A foreclosure sale transfers the property through the foreclosure process, but it does not automatically answer whether you still owe money. In many states, the lender may pursue a deficiency judgment—the difference between the debt and the foreclosure-auction price—although state law, the loan documents and the sale determine whether that claim exists and can be collected.
On your credit report, CFPB guidance says foreclosure information generally remains for seven years from the foreclosure date. You may still qualify for another mortgage later, but there is no single national waiting period or guaranteed approval. Your immediate priorities are to obtain the servicer’s final accounting, check every credit report for accuracy, learn your state’s post-sale possession rules and get qualified legal help if a balance is claimed.

What happens to your mortgage balance after the sale?
The foreclosure sale resolves the lender’s right to sell the home under the applicable foreclosure process. It does not, by itself, prove that the loan balance is zero. The key question is whether your state permits a deficiency judgment and whether the facts of your loan and sale satisfy that law.

The Federal Trade Commission describes a deficiency judgment as the difference between the amount owed and the foreclosure-auction sale price. For example, if the legally recognized debt were higher than the auction proceeds, the lender might seek the shortfall. The example is only a description of how the calculation works; it is not a prediction of liability in any particular case.

Rules differ substantially by state. Some jurisdictions limit or prohibit deficiency claims for certain residential loans, impose court procedures or deadlines, or apply protections based on the property and loan type. Other jurisdictions may allow a claim subject to valuation and procedural requirements. The loan documents, payment history, foreclosure notices, sale accounting and state law all matter. A foreclosure sale alone cannot establish that you owe a deficiency, nor can it establish that no deficiency is collectible.
Ask for a written final accounting
After the sale, request a written statement from the servicer or lender showing how it calculated the debt and how the sale proceeds were applied. Keep copies of the note, mortgage or deed of trust, payment records, foreclosure notices, sale documents and all correspondence. If a company contacts you about a remaining balance, ask for the legal basis, the calculation, the current owner of the debt and any response deadline in writing.
Do not ignore a summons, demand letter or court deadline. A state-licensed attorney or legal-aid provider can determine whether a deficiency is permitted, whether the amount is calculated correctly and whether defenses or time limits apply. The FTC’s consumer guidance establishes that deficiencies are possible in many states, but only state-specific advice can address your situation.

How does foreclosure affect your credit report?
CFPB guidance states: “Foreclosure information generally remains in your credit report for seven years from the date of the foreclosure.” The CFPB page containing that statement was last reviewed September 11, 2024. The seven-year period is a reporting rule; it is not a promise that your credit score will recover on a particular schedule or that every related account entry will disappear at the same time.
The score impact is real but not a fixed number
A foreclosure is negative information and can make future borrowing, including a home loan, more difficult or expensive. Official consumer guidance does not establish one universal point drop for every borrower. The effect depends on the rest of your file, what was reported before the sale, the age of each account and the scoring model used. Avoid calculators or advertisements that present one guaranteed score loss as a rule.
Check how the disposition is described
The FTC notes that credit-report entries can sometimes make it unclear whether an account ended in foreclosure, a short sale or a deed in lieu of foreclosure. Review the status, dates, balance and payment history on each report. Make sure the report reflects the actual disposition and does not show a balance that conflicts with the final accounting or applicable law.

How to review and dispute foreclosure information
You can obtain your credit reports, review them line by line and challenge inaccurate information yourself. CFPB guidance says you may dispute an error with both the credit-reporting company and the company that furnished the information.
- Collect the records. Assemble the foreclosure sale notice, closing or sale statement, servicer correspondence, payment history and any court documents. Mark the date of the foreclosure sale and the date each account was reported.
- Identify the exact error. Examples include a wrong sale date, an incorrect balance, duplicate reporting, an account shown as open when it was closed, or a foreclosure status that does not match the actual resolution.
- Send a clear dispute to the reporting company. Identify the account, explain what is wrong, state the correction you seek and attach copies—not originals—of supporting documents.
- Send the same dispute to the furnisher. The furnisher is the lender, servicer or debt company that supplied the data. Include the evidence and keep proof of delivery and copies of everything submitted.
- Review the investigation result. If information is corrected, obtain an updated report. If it is not corrected and you still believe it is wrong, preserve the response and seek consumer-law or legal-aid advice about next steps.
Accurate negative information generally cannot be removed simply because it is unfavorable. CFPB warns consumers to be skeptical of credit-repair companies that promise to erase accurate foreclosure information or guarantee a particular score. You do not need to pay a repair company to submit a legitimate dispute.
Can you get another mortgage after foreclosure?
Possibly. CFPB says a borrower may qualify for another mortgage after foreclosure, but a foreclosure can make approval harder and borrowing more costly. There is no single waiting period that applies to every loan, lender or borrower, so do not rely on a generic rule stated without a program, lender and date.

What an underwriter is likely to examine
- Time since the foreclosure: The elapsed time is one factor, but it does not independently guarantee eligibility.
- Loan-program rules: Different programs can set different requirements, and those requirements can change.
- Credit history: Underwriters may review whether other accounts are current, how your credit has rebuilt and whether new delinquencies occurred.
- Financial circumstances: Income, assets, debts, employment stability and the reason for the foreclosure may affect the decision.
- Documentation: Be prepared to document the foreclosure, any settlement or deficiency resolution, income and assets.
Compare the cost of borrowing now with waiting
When you become eligible, compare more than the advertised interest rate. Ask each lender about program eligibility, required waiting or seasoning rules, documentation, interest rate, points, origination charges, mortgage insurance and other fees. Calculate the total cost over the period you expect to keep the loan. Waiting longer while rebuilding credit or saving a larger down payment may improve terms, but the right choice depends on your finances and housing needs.
| Question | General guidance | What determines the result |
|---|---|---|
| Can a balance remain? | A deficiency judgment may be possible in many states. | State law, loan documents, sale price, debt calculation and procedural requirements. |
| How long can foreclosure appear? | Generally seven years from the foreclosure date. | The accuracy of the reported date and status, plus the separate reporting treatment of related accounts. |
| Can you obtain another mortgage? | Qualification is possible, but not guaranteed. | Loan program, lender underwriting, credit history, financial circumstances and current rules. |
| How long may you remain in the home? | The period can range from days to months. | State foreclosure and eviction procedures and local court practice. |
How long can you stay in the home after the foreclosure sale?
The sale date is not a nationwide move-out deadline. CFPB guidance says the time to leave depends on state foreclosure and eviction procedures and may range from days to months. Some occupants receive a notice before an eviction case; others may have additional procedural steps. The answer can also depend on whether the foreclosure was judicial or nonjudicial and on local court requirements.

A practical plan for the weeks after the sale
- Confirm the sale details. Keep the official sale date, sale result and any recorded documents. These dates affect credit-report review and legal deadlines.
- Request the final loan accounting. Ask the servicer to show the debt, fees, sale proceeds, credits and any claimed remaining balance in writing.
- Get state-specific advice if money is claimed. Take the accounting and loan records to a licensed attorney or legal-aid provider in the property’s state, especially if a demand or lawsuit includes a deadline.
- Review all credit reports. Check the foreclosure date, status, balance and related accounts for accuracy. Save a copy of each report and the date obtained.
- Dispute errors directly. Send documented disputes to both the reporting company and the furnisher. Track responses and request corrected reports.
- Plan housing and future borrowing separately. Learn the local possession timeline, then address credit rebuilding, savings and mortgage-program requirements without assuming that one answer resolves the others.
Where to get legitimate help—and what to avoid
For mortgage or housing problems, the FTC points consumers toward free, legitimate housing counseling. A counselor can help organize documents and explain options, but no company can guarantee that it will stop a foreclosure or erase accurate credit history. Be cautious if anyone demands upfront money, tells you to stop communicating with the servicer, asks you to sign over ownership, or promises a guaranteed deficiency cancellation or mortgage approval.
Legal-aid organizations and state-licensed attorneys are the appropriate sources for questions about deficiency judgments, eviction deadlines, bankruptcy consequences or disputes over the foreclosure process. Credit-report errors can be challenged without hiring a credit-repair company. Use the relevant state and local resources because the controlling rules are not uniform across the United States.
Keep these issues separate
Four decisions are often mistakenly treated as one: whether a deficiency is legally available, whether the credit report is accurate, whether you can qualify for a future mortgage and when you must leave the property. Each has a different decision-maker and timeline. The foreclosure sale may trigger all four questions, but resolving one does not automatically resolve the others. A written accounting, accurate reports, current state advice and a careful review of future loan costs give you the clearest path forward.
