What Happens to a Reverse Mortgage When One Spouse Moves Into Care?

By TheFinanceBase Team 9 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If one spouse with a reverse mortgage moves to a nursing home, assisted-living facility, hospital or rehabilitation center, the result depends first on the loan type and then on who remains in the home. For an FHA-insured Home Equity Conversion Mortgage (HECM), a medical stay can generally last up to 12 consecutive months without ending the borrower’s principal-residence status. After more than 12 consecutive months, the HECM may become due if no co-borrower remains in the home. A spouse who is a co-borrower has stronger protection than a spouse who is not on the loan. An eligible non-borrowing spouse may receive a deferral, but qualification depends on the FHA case-number date and facts documented in the loan file.

These rules apply to HECMs, not automatically to proprietary reverse mortgages. For any loan, contact the servicer promptly and review the note, security instrument and servicing instructions before assuming the balance is due.

Start with the loan type

The 12-month medical-absence rule comes from HUD requirements for FHA-insured HECMs, the most common reverse-mortgage product. It should not be treated as a universal rule for every reverse mortgage.

FHA-insured HECM

A HECM treats the property as the borrower’s principal residence during a temporary healthcare confinement that does not exceed 12 consecutive months. The borrower must still satisfy the loan’s other obligations, including property charges, insurance and maintenance requirements.

Proprietary or other non-HECM loan

A proprietary reverse mortgage may use different definitions, notices and deadlines. The controlling documents are the promissory note, mortgage or deed of trust, loan agreement and the servicer’s written instructions. Ask the servicer to identify the product before applying HECM thresholds to the situation.

What happens in each spouse situation

Situation General HECM result What determines the final outcome
Spouse in care is one of two co-borrowers; the other spouse remains home The spouse remaining in the home can generally stay and continue receiving HECM disbursements. The remaining co-borrower must continue meeting occupancy, property-charge, insurance, maintenance and other loan requirements.
Borrower is in a healthcare facility for up to 12 consecutive months The medical absence can generally be treated as temporary for principal-residence purposes. The absence must be tracked as consecutive months, and other defaults can still make the loan due.
Borrower is in care for more than 12 consecutive months and no co-borrower remains The HECM may become due because principal-residence status ends. The servicer must review the file, dates and any eligible non-borrowing-spouse protection.
Spouse remaining home is a non-borrowing spouse A deferral may be available instead of immediate payoff. Eligibility is conditional on case-number date, documentation, occupancy and continuing compliance.
No applicable deferral or other protection The loan generally must be repaid. The servicer will explain deadlines, payoff figures and available repayment options.

If the spouse in care is a co-borrower

When both spouses are borrowers and one enters care, the spouse who remains in the home normally has the clearest continuity protection. The remaining co-borrower can stay in the property and continue receiving scheduled or unscheduled HECM proceeds as long as the loan remains in good standing.

That protection does not waive ordinary HECM duties. The co-borrower who remains must keep the home as a principal residence, pay property taxes and other required charges, maintain homeowners insurance, and keep the property in good repair. A separate failure, such as unpaid taxes or a lapsed policy, can create a due-and-payable event even while the other borrower is in care.

If the spouse remaining home is not a borrower

A non-borrowing spouse does not automatically acquire the same rights as a co-borrower. HUD rules may allow an eligible non-borrowing spouse (NBS) to remain in the home without paying off the HECM after the borrower has been away for more than 12 consecutive months, but the protection is fact-specific.

FHA case numbers assigned on or after August 4, 2014

Consumer guidance from the Consumer Financial Protection Bureau identifies several conditions for the post-2014 NBS process. The spouse generally must have been married to the borrower when the loan documents were signed, be identified in those documents as a non-borrowing spouse, have lived in the home at closing, and continue using it as a principal residence. The spouse must also satisfy the HECM’s ongoing requirements, including payment of property charges and maintenance of the home.

Being married today, or having lived in the property for many years, does not by itself prove eligibility. The servicer must compare the spouse’s circumstances with the original loan file and HUD requirements.

Earlier FHA case numbers

Loans with FHA case numbers assigned before August 4, 2014 follow a different potential path. If the applicable conditions are met, the lender may use HUD’s Mortgage Optional Election (MOE) Assignment process. The MOE process is not automatic; the servicer must determine whether the loan and spouse satisfy the rules that applied to that case number.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When the spouse does not qualify

If no eligible NBS deferral or other protection applies, the HECM can become due after the borrower’s principal residence ends. The home does not necessarily have to be surrendered immediately, but the balance must be resolved under the servicer’s instructions. The usual route is selling the property and using the proceeds to repay the loan. Someone who wants to keep the home may need to pay the balance from another source, such as savings or replacement financing.

How absence length and reason affect the loan

Do not treat “moving into care” as a single legal event. The reason for the absence and the number of consecutive months matter.

Medical absence of up to 12 consecutive months

For a HECM, a borrower’s stay in a hospital, assisted-living facility, nursing home or rehabilitation center can generally remain temporary for up to 12 consecutive months. The home must continue to meet the principal-residence and property-condition requirements, and the borrower or household must keep required charges current.

Medical absence longer than 12 consecutive months

Once the borrower has been in a healthcare institution for more than 12 consecutive months, principal-residence status can end when no co-borrower remains in the home. At that point, the servicer will examine whether a non-borrowing spouse qualifies for a deferral or whether the loan must proceed toward repayment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Non-medical absence

Non-medical absences use a different threshold. CFPB guidance says that when no co-borrower lives in the home, an absence longer than two months but shorter than six months should be reported to the lender or servicer. Being away for more than six months for a non-medical reason can end principal-residence status. Therefore, the 12-month medical rule is not a blanket safe harbor for travel, living with relatives or another non-medical move.

Track consecutive months

Count the healthcare stay as consecutive months rather than resetting the clock casually for short visits elsewhere. Keep admission, discharge, transfer and return-home records. Ask the servicer how it counts partial months and what evidence it requires before the 12-month point.

Obligations that continue while a spouse is in care

A reverse mortgage does not transfer responsibility for the property to the facility. The household must continue to:

  • Use the home as the required principal residence when the loan rules call for it.
  • Pay property taxes and other property charges on time.
  • Keep homeowners insurance in force and provide proof when requested.
  • Maintain the home in good repair and address hazards or needed work.
  • Respond to servicer occupancy certifications, notices and requests for documentation.

CFPB lists unpaid taxes, insurance failures and inadequate maintenance as possible reasons a reverse mortgage can become due. These issues can arise before the medical-absence threshold, so do not wait for the 12-month date if a bill, insurance renewal or repair problem is already outstanding.

What to do as soon as the move is planned

  1. Identify the product. Ask whether the loan is an FHA-insured HECM or a proprietary reverse mortgage. Request the answer in writing if the documents are unclear.
  2. Confirm every person’s role. Determine who is listed as borrower or co-borrower and whether the spouse is identified in the closing documents as a non-borrowing spouse.
  3. Find the FHA case-number date. For a HECM, ask the servicer when the FHA case number was assigned. The August 4, 2014 dividing date affects which NBS rules may apply.
  4. Report the absence. Tell the lender or servicer the facility name, admission date, expected duration and whether the move is medical. Ask what occupancy form or medical documentation is required.
  5. Get the threshold in writing. Ask the servicer to state the date that marks 12 consecutive months and, if relevant, the date that marks six months for a non-medical absence.
  6. Check the loan’s current standing. Verify property taxes, insurance, maintenance, homeowner-association charges if applicable, and any unresolved notices.
  7. Ask about spouse protection before the deadline. If the remaining spouse is not a borrower, request a written determination of possible eligible non-borrowing-spouse deferral or MOE Assignment eligibility.
  8. Keep a file. Save the note, mortgage, closing disclosures, marriage records, occupancy evidence, facility records, tax receipts, insurance declarations and every servicer communication.
  9. Use independent counseling when needed. A HUD-approved housing counselor can help the family understand HECM terminology and prepare questions for the servicer.

What the servicer will usually need to review

The servicer cannot decide the outcome from the facility name alone. Expect questions about:

  • The loan type and FHA case-number assignment date.
  • Whether the spouse in care is a borrower, co-borrower or non-borrowing spouse.
  • Whether the non-borrowing spouse was married to the borrower, lived in the home at closing and was named in the original documents.
  • Whether the home remains the continuing principal residence of the person entitled to occupy it.
  • The exact admission date and any periods back in the home.
  • Payment status for taxes, insurance and other property charges.
  • Property condition and completed repairs.

Provide complete information rather than waiting for a demand letter. A missed occupancy certification or unanswered notice can make an otherwise manageable problem harder to resolve.

If the loan becomes due

A due-and-payable determination does not mean the family should guess at a deadline or sign a sale contract immediately. Ask the servicer for the written notice, payoff calculation, response date and available extensions or repayment procedures.

Selling the home

Selling is the common way to repay a reverse mortgage. The payoff generally comes from the sale proceeds, subject to the terms of the loan and applicable protections. The servicer can explain how it handles a listing, appraisal, closing statement and any shortfall or surplus question.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keeping the home

An occupant who wants to remain generally must pay the balance from another source. Ask about the exact amount needed, whether interest and advances continue to accrue, and what financing or estate funds the servicer will accept.

Getting professional help

An elder-law or real-estate attorney may be appropriate when ownership, estate administration, Medicaid planning or a dispute over eligibility is involved. A HUD-approved counselor can help explain HECM processes, but neither a counselor nor this article can determine the legal status of a particular loan.

Common mistakes to avoid

  • Assuming every reverse mortgage has a 12-month rule. That threshold is a HECM rule; proprietary contracts may differ.
  • Counting a co-borrower and a non-borrowing spouse as the same. A co-borrower has contractual borrower rights; an NBS must meet separate HUD conditions.
  • Waiting until month 12 to notify the servicer. Reporting and documentation requirements can apply earlier.
  • Ignoring non-medical absences. More than six months away for a non-medical reason can affect principal-residence status.
  • Focusing only on occupancy. Taxes, insurance and maintenance defaults can trigger problems independently.
  • Assuming marriage alone guarantees a deferral. The case-number date, closing documents, occupancy history and current compliance all matter.

Questions to ask the servicer

  • Is this loan an FHA-insured HECM or a proprietary reverse mortgage?
  • Who is listed as a borrower or co-borrower?
  • Was the spouse recorded as a non-borrowing spouse at closing?
  • What is the FHA case-number assignment date?
  • What notices and evidence are required for this healthcare absence?
  • What date does the servicer use for 12 consecutive months, and how should partial months be counted?
  • Are any property taxes, insurance premiums, repairs or other charges past due?
  • If the borrower remains in care beyond 12 consecutive months, does the spouse qualify for an eligible NBS deferral or an MOE Assignment?
  • If repayment is required, what are the written deadline, payoff amount and available sale or payoff procedures?

The practical answer is therefore conditional: a co-borrower who remains in the home can generally continue the HECM, while a non-borrowing spouse may have a conditional deferral. If the borrower’s medical absence exceeds 12 consecutive months and no qualifying protection applies, the loan may become due. The servicer’s review of the actual documents and dates is decisive.
