GST cancellation does not automatically wipe out input tax credit (ITC) connected with your remaining goods. Under section 29(5) of the Central Goods and Services Tax (CGST) Act, you generally have to pay the prescribed amount for inputs in stock, inputs contained in semi-finished or finished goods, and capital goods or plant and machinery held immediately before cancellation. For the specified goods, the amount is the higher of the applicable ITC and the output tax payable, subject to the separate capital-goods proviso.
You disclose the cancellation-related liability through the final return, GSTR-10. The calculation is different for ordinary stock and for capital goods, and the filing deadline depends on the effective cancellation date and the cancellation order date. Cancellation also leaves earlier tax periods, returns, interest, penalties and other statutory obligations intact.

The rule that applies when GST registration is cancelled
Section 29(5) of the CGST Act creates a final ITC adjustment when a registration is cancelled. It applies to goods held on the day immediately preceding the cancellation date, not to an undefined year-end balance or the date on which you happen to prepare the return.

In practical terms, identify the relevant inventory and capital assets, calculate the prescribed ITC amount, calculate the applicable output tax amount, and pay whichever amount the law requires. The liability is treated as output tax liability and is reported in GSTR-10 under Rule 44 of the CGST Rules.
Which date controls the calculation?
Freeze the relevant quantities and values as at the day immediately before the effective cancellation date. For example, if cancellation is effective on 31 March, the statutory stock reference is 30 March. Keep evidence that supports that cut-off, such as inventory records, purchase invoices, bills of entry, debit notes, credit notes and the ledger from which ITC was claimed.
Where is the payment made?
The amount may be discharged by debit to the electronic credit ledger or the electronic cash ledger, as permitted by the applicable liability. Do not assume that an unused credit balance disappears without an adjustment; first determine the amount payable under section 29(5) and Rule 44.
What items are covered, and why their calculations differ
Section 29(5) covers three related categories, but Rule 44 does not calculate them in the same way.
| Category | What you identify | Prescribed basis | Key evidence |
|---|---|---|---|
| Inputs held in stock | Raw materials and other inputs still held on the day before cancellation | Proportionate ITC from the corresponding invoices, when available | Tax invoices, stock quantities and ITC records |
| Inputs contained in semi-finished or finished goods | Taxable inputs embedded in work-in-progress and finished inventory | Proportionate ITC from the corresponding invoices, when available | Bill of materials or consumption records, invoices and stock valuation |
| Capital goods, plant or machinery | Capital assets still held at cancellation | ITC attributable to the remaining useful life, using a five-year useful life and month-based pro-rating | Original tax invoice, date of use, asset register and tax-head split |
The distinction matters. Treating all stock as one pool can overstate or understate the amount, particularly when a business has older capital equipment or a mixture of raw materials and finished products.
How to calculate ITC on inputs and goods in stock
1. Establish the closing quantities
Prepare a stock statement as at the day immediately preceding cancellation. Separate raw materials, packing materials and other inputs from semi-finished and finished goods. For manufactured goods, identify the input tax contained in the units still on hand rather than using the entire ITC claimed during the period.

2. Match the stock to invoices
Rule 44 uses the corresponding invoices on which ITC was availed. Match each class of stock to those invoices and determine the proportion attributable to the quantity remaining. If an invoice covered 1,000 units and 120 units remain, the relevant credit for that invoice is apportioned to the 120 units, subject to the statutory comparison with output tax.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteFor semi-finished and finished goods, use reliable consumption or bill-of-material records to connect the embedded inputs with the invoices. Include adjustments reflected through debit notes or credit notes; the GSTR-10 fields require details of those adjustments.
3. Keep tax components separate
Calculate Central tax, State or Union Territory tax and Integrated tax separately. Your working should show the invoice value, tax charged, quantity originally purchased, quantity remaining, the proportion used for the cancellation calculation and the resulting amount for each tax component.
4. Compare the ITC amount with output tax payable
After calculating the applicable ITC, determine the output tax payable on the specified goods. Section 29(5) requires the higher amount for the relevant goods. A credit-based calculation is therefore not automatically the final liability if the output-tax comparison produces a larger figure.
How to calculate the amount for capital goods and machinery
Use the statutory five-year useful life
Rule 44 prescribes a useful life of five years for this calculation, expressed as 60 months. Determine the months of useful life remaining on the cancellation date and apply that fraction to the original ITC.
The prescribed method can be expressed as:
ITC attributable to remaining life = original ITC × remaining useful-life months ÷ 60

For illustration, where five months remain, the Rule 44 illustration uses original ITC multiplied by 5/60. That fraction is a method illustration, not a universal amount; every asset must be calculated using its own remaining months and original credit.
Apply the capital-goods proviso
For capital goods or plant and machinery, the proviso to section 29(5) separately compares the reduced ITC amount with the tax on the transaction value determined under section 15. Use the amount required by that comparison rather than applying the ordinary stock-input formula mechanically.
Document the asset calculation
- Record the asset description, invoice date, original taxable value and original ITC.
- Record the date the asset was received or put to use and the cancellation date used for the month count.
- Show the remaining months, the 60-month denominator and the result separately for Central, State or Union Territory and Integrated tax.
- Retain the fixed-asset register and evidence supporting any sale or other transaction value used in the section 15 comparison.
What if the purchase invoices are missing?
Rule 44 provides an estimation route when the relevant input invoices are unavailable. The amount is estimated using the prevailing market price on the effective date. This is not a licence to choose an arbitrary value: retain the basis for the market-price estimate, the stock quantities and the date on which the price was observed.

Under the amended rule, details furnished under this invoice-unavailable estimation provision must be certified by a practicing chartered accountant or cost accountant. Arrange that certification before filing rather than treating it as an optional review after submission.
How GSTR-10 records the cancellation liability
GSTR-10 is the final-return mechanism for a cancelled registration. Rule 44 directs that the cancellation-related amount be reported in this return. The form asks for cancellation details and particulars of stock and capital goods on which ITC is to be reversed and paid.
Information to assemble for the form
- The effective cancellation date and the cancellation order date.
- Descriptions and quantities of inputs, semi-finished goods and finished goods held on the relevant cut-off date.
- Invoice or bill-of-entry numbers and dates, taxable values, tax amounts, and adjustments through debit or credit notes.
- Details of capital goods or plant and machinery and the remaining-useful-life calculation.
- The amount payable under the ITC calculation, the output-tax comparison and the payment made through the electronic credit or cash ledger.
Reconcile the figures in GSTR-10 with the stock statement and accounting records. A return that contains only a single unsupported total is difficult to defend if the tax authority asks how the amount was derived.

When GSTR-10 is due
CBIC Circular 69/43/2018-GST states that a person required under section 45 to file GSTR-10 must submit it within three months of the later of the effective cancellation date or the date of the cancellation order. The rule is intended to ensure that the section 29(5) liability is discharged.

Check the taxpayer category and any current notification or extension before relying on that period for a particular case. The circular identifies exceptions that include an Input Service Distributor, a non-resident taxable person and persons paying tax under sections 10, 51 or 52. A deadline can also be affected by later amendments or a case-specific extension.
Do not confuse cancellation application timing with the final-return deadline
CBIC’s registration rules state that the specified cancellation application is made within 30 days of the event warranting cancellation and includes details of stock, capital goods, liability and payment made against it. That 30-day application period is separate from the three-month GSTR-10 window described in Circular 69/43/2018-GST.

- Confirm the legal status. Read the cancellation order, identify the effective date and check whether your taxpayer category is covered by section 45 and GSTR-10.
- Freeze the inventory. Prepare the stock statement for the day immediately before cancellation, separating raw inputs, semi-finished goods, finished goods and capital assets.
- Collect source records. Gather purchase invoices, bills of entry, debit notes, credit notes, inventory reports, bill-of-material records and the fixed-asset register.
- Calculate ordinary stock ITC. Apportion invoice-based credit to the quantities remaining, including inputs embedded in semi-finished and finished goods.
- Calculate capital-goods ITC. Apply the remaining-months fraction over 60 months and keep Central, State or Union Territory and Integrated tax separate.
- Estimate where necessary. If invoices cannot be located, use the prevailing-market-price method and obtain the required practicing chartered accountant or cost accountant certification.
- Perform the statutory comparison. Compare the calculated ITC with output tax payable on the relevant goods, including the separate section 15 transaction-value comparison for capital goods.
- Pay the liability. Debit the permitted electronic ledger and retain the challan or ledger reference.
- File GSTR-10. Enter the cancellation details, stock and capital-goods particulars, tax amounts and payment information by the applicable deadline.
- Archive the working papers. Keep the calculation, evidence and professional certification with the books and returns for the statutory retention period.
Prior-period tax obligations survive cancellation
Cancellation ends the registration from its effective date; it does not erase liabilities for earlier periods. Tax, interest, penalties, unpaid returns, assessments, audits and other statutory obligations relating to periods before cancellation can still be determined or recovered later. Continue responding to notices and preserve records even after the GSTIN is cancelled.
This also means that the GSTR-10 calculation is not a substitute for filing outstanding regular returns or correcting earlier errors. Reconcile the final stock calculation with prior returns so that the same invoice is not omitted from the cancellation adjustment or reversed twice.
Common mistakes and how to prevent them
Using the order date instead of the effective date
The stock reference is the day immediately preceding the effective cancellation date. The order date matters to the GSTR-10 deadline, but it does not replace the statutory stock cut-off.

Reversing all historical ITC
Section 29(5) targets the specified goods held at cancellation. Do not reverse every unit of ITC ever claimed without tracing the stock and capital assets covered by the rule.
Applying the stock formula to machinery
Capital goods require the remaining-useful-life calculation and the separate transaction-value comparison. A simple invoice-by-invoice stock apportionment is not the prescribed method for machinery.
Ignoring the higher-of comparison
Calculating ITC alone can leave a shortfall when output tax payable is higher. Perform and retain both sides of the comparison.
Failing to separate tax heads
Rule 44 requires Central, State or Union Territory and Integrated tax amounts to be determined separately. A combined figure without a tax-head reconciliation can produce filing and ledger errors.
Relying on unsupported estimates
When invoices are unavailable, retain market-price evidence and obtain the required professional certification. An unexplained estimate is more vulnerable than a documented method tied to the effective date.
Missing the final-return window
Track both the effective cancellation date and the cancellation order date, then apply the later-date rule described by CBIC Circular 69/43/2018-GST, while checking current notifications and exceptions.
When professional help is sensible
A GST practitioner, chartered accountant or cost accountant can be particularly useful where invoices are missing, manufacturing records do not identify embedded inputs, capital assets have mixed tax credits, or the cancellation followed a business transfer or sale. Professional involvement does not replace the taxpayer’s responsibility to preserve the underlying records, but the rules specifically require certification by a practicing chartered accountant or cost accountant for the described invoice-unavailable estimation method.
