For an unfiled return, you may still be able to submit a belated return within the deadline for your assessment year (AY), usually with a late fee and possibly interest. If that window has closed, an updated return (ITR-U) or a condonation-of-delay request may help only when its separate eligibility rules are met. If you already filed and discovered an error, use the revised-return route instead.
The date matters: for AY 2026-27, the Income Tax Department currently lists 31 December 2026 or completion of assessment, whichever is earlier for a section 139(4) belated return. Do not apply that date automatically to another AY.

Start with the assessment year, not the calendar year
Indian income-tax filing deadlines are tied to the assessment year (AY) and the law governing that year. First identify the AY shown on your return or tax documents. The Income Tax Department says AY 2026-27 and earlier filings continue under the Income-tax Act, 1961. The Income-tax Act, 2025 applies to tax years beginning on or after 1 April 2026. The forms, deadlines, fees and correction routes can therefore differ between years.

That is an AY-specific rule. A later extension, a different AY or a completed assessment can change the answer, so check the official e-filing portal for the exact year before submitting.
#1 Best Overall
The Department’s FAQ frames the question as: “What happens if I file Income Tax Return after the due date u/s 139(1)?” The practical answer depends on whether you are filing for the first time, correcting a return already filed, seeking a refund or loss carry-forward, and whether another tax proceeding has started.
Choose the route that matches your situation
| Your position | Possible route | Main timing or eligibility issue |
|---|---|---|
| No return has been filed and the statutory window remains open | Belated return under section 139(4) | For AY 2026-27, 31 December 2026 or completion of assessment, whichever is earlier; late fee and interest may apply. |
| A return was filed but contains an omission or error | Revised return | For AY 2026-27, the Department says revision is allowed through 31 March 2027; a section 234I fee applies when filed after 31 December 2026 and through 31 March 2027. |
| The ordinary filing period has passed | Updated return (ITR-U) | Generally available only within four years from the end of the relevant AY, with additional tax and statutory exclusions. |
| You have genuine hardship involving a refund or loss carry-forward | Condonation request under section 119(2)(b) | Discretionary relief requiring an approval order; it is not an automatic extension. |
These routes are not interchangeable. An ITR-U is not a routine late return, and condonation is not a guaranteed way to reopen every missed deadline.
If you have not filed: submit a belated return
AY 2026-27 deadline
For AY 2026-27, section 139(4) permits a belated return until 31 December 2026 or completion of assessment, whichever occurs earlier, according to the Department’s current FAQ. If assessment has already been completed, the earlier event controls even if 31 December has not arrived.

For the AY 2026-27 example under the Income-tax Act, 1961, the Department states that section 234F imposes:
Rank #2
- Ideal for Gifting
- Ideal for a bookworm
- Compact for travelling
- ₹1,000 when total income does not exceed ₹5 lakh.
- ₹5,000 when total income is above ₹5 lakh.
Those amounts are tied to the stated AY and the Department’s current FAQ. Do not assume the same fee applies to another year or a different statutory regime.
Interest can be separate
A late fee is not the same as interest. If tax remains payable, interest may also arise under the applicable provisions. The amount depends on your final tax liability, payment dates and the rules for that AY. A return can therefore show both a section 234F fee and interest, or a fee without interest where no tax remains due.
What a belated return may affect
Late filing does not automatically erase every deduction or relief. However, timing can determine whether a particular statutory condition is met. The most important risk is loss carry-forward. For example, the Department says that a belated loss return for AY 2024-25 that does not satisfy sections 139(3) and 80 cannot carry that loss forward. A taxpayer should identify the exact loss provision rather than assume that every loss, deduction or benefit is treated identically.

If you already filed: use a revised return
A return that has already been submitted but contains an omission, wrong figure or other eligible error is generally corrected through a revised return, not by filing a second unrelated belated return. The Department’s FAQ says AY 2026-27 revisions may be filed through 31 March 2027.
Rank #3
AY 2026-27 revision timing and fee
If the revision is filed after 31 December 2026 and through 31 March 2027, the Department lists an additional section 234I fee of:
- ₹1,000 when total income is up to ₹5 lakh.
- ₹5,000 when total income is above ₹5 lakh.
These are the Department’s figures for AY 2026-27. Confirm the portal’s calculation for your return before paying. Also verify that the correction is procedurally eligible and that the return has not reached a stage that prevents revision.
What to correct before revising
- Reconcile salary, interest, capital-gain and other income with the information shown in Form 26AS and the Annual Information Statement (AIS).
- Check tax deducted or collected, advance tax and self-assessment tax credits.
- Review bank-account details where a refund or tax payment is involved.
- Identify whether the change affects a loss, carry-forward claim, refund or total tax liability.
- Use the AY-specific form and instructions displayed by the official portal.
A revision replaces the earlier return for processing purposes; it is not a licence to change facts without supporting records. Keep the computation and documents that explain each adjustment.

When an ITR-U may be available
An updated return (ITR-U) is a possible route after ordinary filing time has passed, but it has stricter economics and eligibility rules. The Department’s manual says an ITR-U cannot be filed beyond four years from the end of the relevant AY and requires additional tax at the applicable rate.
Rank #4
Outcomes an ITR-U cannot achieve
The Department’s official notice lists important exclusions. An updated return generally cannot:
- Be a return of loss.
- Decrease the total tax liability reported or previously determined.
- Create a refund or increase an existing refund.
That means ITR-U is not a mechanism for obtaining a late refund or reducing a tax bill after discovering an overstatement. Its purpose is to disclose additional income or tax in circumstances permitted by law.
Additional restrictions
The notice also identifies restrictions connected with specified search and survey situations, pending or completed proceedings, and information communicated to the taxpayer. Whether a restriction applies depends on the facts and the relevant AY. Check the current form, statutory provisions and portal validation rather than treating the four-year period as the only test.
Additional tax changes the calculation
The extra tax required for an ITR-U is separate from the underlying tax and any interest or fee that may apply. The applicable percentage and calculation can depend on when the updated return is filed. Because those rates and windows are year-sensitive, calculate them using the current official instructions for the specific AY.

When to consider condonation of delay
Section 119(2)(b) condonation is discretionary relief for qualifying cases of genuine hardship. The Department’s manual describes it principally for a refund claim or the carry-forward of losses. It is a request to the tax authority, not an automatic extension of the statutory deadline.
Approval comes first
You must obtain an order approving condonation before using the special filing route. After approval, the return is filed under section 139(9A). The manual’s instructions describe filing through an offline utility after the order is issued.
Documents and portal prerequisites
The manual lists prerequisites that can include:
- A valid e-filing portal user ID and password.
- The DIN of the condonation order.
- Bank-account details.
- Form 26AS and AIS information.
Prepare a clear explanation of the hardship, the dates, the refund or loss involved and the evidence supporting the request. Approval is fact-specific; filing an application does not itself preserve the refund or loss claim.

How to decide what to do next
- Write down the exact AY. Do not use the current year’s date as a substitute for the AY shown in your documents.
- Check whether a return already exists. An unfiled return points toward a belated return; an accepted filing with an error points toward revision.
- Check the statutory window on the official portal. For AY 2026-27, compare 31 December 2026 with the date assessment is completed.
- Define the objective. Are you reporting income, correcting data, claiming a refund or preserving a loss carry-forward? Refund and loss objectives have special restrictions.
- Calculate the cost. Include the AY-specific late or revision fee, any interest and, for ITR-U, the additional tax.
- Screen for disqualifying events. For ITR-U, review search, survey, proceeding and communicated-information restrictions. For revision, confirm that the return remains revisable.
- Assemble records. Reconcile Form 26AS, AIS, bank details and the documents supporting income, deductions, tax credits and losses.
- Use condonation only where its test fits. If genuine hardship involves a refund or loss carry-forward and the ordinary routes are closed, prepare the approval request rather than assuming a late return will be accepted.
Common situations and the likely direction
| Situation | Direction to examine | Critical warning |
|---|---|---|
| You missed the original due date, but AY 2026-27’s belated window is still open | File under section 139(4). | Use 31 December 2026 or assessment completion, whichever is earlier; calculate fee and interest. |
| You filed, then found omitted interest income | Consider a revised return. | For AY 2026-27, a revision after 31 December 2026 through 31 March 2027 attracts the stated section 234I fee. |
| You want to disclose additional income after the normal period | Screen for ITR-U. | It cannot create a refund, increase a refund, reduce tax or report a loss, and additional tax applies. |
| You missed the deadline and need to carry forward a qualifying loss | Check whether the loss rule requires a timely return; if genuine hardship exists, examine condonation. | The Department says a belated AY 2024-25 loss return failing sections 139(3) and 80 cannot carry the loss forward. |
| You seek a late refund because of circumstances beyond your control | Consider a section 119(2)(b) condonation request. | Approval is discretionary and must precede the special filing route. |
Errors that make a late filing harder to fix
- Using the wrong AY. A deadline from AY 2026-27 cannot be carried over to another year.
- Confusing a belated and revised return. The former is for a return not previously filed; the latter corrects an existing filing.
- Treating ITR-U as a refund route. Its statutory exclusions generally prevent a new or larger refund.
- Ignoring loss conditions. Missing a timely-return requirement can block carry-forward even when the loss itself is genuine.
- Assuming an application equals approval. A condonation request has no automatic effect until the competent authority issues an order.
- Relying on old fee tables. Fees and additional-tax calculations are tied to the AY and current instructions.
- Failing to reconcile information statements. Differences between your return, Form 26AS and AIS can lead to notices or processing adjustments.
What to retain after filing
Save the submitted return, acknowledgement, computation, payment challans and the records used to reconcile income and tax credits. Keep any revised-return acknowledgement, ITR-U computation or condonation order with its DIN. These records make it easier to answer a notice and demonstrate why a figure, refund or loss claim was reported.
The Income Tax Department’s portal and the governing law should be checked again immediately before filing because deadlines, forms and statutory conditions can change. This is general information, not individualized tax advice; a tax professional can assess whether your facts satisfy a loss, refund, revision, ITR-U or condonation condition.
