When you sell the home that secures a home equity line of credit (HELOC), the line is generally paid off in full as part of the closing. Ask the HELOC creditor or servicer for a written payoff amount calculated through the expected closing date, give its payment instructions to the settlement agent, and verify afterward that the lien was released. An ordinary account balance is not necessarily the amount needed to satisfy the debt on a particular date.
The basic rule: the sale usually requires a full HELOC payoff
A HELOC is open-end credit secured by an interest in your home. That security interest is recorded against the property, so selling the property normally requires the debt to be satisfied before ownership can be transferred free of that lien. The Consumer Financial Protection Bureau (CFPB) states in its consumer guidance that if you sell your home, you are generally required to pay off your HELOC in full immediately.

In a conventional sale, this does not usually mean that you personally send the lender a check before listing or before the buyer arrives. Instead, the payoff is handled through the closing process. The settlement agent receives the sale funds, pays approved liens and other closing obligations according to the transaction documents, and sends the HELOC payoff to the creditor using the creditor’s instructions.
The word “generally” matters. Your credit agreement, the servicer’s procedures, the purchase contract, and state recording rules control the individual transaction. The general rule does not promise that a buyer can assume your line, that the lender will accept less than the balance, or that the sale proceeds will be enough.

Why an old statement balance is not enough
The figure on your latest monthly statement may not be the amount required to release the lien on closing day. A payoff statement is calculated as of a specified date and can include interest accruing after the statement was issued and any other amounts required under the agreement. If the closing occurs on a different day, the good-through amount can change.
Ask the creditor or servicer for a payoff statement for the anticipated closing date. Request the total amount needed to pay the obligation in full, the date through which that figure is valid, the acceptable payment method, the receiving-bank or other delivery instructions, and any fees included. Follow the servicer’s authorization and request procedures; it may require written permission before discussing the account with your settlement agent.
How to arrange the payoff before closing
- Tell the settlement professional about the HELOC. Provide the title or escrow company, closing attorney, or other settlement agent with the account information as soon as the sale is underway. A recorded HELOC lien should be identified during the title and payoff process, but you should not assume another party has complete or current information.
- Submit a written payoff request. Ask the creditor, assignee, or servicer for a payoff statement tied to the expected closing date. Use the procedure it specifies and allow time for identity or authorization checks.
- Send the statement and instructions to the settlement agent. The agent needs the amount, good-through date, and payment directions to include the payoff in the closing figures. Confirm how the HELOC will appear on the settlement statement and which funds will be used.
- Compare dates. Check that the statement remains valid through the scheduled signing and funding date. If there is a gap, ask whether the servicer requires an updated statement or an additional per-day amount.
- Confirm funding and discharge steps. Ask the settlement agent when the payoff will be transmitted and how confirmation will be documented. Keep the payoff statement, wire or check details, and closing disclosure with your sale records.
Do not independently alter the servicer’s wire instructions based on an email or telephone message that has not been verified through a trusted channel. A settlement agent should follow the creditor’s authenticated instructions, but you should still review the figures and destination before funds are sent.

The settlement agent coordinates the closing documents, collects money required by the transaction, disburses those funds, and arranges recording of the ownership transfer. The HELOC payoff is one item in that disbursement schedule. The agent does not decide unilaterally that a reduced amount is acceptable; the creditor must provide instructions or approve an alternative.
| Stage | What you should verify | Why it matters |
|---|---|---|
| Title and payoff review | The HELOC account and lien are identified and the correct creditor or servicer is contacted. | A missing or outdated payoff request can delay funding or recording. |
| Before signing | The payoff amount is calculated through the expected closing date and matches the settlement figures. | Interest and other amounts can make a statement balance different from the amount needed for release. |
| Funding | The agent has the creditor’s current payment method and delivery instructions. | The lienholder must receive the required amount in the required form. |
| Date change | The agent and servicer explain whether a refreshed payoff is needed. | A payoff tied to one date may not cover a later closing date. |
| After closing | The payoff was sent and the public record eventually shows a release. | Payment and recording can occur at different times. |
Ask the agent what happens if the scheduled closing date changes, if funding is delayed, or if the buyer’s lender requires a different recording sequence. The answer is transaction-specific, because the payoff figure and the recording process are tied to dates and local practice.

If the sale proceeds will not cover the HELOC
Estimate the available net proceeds early, not on the morning of closing. Compare the money expected to remain after the sale’s required expenses and other liens with the dated HELOC payoff. If the net proceeds are insufficient, tell both the HELOC servicer and the settlement professional promptly.
Do not assume that the creditor will release its lien for the amount available, accept a partial payment, or let the sale close first and collect the rest later. The reviewed CFPB guidance and federal rule do not establish one universal shortfall procedure. Any alternative—if one is available—depends on the creditor’s approval and the facts of the contract and transaction.
Questions to raise as soon as a shortfall appears
- What exact amount is required to release the lien on the proposed closing date?
- Will the servicer review a proposed arrangement, and what written approval is required?
- How will any approved payment arrangement be documented and reflected in the closing documents?
- What happens if approval is not obtained before the contractual closing deadline?
- Which party will update the title company and buyer’s lender about the status?
Do not promise the buyer that the lien will be released until the servicer and settlement agent have confirmed the terms. A shortfall can affect whether the contract can close on schedule, but the sources do not prescribe a standard outcome for every state or lender.
How long a payoff statement should take
Federal Regulation Z addresses the creditor’s obligation to furnish a payoff statement. For a covered dwelling-secured consumer credit obligation, the creditor, assignee, or servicer, as applicable, generally must provide an accurate statement of the total amount required to pay in full as of a specified date within seven business days after receiving a written request.
The seven-business-day period is a regulatory deadline for providing the statement; it is not a promise that your sale will close within seven business days or that funds will arrive by then. Build in additional time for the servicer’s request process, authorization checks, weekends, holidays, corrections, and the settlement agent’s review.

Regulation Z identifies exceptions, including certain bankruptcy or foreclosure circumstances, reverse mortgages or shared-appreciation mortgages, and natural disasters or similar circumstances. In an applicable exception, the statement must be provided within a reasonable time rather than under the general seven-business-day standard. Ask the servicer which rule applies to your account rather than assuming the ordinary deadline.

When the statement arrives, check the borrower and property information, the payoff good-through date, the total amount, daily interest or other date-change instructions, and the method for sending funds. If any item is unclear, obtain a corrected statement before closing.
What if the closing date moves?
A delayed closing can make an otherwise accurate payoff statement stale. Notify the settlement agent and servicer immediately when the signing, funding, or recording date changes. Ask whether the creditor will honor the existing figure, add a specified per-day amount, or issue a new statement.
Do not calculate a replacement amount yourself unless the servicer’s written instructions expressly tell you how. The settlement agent should use the creditor’s current instructions so that the amount sent is sufficient for the date on which the obligation is paid.
After payoff: make sure the lien is released
Paying the HELOC and seeing the public record updated are separate events. CFPB consumer guidance notes that a delay between payoff and lien release can occur. After closing, check the county recorder or other local property-record office for the release or satisfaction of the HELOC lien.

Keep the closing statement and proof of payment while the record is being updated. If the record remains unclear, contact the company that received the payoff and ask for the status of the release and any additional information it needs. If the creditor says it has released the lien but the public record does not reflect that, ask the recorder’s office what filing or indexing step is pending.
Recording practices and terminology vary by jurisdiction. The relevant document may be described as a release, satisfaction, discharge, or another local equivalent. The important check is that the recorded property information no longer shows the paid HELOC as an outstanding lien.

“The balance on my online account is the payoff.”
Not necessarily. The payoff is date-specific and may include additional interest or other amounts. Use the written statement for the expected closing date.
“The title company will find and solve everything.”
The settlement agent coordinates the transaction, but you should disclose the HELOC, provide account information, review the figures, and respond to servicer requests. A line that was not disclosed can still affect funding and recording.

Do not assume assumption is permitted. The general sale rule is full payoff unless the creditor has expressly approved a different arrangement under the applicable agreement and transaction.

“If I cannot pay the entire amount, the lender must accept the sale proceeds.”
There is no universal rule in the reviewed material requiring a lender to accept less than the full payoff or release the lien automatically. Obtain written direction before relying on any alternative.
“Once the money is sent, the lien disappears immediately.”
Payment and public recording can be separated by a delay. Check local records and follow up with the payoff recipient.
A practical timeline for a normal sale
- When the sale is listed or accepted: disclose the HELOC and give the settlement professional the account details.
- Several weeks before the anticipated closing: submit the written payoff request using the servicer’s required process.
- After the statement arrives: compare its good-through date and total with the settlement figures and expected net proceeds.
- Before signing: verify that the agent has current payment instructions and knows about any date or funding changes.
- At funding: confirm that the HELOC payoff is included in the disbursement schedule and retain the final settlement documents.
- After closing: monitor local property records for the lien release and contact the payoff recipient if the record does not update or is ambiguous.
What this means for your planning
The financial question is not simply how much you have drawn on the line. It is whether the net amount available at closing will cover the dated HELOC payoff along with every other required transaction amount. Get that comparison early enough to address a potential shortfall while the contract and closing schedule can still be discussed.
These are general U.S. rules and practices based on CFPB consumer guidance and federal Regulation Z. Your HELOC agreement, the servicer’s written instructions, the sale contract, and state or local recording procedures govern the particular transaction. For a sale involving bankruptcy, foreclosure, a reverse or shared-appreciation mortgage, a disaster-related delay, or another unusual circumstance, ask the servicer and an appropriately qualified closing professional how the applicable exception or procedure affects the payoff.
The bottom line
Plan for the HELOC to be paid in full through the sale closing. Request a dated payoff statement in writing, coordinate its instructions with the settlement agent, raise any proceeds shortfall before closing, and verify the lien release in public records afterward. The seven-business-day federal standard helps establish when a qualifying payoff request should be answered, but it does not guarantee a closing date, sufficient sale proceeds, or an automatic solution when the numbers do not work.
