What Happens to a HELOC or Home Equity Loan When You Sell Your Home?

When you sell a home, the HELOC or home equity loan secured by it is generally paid from the sale proceeds at closing so the lien can be released. Request a written payoff amount for the planned disbursement date, give it to the settlement agent, and check the public record afterward; if the proceeds may be short, contact the lender before closing.

What happens at a sale closing

A home sale normally requires the liens against the property to be addressed before the buyer receives clear title. Your settlement agent (also called a closing or escrow agent, depending on the location) obtains or uses payoff information for the first mortgage, HELOC or home equity loan, taxes, fees, and other closing obligations. Those amounts are deducted from the seller’s proceeds and sent to the creditors as part of the closing disbursement.

The Consumer Financial Protection Bureau (CFPB) states in its HELOC brochure: “If you sell your home, you are generally required to pay off your HELOC in full immediately.” A home equity loan is handled through the same practical payoff process, although the loan contract and security instrument control its exact terms.

Paying the debt at closing does not mean the balance shown on your latest statement is automatically the amount sent. Interest can accrue between the statement date and closing, and unpaid fees may be included. The servicer’s date-specific written payoff is the figure the settlement agent should use.

HELOC and home equity loan: what differs

Feature HELOC Home equity loan
How money is advanced A revolving line that permits repeated borrowing up to a credit limit. Usually a lump-sum advance made at the start of the loan.
What is paid at sale Generally the full amount required by the servicer when the property is sold, including applicable interest and fees through the payoff date. The contractual payoff amount calculated for the requested date; it may differ from the displayed principal balance.
Position when a first mortgage exists Commonly a junior (second) lien. Commonly a junior (second) lien.
Effect on your proceeds The payoff is deducted with the first mortgage and other closing obligations before the remaining funds go to you.

The CFPB explains the distinction between these products in its consumer guide. For a closed-end home equity loan, read the promissory note and security instrument and obtain the servicer’s payoff rather than assuming the principal shown online is sufficient.

Step-by-step: prepare the payoff

1. Locate the account and security documents

Find the latest statement, account number, servicer’s contact details, promissory note, and mortgage or deed-of-trust information. Tell the servicer that the property is being sold and ask how it accepts a payoff request. Ask whether the title or settlement agent needs a borrower-signed authorization before the servicer can release information.

Federal rules allow reasonable identity and authorization checks. A settlement professional may therefore ask you to sign a form or provide identifying information before requesting figures on your behalf.

2. Order a written payoff for the intended disbursement date

Request an amount valid through the date you expect the sale proceeds to be disbursed, not merely through the day you make the request. The CFPB’s explanation of payoff amounts notes that accrued interest and unpaid fees can make the payoff different from the current balance: What is a payoff amount and is it the same as my current balance?

Under Regulation Z, for a covered dwelling-secured consumer credit transaction, a creditor generally must send a requested payoff statement within a reasonable time and no more than seven business days after receiving a written request. The regulation states: “The statement shall be sent within a reasonable time, but in no case more than seven business days, after receiving a written request from the consumer or any person acting on behalf of the consumer.” This rule has coverage limits and exceptions, and the creditor may first complete identity or authorization checks. See 12 CFR § 1026.36(c)(3).

Check the statement for its valid-through date, per-diem interest (the daily amount added after that date), wire or processing instructions, and any conditions the servicer lists. Do not alter wiring instructions based solely on an email; confirm them through a trusted phone number because payoff fraud can redirect closing funds.

3. Update the figure if closing moves

If the buyer’s closing or the settlement agent’s disbursement date changes, ask whether the original statement remains valid. The servicer may issue a revised statement or tell the agent to add or subtract a per-diem amount. Give every revised figure to the settlement agent promptly so the disbursement is not based on an expired total.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Send the details to the settlement agent

Provide the servicer’s name, payoff department contact, account number, property address, authorization, and the written payoff. The agent coordinates payoff demands, lien documents, signing, recording, and disbursement. In covered mortgage transactions, the seller’s disclosure includes separate line items for first- and second-mortgage payoffs under the mortgage-closing disclosure rules. The CFPB describes the closing process at What can I expect in the mortgage closing process? and the seller payoff entries in 12 CFR § 1026.38.

How to tell whether the sale will cover the debt

Before signing final figures, compare the expected sale price with all amounts that must be paid from the transaction:

  • the first-mortgage payoff, if one exists;
  • the HELOC or home equity loan payoff;
  • property taxes, commissions, settlement charges, and other stated closing obligations; and
  • other liens or judgments the settlement process identifies.

A simple planning calculation is:

Estimated seller proceeds = sale price − first-lien payoff − junior-lien payoff − taxes, fees, and other closing obligations.

The calculation is only an estimate until the servicers provide date-specific figures and the settlement agent prepares the final disclosure. Interest can continue to accrue while the transaction is pending, so leave room for an updated payoff if the closing date is uncertain.

What if the proceeds are not enough?

When a first mortgage and a HELOC or home equity loan both encumber the property, the home equity debt is usually the junior lien. Liens are generally paid according to priority from the available sale proceeds. The CFPB explains the concept in What is a second mortgage loan or “junior-lien”?: a second-lien lender may not receive all it is owed when the property’s equity is insufficient.

That priority rule does not by itself answer whether you remain personally liable for an unpaid balance. The result can depend on the note, security instrument, state law, whether foreclosure or insolvency proceedings are involved, and any written agreement with the lender. Do not assume that a lien’s release automatically cancels a deficiency, or that a lender will accept less than the payoff.

If your estimated proceeds are short, tell both the servicer and the settlement professional before you sign final documents. Ask the lender what written arrangement, if any, is required for the sale to proceed and what amount it will accept. The available options and approval criteria are transaction-specific; obtain the agreement in writing before relying on it.

What you should review before signing

  • Confirm that the payoff dates match the expected disbursement date.
  • Compare each payoff with the account number and property address to prevent a payment to the wrong loan.
  • Check that the first mortgage and junior-lien payoffs appear as separate entries when the applicable disclosure requires them.
  • Review the amount shown as cash to or from the seller after every lien and closing obligation.
  • Ask immediately about any unexplained fee, missing lien, or difference between your estimate and the settlement statement.

After closing: verify the lien release

The servicer or the company handling the payoff should send a release, satisfaction, or reconveyance for recording. After closing, search the county recorder, land-records office, or other local property-record system for the property and lien. The CFPB’s guidance is available at How do I check if my lien was released?

Recording can lag behind the payoff. Keep the settlement statement, payoff confirmation, wire receipt, and any release document while you wait. If the record still shows the lien after a reasonable local processing period, contact the servicer and the settlement company that sent the funds, then ask what document was recorded and under which recording number. State and county timelines are not uniform, so a local records office can explain its process.

Questions to ask the servicer and closing agent

Ask the servicer

  • What written authorization is required for the settlement agent to obtain the payoff?
  • What amount is valid through the planned disbursement date?
  • What per-diem interest or fee applies if the date changes?
  • How and when will the release document be sent for recording?
  • If proceeds are insufficient, what written approval or agreement is required?

Ask the settlement agent

  • Have payoff demands been ordered for every lien found in the title search?
  • Which payoff figures and validity dates will appear on the seller disclosure?
  • What is the estimated net amount after all payoffs and closing obligations?
  • Who will confirm that each release was recorded after disbursement?

Key limits to keep in mind

The seven-business-day federal timing rule applies only to covered transactions and includes exceptions; it is not a promise that every request will be completed in that period. The sources cited here do not establish a universal state deadline for recording a release, tax treatment of the payoff, a lender’s short-sale criteria, or your personal liability for any unpaid balance. Your loan documents, state law, and a written lender agreement control those issues. For a transaction-specific answer, use the servicer and a licensed settlement or real-estate professional in the property’s jurisdiction.
