What Happens If You Sell or Refinance Before a Mortgage Buydown Expires?

If you sell your home or refinance before a temporary mortgage buydown ends, the original mortgage is paid off. The remaining subsidy does not automatically become your cash or disappear: the signed buydown agreement and the servicer’s payoff accounting determine whether unused funds are credited, refunded, transferred, or retained.

Request a written payoff statement and a separate buydown-account balance before you set a sale price or sign refinance documents. Treat ordinary tax-and-insurance escrow as a different account, because escrow-return rules do not decide who receives an unused buydown balance.

What a temporary mortgage buydown actually changes

A temporary buydown is a payment subsidy, not a permanent reduction in your mortgage note rate. A lump sum is deposited into a buydown account. The servicer releases portions of that money on a schedule so your effective payment is lower during the early years.

Your promissory note still states the permanent interest rate, principal-and-interest payment, and other contractual obligations. Fannie Mae’s Selling Guide requires the mortgage documents to reflect those permanent terms. The buydown agreement also must state that you remain responsible for the note’s required payments if the subsidy is unavailable.

That distinction matters at payoff. Selling or refinancing satisfies the note; it does not rewrite the note rate or convert every unreleased subsidy dollar into a borrower-owned asset.

How a 3-2-1 schedule works

Fannie Mae uses a 3-2-1 structure as a common example. The payment is calculated using a rate three percentage points below the note rate in year one, two points below in year two, and one point below in year three. The permanent note rate applies afterward.

Period Illustrative calculation What remains contractual
Year 1 Note rate minus 3 percentage points The note rate and debt remain unchanged
Year 2 Note rate minus 2 percentage points The borrower still owes the scheduled note obligation
Year 3 Note rate minus 1 percentage point The subsidy continues to be released under the agreement
Year 4 and later Permanent note rate No temporary buydown reduction remains

The schedule is an example, not a guarantee that your loan has a 3-2-1 plan. Two-year 2-1 plans and other schedules are possible. Your closing documents control the exact dates, rates, and release amounts.

What changes when you sell before the buydown expires

A sale normally requires the existing mortgage to be paid in full from the closing proceeds. The payoff date determines how much of the subsidy has already been released and how much remains in the buydown account.

The closing statement may show only what the agreement permits

Ask the settlement agent to obtain the servicer’s written payoff and buydown accounting early in the transaction. If the agreement says a remaining balance is payable to you, the closing agent can generally show that amount as a credit or disbursement in the settlement figures. If the agreement directs the balance to the lender or another party, you should not expect a borrower credit.

Do not estimate the amount by multiplying the number of remaining months by the current payment reduction. Servicers calculate the account under the actual release schedule, payoff date, and loan records. A payoff quote may also include per-diem interest, recording charges, and other items that are unrelated to the subsidy.

Sale timing can affect the amount

Two sales a few weeks apart can produce different remaining balances if a scheduled release occurs between them. Ask for an accounting through the anticipated payoff date and request an updated quote if closing moves. Keep a copy of the final agreement and the statement showing how the balance was applied.

What changes when you refinance before the buydown expires

A refinance pays off the old mortgage just as a sale does. The new loan’s rate, term, fees, and cash-to-close are separate decisions from the disposition of the old buydown account.

Separate buydown funds from transferred escrow

On a refinance Closing Disclosure, an existing tax-and-insurance escrow balance transferred from the old loan can appear as a credit. That disclosure treatment does not establish that an unused buydown subsidy belongs to you. Ask the new lender and old servicer to identify each balance by name rather than treating every credit as “escrow.”

Compare the refinance using actual figures

Evaluate the refinance with the new loan estimate and Closing Disclosure: interest rate, annual percentage rate, points, origination charges, prepaid items, monthly payment, term, and cash required at closing. A projected buydown refund should be listed separately from ordinary refinance savings. If the refund is uncertain, do not count it as guaranteed cash when calculating a break-even period.

Who receives unused buydown money?

There is no universal rule that awards every leftover dollar to the borrower. The Consumer Financial Protection Bureau’s Official Interpretation of Regulation Z § 1026.17(c)(1), comment 4, explains: “Depending upon the buydown plan, the consumer’s prepayment of the obligation may or may not result in a portion of the amount being credited or refunded to the consumer.”

Fannie Mae likewise says a buydown agreement may provide for remaining funds to be returned to the borrower or to the lender if that lender funded the buydown. That permission is not a blanket promise of a refund; the executed agreement and servicing records still govern.

Funding or arrangement What the general rules establish What you must verify
Borrower-paid amount Regulation Z commentary recognizes that the amount may be placed in escrow or retained by the creditor, and early prepayment may or may not produce a credit or refund. Whether your plan promises a payoff credit, who receives it, and how the amount is calculated.
Lender-funded buydown Fannie Mae permits an agreement to return remaining funds to the borrower or to the funding lender. If servicing transfers, lender-funded buydown funds must be transferred to the new servicer. The agreement’s recipient clause and the current servicer’s balance after any servicing transfer.
Seller, builder, or other third-party contribution General guidance does not establish that the subsidy automatically reverts to the seller, borrower, or lender at payoff. The contribution agreement, closing documents, and any incorporated servicing terms.

Because labels such as “seller-funded” or “lender-funded” do not answer the payoff question by themselves, obtain the signed documents before relying on a refund.

Step-by-step checklist before you sell or refinance

  1. Locate the complete buydown package. Gather the buydown agreement, note, rider, Closing Disclosure, settlement statement, and any amendment describing who supplied the funds. Look for language such as “early payoff,” “prepayment,” “remaining funds,” or “termination.”
  2. Identify the payoff date and schedule. Mark the date the old loan will be paid in full and compare it with each scheduled subsidy release. Ask whether the servicer uses the payoff posting date, wire date, or another date under the agreement.
  3. Request two written figures from the servicer. Ask for a payoff statement showing unpaid principal, interest, and other payoff charges, plus a separate accounting of the buydown account showing deposits, releases, and the balance remaining after payoff.
  4. Ask who receives the balance. Require the servicer to cite the agreement provision that directs any remaining funds to you, the lender, or another party. If the answer is verbal, request confirmation in writing.
  5. Give the figures to the closing professional. For a sale, send the accounting to the settlement agent so the proposed credit or charge appears correctly in the closing figures. For a refinance, give it to both lenders and ask where the amount appears on the Closing Disclosure.
  6. Reconcile the final disclosure. Confirm that the old loan payoff, buydown disposition, ordinary escrow credit or refund, and any new-loan charges are shown as separate line items. Do not accept a combined “miscellaneous credit” without an explanation.
  7. Update the request if closing is delayed. A changed payoff date can alter accrued interest and the subsidy balance. Obtain a refreshed payoff and accounting before signing.

Do not confuse a buydown balance with tax-and-insurance escrow

A temporary buydown account subsidizes mortgage payments. An escrow account holds money for property taxes and insurance. They can both appear in servicing records, but they have different purposes and different rules.

Under Regulation X § 1024.34, after the mortgage is fully paid off, a servicer generally must return remaining escrow funds within 20 days, excluding Saturdays, Sundays, and legal public holidays, subject to the regulation’s stated exception. That deadline applies to remaining escrow funds within the servicer’s control; it does not dictate the treatment of an unused temporary buydown subsidy.

When reviewing a payoff, ask for separate lines labeled principal, interest, fees, escrow, and buydown. A refund of tax-and-insurance escrow should not be used as evidence that a buydown refund is owed.

Clauses that deserve careful reading

Early payoff or termination language

Find out whether the plan ends automatically when the loan is paid off and whether the remaining account balance is distributed. Some agreements state a specific recipient; others make the balance subject to the funding party’s instructions or the mortgage loan agreement.

Funding-source language

Confirm whether the money came from you, the lender, a seller, a builder, or another contributor. The funding source can affect the available options, but it does not replace the need to read the operative clause.

Servicing-transfer language

If your loan changed servicers, request records from the current servicer and compare them with the original closing documents. Fannie Mae’s guidance requires lender-funded buydown funds to move to a new servicer when servicing transfers, so a missing balance should be investigated rather than assumed to be spent.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“No obligation” or payment-shortfall language

The agreement should not be read as forgiving the note payment. Fannie Mae requires the borrower to remain responsible for required payments if buydown funds are unavailable. Continue making the contractual payment unless the servicer provides a different written instruction.

Common mistakes and how to correct them

  • Assuming every leftover dollar is yours. Correction: obtain the agreement’s recipient clause and a written accounting.
  • Assuming the lender keeps everything. Correction: some agreements permit a borrower refund, so check the executed terms.
  • Calling an escrow refund a buydown refund. Correction: request separate account balances and separate disclosure lines.
  • Using the original payment reduction as the balance. Correction: use the servicer’s schedule through the actual payoff date.
  • Relying on a preliminary payoff quote. Correction: refresh the figures when the closing date changes.
  • Stopping payments because the loan is about to close. Correction: keep paying under the note until the servicer confirms payoff; a late payment can create avoidable complications.
  • Counting an uncertain refund in a refinance budget. Correction: treat it as unavailable until the agreement and Closing Disclosure establish the amount and recipient.

Questions to ask the servicer, lender, or closing agent

  • What is the buydown account balance as of the expected payoff date?
  • How much has been released, and on which dates?
  • Which document controls the treatment of funds remaining at payoff?
  • Who funded the subsidy, and who is the stated recipient of any balance?
  • Will the amount be paid through the sale settlement, sent after payoff, credited to the new loan, or retained?
  • Which line on the Closing Disclosure shows the buydown disposition?
  • What separate escrow balance remains, and when will it be returned?

Bottom line for a sale versus a refinance

Both a sale and a refinance pay off the old mortgage, so the same core test applies: compare the payoff date with the subsidy schedule, read the early-payoff clause, identify the funding source, and obtain the servicer’s written account breakdown. A sale adds a settlement statement and closing-agent review. A refinance adds a new loan’s rate, fees, and Closing Disclosure; any transferred escrow credit should remain separate from the buydown balance.

The only reliable answer for a particular loan comes from its signed agreement, note, servicing records, and payoff statement. General CFPB and Fannie Mae guidance confirms that unused funds may or may not be credited or refunded, so do not promise yourself a refund until those documents show who receives what.
