The legal employer, job, worksite, salary structure, dates and conditions should tell the same story. If they do not, obtain a written correction and verify the position with the employer and the relevant authorities before paying money, surrendering originals or travelling.
This guide covers the document checks that apply broadly and identifies where overseas requirements depend on the destination, visa class, worker category and recruitment route. It is not a universal visa checklist or a substitute for advice on a particular country.

Start with a complete document set
Save clear scans and paper copies before you review anything. Put the documents in a folder that you can access without carrying the originals. Your set may include:
- the job advertisement, offer letter and final employment contract;
- joining or onboarding records, policy acknowledgements and any assignment letter;
- recent payslips, bank-credit records and compensation statements for an existing job;
- passport identification and validity pages;
- visa, work permit, approval notice or other work authorization;
- relocation, accommodation, insurance, transport or repatriation terms, when offered;
- recruiter correspondence, receipts and agent documents, if an intermediary is involved.
Keep a signed copy of every version. A verbal assurance, presentation slide or chat message should not override a contradictory contract unless the employer confirms the change in writing.

Review the employment contract against what you were promised
Place the offer, final contract and—if you already work there—your payslips and bank credits side by side. Review each category below rather than relying on a headline annual package.
Employer, role and reporting line
Identify the legal entity that will employ and pay you. A client, group company or project name may appear separately; that does not automatically make it your employer. Check the exact job title, duties, reporting manager and any requirement to work for a named client. If a staffing company, subsidiary or employer-of-record is involved, ask which entity signs the contract, sponsors the authorization and handles payroll.
Look for mobility language. A clause allowing transfer to another city, client or group company can materially change your costs and commute. Ask whether a transfer requires your consent, how much notice is given and who pays relocation expenses.

Work location and working conditions
Confirm the city, office, client site or remote arrangement. For an overseas role, the location in the contract should be consistent with the location on the visa or work authorization. Check expected hours, shifts, on-call duties, travel and applicable overtime treatment. Do not assume that a stated “flexible” arrangement means unrestricted remote work; ask for the permitted locations and any equipment or connectivity obligations.
Salary, variable pay and payment timing
Separate fixed salary from bonus, incentives, stock, allowances and reimbursements. Record the currency, pay period, payment date and the bank account to be used. If an Indian offer quotes cost to company (CTC), request a schedule showing basic pay, allowances, employer contributions, variable components and one-time items. CTC is not the same as monthly take-home pay.

List every deduction or recovery: tax, provident-fund or social-insurance contributions, meal or transport charges, accommodation, advances, equipment, relocation repayment and any service fee. Ask when a variable payment is earned, whether it is discretionary, and what happens if you resign before the payment date. Compare the resulting net amount with payslips and bank credits once employment starts.
The Ministry of Labour and Employment’s additional FAQ dated March 16, 2026, says the Code on Wages provisions on timely payment apply to all employees and includes clarifications on wage calculation. Use the actual contract and pay records to investigate a short payment; a general FAQ does not determine an individual entitlement without considering the applicable law and circumstances.

Benefits and leave
Write down eligibility dates and limits for medical insurance, dependants, retirement or social-insurance contributions, paid leave, sick leave, holidays, meals, transport and any education or housing support. Check whether a benefit is an allowance in cash, reimbursement against receipts or coverage arranged directly by the employer. For an overseas assignment, identify who pays for medical treatment, emergency evacuation and return travel.
Term, probation, notice and termination
Confirm the start date, fixed end date (if any), probation length and the process for confirmation. Compare notice periods for you and the employer, payment in lieu of notice, termination for misconduct or redundancy, and the documents you will receive on exit. A contract that says employment is “at will,” “terminable at any time” or subject to a separate policy needs particular clarification in the jurisdiction governing it.
Repayment and post-employment clauses
Flag training-cost recovery, joining-bonus clawbacks, relocation repayment, liquidated damages, non-solicitation, confidentiality and intellectual-property provisions. Ask for the amount, the event that triggers repayment, the time period and whether the sum reduces over time. Do not sign an undefined obligation to repay “all costs.” Have a local employment lawyer review a clause whose enforceability or value is unclear.

Use a pay-and-conditions worksheet
A simple worksheet exposes differences that a polished offer can hide. Record the wording and the document where you found it.
| Check | What to compare | Questions to resolve |
|---|---|---|
| Legal employer | Offer, contract, payroll entity and visa sponsor | Are these the same entity, or is each relationship explained? |
| Role and location | Job title, duties, client, city and mobility clause | Can the employer change the job or move you without a new agreement? |
| Compensation | Fixed pay, variable pay, allowances, benefits and deductions | What is guaranteed, when is it paid and what is the expected net amount? |
| Working time | Hours, shifts, on-call work, travel and overtime terms | Which time-zone and overtime rules apply? |
| Leave and insurance | Leave types, eligibility, limits and medical coverage | Who is covered, from what date and at what cost? |
| Contract lifecycle | Start/end dates, probation, notice and termination | What happens if either side ends the relationship early? |
| Relocation | Housing, transport, flights, insurance and repatriation | Is support a benefit, reimbursement or repayable advance? |
For an overseas role, cross-check immigration documents
Immigration permission is tied to a particular country, visa class and job. There is no single checklist for every Indian IT employee. Before travel, compare the following fields across your passport, contract, visa and work authorization.
Identity and document validity
Check that your name, date of birth, nationality and passport number are transcribed correctly. Make sure the passport remains valid for the period required by the destination. Ministry of External Affairs guidance mentions six months’ passport validity in specified overseas-employment contexts; that figure is not a universal entry rule. Follow the destination authority’s current requirement for your visa.
Employer, occupation and worksite
The employer named on the authorization should be the entity that recruited you or the relationship should be documented clearly. Confirm that the approved occupation, job category and worksite match the contract. An authorization for one employer, profession or location may not permit you to begin a different assignment. Ask the destination immigration authority or a qualified adviser about employer-change, client-site and remote-work restrictions.
Dates and conditions
Compare the authorization’s validity and entry-by dates with the contract’s start date, probation and assignment period. Check whether you need a separate entry visa, residence registration, medical examination, police certificate or local work card after arrival. Do not travel merely because an application was filed; obtain the approval or document that legally permits the proposed work.

Visa category and the actual job
MEA specifically advises prospective emigrant workers to check that the visa category matches the recruited work. A tourist, business or visitor permission is not automatically a work authorization. If an intermediary asks you to describe the job differently from the contract or application, stop and seek independent confirmation.
Determine whether Indian departure formalities apply to you
Requirements such as emigration clearance, contract attestation, insurance and mission documentation depend on worker category, destination and whether recruitment is direct or through an agent. MEA guidance distinguishes skilled or semi-skilled workers from unskilled workers and other specified groups. Do not assume that every IT employee must obtain—or is exempt from—one particular clearance.
- Identify your destination, visa class, occupation, passport details and recruitment route.
- Check the applicable MEA, Protector of Emigrants and Indian mission instructions for that combination of facts.
- Ask the employer or registered recruiter which documents it will provide, and obtain the answer in writing.
- Complete any required insurance, attestation or clearance before departure, not after arriving at the airport.
Local mission pages may publish forms that are specific to one country. For example, the High Commission of India in Kuala Lumpur lists employment-contract and EMI forms for Indian workers in Malaysia. That example cannot be applied to another destination without checking its own mission and immigration instructions.

If an agent is involved, establish the agent’s identity and registration before sharing money or originals. Independently confirm the foreign employer, worksite, salary and job title with the employer or the relevant Indian mission. MEA identifies a demand letter and power of attorney as employer documents to examine when applicable.
Recommended Free Tools
- Do not hand over your passport, educational certificates or experience letters before the job and employer are shown to be genuine.
- Do not pay an unexplained fee or cash deposit. Request a written invoice, receipt and the legal basis for any charge.
- Keep copies of the agent’s registration details, advertisements, messages, contract and every receipt.
- Ask why the visa sponsor, payroll company and worksite differ, and require a written explanation.
Warning signs that require a pause
Pause the process and verify independently if the signed contract names a different employer or role than the offer; salary or benefits change between documents; authorization is missing while you are pressured to travel; originals are demanded for “processing”; deductions or fees are unexplained; signed copies are withheld; or you are asked to misstate the job, salary or purpose of travel. These are practical warning signs, not a government-published fraud list.

Keep records and escalate discrepancies
Store one encrypted digital copy and one paper set separately from your originals. Leave copies with someone you trust and give that person your employer, recruiter, accommodation and mission contact details. Keep a dated log of promises, payments and requested changes.
When you find a mismatch, write a short list identifying the document, page and exact wording. Ask the employer or recruiter to issue a corrected contract or authorization, not merely to promise a correction by email. Do not sign a blank page or an untranslated document you cannot understand.
For destination-specific questions, contact the relevant Indian mission or Protector of Emigrants. For a contract dispute, seek advice from a qualified employment lawyer familiar with the governing jurisdiction. Immigration and employment rules can change, so verify volatile requirements—fees, forms, processing times, validity periods and insurance—with the responsible official authority.

When choosing between offers or deciding whether an overseas assignment is safe to accept, score each set on the same evidence rather than comparing headline CTC figures.
| Decision axis | Evidence to place side by side | Why it matters |
|---|---|---|
| Role and location | Promised duties and city versus the signed contract and authorization | A different role or worksite can affect both pay and immigration compliance. |
| Guaranteed income | Fixed salary, payment date and documented deductions | Variable pay and allowances may not be assured or may not reach take-home pay. |
| Dates | Contract start/end, visa validity and entry deadline | You need authorization for the period and work you actually perform. |
| Employer relationship | Contracting entity, payroll entity, sponsor and client | Unexplained differences can create payment and status risks. |
| Exit and support | Notice, termination, repayment, relocation and repatriation clauses | These terms determine your cost if the assignment ends early. |
What official guidance does—and does not—establish
“Carefully go through the Employment Contract detailing the salary/wage levels and other service conditions.”
That sentence appears in the Ministry of External Affairs consular guidance. Its practical message is to read the entire contract, not just the compensation headline. MEA’s FAQ also asks, “What are the things to ensure before one leaves India for employment abroad?” The answer depends on the worker’s category and destination, so a country- and visa-specific check remains necessary.
No published figure in the cited official material quantifies how often Indian IT employees experience employment- or visa-document errors. Treat each discrepancy as an individual verification problem rather than relying on an industry statistic.
