What Happens to Annuity Payments When You Die? Options for a Spouse or Beneficiary

What happens to annuity payments after your death depends on the payment option in the contract or retirement plan. A single-life annuity usually stops when the annuitant dies. A joint-and-survivor annuity can continue payments to a surviving spouse or other joint annuitant, often at a changed amount. Some contracts guarantee payments for a stated period or provide a separate death benefit.

There is no automatic rule that a beneficiary receives a remaining account balance. The signed contract, beneficiary designation, payment election, timing of death and, for employer plans, federal survivor-protection rules determine whether payments continue, change, convert to a lump sum or end.

The payment form controls what happens at death

Annuities are contracts that can convert money into a stream of income. The stream may be based only on one person’s lifetime, on two people’s lifetimes, on a guaranteed period or on another death-benefit design. The word “annuity” alone does not identify the survivor benefit.

Payment form What generally happens after the annuitant dies Who may receive money
Single-life annuity Payments end at the annuitant’s death No further payments unless another contract provision or plan protection applies
Joint-and-survivor annuity Payments continue for the surviving annuitant’s life The surviving spouse or other joint annuitant named in the election
Period-certain or guaranteed-period option Payments continue for the balance of the stated guarantee period A surviving beneficiary or estate under the contract terms
Other death-benefit option The contract specifies a payout method and amount The beneficiary or beneficiaries on file

The Internal Revenue Service describes a single-life annuity as paying a fixed amount at regular intervals during the annuitant’s life and ending at death. It separately describes joint-and-survivor arrangements in which a survivor receives payments for that survivor’s life. These descriptions do not establish one universal result for every individually purchased policy.

Single-life annuity: why payments often stop

With a single-life election, the insurer calculates payments using the annuitant’s life expectancy. The contract promises income while that person is alive, not a refund of unused principal. When the annuitant dies, the scheduled income generally ends.

A spouse therefore does not automatically inherit the monthly payment from a single-life annuity. Continuing payments would require a different election, such as a joint-and-survivor form, a guaranteed-period provision, or a separate death benefit written into the contract. An estate or beneficiary should not assume that the difference between premiums paid and payments received is payable as a lump sum.

Before concluding that no benefit exists, the beneficiary should read the policy’s death-benefit and settlement sections. Some contracts attach a guarantee period or provide a residual value, while others provide no payment after the annuitant’s death. The exact wording, not the label on the policy, controls.

Joint-and-survivor annuity: what a spouse may receive

A joint-and-survivor annuity pays during the first annuitant’s life and then continues for the survivor’s life. The survivor payment may equal the original payment or be a different percentage selected when the annuity was purchased or when retirement benefits began. Selecting a larger survivor percentage generally affects the amount paid while both annuitants are alive, because the insurer is promising income over two lifetimes.

For a qualified joint and survivor annuity, or QJSA, the IRS states that the surviving spouse’s payment must be at least 50% and no more than 100% of the participant’s payment. The applicable retirement plan and the election determine the percentage. This 50%–100% range is a federal rule for covered qualified plans; it is not a percentage that should be applied to every individually purchased annuity.

A participant may be able to waive a QJSA with the spouse’s properly documented consent and choose another form, such as a single-life annuity or a qualified optional survivor annuity. Whether a waiver was valid depends on the plan’s procedures and applicable federal rules. A beneficiary should ask the plan administrator for the signed election and any spousal-consent record rather than relying on memory or an informal beneficiary designation.

Death before payments start: the preretirement survivor benefit

Death before the annuity starting date can produce a different result from death after payments have begun. In certain qualified employer plans, a vested participant who dies before retirement must have a qualified preretirement survivor annuity, or QPSA, available to an eligible surviving spouse. The QPSA is a life-annuity death benefit, subject to the plan’s eligibility rules and terms.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The IRS overview of spousal annuity requirements says that, in a covered plan, a married participant’s normal benefit form is generally a QJSA unless it was properly waived. If the married, vested participant dies before the annuity starting date, the spouse generally receives a QPSA. These protections do not automatically apply to every plan or to every private annuity contract. The plan document must be checked to determine coverage, vesting, marital status requirements and the benefit calculation.

Death before the starting date may also trigger a contract’s deferred-annuity death benefit. A deferred annuity has not yet begun its scheduled income stream, so the contract may pay a beneficiary a lump sum, an income option or another amount. The beneficiary should obtain the policy’s definition of the annuity starting date and the death-benefit formula before choosing a settlement option.

Death after payments start: the scheduled stream and any guarantees

Once payments have begun, the result usually follows the elected income form. A single-life payment generally ends at death. A joint-and-survivor payment continues to the surviving annuitant. A period-certain option continues only until the guaranteed number of payments has been made, even if the original annuitant dies sooner.

For a guaranteed-period option, the contract may direct the insurer to pay the remaining installments to a named beneficiary, the estate or another designated recipient. The recipient may be allowed to take installments or, depending on the contract, receive a present-value lump sum. The policy’s settlement provisions determine both the available forms and the calculation.

Some contracts combine lifetime income with a separate death benefit. That benefit might be a specified amount, an account value or another formula, but no one formula applies to all annuities. “Remaining balance” is not a reliable description unless the contract actually promises that value. The insurer’s written benefit calculation should identify the amount, form and assumptions used.

Employer retirement plan versus individually purchased annuity

The source of the annuity is a major decision point. An employer retirement plan may be governed by federal pension rules that protect a surviving spouse. Those rules can require a QJSA during retirement and a QPSA for a qualifying spouse when a vested participant dies before payments begin. Plan-specific exceptions, waivers and eligibility requirements still matter.

An individually purchased annuity is governed primarily by its insurance contract and applicable state insurance law. A spouse may have no automatic survivor right unless the spouse is a joint annuitant, beneficiary or protected under another applicable rule. A beneficiary designation can also differ from a joint-annuitant election; being named as beneficiary does not necessarily create a right to continue a lifetime payment.

For either type, the controlling documents are the signed contract or plan document, the beneficiary designation on file, the payment election and any later change or waiver. Marketing descriptions and account statements may not show every condition that applies at death.

What a spouse or beneficiary should do

  1. Contact the correct payer. For an individual annuity, notify the insurer. For an employer plan, contact the former employer or plan administrator. The IRS directs surviving spouses to contact the employer or administrator to claim available benefits.
  2. Report the death and ask what documents are required. The payer may request a certified death certificate, identification, claim forms, proof of relationship and estate or trust documents. Ask for a written list so that missing paperwork does not delay the claim.
  3. Request the governing documents. Obtain the complete annuity contract or the plan’s summary plan description, the beneficiary designation, the payment election and any spousal waiver or consent. Ask the administrator to identify whether death occurred before or after the annuity starting date under the plan’s definition.
  4. Ask for the benefit determination in writing. Request a statement that identifies whether the benefit is a continuing life annuity, a period-certain payment, a lump sum or no further payment. Ask how the amount was calculated, which survivor percentage applies and when payments would begin.
  5. Check settlement choices and deadlines. Some plans allow a beneficiary to choose among installment payments, an annuity and a lump sum. If a rollover is available, the administrator should explain the eligible destination, method and deadline. Do not miss an election deadline while waiting for informal advice.
  6. Review the tax consequences before electing a form. Ask the payer how each option will be reported and whether withholding applies. Then discuss the choice with a qualified tax professional who can review the contract and the beneficiary’s circumstances.

How taxes can differ for a beneficiary

Federal tax treatment depends on whether the payment comes from a qualified retirement plan, an individual annuity, a life-annuity stream, a deferred-annuity death benefit or another arrangement. IRS Publication 575 explains that beneficiaries generally report pension or annuity income under the applicable rules, but the taxable and tax-free portions can vary.

One example involves guaranteed payments under a life annuity. Amounts may be excluded from gross income until distributions, together with the deceased annuitant’s tax-free distributions, equal the contract cost. A different rule can apply when a deferred annuity pays a death benefit before its starting date: the amount above the decedent’s cost can include taxable income.

These examples are not a complete tax analysis. The payer’s tax forms, the contract’s investment-in-the-contract calculation, the plan type and the recipient’s election all matter. A beneficiary should preserve the decedent’s basis records and ask for the insurer’s or plan’s tax reporting explanation before deciding whether to take a lump sum or installments.

Common mistakes that delay or reduce a claim

  • Assuming every annuity has a balance to inherit. A single-life election can end with no further payment.
  • Confusing a beneficiary with a joint annuitant. A beneficiary may receive only the benefit expressly provided in the contract, while a joint annuitant has a lifetime survivor right under the payment election.
  • Applying QJSA rules to a private policy. The 50%–100% survivor range concerns covered qualified plans, not every annuity sold to an individual.
  • Ignoring the annuity starting date. Death before payments begin can invoke a QPSA or a deferred-contract death benefit; death afterward can be governed by the selected payout form.
  • Relying on an old beneficiary designation. Divorce, remarriage, a plan rollover or a later election may have changed who is entitled to receive benefits.
  • Choosing a payout without checking tax timing. A lump sum may create a different taxable year and cash-flow result from installments or a survivor annuity.
  • Accepting a verbal explanation. Ask the insurer or administrator to provide the benefit calculation, election history and applicable deadline in writing.

A practical decision checklist

Use these questions to organize a claim:

  • Was the annuity bought individually or provided through an employer retirement plan?
  • Was the deceased the sole annuitant, or was a spouse or another person named as a joint annuitant?
  • What payment form was elected: single life, joint and survivor, period certain or another death benefit?
  • Did death occur before or after the annuity starting date and first scheduled payment?
  • Was the participant married and vested, and does the plan require a QJSA or QPSA?
  • Is there a valid spousal waiver or alternate election?
  • Who is the beneficiary on the payer’s records, and does the designation match the will or trust?
  • What payment forms, rollover choices and election deadlines does the payer offer?
  • How will each available option be reported for federal income-tax purposes?

Examples of how the outcome can change

Single-life individual annuity

A retiree elects a single-life annuity and dies after receiving payments. Unless the contract includes a guarantee period or death benefit, the insurer stops the payments. The spouse does not receive the monthly amount merely because the spouse is married to the retiree.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Joint-and-survivor employer-plan annuity

A married participant retires under a plan subject to QJSA rules and elects a survivor percentage. After the participant dies, the spouse receives the elected percentage for the spouse’s life, provided the spouse remains eligible under the plan. The percentage is determined by the plan election, not by a general rule for all annuities.

Vested participant dies before retirement

A married, vested employee dies before the annuity starting date in a plan that is subject to QPSA requirements. The eligible spouse may receive the required preretirement survivor annuity. The administrator must confirm eligibility and calculate the benefit under the plan document.

Deferred annuity with a contract death benefit

An owner dies while a deferred annuity has not begun payments. The beneficiary may receive the contract’s specified death benefit or choose an available settlement form. The taxable portion can differ from the treatment of payments under an already-started life annuity.

Where to get a definitive answer

The insurer or plan administrator is the primary source for a specific claim. Ask for the signed contract or plan description, beneficiary designation, payment election, waiver records, starting-date determination and written benefit calculation. State insurance rules, plan design and individual facts can change the result, so a general description cannot substitute for those documents.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The IRS resources “Annuities – A brief description,” “Retirement topics — Qualified joint and survivor annuity,” “Retirement topics – Death,” “Retirement topics — Qualified preretirement survivor annuity” and Publication 575 explain the federal concepts, but they do not determine the payout under a particular private contract. For a disputed or high-value claim, consider advice from a qualified tax professional or attorney after obtaining the payer’s written position.
