The notice number, tax year, requested action, and date printed on that letter determine what happens next. A missed date can limit your opportunity to dispute an adjustment or request a hearing; if the notice concerns an unpaid balance, penalties, interest, and collection activity may continue. Open the letter, identify its exact instructions, and contact the issuing IRS office promptly—even if the deadline has already passed.
Why the notice itself controls
IRS correspondence is not governed by one universal response period. A balance-due reminder, proposed tax adjustment, penalty-abatement denial, and levy notice each serve a different procedural purpose. Their deadlines and remedies therefore differ.

Read the notice from the top and record its notice number, tax year, balance or proposed adjustment, response date, payment date, and contact information. The letter should tell you whether the IRS wants payment, supporting documents, an agreement, a written disagreement, or a hearing request. Use the address, telephone number, form, and submission method printed on that specific notice rather than relying on a general deadline found elsewhere.

Federal IRS guidance does not establish the same rules for state tax letters. A state department of revenue may use different deadlines, appeal forms, and collection powers, so follow the issuing state’s instructions for a state notice.

What can happen after the date passes
You may lose or narrow a dispute opportunity
Some notices give you a defined period to challenge proposed tax or ask for an administrative hearing. If you do nothing by that date, the IRS may proceed under the notice’s next step. A late response is not guaranteed to restore a right that expired, so ask the issuing office what late procedure, if any, remains available.
Charges can continue on an unpaid balance
When a notice concerns tax you owe, late-payment penalties and interest may continue. IRS guidance says interest generally keeps accruing until the assessed tax, penalties, and interest are paid. Penalty relief can be available in qualifying circumstances, but eligibility depends on the facts and the particular penalty; missing a deadline does not automatically erase the charges.
Collection activity can escalate
Ignoring successive collection notices can move an account toward stronger enforcement. The IRS says a CP503 second reminder warns that failure to pay, arrange payment, or contact the agency may lead to filing a federal tax lien. An LT39 notice describes possible lien filing and garnishment of wages, bank accounts, or other income. These are potential consequences at particular collection stages, not automatic results for every missed date.

| Notice or letter | Purpose and required response | Timing described by the IRS | Possible result of inaction |
|---|---|---|---|
| CP503 | Second balance-due reminder stating the amount owed, payment due date, and payment options | Use the payment date printed on the CP503 | Possible federal tax-lien filing if you do not pay, arrange payment, or contact the IRS |
| CP90, CP297, or Letter 1058 | Intent-to-levy or levy notice; request a Collection Due Process hearing using the form and address in the letter if you disagree or need review | 30 days from the notice date for the listed notices | Collection can proceed, potentially including levy action, if no timely resolution is reached |
| Letter 950 | 30-day letter proposing a deficiency adjustment; submit a protest when you disagree | 30 days as described for specified deficiency cases | The proposed adjustment may move forward under the procedures explained in the letter |
| Penalty-abatement rejection letter | Appeal the denial of a request to remove a failure-to-file or failure-to-pay penalty | Generally 30 days, subject to the rejection letter’s own deadline | The denial may stand unless you use the stated appeal route |
Other IRS notices can have different periods or no comparable appeal window. Do not transfer the 30-day period from one example to another letter without checking its instructions.
How to respond when the deadline has already passed
- Secure the complete notice. Keep every page, envelope, attachment, and prior letter in the sequence. Write down the notice number, tax year, amount, printed deadline, and the date you actually received it.
- Classify the requested action. Determine whether the IRS is asking for payment, records, an agreement, a disagreement, a protest, or a hearing request. A payment problem requires a different path from an incorrect tax adjustment.
- Use the listed contact channel immediately. Call the number or use the response address and method printed on the notice. State that the deadline has passed, explain briefly why, and ask which late response, appeal, hearing, or correction procedure is still available.
- Send a focused response. If you believe the notice is wrong, follow its dispute process and include photocopies of records supporting the error. Keep the originals unless the letter expressly requires them. If a hearing form or protest is required, complete that form rather than sending an unstructured letter alone.
- Preserve proof. Make a complete copy of everything submitted. Retain certified-mail records, delivery confirmation, electronic submission receipts, payment confirmations, and notes of calls, including dates, names, and any reference number.
- Address any undisputed balance. Pay what you can through the method the IRS identifies, or ask about an installment or other payment arrangement. Contacting the agency does not itself stop interest, penalties, or collection activity unless an applicable agreement or hold is established.
- Escalate when the stakes are high. A levy, lien warning, large proposed adjustment, or missed hearing period may justify qualified tax assistance. You can authorize a representative to deal with the IRS, and eligible taxpayers may seek help from a Low Income Taxpayer Clinic.
If you disagree with the amount or adjustment
Separate factual disagreement from inability to pay. If income, deductions, credits, payments, identity, or another record is wrong, use the notice-specific correction or appeal process and provide documents that directly support your position. IRS guidance advises contacting the office within the time stated and sending photocopies of records that show an error.
For a listed levy or deficiency notice, the hearing or protest route is time-sensitive. CP90, CP297, and Letter 1058 are examples that provide a 30-day Collection Due Process request period measured from the notice date. Letter 950 is an example of a 30-day protest letter for specified deficiency cases. A late submission may still be worth attempting, but the IRS—not a general rule—determines what procedure remains available in your circumstances.

If a penalty-abatement request was denied, the IRS says a taxpayer may generally request an Appeals conference or hearing within 30 days of the rejection letter. Read that letter carefully because its stated deadline governs, and the right to appeal is not necessarily available indefinitely.

If you agree with the balance but cannot pay
Inability to pay in full is not the same as having no option. IRS Topic 202 directs taxpayers to contact the agency and describes payment arrangements. Review the options identified in your notice and provide accurate financial information if the application requires it.
Continue addressing the account even while seeking an arrangement. Interest generally continues until the assessed tax, penalties, and interest are paid, and a payment plan may have its own terms and fees. Penalty relief is fact-specific; ask whether you qualify rather than assuming a missed deadline or financial hardship automatically removes a penalty.
If collection pressure is severe or the account involves a levy or lien, ask about representation. The IRS permits taxpayers to authorize a representative. Taxpayers who meet the eligibility rules may also obtain assistance from a Low Income Taxpayer Clinic, which is a public-help resource rather than a guarantee of representation.
How collection notices can progress
Balance-due reminders
A CP503 is described by the IRS as a second reminder. It states the amount owed, when payment is due, and available payment methods. Failing to pay, arrange payment, or contact the IRS can lead to a federal tax-lien filing, according to the CP503 guidance.

Levy and lien warnings
Some later-stage notices warn that the government may claim property or take funds. The LT39 guidance describes possible filing of a lien and garnishment of wages, bank accounts, or other income. A levy or garnishment is a serious escalation, so use the telephone number, form, and response address in the letter immediately and ask whether a payment arrangement, hearing, or other review is available.
Hearing information
The IRS’s CP92 information includes hearing and assistance details. Do not infer a deadline from CP92 or from another notice; read the date and instructions on the copy you received.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Common mistakes after a missed deadline
- Assuming every notice allows 30 days. Thirty days applies to specified notices, including the listed levy, deficiency, and certain penalty-appeal examples. Other letters use different dates.
- Waiting for a new letter. A second notice may carry more serious consequences. Contact the issuing office as soon as you discover the missed date.
- Sending originals without retaining copies. Keep a complete record and proof of delivery for every response.
- Paying without addressing an incorrect assessment. Payment may not resolve a factual dispute or preserve an appeal right; follow the letter’s dispute procedure as well.
- Ignoring a balance because payment is impossible. Ask about arrangements and assistance. Silence can allow charges and collection activity to continue.
- Using a general IRS address or phone number found online. The notice’s contact details are tied to its processing unit and instructions.
- Treating a state notice like an IRS notice. State deadlines and remedies vary; use the issuing state’s official instructions.
A practical recordkeeping checklist
Create one file—paper or electronic—for the entire matter. Include the notice and envelope, tax return and schedules for the relevant year, payment confirmations, relevant income or expense records, correspondence, call notes, and proof of every submission. Label each item with the tax year and notice number. If you send a protest, hearing request, or supporting documents, keep the exact version submitted and the delivery evidence together.
This documentation helps the IRS locate the account, lets a representative understand the history, and supports a request to correct a mistake or explain why a response was late. It also prevents separate notices for the same year from being handled as unrelated problems.

When professional help is especially useful
Consider qualified tax help when the notice threatens a levy or lien, proposes a substantial adjustment, involves several years, follows an identity or filing dispute, or arrives after an appeal period has expired. Ask the professional to explain which deadline applies, whether a late request can be accepted, what immediate collection risk exists, and what documents are needed. Verify credentials and fees before authorizing anyone to act.
For taxpayers who meet program requirements, a Low Income Taxpayer Clinic can be an alternative source of assistance. The IRS also allows a taxpayer to authorize a representative directly. Neither option guarantees that a missed deadline will be reopened, so seek help quickly.
Bottom line for a missed IRS notice date
Find the notice number and printed deadline, determine whether the issue is payment, records, disagreement, or a hearing, and contact the issuing IRS office using the letter’s instructions. A late response may leave a path to correction, payment arrangements, or review, but it may not restore every expired right. Unpaid balances can continue accruing interest and penalties, and ignored collection notices can progress toward a lien or garnishment. Prompt, documented action gives you the best chance of preserving whatever options the notice and your circumstances still allow.
