What happens to an equity release loan when you die or move into care?

For a lifetime mortgage, the balance normally becomes repayable when the last borrower dies or moves permanently into long-term care. The property is usually sold, and the sale proceeds repay the original advance, rolled-up interest and allowable costs. Any value left belongs to the estate. A surviving joint borrower or partner who is entitled to remain in the home can change that outcome, so the first death or care move does not automatically mean an immediate sale.

Home reversion is different: it involves selling all or part of the property rather than taking a secured loan. Its contract determines what happens on death or a move into care.

First identify which type of equity release you have

The repayment rules depend on the product named in your documents. In the UK, equity release generally uses one of two structures:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Lifetime mortgage: a loan secured against your home. You receive a lump sum, regular advances or both. Interest may be paid monthly or added to the balance, depending on the plan.
  • Home reversion: you sell all or part of your home to a provider in exchange for a lump sum, regular payments or a combination. You normally retain a right to live there under the agreement, but you no longer own the portion sold.

Guidance about a lifetime-mortgage balance being repaid from a sale cannot be applied automatically to a home-reversion plan. Read the signed contract and obtain the provider’s written explanation of the event that ends your arrangement.

What usually happens when the last borrower dies?

With a lifetime mortgage, the death of the last borrower commonly starts the redemption process. The loan does not disappear, and heirs do not simply inherit the home free of the charge. The provider’s mortgage charge remains registered until the balance is settled.

How the estate settlement works

  1. Notify the provider. The executor or personal representative should contact the lender promptly and provide the death certificate or other evidence it requests. The contract may specify notice and evidence requirements.
  2. Confirm who is still entitled to occupy the property. A joint borrower, spouse or partner with a contractual right to live there may mean that the home is not sold immediately. The provider must assess the survivor’s position under the plan.
  3. Request a redemption statement. Ask for the current advance, rolled-up interest, administration or legal costs, any early-repayment charge and the amount required to clear the mortgage on a stated date. Interest continues to accrue until repayment under the plan terms.
  4. Arrange the sale or another permitted repayment route. Where no entitled survivor remains, the executors normally place the property on the open market and use the proceeds to repay the provider. The Equity Release Council describes this process in its “What happens if circumstances change” FAQ.
  5. Distribute what remains. After the secured debt and sale costs are paid, any remaining equity forms part of the estate and is dealt with under the will or intestacy rules.

There is no single repayment deadline or fee schedule that applies to every plan. The timescale, valuation process, acceptable sale price and charges come from the individual contract and provider.

What if one borrower dies but another remains?

A first death in a joint lifetime mortgage is not necessarily the end of the plan. If another named borrower survives, the agreement may continue until that person dies or permanently moves into long-term care. The survivor’s age, occupancy rights and the plan’s definition of “last borrower” matter.

A spouse or partner who is not a borrower may still have an occupancy right under the contract. The Equity Release Council’s explanation is expressly qualified: if someone is still entitled to live in the property, a care move or death may not require an immediate sale. Do not assume that marriage, civil partnership or cohabitation alone creates that protection; verify the named rights in the legal documents.

What happens if you move permanently into long-term care?

MoneyHelper treats a permanent move into a care home as an end-of-term trigger for many lifetime mortgages. A temporary hospital stay, respite placement or trial move may not meet the plan’s definition. Ask the provider what evidence establishes permanence and when the trigger is considered to have occurred.

When a sale is likely

If no spouse or partner remains entitled to occupy the property, the home is generally sold and the lifetime-mortgage balance and interest are repaid from the proceeds. The Equity Release Council states:

“If you need to move into long-term care, and don’t have a spouse or partner who is still entitled to live in the property, it will be sold and the amount you borrowed, plus interest, will be paid back to your equity release provider.”

This is the Council’s organisational guidance, not a universal term for every provider. Your contract may specify a different permitted arrangement, a notice period or a route for repaying without an immediate sale.

When a partner remains in the home

If a spouse or partner has a contractual right to remain, the provider may allow the mortgage to continue while that person occupies the property. The exact result depends on whether the person is a borrower, a protected occupier or neither, and on the plan’s survivor provisions. Obtain a written decision before making care-funding or housing arrangements.

Lifetime mortgage and home reversion: the key differences

Issue Lifetime mortgage Home reversion
What you take A loan secured on the home Sale of all or part of the property to the provider
What is normally settled after the last borrower dies or a permanent care move occurs The advance, accumulated interest and contractually payable costs The provider’s ownership interest remains governed by the reversion agreement; read its sale, occupancy and termination terms
Who handles a sale when no entitled occupant remains Usually the beneficiaries or executors arrange an open-market sale, subject to the provider’s charge and terms The agreement determines how the provider’s share and any retained share are dealt with
Interest May be paid as it arises or rolled into the balance, depending on the plan There is no lifetime-mortgage interest balance on the portion sold, but the ownership split affects the value ultimately received
Inheritance Any sale value left after repaying the loan and costs may pass to the estate Only the interest in the property that you still own can pass through your estate, subject to the contract

These are structural distinctions, not a substitute for the signed terms. A solicitor or specialist adviser can explain the legal effect of your particular agreement.

Could the estate owe more than the home is worth?

Check for a no-negative-equity guarantee. MoneyHelper says most lifetime mortgages backed by the Equity Release Council have one, and customers must be told if a plan does not. Where the guarantee applies, the customer or estate should not have to repay more than the property’s sale value under the guarantee’s conditions. That can protect other estate assets from a shortfall.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A guarantee is not a promise that beneficiaries will receive a particular amount. Sale costs, the amount borrowed, interest and any contractually permitted charges still reduce the net proceeds. If the plan has no such guarantee, or if its conditions are not met, the estate may have to use other assets to cover a shortfall. Ask the provider to state the guarantee, its exclusions and the calculation in the redemption statement.

What executors and families should do

  1. Locate the complete plan pack. Find the original offer, mortgage deed, illustration, policy schedule and any later variations. Confirm whether it is a lifetime mortgage or home reversion.
  2. Contact the provider promptly. Tell it about the death or proposed permanent care move and ask which forms, certificates and occupancy evidence are required.
  3. Identify every relevant person. Establish the named borrowers, any spouse or partner with a right to occupy, and the person authorised to act for the estate.
  4. Ask for a written redemption figure. Request the balance as at a specific date, the daily interest rate or accrual method, sale costs, legal or administration fees, early-repayment charges and the date the figure expires.
  5. Clarify the sale process. Ask who appoints the estate agent, whether the property must be marketed openly, how the asking price is agreed, and what happens if a sale takes longer than expected.
  6. Check alternatives to an immediate sale. Depending on the plan, a survivor may remain, the loan may be repaid from other funds, or a permitted move may be possible. Do not assume any option is available until the provider confirms it.
  7. Coordinate legal and care advice. The executor, conveyancer and care-funding adviser should use the same redemption figure and understand who has authority to sign.

Moving home, sheltered accommodation or care: terms to check before signing

Financial Conduct Authority disclosure rules require equity-release illustrations to address moving home, sheltered accommodation or long-term/residential care. The illustration should explain portability circumstances and whether early-repayment charges apply. Read those sections before taking the plan, not only after a move becomes necessary.

  • Portability: whether the loan can transfer to another property, the required value and acceptable property type, and what happens if the new home is worth less.
  • Care trigger: whether “permanent” care is defined by a period, medical evidence, local-authority decision or another test.
  • Occupancy: the rights of a surviving borrower, spouse, partner or other permitted resident.
  • Charges: early-repayment charges, valuation, legal, administration and sale-related costs, including when each can be imposed.
  • Interest method: whether interest is paid monthly, added to the balance, or handled through a drawdown structure.
  • Notice and timing: who must be told, what documents are needed and how the provider expects a sale or repayment to proceed.

The FCA’s disclosure rules are set out in MCOB 9, Equity release: product disclosure.

How equity release can affect inheritance and care support

Because interest can compound over many years, the balance may grow and leave less home equity for beneficiaries than the original advance suggests. A sale after death therefore produces a net amount only after the provider and sale costs are paid.

Taking or repaying equity release can also affect means-tested benefits, local-authority care support, tax and inheritance planning. The consequences depend on your income, assets, gifts, care needs and local rules. MoneyHelper warns that equity release may be unsuitable when residential care is likely soon and recommends independent financial advice. An adviser should assess alternatives, explain the effect on benefits and support, and be checked on the Financial Conduct Authority register.

Questions to ask before you take action

  • Is this a lifetime mortgage or home-reversion plan?
  • Exactly what event makes the balance or agreement payable?
  • Does “last borrower” mean the first death is irrelevant while another borrower remains?
  • Does my spouse or partner have a documented right to stay in the property?
  • What evidence proves that a move into care is permanent?
  • Can the plan move to another home, and what valuation or property rules apply?
  • How is interest calculated, and what is the balance today?
  • What early-repayment, legal, valuation or administration charges could apply?
  • Is there a no-negative-equity guarantee, and what conditions or exclusions apply?
  • How could the arrangement affect benefits, local-authority funding, tax and the inheritance available to my estate?

MoneyHelper’s guidance on using equity release to fund care is available at MoneyHelper’s equity-release and care guide. Its lifetime-mortgage overview, including repayment after the last borrower dies and the guarantee caveat, is at MoneyHelper’s lifetime mortgage guide.
