The authority receiving the case must follow the court or appellate order and applicable GST law; it may have to consider the taxpayer’s reply, provide a hearing and issue a fresh, reasoned decision. Remand alone does not mean that no tax is payable.
What “set aside and remanded” means
Setting aside removes the challenged demand order as the operative decision. Remanding sends the matter back for further proceedings, usually so the authority can address a defect and decide again. Unless the order also disposes of the underlying proceeding, the show-cause notice and tax dispute may remain open, subject to the terms of the remand and statutory limits.

The exact effect depends on what the court or appellate body set aside: the original adjudication, an appellate order, or only part of a demand. Read the operative paragraphs of the order rather than assuming that every remand has the same scope.
What the fresh hearing can involve
A useful example is the Allahabad High Court’s order of 29 May 2025, Neutral Citation No. 2025:AHC:92330-DB. The Court quashed a section 73 demand order that did not give reasons and merely incorporated the show-cause notice by reference, then remanded the matter to the Deputy Commissioner, State Tax. It directed that the taxpayer be allowed to respond to the notice within four weeks from the judgment, receive an opportunity of hearing, and then have a fresh order passed in accordance with law. Read the judgment.
That four-week response window was a direction in that case, not a general GST remand deadline. In another matter, the court or appellate order may specify a different period, a different hearing procedure, or other limits. The authority’s fresh decision is not automatically valid merely because it follows a remand: it must comply with the governing statute and the directions in the order.
What to do after receiving a remand order
- Read the operative directions. Identify what order or part of it was set aside, which authority must act, what issues remain open, and every response or hearing date.
- Review the show-cause notice. Match each allegation with a response and supporting records. Follow any filing method specified in the remand or notice, and retain proof of submission.
- Take part in the hearing. Attend or follow the stated process for requesting or joining the hearing. Keep records of attendance and submissions.
- Assess the new order against the right materials. Compare its findings and demand with the notice, evidence, remand directions and applicable law. The relevant version of the Act and rules can depend on the proceeding. The CBIC statutory portal publishes the GST Acts: Explore Act — GST Acts.
- Check the route and deadline before challenging it. A later challenge to the fresh order has its own applicable procedure and time limit; the earlier quashing order does not automatically determine either one.
Which remand procedure applies?
Do not treat a court remand and a statutory appeal as interchangeable. The identity of the body that issued the order, the decision it set aside and the remand’s wording affect the next steps.

| Situation | What it generally means | What to check |
|---|---|---|
| Court quashes an original demand and remands for fresh adjudication | The original demand order is set aside, but the notice and underlying proceeding may still be considered, subject to the judgment and statutory limits. | The court’s directions, the authority named, the issues left open and any filing or hearing dates. |
| Statutory appellate authority decides an appeal | Section 107 and the applicable appeal rules govern the appellate order. The statutory framework limits the Appellate Authority’s power to refer a case back to the adjudicating authority that made the challenged decision. | Which body issued the order, what decision was under appeal and what the operative directions require. CBIC’s Appeal Rules provide for Form GST APL-04 to state the final amount of demand confirmed. |
Section 75 of the GST Acts contains general provisions relevant to determination, including hearing and the form of the determination order; section 107 concerns appeals to the Appellate Authority. Consult the applicable statutory text and rules alongside the specific remand order rather than relying on a general description of remands.

Not by itself. In the Allahabad High Court example, the Court required fresh adjudication; it did not decide that the taxpayer could never be liable. The authority’s decision after remand, and any later challenge, depend on the facts, governing law and precise directions. A fresh order may reach a different result, but it must do so lawfully and in line with the remand.
