What Happens to a Fixed Deposit When the Depositor Dies in India? Nominee and Claim Steps

When a fixed-deposit holder dies in India, the bank does not automatically transfer the deposit to the nominee as an inheritance. A valid nominee or surviving joint holder can usually collect the money through the bank’s deceased-depositor process, but receives it as a trustee for the deceased person’s legal heirs. The heirs’ ultimate rights are governed by succession law, a will and any court order.

The practical route depends on five facts: whether there is a valid nominee or survivorship mandate, whether the FD is single or joint, whether it has matured, whether succession is disputed, and what the holding bank’s current policy says about documents and interest.

The outcome depends on the FD’s registration and the estate’s circumstances

Situation Who normally approaches the bank What controls the payment
Single FD with a valid nominee The named nominee Proof of death, satisfactory identification, the bank’s claim form and absence of a restraining court order
Joint FD with a survivorship clause The surviving holder or holders The exact mandate, identity and death evidence, plus the FD contract
No nominee and no survivorship clause Legal heirs or a person authorised by them The bank’s simplified legal-heir procedure, its risk threshold and the clarity of succession
Unclear or disputed succession Heirs acting jointly, or a court-appointed/authorised representative Additional legal evidence, and potentially a succession certificate, probate or letters of administration
FD still within its term Nominee, survivor or heirs under the applicable route Whether the mandate and contract allow payment before maturity and how interest or penalties are calculated

These are claim routes, not a determination of who beneficially inherits the deposit. The bank’s payment decision and the heirs’ rights against the recipient are separate issues.

What a nomination means—and what it does not mean

Nomination is a collection facility

Under the Reserve Bank of India’s customer-service guidance, payment to a valid nominee can discharge the bank’s liability when the bank is satisfied about the depositor’s death and the nominee’s identity, and no competent court has restrained payment. The nominee therefore has a simpler way to obtain the funds than an heir who must first establish authority under succession law.

The nominee receives the money as trustee

RBI’s circular explains that “the survivor(s) / nominee would be receiving the payment from the bank as a trustee of the legal heirs of the deceased depositor”. In practical terms, the nominee’s receipt settles the bank’s obligation to pay; it does not, by itself, decide the final beneficial ownership of the FD. A will, succession law or a court decision can still determine which heirs are entitled to the money.

Why a bank normally should not demand probate for this route

For a valid nominee or applicable survivor, RBI guidance says that insisting on probate, letters of administration, a succession certificate, an indemnity or surety merely to make the payment is unwarranted, provided the stated identity, death-proof and court-order safeguards are met. This protection concerns the bank’s ability to pay safely. It does not prevent an heir from bringing a later claim against the person who received the proceeds.

How a nominee or survivor claims the FD

Use the following sequence for a single FD with a valid nominee or a joint FD where the survivorship mandate applies. The bank holding the deposit controls its form names and accepted evidence, so obtain its current checklist before collecting documents.

  1. Contact the FD-holding bank or branch. Ask specifically for the deceased-depositor claim form, the document checklist and the process for a nominee or surviving holder. RBI guidance says banks should provide claim forms to people who request them.
  2. Identify the deposit precisely. Provide the FD receipt or account number, customer identification details and, for a joint deposit, the names of all holders and the operating instruction. If the original receipt is unavailable, ask what alternative account-identification evidence the bank accepts.
  3. Submit accepted proof of death. The bank must be satisfied that the depositor has died. Use the form of death evidence the bank specifies and ensure that names and dates match its records; ask in writing about any mismatch before filing a complete claim.
  4. Prove the claimant’s identity and status. A nominee must establish that they are the person recorded in the nomination. A survivor must establish identity and that the survivorship mandate applies. The bank may require its customer-identification documents and a signed declaration in addition to the claim form.
  5. Ask about maturity and early payment. Confirm whether the FD has matured. If it has not, ask whether the contract and mandate permit payment before maturity, who must sign, and what rate, reduction or other adjustment will apply. Do not assume that a nominee or survivor can terminate every FD early.
  6. File a complete claim and retain proof of receipt. Give the branch or bank the full set in one submission where possible. Keep copies, the submission date, the employee or channel that accepted the claim and any acknowledgment number. If the bank considers the file incomplete, request a written list of the missing items rather than relying on verbal explanations.
  7. Check the payment destination and trustee position. Confirm whether the bank will credit an account or issue another permitted form of payment. Before using the money, understand that receipt is subject to the legal heirs’ underlying claims; the nominee should preserve records showing the amount and date received.

A current policy of Central Bank of India for 2025–26 illustrates the type of evidence a bank may request: proof of death and nominee identification for a nominee claim, and proof of authority for legal-heir claims. That policy is an example from one bank, not a universal checklist. The relevant bank’s own current form governs.

If there is no nominee

Ask for the bank’s legal-heir route and threshold

Where neither a nomination nor a survivorship clause applies, ask the bank for its deceased-depositor or legal-heir procedure, the settlement threshold and the exact document list. RBI guidance calls for a simplified process and allows banks to set a minimum threshold up to which they may settle with limited documentation, potentially including an indemnity letter, under their risk controls. The threshold, form and evidence are bank-specific.

What the bank is trying to establish

The bank needs reasonable evidence of who the legal heirs are, who is authorised to receive the funds, and whether all interested parties agree. Depending on the bank’s policy and the facts, that can involve heir-identification documents, declarations, indemnities, affidavits, a joint request or evidence of authority. Do not submit documents copied from another bank’s website as though they were universal requirements; request the holding bank’s written checklist.

When succession evidence becomes necessary

If the succession is unclear, an heir is missing, or the heirs disagree, the simplified route may not be enough. Central Bank of India’s 2025–26 policy says a succession certificate or court representation should be insisted upon only where succession is unclear or where there is a dispute and all legal heirs do not join in signing the required documents. Other banks may use different wording or thresholds, but the underlying distinction is important: a succession certificate is not automatically required merely because no nominee was recorded.

Joint fixed deposits: read the mandate, not just the names

Survivorship instructions determine the bank’s operational route

RBI guidance recognises operating instructions such as “Either or Survivor”, “Anyone or Survivor”, “Former or Survivor” and “Latter or Survivor”. The surviving holder’s ability to collect under one of these instructions is a question of the bank’s mandate and contract. It should not be inferred simply from the fact that one holder outlived another.

Collection and beneficial entitlement remain separate

A survivor who receives a joint FD under the mandate may still have to account to the deceased holder’s heirs for the deceased holder’s beneficial interest. The bank’s payment can discharge its liability while leaving disagreements among the family unresolved. Keep the account-opening form, mandate and any will or family settlement available if ownership is likely to be contested.

Premature termination needs particular care

Ask three separate questions: does the mandate permit the surviving holder to close the deposit before maturity; did the original contract require a joint instruction for early withdrawal; and what interest or charge will the bank apply? RBI material concerning urban co-operative banks discusses joint mandates for premature withdrawal in specified term-deposit situations. That guidance is specific to that bank class and should not be generalised to every bank. Obtain the answer from the FD-holding bank before signing a closure request.

Maturity, death date and interest after maturity

The original FD rate does not automatically continue forever

RBI’s consolidated guidance leaves the treatment of a term deposit that has matured after the depositor’s death to each bank’s transparent, board-approved policy. Consequently, the contracted rate may end at maturity, and the post-maturity rate can differ. Ask the bank for a written calculation showing the death date, maturity date, payment date, rate periods and any premature-termination adjustment.

A published bank-specific example

Central Bank of India’s 2025–26 policy gives one concrete illustration:

  • If death occurred before maturity and the claim is made after maturity, it provides for the contracted rate up to maturity, followed by simple interest at the rate applicable on the maturity date for the period the deposit remained beyond maturity.
  • If death occurred after maturity, it provides for the savings rate operative on the maturity date from maturity until payment.

Those formulas apply to that bank’s stated policy period. They are not a market-wide rule. The FD-holding bank’s current policy and the deposit contract control the actual amount.

How long should a claim take?

Nominee and survivor claims

RBI guidance says: “Banks should settle the claims in respect of deceased depositors and release payments to survivor(s) / nominee(s) within a period not exceeding 15 days”. The period is subject to the bank receiving proof of death and being satisfied about the claimant’s identification. Count from the bank’s receipt of a complete claim, and preserve the dated acknowledgment.

No-nominee claims

The cited RBI passage calls for a simplified legal-heir settlement but does not impose the same 15-day period in that passage. Central Bank of India’s 2025–26 policy gives one month from receipt of all required documents for its no-nominee claims. Treat that one-month period as a bank-specific example, not a universal deadline.

What to do if the bank delays or rejects the file

  1. Request the reason in writing and ask whether the bank considers any document missing, inconsistent or unacceptable.
  2. Ask the branch to identify the exact deceased-claim policy, threshold or interest rule it is applying.
  3. Provide a dated written response to any deficiency and keep delivery proof.
  4. If the bank cites a court restraint, a dispute among heirs or unclear succession, ask what legal order or representation it requires before payment can proceed.
  5. Escalate through the bank’s internal grievance channel if the stated service period has passed without a clear explanation. The available guidance does not establish a single compensation amount or remedy for every delay, so do not assume one without checking the applicable banking and legal process.

A practical document and decision checklist

  • FD number, receipt or other deposit identifier.
  • Proof of death in the bank’s accepted form.
  • Nominee or survivor identity evidence.
  • Claim form and any declarations required by the bank.
  • Joint-account mandate and account-opening records, where applicable.
  • Information about maturity date and whether early payment is requested.
  • For a no-nominee claim: the bank’s legal-heir checklist, authority evidence and any required indemnity or joint-heir undertaking.
  • For a dispute or unclear succession: details of any will, pending case, court order or representation document relevant to the FD.
  • Acknowledgment of submission and a written interest calculation before accepting the final amount.

Three examples of how the routes differ

Single FD, nominee recorded, deposit already mature

The nominee submits the bank’s form, accepted death proof and identity evidence. If no court has restrained payment and the bank is satisfied with the documents, the nominee route generally avoids a demand for probate or a succession certificate. The bank applies its own post-maturity policy, and the nominee’s trustee obligation remains.

Single FD, no nominee, all heirs agree

The heirs request the bank’s simplified legal-heir procedure and submit the documents specified for the deposit amount and risk threshold. If the bank is satisfied about authority and agreement, it may settle without a succession certificate. The timeline and interest treatment come from that bank’s policy, not automatically from the nominee-claim service period.

Joint FD, “Either or Survivor”, heirs object

The surviving holder may be able to collect under the mandate after proving identity and the other holder’s death. That operational payment does not necessarily resolve the heirs’ claim to the deceased holder’s beneficial share. If a competent court restrains payment, the conditions for the straightforward survivor route are no longer met.

Bottom line for families

First establish the FD’s nomination or survivorship instruction, then obtain the holding bank’s current deceased-claim form and checklist. A valid nominee or survivor usually has the fastest bank-payment route and should not be asked for probate or a succession certificate merely as a routine condition. Without a nominee, use the bank’s legal-heir process; unclear or disputed succession may require court-backed authority. Treat the nominee as a trustee for the heirs, verify the bank’s maturity and interest calculation, and keep a dated record of every document submitted.
