If you return to India while holding an FCNR(B) deposit, you can ask your scheduled commercial bank to keep it running until its contractual maturity at the agreed FCNR(B) rate. The Reserve Bank of India (RBI) then treats the deposit as a resident deposit from your return date for most regulatory purposes. At maturity, you choose between a resident rupee deposit and, if eligible, a Resident Foreign Currency (RFC) account.
You may also request early withdrawal. Your bank’s disclosed penalty policy can affect an ordinary premature withdrawal, but RBI specifically bars a penalty when a returning non-resident Indian prematurely converts FCNR(B) balances into an RFC account. Banking status and income-tax residence are separate questions, so your tax result depends on the relevant tax year and your facts.

The rule in plain English
RBI rules do not require an FCNR(B) deposit to be closed merely because you return to India. Under the RBI Interest Rate on Deposits Directions, a scheduled commercial bank may, on your request, allow a qualifying returning person of Indian nationality or origin to continue the deposit until its maturity at the contracted rate.

That continuation is not automatic. The wording gives the bank discretion and requires a request from the depositor. From the date you return, the deposit is treated as a resident deposit for purposes other than the rules governing FCNR(B) interest and reserve requirements. At maturity, the proceeds are converted into either a resident rupee deposit or an RFC account if you are eligible, at your option. The new account’s applicable rate governs interest after conversion.

In practice, you should notify the bank promptly, document your return date and residential-status change, and give written maturity instructions. Banks may use their own forms and workflows; the RBI material does not prescribe one universal form.
What changes on your return date
The deposit can continue, but only after you ask
Ask the bank to record that you have returned to India and that you want the FCNR(B) deposit to run to maturity. Confirm in writing:
- the date the bank records as your return or status-change date;
- the original maturity date and contracted FCNR(B) rate;
- whether the bank is allowing continuation under the RBI provision; and
- your selected maturity destination, or the process and deadline for choosing it later.
Do not assume that a deposit will renew automatically as FCNR(B), or that its original currency and rate will continue after maturity. The continuation rule concerns the existing term; the post-maturity account is governed by its own terms.

RBI states that an FCNR(B) deposit is treated as a resident deposit from the account holder’s return date, except for provisions relating to FCNR(B) interest and reserve requirements. This is a banking and foreign-exchange classification. It does not, by itself, determine whether you are resident or non-resident for income-tax purposes.

What happens at maturity
At maturity, RBI gives you two stated destinations. You can select a resident rupee deposit, or an RFC account if you meet the eligibility requirements. The bank converts the FCNR(B) proceeds into the chosen account, and the interest rate applicable to that new account controls future earnings.
| Destination | Currency treatment | Who can use it | What determines future interest |
|---|---|---|---|
| Resident rupee deposit | FCNR(B) proceeds are converted into Indian rupees | A returning depositor choosing the resident option | The bank’s rate and terms for the selected resident rupee deposit |
| RFC account | Funds remain in a permitted foreign-currency account | Only a depositor who is eligible under the applicable rules | The bank’s RFC rate and terms after conversion |
Neither option is universally better. Compare the currency in which you expect to spend or hold the money, your RFC eligibility, the bank’s applicable rates, access conditions, and your plans for the funds. RBI establishes the two destination types, but it does not set one best choice for every returning depositor.
How to make the maturity choice
- Confirm eligibility. Ask the bank whether you qualify for an RFC account under the current rules and its documentation requirements.
- Compare the new-account terms. Obtain the applicable rate, tenure, withdrawal conditions, minimum balance and currency options for both the resident rupee deposit and RFC alternative.
- Decide whether currency conversion fits your plans. A rupee deposit removes foreign-currency denomination; an RFC account can preserve foreign-currency holdings where permitted.
- Submit written instructions. Keep the bank’s acknowledgement showing the account to be opened at maturity.
- Check the conversion statement. After maturity, verify the principal, interest, conversion date, exchange-rate treatment where relevant, and the new account number.
Can you withdraw before maturity?
Yes. RBI directs scheduled commercial banks to permit premature FCNR(B) withdrawal on request. The financial result depends on what you ask the bank to do and on the bank’s disclosed policy.

For an ordinary early withdrawal, the bank may apply a penalty under its board-approved comprehensive penalty policy. RBI requires the relevant penalty components to be disclosed when the deposit is accepted. The bank should provide a written calculation showing principal, interest actually payable, penalty and any other adjustment before you authorize the withdrawal.

Ask specifically whether the bank will recalculate interest for the shorter completed period. Do not assume that the original contracted rate applies through the withdrawal date.
Early conversion to an RFC account
RBI provides a narrow no-penalty exception: no penalty may be levied when an NRI returning to India prematurely converts FCNR(B) balances into an RFC account. The exception is tied to that returning-NRI conversion. It does not automatically cover an early conversion into a resident rupee deposit, a cash withdrawal, or every other form of premature closure.
When you contact the bank, describe the requested action precisely as a premature conversion of the FCNR(B) balance into an RFC account and ask the bank to confirm in writing that it is applying the RBI no-penalty rule. Keep the request, the bank’s response and the final transaction statement.
If the deposit has not completed the minimum period
RBI’s directions address interest when a deposit that has not completed the stipulated minimum period is converted into an RFC or resident rupee account. The interest payable is capped at the rate applicable to RFC savings deposits. The exact calculation depends on the deposit, transaction and direction in force, so obtain a transaction-specific quote rather than estimating your return from the original FCNR(B) rate.

A practical notification process
- Gather documents. Prepare your passport or other identity document, proof of Indian address, return or status-change information requested by the bank, the FCNR(B) certificate and your account details.
- Contact the branch or authorised channel. Tell the bank that you have returned to India and ask for its residential-status-change and FCNR(B) continuation procedure.
- Record the effective date. Make sure the bank confirms the date from which it treats the deposit as a resident deposit.
- Choose an action. Instruct the bank to continue the deposit to maturity, request an early withdrawal, or request a premature RFC conversion if that is your intended transaction.
- Request a written calculation. For any early action, obtain the interest rate used, penalty (if any), tax withholding shown by the bank, exchange-rate methodology and net proceeds.
- Set a maturity reminder. Reconfirm the resident-versus-RFC instruction before the maturity date and verify the new account after conversion.
What about your NRE and NRO accounts?
Returning to India usually requires separate action on other non-resident accounts. RBI’s Accounts in India by Non-residents FAQ, dated 16 January 2025, states that an NRE account should be redesignated as a resident account or its funds may be transferred to an RFC account, at the account holder’s option.
An NRO account may be redesignated as a resident account when you return for a purpose indicating an intention to stay in India for an uncertain period. These are account-maintenance rules separate from the FCNR(B) maturity decision. Ask the bank to review all of your non-resident accounts together so that the status recorded on each account is consistent with your instructions.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Banking residence is not tax residence
The FCNR(B) resident-deposit treatment does not decide your income-tax residence. Tax residence is determined for a particular tax year under the applicable statutory tests, including day-count rules and exceptions, together with your facts.
The Income Tax Department’s guidance for Non-Resident Individual for AY 2026–2027 describes the section 6 tests under the Income-tax Act, 1961. Its Non Resident FAQs explain that tax years beginning on or after 1 April 2026 use the Income-tax Act, 2025, while earlier years remain governed by the 1961 Act.

Therefore, do not infer from the bank’s account classification that FCNR(B) interest is automatically tax-free or automatically taxable for you. The answer can depend on the relevant year, your residence status under tax law, timing and individual circumstances. Use current official tax guidance and obtain professional advice for a return involving a large balance, multiple jurisdictions or a complex residence history.
Deciding between an RFC account and a resident rupee deposit
Use this framework before giving maturity instructions:
- Eligibility: Can you open and maintain an RFC account under the current rules and the bank’s documentation requirements?
- Currency need: Will you need foreign currency for future expenses, investments or transfers, or will your spending be primarily in rupees?
- Rate and tenure: What rate, term, renewal treatment and minimum balance apply after conversion?
- Access: Are withdrawals, remittances and transfers available in the way you need?
- Tax and reporting: How does the chosen account fit your tax position and reporting obligations for the relevant year?
Request side-by-side written terms from the bank. The FCNR(B) rate that applied before maturity does not set the rate on either replacement account.
Common mistakes to avoid
- Assuming continuation is automatic: RBI says the bank may continue the deposit on your request; obtain confirmation.
- Waiting until maturity without instructions: The bank needs to know whether to create a resident rupee deposit or an RFC account if you are eligible.
- Applying the no-penalty rule too broadly: It covers premature conversion into an RFC account by a returning NRI, not every early withdrawal or rupee conversion.
- Confusing account status with tax status: Banking classification and income-tax residence are determined under different frameworks.
- Using the old FCNR(B) rate for projections: After conversion, the replacement account’s rate and terms apply.
- Ignoring related accounts: NRE and NRO accounts have their own redesignation or transfer rules.
Questions to put to your bank
- What return date and residential status have you recorded?
- Will you allow this FCNR(B) deposit to continue to its contractual maturity at the existing rate?
- What documents and forms are required?
- Am I eligible for an RFC account, and what currencies and terms are available?
- What will the net proceeds be under an ordinary premature withdrawal?
- Would my requested transaction qualify for the RBI no-penalty premature RFC-conversion rule?
- How will you handle my NRE and NRO accounts?
The governing RBI language is direct: “Such deposits shall be treated as resident deposits from the date of return of the account holder to India.” It also states that FCNR(B) deposits at maturity are converted into a “Resident Rupee Deposit Account or RFC Account (if eligible) at the option of the account holder,” and that no penalty is levied for premature conversion into an RFC account by returning non-resident Indians. Those rules explain the available paths; your bank’s written processing details and your tax facts determine the practical outcome.
