Federal student-loan default is more serious than being late. After at least 270 days without scheduled payments, the loan can enter default, the full balance may be accelerated, collection costs can be added, credit reporting can follow, and the government may withhold part of your pay or federal payments. You can usually resolve default through rehabilitation, eligible consolidation, a repayment agreement, or payment in full—but the right route depends on your loan type, holder, and the notices you receive.

When does a federal student loan go into default?

A missed payment first makes a loan delinquent. Federal Student Aid says default generally begins after at least 270 days without the scheduled payments. The exact handling can vary by federal loan program and the organization holding the debt, so treat the 270-day point as the federal standard rather than a promise that every notice will arrive on the same day.

If you are having trouble making payments, contact your loan servicer before default. Lower-payment or temporary-relief options may be available while the loan is still current or delinquent. Once the account is placed in default, several protections and repayment choices become harder to access.

What default changes immediately

The balance may be accelerated

“Acceleration” means the entire unpaid principal and accrued interest can become due immediately instead of being paid through the original monthly schedule. Collection fees may be added, and in some cases court costs or attorney fees can increase the amount owed. Interest and fees depend on the loan and collection stage; request a current payoff or balance statement from the official holder.

Your credit file can show a default

Federal Student Aid reports that defaulted loans are reported to credit bureaus. For loans handled by the Department’s Default Resolution Group (DRG), its FAQ says reporting may begin when a borrower takes no action within 65 days after placement in default. That is a procedural trigger, not a guaranteed score change: the effect depends on the rest of your credit history and on what each bureau receives.

A default record associated with a later consolidation can remain on a credit history for up to 10 years, according to the federal FAQ. Successful rehabilitation is treated differently: after the ninth required rehabilitation payment, the Department requests removal of the default notation. Earlier late-payment history can remain even after the default notation is removed.

Collections can reach wages and federal payments

The Department may use administrative wage garnishment to take up to 15% of disposable pay without first obtaining a court judgment. “Disposable pay” is calculated under federal garnishment rules, so the amount withheld is not simply 15% of gross salary.

Treasury offset can divert a federal income-tax refund or certain federal benefits to the debt. These actions are not automatic for every borrower on the same timetable. The notices you receive identify the proposed action, the deadline, and the way to request a review or dispute.

Federal aid and some repayment benefits can be suspended

A borrower in default generally loses eligibility for additional federal student aid. Federal Student Aid also lists loss of certain repayment benefits, including deferment and forbearance. Eligibility can return after the default is resolved, but restoration is subject to the rules of the specific program and the status of each loan.

Other effects are possible, not universal

The Department’s overview lists possible court action. A school may also withhold an official transcript; if that happens, the federal guidance says you may request an unofficial transcript. Neither outcome occurs in every case, so do not assume that a lawsuit or transcript hold is inevitable.

Default and collections are not the same thing

Default is the status of the loan after the required period of nonpayment. Collections are the actions used to recover the debt, such as notices, payment demands, Treasury offset, or wage garnishment. A loan can be in default before an involuntary collection action starts, and resolving the default is what ends the default-based collection process—not merely waiting for a letter to arrive.

Department-held loans generally move to the Default Resolution Group. A defaulted Federal Family Education Loan (FFEL) may instead be handled by a guaranty agency. Your notice or account record should identify the current holder; send payments and documents only through the contact information in an official notice or on a verified federal site.

What if you ignore a default notice?

  1. Placement in default: The holder records the default after the applicable nonpayment period and sends notices explaining the debt and available actions.
  2. Credit reporting and collection preparation: For DRG accounts, the federal FAQ says a report to credit bureaus may begin if no action is taken within 65 days of placement in default.
  3. Involuntary collection: If the debt remains unresolved, the government may pursue wage garnishment or Treasury offset, subject to the notices and procedures for that action. A tax refund or eligible federal benefit can be intercepted, and up to 15% of disposable pay may be garnished administratively.
  4. Longer-term restrictions: Aid and selected repayment benefits remain unavailable until the default is resolved under the applicable program rules.

These stages do not run on one universal calendar. Read every notice immediately: a deadline in your notice controls your opportunity to request documents, arrange a payment, or challenge a proposed collection.

Ways to get out of federal student-loan default

Federal Student Aid identifies four broad routes. Compare eligibility, how quickly the default status is cleared, monthly payment burden, interest or fees added, credit reporting, and whether involuntary collection stops. The table gives the core differences; the sections that follow explain the steps and cautions.

Option Who may use it Key requirement or effect Credit and cost considerations
Rehabilitation Generally available for Direct and FFEL loans; Perkins rules differ Direct/FFEL: nine on-time voluntary payments within 10 consecutive months. Perkins: nine consecutive payments. After successful completion, default status is removed and ED requests removal of the default notation; earlier late payments remain. Collection can continue until the loan leaves default or at least five rehabilitation payments are made.
Direct Consolidation Only borrowers and loans meeting federal eligibility rules Combines eligible federal loans into a new Direct Consolidation Loan and may clear default faster than rehabilitation. Default and preceding late-payment records may remain for up to 10 years. Capitalized interest and collection costs can increase the new balance.
Repayment agreement Borrowers whose holder offers an agreement for the defaulted debt Make the payments and follow the terms stated by the holder and in the notice. Do not assume an agreement alone removes the credit notation or restores every benefit; confirm the specific result in writing.
Pay in full Borrowers able to satisfy the current payoff amount Obtain the official payoff figure and pay through the authorized holder. Confirm how the payment changes collection status, credit reporting, and aid eligibility before sending funds.

Rehabilitation

For Direct and FFEL loans, rehabilitation generally requires nine on-time, voluntary payments within 10 consecutive months. Federal Perkins loans require nine consecutive payments under a different schedule. The standard rehabilitation amount is 15% of annual discretionary income divided by 12. If that amount is unaffordable, ask the holder to calculate an alternative based on your current financial circumstances.

After all required payments are accepted, the loan leaves default, collection stops, and federal benefits that were suspended because of default can return under program rules. The Department requests removal of the default notation after the ninth payment, while earlier late payments may continue to appear. Wage garnishment or another involuntary action may continue during rehabilitation until the loan is no longer in default or at least five rehabilitation payments have been made.

Direct Consolidation

Consolidation can be a faster way out when the borrower and loans qualify. Ask the holder which loans are eligible and what documentation is required; not every defaulted loan can be consolidated under every circumstance. A consolidation does not erase the prior payment history: the default record and preceding reported late payments may remain for up to 10 years. Unpaid interest can capitalize, and collection costs may be included, increasing the new principal.

Repayment agreement or payment in full

A holder may offer a repayment agreement, and Federal Student Aid also lists paying the debt in full. The precise payment amount, timing, and effect on collection actions come from your notice and account. If a notice gives a deadline for making a first payment to avoid a particular involuntary action, meet that deadline and keep proof of delivery. Do not rely on a generic date from another borrower’s case.

Step-by-step: what to do after receiving a default notice

  1. Verify the holder. Review your federal account and the notice to determine whether the debt is with DRG or a guaranty agency. For Department-held loans transferred to DRG, the official MyEdDebt portal provides status, payment, and payment-history information.
  2. Request a complete debt record. The Department’s FAQ says borrowers may request documents related to the debt. Ask for the balance, interest, collection costs, loan types, payment history, and the date default was recorded.
  3. Read every deadline. Mark the dates for a payment arrangement, rehabilitation request, consolidation, hearing, or Treasury-offset dispute. A deadline in your own notice governs.
  4. Gather income and expense information. Rehabilitation and repayment discussions may require current financial details. Keep pay stubs, benefit statements, tax information, and records of essential expenses available.
  5. Compare the resolution paths. Ask how each option changes the monthly payment, total balance, collection activity, credit reporting, and eligibility for federal aid or deferment.
  6. Submit the chosen application or agreement through the official holder. Keep copies of forms, confirmation numbers, payment receipts, and the name of the representative who confirmed the arrangement.
  7. Continue monitoring the account. A first payment or submitted application does not automatically mean the default has been cleared. Check that payments are credited and that the holder confirms the next required step.

Your rights when collection is proposed

Requesting a wage-garnishment hearing

If you receive an administrative wage-garnishment notice, the federal FAQ describes a hearing process to challenge the action. The request must be postmarked no later than 30 days after the notice date. A timely hearing request can temporarily pause that collection step while the challenge is considered; it does not itself resolve the loan’s default.

Use the instructions and address in your notice. State the basis for the challenge and attach supporting records, such as proof of payment, an identity or ownership dispute, or evidence that the proposed withholding would violate the applicable rules.

Disputing a Treasury offset

The Department also describes a process to dispute a Treasury offset. The notice explains the deadline and where to send the dispute. Respond by that deadline, keep a copy, and include documents supporting your position. A dispute concerns the offset; you still need a separate plan to resolve the underlying default.

Obtaining debt documents

You may ask the holder for records connected with the debt. Compare the records with your own payment history and tax or wage notices. If the holder cannot explain a balance or payment, raise the issue in writing and retain proof that you did so.

How to avoid scams while fixing default

Federal Student Aid says DRG does not charge for its service and warns borrowers about companies that charge enrollment, subscription, or maintenance fees to get them out of default. You do not need to pay a private company simply to contact the federal holder, request records, or discuss rehabilitation and consolidation.

  • Start with the holder named in your federal notice or your verified StudentAid.gov account.
  • Do not share your Federal Student Aid ID password with a company that promises guaranteed forgiveness or an immediate credit-score repair.
  • Do not sign a power of attorney or authorize payments until you understand who will receive the money and what service is actually being provided.
  • Be cautious when a caller demands an upfront fee, promises to stop garnishment without reviewing your notice, or tells you to stop communicating with the Department.

How the official guidance applies to your situation

Default rules differ by loan type, holder, and procedural stage. Direct and FFEL rehabilitation use the 10-month schedule described above, while Perkins rehabilitation uses nine consecutive payments. Department-held loans generally use DRG; defaulted FFEL loans may involve a guaranty agency. Collection and credit effects are possible consequences, not guaranteed events on one fixed timetable.

Use the current notices and your official account to confirm eligibility, balances, deadlines, and benefit restoration. The federal pages can change as procedures change, so verify details directly with the organization currently holding your loan before choosing a resolution path.

For the governing borrower explanations, consult Federal Student Aid’s default and collections FAQ, rehabilitation FAQ, and default overview.
