Selling usually means the HELOC must be paid off at closing; retiring does not, by itself, make the balance immediately due. In the United States, the sale rule comes from the lien securing the home and the loan agreement. Retirement changes your income and may coincide with a higher HELOC payment, but the contract—not retirement status alone—sets when and how you repay.
The Consumer Financial Protection Bureau (CFPB) states in its consumer booklet, What you should know about Home Equity Lines of Credit (HELOC): “If you sell your home, you are generally required to pay off your HELOC in full immediately.” Your lender, the other lienholders, and the closing professional must calculate the actual amount and handle any shortfall under the documents and applicable law.

What happens when you sell a home with a HELOC?
A HELOC is secured by your home. When ownership transfers, the lender generally expects its lien to be released, which normally requires paying the outstanding balance and other amounts due. The payoff is usually arranged through the settlement or closing process rather than by handing the lender a check after the sale.
“Generally” matters. Your HELOC agreement, the lender’s payoff procedures, lien priority, sale price, transaction costs, and state law determine the details. A sale does not automatically guarantee that every dollar owed disappears if the proceeds are insufficient.

Get an official, date-specific payoff amount
Ask the HELOC servicer for a written payoff statement using the lender’s required request method. It should state the total needed to satisfy the account on a specified date, including accrued interest, fees, and any other amounts the contract requires. Because interest may accrue daily and the closing date can move, ask how to obtain an updated statement if settlement is delayed.
For covered transactions, Regulation Z (12 CFR § 1026.36(c)(3)) generally requires the creditor, assignee, or servicer to provide an accurate payoff statement within a reasonable time and no more than seven business days after receiving a written request, subject to the rule’s exceptions and request procedures. That timing is not a promise that a last-minute request will fit your closing schedule, so request the statement early.
Coordinate every lien through closing
Give the closing agent or settlement professional information for the HELOC and the first mortgage. They must identify senior liens, the HELOC as a possible junior lien, property taxes, judgments, and other charges that must be paid or released. The sale proceeds are applied according to lien priority and the settlement statement.

If the sale price covers the first mortgage, the HELOC, and transaction costs, the closing can normally pay both loans and release the liens. If it does not, the junior-lien lender may receive less than the full balance. Do not assume that handing over the property or completing a sale cancels a deficiency; whether you remain liable depends on the loan documents, agreements reached with the lenders, and applicable law. Ask the lender and a qualified closing or legal professional what applies to your transaction.
Do not change the balance without checking
A HELOC normally permits draws during its borrowing period. Avoid making a new draw while a sale is being arranged unless the lender and settlement agent confirm how it will affect the payoff and closing instructions. A last-minute advance can make an earlier payoff statement inaccurate or create a funding problem. Follow the servicer’s current directions instead of relying on an old balance shown online.
Does retiring make a HELOC due?
Retirement alone is not identified in the reviewed CFPB guidance as an automatic payoff trigger. If you keep the home, the HELOC remains governed by its agreement. You still owe the required payments, interest, and any charges, regardless of whether your income now comes from wages, a pension, Social Security, investments, or another source.

This is a contract-specific conclusion, not a guarantee that every HELOC has identical terms. Read your note and disclosures, then ask the lender how the planned change in employment status affects payment requirements, verification requests, and available options.
Find out which stage your HELOC is in
Most HELOCs have a draw period followed by a repayment period, but the length and payment formula differ. During the draw period, you may be allowed to borrow and make payments based on the balance and the plan’s terms. When the draw period ends, additional borrowing may stop and the required payment can rise substantially as principal is amortized.
The CFPB warns that repayment-period payments are often significantly higher and that, in some plans, the entire balance becomes due when repayment begins. A variable interest rate can also change the monthly payment, commonly as the underlying index or margin changes. Some plans permit converting part or all of the balance to a fixed rate, usually at a higher but more predictable rate. Conversion availability, limits, and fees are controlled by your agreement.

Compare the two decisions: sell the home or keep it in retirement
| Question | If you sell | If you keep the home |
|---|---|---|
| What happens to the lien? | The HELOC is generally paid in full through closing so the lien can be released. | The lien remains, and the account continues under its contract. |
| What number must you establish? | A dated payoff amount, refreshed if the closing date changes. | The current balance, rate, payment schedule, draw-end date, and repayment terms. |
| What can create a cash problem? | Insufficient equity after the first mortgage, HELOC, and selling costs. | A higher repayment-period payment, a variable-rate increase, or a lump-sum due date. |
| Who should be involved? | The HELOC servicer, first-mortgage servicer, closing professional, and—if there is a shortfall—a qualified legal or financial professional. | The HELOC lender and a counselor or adviser who can test the payment against reliable retirement income. |
Step-by-step checklist for selling with a HELOC
- Read the HELOC documents. Locate the balance calculation, draw-period end date, repayment formula, payoff instructions, early-cancellation provisions, and possible fees. CFPB materials list cancellation fees among possible HELOC fees; do not assume your plan charges one or that it does not.
- Tell the lender and closing professional early. Provide the account number and ask where payoff requests must be sent. Also disclose the first mortgage and any other liens.
- Request the payoff statement in writing. Specify the anticipated closing date and retain proof of the request. Confirm the per-day interest or other adjustment used when the date changes.
- Check the settlement math. Compare the expected sale proceeds with the senior mortgage, HELOC payoff, taxes, commissions, and other closing charges. Ask immediately if the estimated proceeds do not cover the liens.
- Confirm funding and lien release instructions. The settlement agent should verify the lender’s wire or payoff address and the documents needed to release the lien. Treat unexpected payment instructions as a fraud risk and verify them through a known lender telephone number.
- Refresh the payoff if closing moves. Do not use an expired statement. Obtain the lender’s updated figure and send it to the settlement professional.
- Keep final records. Save the closing disclosure or settlement statement, payoff confirmation, and evidence that the HELOC was closed or the lien released. Check the account afterward and dispute any unexplained balance promptly.
Retirement planning: numbers to request before you stop working
Ask the HELOC lender for these facts in writing or through a secure account message:
- Current principal balance and any pending interest or fees.
- Current annual percentage rate, index, margin, rate cap, and how often the rate can reset.
- The exact date the draw period ends and whether borrowing stops then.
- The required payment during the remaining draw period and during repayment.
- Whether repayment is principal-and-interest, interest-only for a period, or a lump sum at a stated date.
- Whether a fixed-rate conversion is available, which portion can be converted, and the conversion rate and fees.
- Fees for early cancellation, account closure, conversion, or other changes.
Put the projected payment beside dependable retirement income, taxes, insurance, healthcare costs, and essential living expenses. Test the budget against a higher variable rate and the first repayment-period payment, not only today’s minimum. If the balance is scheduled to become due at once, identify the source of the lump sum before retirement rather than assuming a future refinance or sale will be available.

Contact the lender as soon as you see a problem. Explain the expected income change, ask what assistance or contractual options exist, and request the requirements and deadlines in writing. A lender may have its own review process, but no modification, refinance, rate conversion, or payment pause is guaranteed by the general CFPB guidance.

The CFPB directs consumers having mortgage-payment trouble to speak with the lender and points to HUD-approved housing counseling. A housing counselor can help organize income and debt information and discuss questions to raise with the servicer. Verify that a counselor is HUD-approved and understand any fees before signing an agreement.
Common mistakes and how to avoid them
- Assuming retirement accelerates the debt. Retirement is not the same event as a home sale. Check the contract’s draw, repayment, and maturity provisions.
- Using the online balance as the closing payoff. A displayed balance may omit per-day interest or fees. Use the lender’s dated payoff statement.
- Ignoring lien priority. The first mortgage and other senior claims are paid before a junior HELOC. Calculate net equity after all costs.
- Waiting until the week of closing. Payoff requests have procedures and regulatory timing rules. Start early and refresh the figure if the date changes.
- Counting on a fixed payment that is not fixed. Confirm whether the rate is variable and how repayment-period payments are calculated.
- Assuming a shortfall is forgiven. Get a written agreement if a lender accepts less than the contractual balance; otherwise obtain qualified legal advice about continuing liability.
Questions to take to the lender or closing professional
- What is the exact payoff amount for the planned closing date, and how is it updated?
- What fees or daily interest will change that amount?
- Will the HELOC be closed and its lien released at settlement?
- Are there other liens or recorded claims the closing must address?
- If the proceeds are short, what options and documents are required before closing?
- When does my draw period end, and what will the first repayment-period payment be?
- Is any part of the balance due in a lump sum?
- How will the rate and payment change if the underlying index moves?
- Can I convert a portion to a fixed rate, and what are the limits and fees?
- What assistance process should I use if retirement income will not cover the required payment?
What the evidence does—and does not—establish
The cited CFPB material is U.S. consumer guidance and federal regulation. It establishes a general immediate-payoff expectation on sale, the importance of lien priority and sale proceeds, and the possibility of higher or variable payments. It does not establish a population statistic for how many retirees have HELOCs, a typical shortfall amount, or a universal rule for every contract. Your signed agreement and the facts of your property control the outcome.
