Your mortgage escrow analysis compares the money in your escrow account with the target balance needed for upcoming property taxes, insurance premiums and other escrowed bills. A qualifying surplus may be refunded; a shortage can be left in the account or collected through higher payments, depending on its size. A negative balance is a different condition called a deficiency. The federal rules below apply generally to federally related mortgage loans, but your loan documents, payment status and coverage under Regulation X still matter.
Start with the three balances your statement can show
The servicer uses an escrow analysis to project the account month by month. It estimates deposits from your monthly payment, scheduled tax and insurance disbursements, and the minimum balance required by the loan or applicable rules. The result is compared with the account’s target balance.

| Term | What it means at analysis | Why it matters |
|---|---|---|
| Surplus | The current escrow balance is higher than the target balance. | A current borrower with a surplus of at least $50 generally must receive a refund within 30 days of the analysis. |
| Shortage | The balance is below the target balance, but the account is not negative. | The servicer chooses among options that can leave the amount in place or collect it through a lump payment or higher escrow installments, subject to the rules below. |
| Deficiency | The escrow account has a negative balance. | Regulation X has separate repayment provisions. Do not assume the rules for a shortage apply to a deficiency. |
The word “shortage” is often used loosely in borrower conversations, but a shortage and a deficiency are not synonyms. The distinction is important because the permitted collection methods differ.

How the annual escrow analysis creates the result
A servicer must analyze an escrow account before establishing it and at the end of the escrow computation year. It may perform additional analyses when circumstances warrant. The analysis uses a trial running balance: the servicer lays out expected monthly deposits and expected disbursements, then determines the target balance and the monthly escrow amount for the next year.

The annual statement normally arrives within 30 days after the computation year ends. It should show the account history, the projected schedule for the coming year, the year-end balance and how any surplus, shortage or deficiency will be handled. The statement should also explain a material difference between the prior projected low balance and what actually happened in the account.
What happens to an escrow surplus
A surplus of $50 or more when you are current
For this rule, you are generally considered current when the servicer receives your payments within 30 days of their due dates. If the analysis discloses a surplus of at least $50 and you meet that current-payment standard, the servicer must refund the surplus within 30 days from the date of the analysis. The countdown starts on the analysis date, not when you receive the statement or when the check is printed.
The federal regulation states: “If an escrow account analysis discloses a surplus, the servicer shall, within 30 days from the date of the analysis, refund the surplus to the borrower if the surplus is greater than or equal to 50 dollars ($50).”
A surplus under $50
When the surplus is less than $50, the servicer may refund it or credit it against your escrow payments for the next computation year. A credit reduces the amount that would otherwise need to be collected through future monthly payments; it is not the same as a cash refund.

What if you are not current?
If you do not meet the regulation’s current-payment standard, the servicer may be able to retain the surplus under the loan documents instead of sending the ordinary refund. Check the payment history and the note or mortgage agreement before assuming that a refund is due. The $50 threshold and 30-day deadline do not override the separate treatment that can apply when the loan is delinquent.
What happens to an escrow shortage
A shortage means the account is below its target balance at analysis. The first comparison is the shortage amount with one month’s escrow account payment. “One month’s payment” refers to the monthly amount allocated to escrow, not necessarily your entire mortgage payment that also includes principal and interest.
Shortage smaller than one monthly escrow payment
For a shortage of less than one month’s escrow payment, the servicer has three permitted courses:
- Leave the shortage in the account and adjust future deposits as allowed by the analysis.
- Require repayment within 30 days.
- Require repayment in equal monthly installments over at least 12 months.
If the last option is used, the shortage recovery is added to the escrow portion of your monthly bill. It can raise the total mortgage payment even if your principal-and-interest payment has not changed.

Shortage equal to or greater than one monthly escrow payment
For a shortage at least as large as one month’s escrow payment, the servicer may leave it in place or require equal monthly repayment over at least 12 months. The regulation does not give this category the 30-day repayment option that is listed for a smaller shortage.
Voluntary lump-sum payments
You may choose to send an unsolicited lump sum to cover a shortage that is at least one monthly escrow payment, and the servicer may accept it. A voluntary payment is different from a repayment method the servicer requires. The annual escrow statement cannot present that lump sum as a required or offered repayment option. A servicer may communicate separately about a voluntary payment only if it clearly says that the payment is optional.
Why a shortage can increase your monthly mortgage payment
Two separate changes can appear after an analysis. First, the servicer may spread required shortage repayment across at least 12 months. Second, the projected cost of taxes, insurance or other escrowed charges may have increased. The new total payment can therefore rise because of the repayment amount, higher projected bills, or both. A bank’s consumer guidance may allow a payment increase when its analysis shows escrow funds would otherwise be insufficient, but your contract controls account-specific terms.
Deficiency: the negative-balance rules are different
A deficiency exists when the escrow balance is below zero. That means the servicer has already paid more in escrowed charges than the account contained. Regulation X separates deficiency handling from shortage handling.

Deficiency smaller than one monthly escrow payment
When you are current under the 30-day payment standard and the deficiency is less than one month’s escrow payment, the servicer may:
- Leave the deficiency in place;
- Require repayment within 30 days; or
- Require repayment in two or more equal monthly payments.
Deficiency at least one monthly escrow payment
For a deficiency at least as large as one month’s escrow payment, the servicer may leave it in place or require repayment in two or more equal monthly payments. If you are not current, the servicer may recover a deficiency under the loan documents instead of using the current-borrower options above.

Do not look only at the line labeled “shortage” or “surplus.” Work through the statement in this order:
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →- Confirm the computation year. Make sure the beginning and ending dates match the period your servicer says it analyzed.
- Check deposits. Compare the monthly escrow amounts credited with the escrow portion of your mortgage statements and your payment records.
- Check disbursements. Match property-tax payments, insurance premiums and other listed charges to bills, renewal notices and tax records. Note the payment date and amount for each item.
- Find the year-end balance. This is the actual account balance shown at the end of the completed year, not merely the projected balance from last year’s statement.
- Review the projected schedule. Look for revised tax, insurance or other charge estimates and for the required minimum or target balance.
- Recalculate the balance direction. Starting with the opening balance, add each deposit and subtract each disbursement. The result should reconcile to the displayed ending balance, subject to the servicer’s stated timing conventions.
- Identify the treatment. The statement should say whether a surplus is being refunded or credited, whether a shortage is being collected and over what period, or how a deficiency is being handled.
- Compare the prior projection with actual history. The statement should explain any relevant difference between the low balance that was projected and the low balance that actually occurred.
If a number does not reconcile, ask the servicer for a transaction-level explanation and the date used for each tax or insurance disbursement. Keep copies of the statement, bills, payment confirmations and correspondence. Your loan documents may contain additional terms, and the federal rules do not establish the arithmetic for an individual account.

Illustrative calculations
These examples show how the rules work; they are not predictions of any particular loan.
Surplus example
Suppose the analysis shows a target balance of $2,400 and an actual balance of $2,475. The surplus is $75. If the borrower is current under the regulation’s 30-day standard, the servicer must refund the $75 within 30 days of the analysis date.
Shortage example
Suppose the monthly escrow payment is $500 and the analysis shows a $300 shortage. Because $300 is less than one monthly escrow payment, the servicer could leave it in place, require payment within 30 days, or collect it in equal installments over at least 12 months. A 12-month schedule would add $25 per month to escrow for the recovery period, before considering any change in projected taxes or insurance.

Large-shortage example
If the same monthly escrow payment is $500 and the shortage is $700, the amount is at least one monthly escrow payment. The servicer could leave it in place or require equal monthly repayment over at least 12 months. Under a 12-month schedule, the shortage component would be about $58.33 per month, in addition to the escrow amount needed for upcoming bills.
What changes when you pay off the mortgage
Paying the loan in full triggers a separate escrow-refund rule. Generally, within 20 days after full payoff, the servicer must return the remaining escrow funds under its control. The 20-day period excludes legal public holidays, Saturdays and Sundays.
In specified circumstances, the servicer may credit the remaining funds to a new escrow account if you agree to that transfer. The servicer is not required to use the transfer option and may refund the money instead. This payoff deadline is distinct from the 30-day deadline for refunding a qualifying surplus after an annual or other escrow analysis.
When to contact the servicer or seek help
- Contact the servicer when the statement’s opening balance does not match the prior ending balance, a tax or insurance payment is missing, or a charge appears twice.
- Ask for the analysis date when calculating the 30-day surplus-refund deadline.
- Ask which portion of a higher payment is shortage recovery and which portion reflects new projected bills.
- Confirm whether a proposed lump-sum payment is voluntary or required, and request that the distinction be stated in writing.
- Review the note, mortgage or deed of trust for terms that apply when payments are delinquent or the account is paid off.
These federal provisions concern covered mortgage servicing and do not determine every loan’s coverage, state-law requirement or contract term. If the servicer cannot explain a documented discrepancy, you can use the servicer’s formal error-resolution or information-request process and consider qualified housing or legal advice for your jurisdiction.
