What Happens When You Miss a GST Return or Payment Deadline?

Missing a GST deadline can create two separate problems: a consequence for filing the return late and another for paying tax late. Depending on the country, return type, reporting period, amount owing and length of delay, you could face a late-filing fee or penalty, interest on overdue tax, or additional enforcement. A nil return may still be mandatory.

GST is administered nationally or provincially, so no single penalty or due date applies everywhere. The examples below identify the jurisdiction clearly: Canada’s GST/HST system, New Zealand GST and India’s CGST framework as described in a Telangana Commercial Taxes Department handbook. Confirm the date and balance in your own tax authority account before relying on any figure.

What happens if you file a GST return late?

The authority may charge a late-filing penalty even when the payment issue is handled separately. The amount can depend on tax owing, complete months or days late, turnover, the return form and any waiver that applies to the relevant period. Some systems impose a filing penalty only when tax is owing; others state that a return must be filed for every taxable period, including a nil period.

Filing late does not necessarily mean your GST registration is cancelled. The official material considered here does not establish automatic cancellation after one missed deadline. More serious or continuing noncompliance can lead to further penalties, interest or prosecution in some jurisdictions.

Late filing and late payment are different

A return tells the authority what your taxable sales, input tax and net tax are. Payment transfers the amount due. You can file on time but pay late, file late and pay immediately, or do both late. The authority may assess each consequence independently.

  • Late filing: a fee or penalty for submitting the return after its filing deadline.
  • Late payment: interest, and sometimes a payment penalty, on the unpaid balance after the payment due date.
  • Nil period: a period with no net GST to remit. In Canada and New Zealand, the cited guidance still requires a return for such a period.

Do not use another country’s formula or a generic online calculator. First identify the tax authority, filing frequency, form and reporting period shown on your account or notice.

Country examples: how the rules differ

Canada: GST/HST

The Canada Revenue Agency (CRA) applies a specific late-filing formula when a GST/HST return is late and an amount is owing. It describes the penalty as A + (B × C):

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • A is 1% of the amount owing.
  • B is 25% of A.
  • C is the number of complete months the return is late, up to 12 months.

The CRA says it will not charge this late-filing penalty when you owe $0 or the CRA owes you a refund. That exception does not remove the obligation to file the return.

For illustration only, if the amount owing were CAD 10,000 and the return were two complete months late, A would be CAD 100 and B would be CAD 25. The formula would produce CAD 150 (CAD 100 + CAD 25 × 2). Your actual assessment can differ if the account, reporting period or applicable rules differ.

Overdue GST/HST balances can also accrue arrears interest. CRA guidance says the interest rate is set quarterly and compounded daily. Interest continues to increase while a balance remains unpaid, so filing a return does not by itself stop payment interest.

Canada: finding the due date

For monthly and quarterly reporting periods, the return and payment are generally due one month after the period ends. Annual-filer rules vary. For example, a sole proprietor with a December 31 year-end and business income may have payment due April 30 while the return is due June 15. Those dates depend on the taxpayer’s circumstances; use the due date in the CRA account or notice rather than assuming the example applies to you.

Registered businesses must file a return for each reporting period, including a period with no business transactions or no net tax to remit. If the return is missing, submit it even when the amount is zero, then review the account for any penalty or interest posted.

New Zealand: GST

Inland Revenue requires a return for every taxable period, including a nil return, and states that there is no extension of time to file. Its published usual deadline is the 28th day of the month after the taxable period ends. Two exceptions listed by Inland Revenue are:

Taxable period ending Usual filing and payment date
March 31 May 7
November 30 January 15
All other periods covered by the usual rule 28th of the following month

Payment is due on the same day as the return. Inland Revenue says late-filing and late-payment penalties may apply, but the page cited here does not state their calculation. Do not infer a dollar amount from the calendar rule alone.

Returns can be filed through myIR, through some accounting software, or on paper if you do not have a myIR account. If you receive a non-filing notice, check myIR to confirm that the return shows as received; if it does not, file again and retain the confirmation.

The Inland Revenue page used for these dates was last updated June 23, 2021. Check the current myIR instructions and legislation for the period you are filing, particularly if a date or penalty has changed.

India: CGST framework and the Telangana handbook

A December 2025 Telangana Commercial Taxes Department handbook explains that late fees differ by return form and can be affected by notifications and waivers. For the annual return under section 44 of the CGST Act, it reproduces a statutory late fee of ₹100 per day, capped at one-quarter of 1% (0.25%) of turnover in the relevant State or Union territory.

That figure is not a universal “GST late fee.” The handbook also discusses return-specific rates, caps and relief for particular periods. Before paying, identify the exact form and tax period and check the latest central and state notifications. A waiver that applied to an earlier filing window may not apply to a later one.

Do you still have to file a nil GST return?

Usually, yes where the jurisdiction requires a return for every taxable period. Canada requires registered businesses to file for each reporting period even when there were no transactions or no net tax to remit. New Zealand expressly requires a nil return for every taxable period. A zero balance can prevent a particular Canada late-filing penalty, but it does not erase the filing requirement.

Submit the nil return through the authority’s approved channel and keep the receipt. If your business stopped trading, do not assume that silence closes the GST account; ask the authority whether a final return or registration cancellation is required.

Will interest be charged if you pay GST late?

Interest is commonly tied to the unpaid amount and the period after the payment due date, but the rate and compounding method are jurisdiction-specific. In Canada, CRA arrears interest on an overdue GST/HST balance is determined quarterly and compounded daily. The account balance, not a general estimate, is the reliable figure because interest can continue to accrue and rates can reset.

New Zealand’s cited guidance confirms that payment is due on the return’s due date and that late-payment penalties may apply, but it does not provide a calculation in the material available here. India’s handbook section discussed above focuses on return late fees; it should not be treated as a complete statement of interest rules for every CGST liability.

What to do immediately after missing the deadline

  1. Identify the jurisdiction and obligation. Confirm the country or state, GST/HST registration, return form, filing frequency, taxable period and both filing and payment dates in the official account or notice.
  2. File the overdue return. Complete the return accurately and submit it through the authority’s channel. File a nil return when the rules require one, even if no payment is due.
  3. Save proof of submission. Keep the receipt, acknowledgement number, timestamp and a copy of the submitted figures. Check the account later to make sure the return is marked received.
  4. Review the posted balance. Look for the assessed net tax, late-filing fee, payment penalty and interest. Use the authority’s calculation rather than applying a formula from another country.
  5. Pay what you can by the fastest accepted method. Paying the principal reduces the period on which interest can accrue, although it may not remove a penalty already assessed.
  6. Contact the tax authority if full payment is not possible. CRA guidance specifically tells taxpayers who cannot pay on time or in full to contact it. Ask the relevant authority about available arrangements, but do not assume that contacting it guarantees a waiver or payment plan.
  7. Correct errors promptly. If the late return contains an incorrect figure, use the authority’s amendment or correction process rather than leaving an inaccurate return on file.

  • The reporting period and filing frequency assigned to your registration.
  • The original due date and whether a weekend, holiday or special period rule changes it.
  • The net tax reported and any payments or credits already posted.
  • The date from which interest is calculated and the rate used for that period.
  • Any late-filing penalty, payment penalty, waiver or adjustment shown on the statement.

For Canada, the CRA account is the place to confirm reporting-period dates and the current GST/HST balance. For New Zealand, use myIR to verify filing receipt and notices. For India, check the applicable return form and current central and state notifications in addition to the Telangana handbook’s explanation.

Common mistakes that make a missed deadline worse

Waiting until the payment is available

Filing and paying are separate. If you cannot pay the entire amount, filing the accurate return first establishes the liability and prevents the filing delay from growing. Then contact the authority about the unpaid balance.

Assuming a zero return can be skipped

Canada and New Zealand both require returns in specified nil or no-activity situations. Skipping the form can trigger a non-filing notice even when the eventual tax is zero.

Using a flat daily fee from a different form

India’s handbook demonstrates why a blanket daily amount is unsafe: annual and other returns can have different rates, caps and waivers. Canada’s formula is based on amount owing and complete months late, not a universal daily charge.

Ignoring a notice after filing

An acknowledgement is not the same as a cleared account. Reconcile the submitted return with the statement and respond to a non-filing or balance-due notice. In New Zealand, Inland Revenue advises checking myIR receipt status and filing again if the return is not recorded.

Assuming registration is cancelled automatically

A missed deadline alone is not established as automatic cancellation in the cited official material. Keep filing until the authority confirms that your registration has been closed or your filing obligation has changed.

When professional help is sensible

Consider a tax professional or direct authority contact when several periods are missing, the business changed filing frequency, records are incomplete, a return includes cross-border transactions, or a notice threatens enforcement. Bring the registration number, periods affected, sales and purchase records, payment confirmations and every notice. Ask for a written explanation of the assessed amount and the procedure for requesting a correction or waiver where one exists.

Payment consequence covered here Arrears interest, rate set quarterly and compounded daily Late-payment penalties may apply; calculation not stated in the cited guidance Check the current rules for the specific liability and period
Special due-date example Some annual sole proprietors: payment April 30 and filing June 15 for a December 31 year-end March 31 period due May 7; November 30 period due January 15 Confirm the form, period and current notification

These examples are not interchangeable. The authority account and law for your filing period control the result.

Bottom line

File the missing GST return now, even if it is nil; check the official account for the assessed tax, fee and interest; pay what you can; and contact the tax authority promptly if you cannot pay in full. The exact consequence depends on the jurisdiction, form and reporting period, so treat Canada, New Zealand and India’s rules as distinct examples rather than a global GST standard.
