What Happens If You Receive an Eviction Notice in Vermont?

A Vermont eviction notice is a written notice that your landlord is ending the tenancy. It is not a court order and does not, by itself, authorize a lockout or removal. Read the stated grounds and termination date, preserve every document, and get legal advice quickly. If a court later serves you with a summons and complaint, that is a separate step with a generally applicable 21-day answer deadline.

This guide covers Vermont residential rentals. Commercial property is outside the scope of the Vermont Judiciary’s residential eviction guide, and subsidized housing or local rules may add requirements.

What an eviction notice means in Vermont

Landlords and tenants may call the document an eviction notice, notice to quit, notice to vacate, or notice to terminate residency. Whatever the label, the Vermont Judiciary says a residential termination notice must be in writing, identify the grounds for ending the tenancy, and give a termination date. The landlord may deliver it by hand, by first-class mail to the tenant’s last known address, or by certified mail. See the Vermont Judiciary’s Eviction Process guide.

The document starts a possible eviction process; it does not complete one. A landlord cannot use the notice alone to remove you, change your locks, shut off utilities, or take your belongings. Forced removal requires a court case, a judgment granting possession, a writ of possession, and sheriff service.

Do not assume that every Vermont tenant receives the same amount of notice. The required period depends on the stated grounds and can be affected by municipal rules, the type of rental, and subsidy-program requirements. The Judiciary’s guide points to 9 V.S.A. § 4467 for statewide requirements, but a single number cannot safely be applied without knowing the facts.

What to do as soon as you receive the notice

1. Read the grounds and date word for word

Find the reason the landlord gives for ending the tenancy and the exact termination date. Check whether the address, names, and tenancy information are correct. Do not treat a phone call, text message, or informal demand as a substitute for reviewing the written notice; preserve those communications as well.

2. Preserve the original and record delivery

Keep the notice and its envelope, take clear photographs or scans, and write down when and how you received it. Keep the lease, rent receipts or bank records, repair requests, inspection records, messages with the landlord, and any subsidy paperwork together. This organization is practical preparation, not a special court filing requirement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. Identify rules that may change the deadline

  • Grounds for termination: The notice period is tied to the reason stated, so do not borrow a deadline from a different situation.
  • Locality: Some Vermont cities and towns may require more notice than the statewide baseline.
  • Subsidized housing: State or federal subsidy programs can impose additional notice and termination rules.
  • Rental type: The Judiciary’s process guide addresses residential property, not commercial rentals.

4. Get advice before the date passes

Eviction cases can be complicated. The Vermont Judiciary directs tenants to seek an attorney and to contact Legal Services Vermont to ask whether they qualify for free or lower-cost help. Call 800-889-2047, or use the online referral available through the Judiciary’s housing self-help page. Explain that you received a termination notice, give the date shown on it, and ask what deadline applies to your circumstances.

How the termination date and notice period work

The termination date is the date the landlord says the tenancy ends. It is not automatically the date a sheriff can remove you. Whether the notice is legally sufficient can depend on the ground, the length and type of tenancy, municipal requirements, and subsidy rules. If any of those facts are unclear, ask a qualified Vermont housing lawyer or legal-aid advocate to review the notice.

Because the applicable period is fact-specific, the safest response is to treat the date on the paper as urgent while confirming whether it is correct. Do not wait for the landlord to send another reminder. If the notice appears to give too little time, keep it, note the issue, and raise it with counsel or in your court response if a case is filed.

What your landlord may and may not do before a court order

A termination notice does not authorize self-help eviction. Under the Judiciary’s process guidance, a landlord may not remove a tenant, change the locks, shut off utilities, or remove belongings without a court order. If someone attempts one of those actions, document what happened, keep copies of messages and photographs, and seek immediate legal advice. Do not respond by threatening or physically confronting anyone.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The notice also does not eliminate the need for the landlord to follow the court process. If you move voluntarily, arrange the handover of keys and document the condition of the property. If you remain, the landlord must wait for the termination date before taking the next court step.

What happens after the termination date

If you have not complied by the termination date, the landlord may file an eviction case, but the filing is not immediate authority to remove you. The landlord must wait until the termination date has passed and file within 60 days after that date. If the landlord does not file within that window, the Judiciary says the landlord must start again with a new notice.

The case is filed in the Civil Division of the Superior Court in the county where the property is located. The landlord arranges for the sheriff to serve the court papers. Those papers generally include a summons and complaint. Their arrival is a new event with its own deadline; the 21-day answer period does not run from the date you received the earlier termination notice.

Document or event What it does Time point stated by the Vermont Judiciary
Written termination notice States the grounds and the date the landlord says the tenancy ends. Notice period varies with the grounds and may be affected by local and subsidy rules; no single number applies.
Termination date passes Allows the landlord to consider filing if the tenancy has not ended. The landlord must wait until after this date.
Landlord’s filing window Limits how long the landlord can use that notice to start the case. File within 60 days after the termination date, or begin again with a new notice.
Summons and complaint served Starts the court case and tells you to respond. Generally 21 days after service to file a written answer.
Writ of possession served by sheriff Enforces a judgment granting the landlord possession. Ordinary move-out period is 14 days; a writ following a missed rent-escrow payment has a seven-day period.

How to respond to a Vermont eviction complaint

Mark the service date immediately

When the sheriff or other authorized process server gives you the summons and complaint, write down the date of service and keep the papers together. The general deadline is 21 days after service to file a written answer, according to the Vermont Judiciary. Count from service of the complaint, not from the termination notice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Prepare and file a written answer

Your answer responds to the allegations in the complaint. The Judiciary says you may include affirmative defenses and may request a jury trial. Use the court’s current instructions or obtain legal assistance so that your filing addresses the claims and any defenses supported by your facts.

  3. Write and sign the answer, including any affirmative defenses you have a factual and legal basis to assert.
  4. If you want a jury trial, make that request in the manner allowed by the court instructions.
  5. File the answer with the Civil Division of the Superior Court handling the case by the deadline.
  6. Deliver a copy to the landlord or the landlord’s attorney by the same deadline and file a Certificate of Service showing that you did so.

Failure to answer can allow the landlord to seek a default judgment. If the deadline is close or has passed, contact the clerk and a lawyer or legal-aid provider immediately rather than assuming the case is over.

What the court decides

An eviction trial is not limited to the question of whether you received a notice. The judge considers the evidence and decides whether the landlord is entitled to possession, whether either party owes money, and other issues properly raised in the case. Bring the original papers and organized copies of relevant records, and follow every court instruction about witnesses, exhibits, and hearing dates.

The court process is separate from negotiations with the landlord. A payment arrangement or move-out agreement may affect the case, but do not rely on an informal promise to dismiss it. Get any agreement in writing and confirm what is filed with the court.

What happens if the landlord wins

If the judge grants the landlord possession, the judgment does not mean the landlord can immediately conduct a lockout. A writ of possession may issue, and the sheriff must serve it. The ordinary move-out period after service of that writ is 14 days. The Judiciary describes a seven-day period when the writ follows a missed rent-escrow payment.

Use the time after service of the writ to arrange housing, protect medication and essential belongings, and obtain urgent legal advice about any stay, payment, or other option that may be available in your case. Do not wait until the final day to read the writ or ask what it requires.

Residential, commercial, local, and subsidized rentals are not interchangeable

Residential versus commercial property

The Vermont Judiciary’s eviction guide is for residential properties. Commercial tenants should not assume that its notice, filing, or response rules apply to a business lease; obtain advice specific to the commercial agreement and property.

Local requirements

Some municipalities may require more notice or impose additional procedures. The property’s town or city matters, so tell a legal adviser where the rental is located rather than relying only on a statewide summary.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Subsidized housing

State or federal subsidy programs can add requirements to termination notices and court cases. Gather program notices, housing-authority communications, and the lease addenda along with your other records.

A practical document and deadline checklist

  • Keep the notice, envelope, and delivery details.
  • Write down the termination date and the grounds stated.
  • Save the lease, renewals, rent-payment proof, and deposit records.
  • Save repair requests, inspection reports, photographs, and messages.
  • Record the date any summons and complaint is served.
  • Calendar the generally applicable 21-day answer deadline from complaint service.
  • File the answer, serve the landlord, and file the Certificate of Service.
  • Attend every hearing and bring organized evidence.
  • If a writ is served, note whether it provides the ordinary 14-day period or the seven-day rent-escrow period.
  • Call Legal Services Vermont at 800-889-2047 or use the Judiciary’s housing self-help referral if you need help finding representation.

Where to find Vermont court information

The Vermont Judiciary’s Eviction Process page explains the residential notice, filing, answer, trial, writ, and enforcement stages. Its Eviction and Foreclosure housing self-help page provides housing resources and the Legal Services Vermont referral. Court guidance is general information, not a substitute for advice about the facts, location, subsidy status, and documents in your case.
