If a crypto exchange fails, the Bitcoin shown in your account can become inaccessible while withdrawals are frozen and a bankruptcy, insolvency, receivership or other legal process determines what customers can recover. You might eventually receive Bitcoin, cash or a claim against the failed company—or recover less than your displayed balance. There is no universal recovery percentage or timetable.
Bitcoin held by an ordinary exchange is not automatically protected like money in an FDIC-insured bank account or securities at a SIPC-member brokerage. The result depends on the exchange’s custody agreement, how customer accounts and coins were structured, the type of proceeding, the jurisdiction and the assets available to satisfy claims.

What an exchange failure can look like
“Failure” is not one event. An exchange can stop withdrawals temporarily, become insolvent, enter a court-supervised bankruptcy, be placed into receivership, suffer fraud or discover that it does not hold enough assets to meet customer balances. Each scenario can produce a different result.
Withdrawals may stop before a formal bankruptcy
An exchange can suspend Bitcoin withdrawals even while its website and mobile app continue to show your balance. You may be able to log in and see a number, but the exchange may block transfers, sales or conversions. A suspension can be temporary, but customers generally cannot know from the displayed balance alone whether the company has enough immediately available Bitcoin to honor every request.

A legal process determines the treatment of assets and claims
If the company becomes insolvent or files for bankruptcy, a court, trustee, receiver or claims administrator may have to determine whether particular customer coins can be returned, whether the coins are estate property, or whether customers hold monetary claims against the debtor. The U.S. Securities and Exchange Commission (SEC) warns that, in crypto-entity bankruptcies, it may be unclear how much customers will recover, if anything.
A shortfall or fraud can change the outcome
If an exchange lent, rehypothecated, commingled or lost assets, the amount available for customers may be less than the balances recorded in its systems. A court may need to sort competing claims and establish priorities. Do not assume that a failure always means a total loss, and do not assume that every customer will receive the exact number of Bitcoin shown in the app.
Is Bitcoin on an exchange insured?
Usually, no. An exchange account should not be treated as an insured bank deposit or as a securities account with automatic investor protection.

| FDIC insurance | Eligible deposits at participating banks, subject to statutory limits and rules. | Bitcoin held with a crypto exchange is not an FDIC-insured bank deposit merely because its value is displayed in dollars. |
| SIPC protection | Customer assets at a qualifying SIPC-member brokerage when the statutory conditions for a SIPC liquidation are met. | An ordinary crypto exchange account is not automatically a SIPC-protected brokerage account. |
| Other insolvency protections | Protection can depend on a specific institution, asset classification, contract and governing law. | There is no single, generally applicable federal guarantee for Bitcoin balances at all exchanges. |
Investor.gov explains that bitcoins held in a digital wallet or Bitcoin exchange do not have protections similar to FDIC-insured bank accounts or SIPC-protected securities accounts. The SEC staff’s investor FAQ also says that non-security crypto assets are not protected by the Securities Investor Protection Act (SIPA) and may not be covered by another specific insolvency regime.
The SEC FAQ describes a narrow, conditional possibility: if certain non-security crypto assets are contractually treated as financial assets carried in a securities account, they may have a better chance of avoiding treatment as estate property if a broker-dealer enters liquidation. That is not a blanket rule for crypto exchanges. It depends on the institution, the account structure, the contract and the facts of the proceeding.

SIPC’s claims process illustrates the distinction. SIPC protection applies when a qualifying member brokerage fails and the statutory requirements are satisfied. A crypto exchange customer cannot assume that process applies simply because the account contains an asset that trades through an online platform.
Why two customers can receive different results
The custody agreement
The exchange’s customer agreement may describe whether you own specific coins, have a contractual right to equivalent coins, or hold a general claim against the company. It may also address lending, staking, rehypothecation, pooling, withdrawal rights and the exchange’s ability to use or transfer assets. Courts interpret those terms under applicable law; a marketing description of “your Bitcoin” does not settle the legal question.
Account and wallet structure
Assets held in a segregated customer wallet or account can raise different legal questions from assets pooled with the company’s property. Records showing which assets belong to which customers may matter. Segregation, however, is not a promise that recovery will be immediate: the administrator may still need to identify, trace and distribute the property.
The asset and activity involved
Spot Bitcoin, staked assets, tokens lent to a platform and derivatives positions can have different contractual and legal treatment. A Bitcoin balance that was available for instant withdrawal may not be treated the same way as an amount committed to a lending or yield program.
Jurisdiction and the type of proceeding
Bankruptcy, liquidation, receivership and insolvency proceedings follow different rules. The governing country, state or territory can affect priorities, notices, deadlines and available remedies. The U.S. Bankruptcy Code includes notice and claims provisions for defined commodity-broker liquidation situations, but those provisions do not automatically govern every crypto-exchange failure.

Assets available to pay claims
Even when a customer has a valid claim, the amount and timing of recovery depend on the debtor’s remaining Bitcoin, cash and other property, plus administrative costs and higher-priority claims. A court-approved distribution may return coins, cash, a combination of both or a pro-rata amount that is smaller than the account statement.
What to do when an exchange fails
Act methodically. A rushed transfer, altered record or payment to a fake “recovery agent” can make a difficult situation worse.
- Confirm the status through official channels. Check the exchange’s own notices, regulator announcements and court or trustee materials. Distinguish a scheduled maintenance outage from a withdrawal freeze, insolvency filing or law-enforcement seizure.
- Save evidence immediately. Download account statements, transaction histories, deposit and withdrawal confirmations, tax forms, wallet addresses, customer-support messages and identity-verification records. Save copies in more than one secure location, preserving dates and original file formats where possible.
- Record your balance and transactions. Note the amount and type of each asset, the date of the last successful withdrawal, pending orders, loans, staking positions and any fees or restrictions. Screenshots can supplement, but should not replace, downloadable records.
- Secure your related accounts. Change passwords for the exchange email account and any reused credentials, enable multifactor authentication where still available, and watch for password-reset or phishing messages. Do not disclose recovery phrases, private keys or one-time authentication codes.
- Identify the actual proceeding. Find the court docket, receiver, trustee or claims administrator named in an official notice. Use the contact details published in those materials rather than a link sent in an unsolicited message.
- Read the claim instructions and deadlines. The required form, documentation, currency of the claim and filing date are case-specific. Missing a deadline can affect participation, so verify it against the current court or administrator notice.
- Submit only accurate information. Keep a complete copy of anything filed, including confirmation numbers and supporting documents. Do not inflate a claim or combine unrelated accounts without instructions to do so.
- Monitor updates and distributions. Proceedings can change through court orders, settlement agreements or amended plans. Check official notices periodically and update your address or payment details through the approved process.
- Reject guaranteed-recovery offers. No legitimate administrator can promise that you will recover all Bitcoin immediately. Be suspicious of anyone demanding an upfront fee, remote access, a wallet backup or a private key.
How the claims process usually works
There is no universal portal, deadline or recovery timetable for all failed exchanges. A case may require a proof of claim, an account reconciliation, identity verification or a response to an objection. Another proceeding may distribute assets automatically to verified customers, while a different one may require a formal filing.
Read the definitions in the governing notice carefully. “Customer claim,” “general unsecured claim,” “priority claim” and “property claim” can have different consequences. A claim for the return of specific Bitcoin is not necessarily valued the same way as a claim for the dollar value of Bitcoin at a particular date.
Keep your tax records separate from the insolvency claim. A blocked withdrawal, sale, distribution or eventual loss can have tax consequences that depend on your jurisdiction and facts. A qualified tax professional or lawyer can explain those issues; the court’s claims office generally cannot give individualized tax or legal advice.

Possible outcomes for your Bitcoin
| Potential result | What it means | Why it is not guaranteed |
|---|---|---|
| In-kind return | The administrator identifies and transfers some or all of the Bitcoin attributed to you. | Coins may be missing, commingled, encumbered or needed to satisfy competing claims. |
| Cash or substitute distribution | You receive cash or another approved asset instead of Bitcoin. | The valuation date, exchange rate and distribution formula are set by the case. |
| Allowed claim paid over time | Your claim is recognized and paid in one or more distributions. | Payment depends on available estate assets, priorities and court approval. |
| Partial recovery | You recover less than the account balance. | Administrative expenses, asset shortfalls and higher-priority claims can reduce distributions. |
| No recovery | A claim may ultimately produce no distribution. | The SEC says recovery can be uncertain in crypto-entity bankruptcies. |
Self-custody: reducing future exchange exposure
Self-custody means holding the private keys that authorize Bitcoin transactions instead of leaving withdrawal authority with an exchange. It can reduce counterparty exposure after a successful transfer, but it does not retrieve coins already trapped at a failed platform.
Moving Bitcoin to a hardware wallet
Official Bitcoin guidance from Trezor describes transferring BTC from an exchange to a compatible hardware wallet. The practical sequence is:
- Initialize the wallet using the manufacturer’s instructions and create its backup.
- Install or open the wallet software and verify that the receiving address is displayed on the hardware device, not only on the computer screen.
- In the exchange withdrawal screen, paste or scan the address and select the Bitcoin network. Do not use an address for another network or asset.
- Send a small test amount first when fees and minimums make that practical.
- Confirm the destination address and amount on the hardware device, submit the withdrawal and wait for network confirmations.
- Check the transaction ID independently and retain the withdrawal record.
A hardware wallet changes who controls the keys; it does not eliminate phishing, malware, mistaken-address transfers, network-fee surprises or theft of the backup.
Protecting the wallet backup
The backup is essential if the device is lost or damaged. Trezor’s guidance says not to share the backup and not to keep digital copies. Store it privately, protect it from fire and water, and make sure a trusted recovery plan exists without exposing the words to an internet-connected device.

Exchange custody versus self-custody
| Consideration | Exchange custody | Self-custody |
|---|---|---|
| Control | The exchange controls withdrawal infrastructure and may suspend access. | You control the keys and authorize transactions directly. |
| Counterparty risk | You depend on the provider’s solvency, systems and legal obligations. | You remove the exchange as an ongoing custodian. |
| Recovery responsibility | You may need to prove a claim and follow a court or administrator process. | You must keep a usable, confidential backup and replace a lost or damaged device. |
| Operational risk | Outages, freezes, account lockouts and platform failures can block access. | Lost backups, phishing and incorrect transactions can permanently block access. |
| Legal protection | Do not assume FDIC or SIPC treatment; protection depends on institution, asset, contract and law. | There is no exchange insolvency claim for coins you control, but ordinary property and theft laws still apply. |
Questions readers commonly ask
Will I get my Bitcoin back if an exchange goes bankrupt?
Possibly, but neither a full recovery nor a total loss is automatic. The court or administrator will apply the governing contract and law to the available assets and customer claims.
Can I withdraw after a failure is announced?
Only if the exchange and the applicable proceeding permit it. A visible account balance does not mean a withdrawal will be processed.
Does buying a hardware wallet recover trapped Bitcoin?
No. It can help you control Bitcoin that you successfully withdraw in the future; it cannot unlock an exchange account or improve a claim already in a legal proceeding.
