In India, an NBFC instalment that has not reached the lender by its contractual due date is overdue. The lender may apply disclosed, reasonable penal charges and contractual interest on unpaid dues, but Reserve Bank of India (RBI) rules prohibit adding a separate “penal interest” rate or charging further interest on the penal charge itself. One missed instalment does not automatically make a term loan a non-performing asset (NPA); the relevant NBFC threshold is more than 90 days overdue.
Pay what you can through an official channel, ask the NBFC for an itemised amount, and get any revised arrangement in writing. The exact late fee, payment-return charge, reporting date and recovery steps depend on your agreement, product and lender policy.

What happens if I miss my NBFC loan EMI?
The EMI becomes overdue when the scheduled amount has not been received by the contractual due date. A failed automatic debit can leave the instalment unpaid even if you expected the bank to retry it, so check both your bank statement and the NBFC’s loan account.

After the missed payment, the NBFC can contact you and apply charges that are authorised by the loan contract and its board-approved policy. Contracted interest can continue on the unpaid amount until the account is brought up to date. The lender may also report repayment information to a credit information company, but there is no single RBI timetable or guaranteed score impact for every NBFC and borrower.

| Point in time | What may occur | What you should do |
|---|---|---|
| Contractual due date | If the scheduled amount has not been received, the instalment is overdue. | Confirm whether the debit failed, was rejected or is still pending; check the loan ledger and bank statement. |
| After the missed payment | The NBFC may contact you, apply disclosed charges and continue contracted interest on unpaid dues. | Request a written, itemised amount and pay through an official channel as soon as feasible. |
| Before 90 days overdue | Arrears, collection activity and possible credit reporting can occur even though the account is not yet an NPA under the applicable term-loan threshold. | Do not treat the threshold as a grace period; agree a documented remedy promptly. |
| More than 90 days overdue | An NBFC term loan reaches the RBI’s relevant NPA classification threshold. | Seek urgent written repayment or restructuring advice and preserve all records. |
For a secured loan, later enforcement or repossession depends on the security, contract, applicable law and required procedure. RBI’s longstanding fair-practices guidance specifically says vehicle-loan contracts should state notice and sale procedures for repossession; that vehicle guidance should not be assumed to govern every type of collateral.
Can an NBFC charge a late fee or “penal interest”?
RBI’s Fair Lending Practice—Penal Charges in Loan Accounts circular dated August 18, 2023 applies to NBFCs among other regulated entities. It requires a penalty for breach of a material loan term to be treated as a penal charge, not as an extra rate of interest added to the loan. The policy must be approved by the lender’s board, and the amount must be reasonable and commensurate with the borrower’s non-compliance.
What a disclosed penal charge can cover
- Default in repayment is a breach of a material repayment term, so a penal charge may be levied on the amount in default when the contract and the lender’s policy allow it.
- The charge, its trigger and its reason must be disclosed in the loan agreement and in the applicable Key Facts Statement (KFS) or equivalent key-terms material.
- For an individual borrowing for a non-business purpose, the penal charge cannot exceed the charge imposed on comparable non-individual borrowers for similar non-compliance.
- A separate payment-return or “bounce” fee may apply if the contract discloses it. Its amount and trigger are lender- and product-specific.
What the RBI rule prohibits
- The NBFC cannot add a penal percentage to the contracted interest rate and label the result “penal interest.”
- The penal charge cannot be capitalised so that further interest is calculated on that charge.
- The rule does not freeze the underlying debt. Ordinary interest on unpaid principal, and interest on unpaid interest where the contract permits it, may continue at the contracted rate until remediation; it cannot be converted into a penal rate.
The RBI’s stated purpose is credit discipline, not revenue enhancement: “The intent of levying penal interest/charges is essentially to inculcate a sense of credit discipline and such charges are not meant to be used as a revenue enhancement tool over and above the contracted rate of interest.”

There is no universal RBI late-fee figure. Do not rely on a generic online estimate. Check the sanction letter, loan agreement, repayment schedule and KFS, then ask the NBFC for a calculation showing the overdue EMI, contracted interest, penal charge and any return fee separately.
Will one missed EMI make my loan an NPA?
No. For an NBFC term loan, the RBI threshold is more than 90 days overdue. That is a regulatory classification point, not a free 90-day window. Collection contact, contractual charges, credit-file updates and other remedies can arise well before it.
Credit reporting is account-specific. The available RBI material does not establish one reporting day for every NBFC or a fixed number of credit-score points for one missed instalment. The lender, the credit information company and your previous repayment record affect both timing and impact. Keep making subsequent instalments on time even while you resolve the arrear.

How to avoid extra charges before the due date
- Check the exact amount and date. Use the NBFC app, statement or repayment schedule, including any changed interest or insurance component shown there.
- Keep the linked account funded. Leave sufficient balance ahead of an automatic debit and confirm that the mandate, account number and bank details remain active. This reduces preventable failures but cannot guarantee that bank or lender processing will be error-free.
- Use an official payment route. Save the confirmation, transaction reference and updated loan ledger rather than relying on a screenshot of an uncompleted attempt.
- Contact the NBFC before a likely shortfall. Explain when funds will be available and ask whether a permitted revised date or other arrangement exists. Request written confirmation of any effect on charges, the next due date and credit reporting; a verbal promise does not amend the contract.
What to do immediately after an EMI fails
- Verify the status. Determine whether the debit was rejected, is awaiting settlement, or was accepted but not reflected. Ask whether the lender will retry it or requires a manual payment.
- Request an itemised demand. Ask for separate figures for the missed EMI, contracted interest, penal charge, payment-return charge and any other disclosed amount, plus the date through which each figure is calculated.
- Pay through the NBFC’s official channel. Confirm that the payment is credited to the correct loan account. Retain the receipt, bank statement and updated account statement.
- Check the next instalment. A catch-up payment may not automatically cover the next EMI. Ask for the exact amount and date needed to avoid a second default.
- Challenge an incorrect fee in writing. Compare the charge with the agreement and KFS, ask for the calculation to be corrected, and keep the complaint reference.
What if I cannot pay this month?
Tell the NBFC before the due date or as soon as you know the payment will fail. Ask about rescheduling, a tenure extension, a permitted date change or another contractual option. Compare the total rupee cost, not merely the lower immediate EMI:

- contracted interest over the revised tenure;
- each disclosed processing, penal or payment-return charge;
- the date a payment must clear and whether a failed debit creates a separate fee;
- the resulting next due date, tenure and total repayment; and
- the lender’s written confirmation and grievance route.
Do not stop paying without an agreed arrangement, and do not take a high-cost loan to cover the EMI until you have compared its total cost with the NBFC’s documented options. For EMI-based floating-rate personal loans, RBI instructions require communications and options around interest-rate resets, including choices involving EMI, tenor and prepayment, subject to the applicable instructions. Those reset options are not an automatic right to restructure every missed fixed-rate EMI.
Can recovery agents call or visit me?
Collection contact after an overdue payment is not automatically unlawful. RBI’s NBFC Fair Practices Code says lenders should not use undue harassment, repeatedly bother borrowers at odd hours or use muscle power, and expects staff and agents to behave appropriately. NBFCs should also maintain an internal grievance-redress mechanism. Detailed provisions can change, so rely on the current directions and the lender’s published complaint process for your case.

Keep a dated log of calls, messages and visits, including the caller’s name, agency, number, time and what was said. Save payment receipts and complaint references. If conduct becomes threatening or abusive, make a written complaint to the NBFC’s grievance-redress officer, describe the conduct and state the remedy you seek. Do not assume that every visit is prohibited, and do not promise yourself a particular compensation or complaint outcome.

- Locate the relevant clause in the loan agreement, sanction letter and KFS.
- Ask the NBFC to identify the clause, policy trigger and calculation for each amount.
- Check that a penal charge has not been added to the interest rate and that no further interest is being calculated on the penal charge.
- Send supporting bank records if the debit failed because of a lender or mandate error.
- Escalate through the NBFC’s grievance mechanism if the first response does not resolve the issue, retaining the complaint number and correspondence.
Special note for NBFC-MFI borrowers
Microfinance borrowers should read the current product documents and rules that apply to their particular loan. A 2012 RBI Fair Practices Code circular contained a microfinance provision that the agreement should disclose that no penalty is charged for delayed payment. That is legacy guidance and should not be generalised to every NBFC product or treated as the complete current microfinance rulebook. Ask the NBFC to identify the current clause governing your account.

Does contacting the NBFC erase the overdue status?
No. Early contact can help you obtain an arrangement, but the instalment remains overdue until the lender receives and credits the required payment or formally changes the terms in writing.

Is a “bounce charge” the same as a penal charge?
Not necessarily. A return fee can be a separate contractually disclosed amount linked to a failed payment instruction. Ask for each fee to be identified and calculated separately.
Can I rely on a collection agent’s verbal promise?
No. Ask the NBFC itself for written confirmation of any revised date, waiver, settlement, reporting treatment or change to the next instalment.
