must Verify Themselves

IRDAI regulates insurers and the insurance market; it does not decide from a general rule whether your individual claim is payable. In India, the Insurance Regulatory and Development Authority of India (IRDAI) registers and supervises insurers, protects policyholder interests in specified contract matters, and provides a route for escalating unresolved complaints. Your actual coverage still depends on the policy wording, schedule, benefits, exclusions, limits, options, and claim instructions issued for your contract.

Use IRDAI’s role as a framework for accountability, then use your own documents to establish what you bought and what you must do.

What IRDAI regulates

IRDAI’s statutory duty comes from section 14 of the Insurance Regulatory and Development Authority Act, 1999. IRDAI describes that duty as to “regulate, promote and ensure orderly growth of the insurance business and re-insurance business.” The remit covers the insurance business as a whole, not just an individual policy dispute.

Insurer registration and authorisation

IRDAI’s listed functions include issuing, renewing, modifying, suspending, or cancelling insurer registrations. This is the regulatory gatekeeping function: an insurer must operate within the authority granted to it and the applicable regulatory framework.

Protection of policyholder interests

The Authority’s functions specifically include protecting policyholder interests in matters such as assignment, nomination, insurable interest, settlement of claims, surrender value, and other terms of insurance contracts. These subjects are areas of regulatory oversight. They are not a promise that every claim, surrender request, or nomination will produce a particular result regardless of the contract.

Rules and the current regulatory framework

IRDAI’s consolidated listing reviewed for this guide identifies the IRDAI (Protection of Policyholder’s Interests, operations and allied matters of insurers) Regulations, 2024, reference IRDAI/Reg/11/205/2024, dated 1 April 2024, as non-archived. Treat that listing as a starting point, not a permanent substitute for checking the live consolidated regulations. Amendments or later directions may affect the rule that applies when you buy, renew, service, or claim under a policy.

What IRDAI regulation does not tell you

IRDAI’s existence does not mean the Authority approves each individual claim in advance, guarantees a benefit, or replaces the insurer’s claims and complaints process. A claim is assessed against the particular product, schedule, endorsements, conditions, exclusions, limits, and evidence required by the contract.

For example, knowing that claim settlement is a policyholder-protection concern does not establish that a loss is covered. You still need to identify the insured event, check whether an exclusion or condition applies, confirm the available limit, and follow the notice and documentation requirements in your policy.

The policyholder verification checklist

Before relying on a policy, renewal notice, benefit illustration, or sales explanation, check the contract documents themselves. The following questions separate what you should verify from what IRDAI oversees at a system level.

Question Where to check Why it matters
What is insured? Policy schedule and applicable wording Confirms the type of insurance, insured person or property, sum assured or limit, and listed benefits.
What is excluded or restricted? Exclusions, conditions, waiting periods, and other limitations in the wording Explains circumstances in which a benefit can be reduced, delayed, or unavailable.
Which choices and dates apply? Schedule, options section, notices, and policy terms Identifies relevant free-look, renewal, revival, surrender, nomination, or other election periods.
How must a claim be made? Claim instructions and servicing information Sets the contact route, documents, notice steps, and contractual conditions for presenting a claim.
Where can a service complaint go? Insurer grievance information and escalation details Gives you a documented path when servicing or a claim response is unsatisfactory.

1. Confirm the policy’s scope

Start with the schedule. Record the product type, policy number, insured person or property, sum assured or limit, start and end dates, and the benefits shown for your version of the contract. If the schedule differs from a quotation or sales presentation, ask the insurer for a written explanation before relying on the benefit.

2. Read exclusions and conditions with the benefits

Do not read a benefit headline in isolation. Locate every exclusion, condition, waiting period, sub-limit, deductible, eligibility rule, and other restriction that applies to that benefit. Product lines use different wording, so do not transfer an exclusion or waiting-period assumption from one kind of insurance to another.

3. Check options and deadlines

Look for the choices available under your policy and the dates that control them. Depending on the product, these may include a free-look period, renewal, revival, surrender, nomination, or another option. A right that exists only within a stated period can be lost if you wait, so keep the notice or schedule showing the relevant date.

4. Save the claim procedure before you need it

Identify the insurer contact route, notice requirement, document list, and any conditions attached to a claim. Keep the policy wording and schedule together with receipts, correspondence, and acknowledgement of any notice you send. If the insurer gives you a reference number, retain it with the claim file.

5. Locate the grievance route

Your documents should identify how to complain to the insurer about a claim, service issue, or delay. Use that route first and keep a dated copy of your complaint, supporting documents, and the insurer’s response. A clear record makes later escalation easier.

Using the Customer Information Sheet in life insurance

For life insurance, IRDAI’s 2024 Master Circular on Life Insurance Products says the Customer Information Sheet (CIS) should be given to policyholders. It is designed as a concise orientation document and should include the insurance type, sum assured, benefits, exclusions, options such as the free-look period, and claims, servicing, and grievance-redressal information, including the appropriate Insurance Ombudsman contact.

Use the CIS as a checklist, not as a replacement for the full policy. Compare each CIS item with the schedule and complete wording. If a summary appears to conflict with the contract, ask the insurer to clarify the discrepancy in writing and retain that clarification with your records.

The CIS point is specific to the life-insurance circular. It should not be treated as a universal document rule for health, motor, property, or other lines unless the applicable rules and policy documents say so.

How to complain about an insurance company

Step 1: Complain to the insurer

IRDAI says prospects and policyholders should first file a complaint with the relevant insurance company. Send it through the insurer’s stated grievance channel and describe the policy number, issue, dates, remedy requested, and documents attached. Keep proof that the complaint was received.

Step 2: Wait for a response or assess the response

If the insurer does not respond within a reasonable period, or if you are dissatisfied with its response, you can approach IRDAI’s Policyholder Protection & Grievance Redressal Department. “Reasonable period” should be read with the insurer’s published process and any applicable rule for your product; do not assume that every type of complaint has the same deadline.

Step 3: Use IRDAI’s escalation route for facilitation

IRDAI describes its role at this stage as facilitating re-examination and resolution by the insurer. That means the Authority can take up the complaint with the insurer and help move the matter through the grievance process. It is not a promise that IRDAI itself will adjudicate every dispute or guarantee the outcome you seek.

What Bima Bharosa is

IRDAI describes Bima Bharosa, previously called the Integrated Grievance Management System (IGMS), as a way to register a complaint with an insurer and track its status. It is useful when you want a central record of the complaint and its progress after using the insurer’s process.

IRDAI’s page lists the Grievance Call Centre numbers 1800 4254 732 and 155255. Contact routes and portal details can change, so verify the current information on IRDAI’s official grievance page when you are ready to file. A number copied from an old document should not be treated as current without that check.

A practical decision path for common situations

You are deciding whether a loss is covered

  1. Identify the insured event and the person, property, or interest involved.
  2. Match that event to the benefit and limit in the schedule and wording.
  3. Read the exclusions, conditions, waiting periods, and other restrictions attached to that benefit.
  4. Check whether the policy was active and whether any required notice or documentation step applies.
  5. Use the policy’s claim instructions and ask the insurer for a written explanation if coverage is unclear.

You received a claim rejection

  1. Ask the insurer to identify the exact clause, exclusion, condition, or limit relied upon.
  2. Compare that explanation with the complete wording, schedule, and any endorsement that applies to your policy.
  3. Submit a written grievance through the insurer, attaching the relevant documents and addressing the stated reason for rejection.
  4. If there is no response within a reasonable period or the response remains unsatisfactory, use IRDAI’s escalation route or Bima Bharosa for registration and tracking.

You are changing or ending a policy

Check the option and date provisions before acting. Free-look, renewal, revival, surrender, and nomination rules can be product-specific. Ask the insurer what document or form is required and request a written calculation or confirmation where money or coverage changes are involved.

Common mistakes to avoid

  • Assuming regulation equals approval of your claim: IRDAI oversees the framework; the contract determines the individual benefit.
  • Reading only the benefit summary: exclusions, conditions, waiting periods, and limits can materially change the result.
  • Using a generic checklist across products: life, health, motor, property, and other insurance have different documents and restrictions.
  • Skipping the insurer grievance stage: IRDAI’s published route starts with the insurer.
  • Relying on old contact details: confirm current Bima Bharosa and call-centre information on IRDAI’s live page.
  • Discarding records: retain the schedule, wording, CIS where applicable, notices, claim documents, complaint acknowledgement, and responses.

How to keep your policy file usable

Maintain one folder, digital or physical, for the schedule, full wording, endorsements, premium or renewal notices, and claim and grievance correspondence. Add a one-page index showing the policy number, insurer contact, renewal date, major limits, exclusions you need to remember, and the location of the claim instructions. The index is a navigation aid; the contract remains the controlling document.

Review the file after every renewal, alteration, nomination change, revival, or claim. Replace superseded schedules while retaining them separately so you can establish which version applied on a particular date.

Where to verify the rules

For regulator-level questions, consult IRDAI’s Duties and Responsibilities information, the current consolidated regulations listing, the applicable product circular, and the live grievance information. For coverage questions, give priority to your own policy schedule and wording. If the issue involves a significant financial or legal dispute, obtain advice suited to the facts and the current rules rather than relying on a general description of IRDAI’s powers.
