What Happens When an E-Invoice Is Missing or Incorrect?

A missing or incorrect e-invoice can become a tax-compliance problem, but the result depends on the country, transaction type, error and applicable deadline. You may need to issue a correction, the customer may have difficulty supporting an input-VAT deduction, and the issuer may face a fine. There is no single EU-wide penalty and an error does not automatically cancel every deduction.

First identify the issuing and receiving countries, whether the transaction is B2B, B2C or B2G, and whether it is domestic or cross-border. Then classify the defect: no invoice, a missing field, a wrong VAT calculation, an invoice sent to the wrong recipient, or a failure to use the required structured format. Those facts determine the remedy.

Why the country and transaction come first

The European Union has common VAT invoicing principles, but member states add their own requirements, deadlines, correction procedures and sanctions. The European Commission’s VAT invoicing guidance says invoices are generally required for most business-to-business supplies, subject to exceptions. It also notes that national rules can govern particular transactions, invoice types and electronic systems.

The same defect can therefore have different consequences in Belgium, Spain or another member state. A domestic B2B invoice may be subject to a structured-e-invoicing mandate, while a consumer transaction or a cross-border supply follows different rules. Public-sector (B2G) transactions can also use a mandated platform or format. Do not apply the Belgian or Spanish examples below as if they were EU-wide law.

Before changing an invoice, record:

  • the supplier’s and customer’s countries and VAT numbers;
  • whether the supply is B2B, B2C or B2G, and whether it is domestic or cross-border;
  • the date of supply, invoice date and any reporting deadline;
  • the exact defect and whether the invoice has already been reported, paid or used to claim VAT; and
  • the national rule or platform that governs the transaction.

What counts as a missing or incorrect e-invoice?

An e-invoice is not merely any file sent by email. Under the consolidated EU VAT Directive, it is an invoice containing the required information and issued and received in an electronic format. Where a structured format is mandated, the file must also comply with the applicable technical model and national implementation.

Defect Typical compliance question Possible consequence
No invoice issued Was an invoice legally required, and has the issuance deadline passed? Late or non-issuance sanctions, a required invoice, and difficulty supporting the customer’s deduction.
Required field missing Are date, sequential number, supplier or customer details, description, VAT rate or special wording absent? Correction document, rejection by a platform or customer, and possible tax fine.
Wrong amount or VAT Was the taxable base, rate or VAT amount calculated incorrectly? Corrective invoice, amended VAT reporting and possible interest or penalties under local law.
Wrong recipient Did the named customer actually receive the goods or services? The recipient should not claim the invoice; the issuer may need a credit or other corrective document.
Invalid structured format Does the file meet the required EN 16931-based model, national CIUS or platform rules? Technical rejection, inability to transmit or receive, and sanctions where a structured system is mandatory.
Altered or unreadable record Can the parties demonstrate authenticity, integrity and legibility through the retention period? Weak audit evidence and a challenge to the invoice’s tax reliability.

What a compliant invoice normally contains

EU baseline rules can require, depending on the transaction and member state, the issue date, a unique sequential invoice number, supplier and customer identification, a description and quantity of goods or services, prices, the VAT rate and VAT amount. Special wording may also be required, such as a reverse-charge reference. National rules can add fields or prescribe a particular electronic route.

The European Commission states that, once the required information is present, the invoice acts as proof that allows a business to deduct VAT in the relevant member state. That makes the invoice important evidence, not a guarantee that every deduction will be accepted. The underlying supply, correct VAT treatment, payment records and local procedural rules can also matter.

What can happen to the buyer

Input-VAT evidence may be inadequate

A buyer with no invoice, or with an invoice that does not establish the supply and VAT charged, may be unable to support an input-VAT claim when the tax authority asks for evidence. The usual practical response is to obtain a corrected invoice before filing or amending the return. Whether a deduction can be preserved through other evidence or a later correction is a national-law question; do not assume that any mistake automatically destroys the claim.

Structured invoices can be a legal condition

Belgian Federal Public Service Finance guidance gives a country-specific example: for transactions within Belgium’s structured-e-invoicing obligation, the buyer needs a structured electronic invoice to exercise deduction. The guidance also describes a conditional substance-over-form exception where the material conditions are met. That exception is not a general EU rule. The same Belgian guidance says a buyer can face an administrative fine for lacking the technical means to receive a structured e-invoice.

A wrong recipient must not use the invoice

Belgian guidance treats an invoice for goods or services not supplied to the named recipient as a serious error. The recipient should reject it, should not include it in the accounts and does not qualify for deduction on that document. If the transaction belongs to another customer, the issuer must correct the record with the appropriate document.

What can happen to the issuer

Failure to issue or inaccurate content

Where an invoice was required, failing to issue it, omitting mandatory information or stating inaccurate values can trigger a proportional tax fine, a correction requirement or both. The exact amount, calculation and appeal rights are national. Late issuance may be treated differently from a missing field, and a technical transmission failure may have its own rule.

Belgium: published examples, not an EU tariff

Belgium’s official e-invoicing FAQ says existing fines for failure to issue invoices and for non-compliant invoices also apply to structured e-invoices. It describes proportional fines for an unissued structured invoice, missing mandatory information or inaccuracies, under Table C of the annex to Royal Decree No 41 of 30 January 1987. It also identifies non-proportional fines for late issuance and certain other legal or technical failures.

The FAQ summarizes a Belgian Royal Decree of 8 July 2025 that introduced fines for lacking the technical means to issue and receive structured invoices: €1,500 for a first offence, €3,000 for a second and €5,000 for subsequent offences, subject to the recurrence conditions stated in the Belgian rules. These figures apply to that Belgian offence and date; they are not EU-wide penalties. Verify the current decree, effective dates and enforcement conditions before relying on them.

How to correct an e-invoice

Use a document linked unambiguously to the original

The EU VAT Directive treats a document or message that amends an invoice and refers specifically and unambiguously to the original as an invoice. This supports the general corrective-invoice or credit-note approach, but it does not prescribe one workflow for every country or error.

  1. Stop relying on the defective document. Tell the customer and your accounting team whether the invoice must be rejected, held or excluded from a VAT return.
  2. Identify the original. Record its invoice number, date, supplier, customer, supply, taxable base and VAT amount. Do not silently overwrite the original record.
  3. Classify the correction. A wrong VAT rate or amount, missing mandatory field, changed consideration, cancellation or wrong recipient may require different local documents.
  4. Issue the permitted corrective document. State that it is corrective, explain the reason, identify the original invoice or invoices and show the corrected values. Use the required structured format and transmission channel where applicable.
  5. Update reporting and accounts. Determine whether the original or corrected VAT return, sales listing or platform submission must be amended and whether the customer needs to adjust its deduction.
  6. Retain the audit trail. Keep the original, correction, delivery or rejection records and evidence of the underlying supply for the statutory retention period.

Spain: a specific corrective-invoice procedure

Spain’s Tax Agency says a corrective invoice is mandatory when one or more required elements are missing or when VAT amounts were determined incorrectly, among other listed circumstances. Correction should be made as soon as the issuer becomes aware of the relevant circumstances, provided four years have not elapsed in the situations described by the agency.

The Spanish corrective invoice must identify its corrective status, explain the reason, identify the original invoice or invoices, state the correction and satisfy the general invoice requirements. This is Spanish guidance, not a universal EU deadline or template.

Belgium: wrong-recipient invoices

For an invoice sent to the wrong Belgian recipient, the tax authority’s guidance says the issuer must account for the mistake as described in its rules and include the wrongly invoiced amounts in a corrective document, in practice a credit note. The unintended recipient should reject the invoice and keep evidence of the rejection.

Structured e-invoicing adds technical duties

The European Commission’s EN 16931 guidance distinguishes a compliant structured invoice from an arbitrary electronic attachment. Invoice-level compliance includes mandatory information, correctly structured information, correctly calculated amounts and permitted values. A receiver that must accept electronic invoices must be able to process invoices compliant with the relevant CORE model or national CIUS, subject to applicable implementation rules.

A PDF may be readable yet fail a mandate that requires structured data. Conversely, a file can pass a schema check while containing an incorrect VAT rate or wrong customer. Check both layers:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Business content: parties, supply, dates, quantities, prices, VAT treatment and totals.
  • Technical content: required XML or other syntax, code lists, decimal rules, identifiers, endpoint or access-point requirements and national CIUS constraints.
  • Transmission: whether the platform accepted, rejected or merely delivered the message, and the timestamp of each event.

If your system cannot receive or issue the required format, the problem may itself be a compliance defect. Arrange the technical capability before the mandate or deadline applies; do not assume that emailing a PDF cures a failed structured submission.

Preserve authenticity, integrity and legibility

The consolidated VAT Directive requires authenticity of origin, integrity of content and legibility from issuance through the end of the storage period. Businesses may use controls that create a reliable audit trail. In practice, preserve the original electronic record, restrict unauthorized edits, link every correction to its source and retain evidence showing who issued, received, rejected or amended the invoice.

Keep related purchase orders, contracts, delivery evidence, payment records and VAT calculations where they help demonstrate that the supply occurred and that the corrected figures are accurate. A correction should add a traceable record, not erase the history of the first invoice.

Decision checklist before you act

  1. Confirm the rule. Check the country, transaction category, invoice mandate, platform and current national deadline.
  2. Separate the defect. Decide whether it is non-issuance, a missing field, wrong value, wrong recipient or format failure.
  3. Protect the return. Ask whether the invoice has been used to claim or report VAT and whether an adjustment is required now.
  4. Contact the other party. Agree how the invoice will be rejected, corrected, transmitted and recorded.
  5. Use the correct document. Follow the local rule for a corrective invoice, credit note, debit note or replacement document; never create an unexplained duplicate.
  6. Check timing. Confirm correction, issuance, reporting and retention deadlines, including any four-year period or shorter national limit.
  7. Document the fix. Preserve the original, correction, platform status and supporting evidence.
  8. Escalate unusual cases. Obtain local tax advice for cross-border supplies, reverse-charge transactions, repeated failures, audits or disputed deductions.

Key distinctions that prevent costly mistakes

Question Why it changes the answer
Who issued and received the invoice? Each country can impose different fields, formats, deadlines and penalties.
What kind of transaction is it? B2B, B2C, B2G, domestic and cross-border supplies can have different invoicing and reporting rules.
Is the problem content or format? A correct amount in an invalid structure can still be rejected where structured invoicing is mandatory.
Has VAT already been claimed or reported? The correction may require a return adjustment, not only a replacement document.
Was the recipient actually supplied? An invoice for another party’s supply should not be used for deduction or accounting.

The European Commission’s common framework is a starting point, not a substitute for the national rule. The Commission’s Your Europe VAT information was last checked on 11 May 2026; the consolidated Directive text cited here is shown through 20 March 2025. National guidance, including the Belgian and Spanish examples above, was accessed on 13 October 2026. Rules and amounts can change, so verify the applicable country’s current requirements before filing or correcting an invoice.

The Bottom Line

A missing or incorrect e-invoice usually calls for a documented correction, but the buyer’s deduction and the issuer’s exposure depend on the country, transaction, defect and deadlines. Identify those facts first, use the locally permitted corrective document, meet any structured-format requirement and preserve a complete audit trail.
