If you knowingly tell a lender that you will live in a property as your primary residence or use it as a second home when you actually intend to rent it out, the statement can be treated as mortgage fraud. Federal law may impose criminal exposure when a knowingly false statement is made to influence a covered lender. The statutory ceiling under 18 U.S.C. § 1014 is a fine of up to $1 million, imprisonment of up to 30 years, or both. Those are maximums, not automatic sentences.
An inaccurate answer is not automatically a crime. Prosecutors generally must prove the required elements, including that the statement was false, made knowingly, and intended to influence the lender. A genuine change in plans after closing is different from lying when you apply, although your note, occupancy agreement, insurer requirements, and state law still control what happens next.

Why occupancy matters to a mortgage lender
Occupancy is the lender’s understanding of how you will use the property: as a primary residence, a second home, or an investment property. Those categories appear in applications, occupancy affidavits, riders, closing certifications, and sometimes later documents. The exact definition and underwriting treatment come from the particular loan program and documents; a label that sounds ordinary in conversation may have a precise contractual meaning.

A borrower who lives in a home is generally assessed differently from a borrower acquiring a property primarily to rent to others. The occupancy representation can therefore affect approval, required documentation, interest rate, down payment, reserves, mortgage insurance, and other terms. Whether a difference is “material” depends on the facts and the transaction, not merely on the fact that the property was later rented.

| Representation | What the label concerns | What controls the legal meaning |
|---|---|---|
| Primary residence | The borrower states that the property will be the principal home. | The signed application, occupancy certification, note, rider, loan program and applicable law. |
| Second home | The borrower states that the property is intended for personal use as an additional home rather than primarily as a rental investment. | The actual second-home provisions and certifications in the loan file. |
| Investment property | The property is acquired or used primarily to generate rental or investment returns. | The lender’s investment-property terms, underwriting rules and contract language. |
Do not assume that continuing to make mortgage payments cures a false statement made at application. Payment history and the truthfulness of the original certification are separate issues.
When a false occupancy statement can become a federal offense
Section 1014 of Title 18 of the United States Code covers knowingly making a false statement or report for the purpose of influencing specified financial institutions, mortgage lending businesses, or entities making federally related mortgage loans, in connection with a loan application or related transaction. The current statutory text provides for a fine of not more than $1,000,000, imprisonment of not more than 30 years, or both. Congress’s maximum is a legal ceiling, not a prediction of what any particular defendant will receive.
A prosecutor would need to establish the elements required by the statute and the surrounding case law. In practical terms, investigators would look at what you said, what you believed when you said it, where and when you signed it, and whether the statement was intended to influence the lender. The word “knowingly” is important: an innocent misunderstanding, clerical error, or later change in circumstances is not automatically equivalent to intentional deception.

| Did you know it was false? | Section 1014 is directed at knowing conduct, not every mistake. |
| Was it made to influence a covered lender? | The statute requires the purpose of influencing an institution in a covered loan transaction. |
| Was the statement material to the transaction? | The surrounding facts can show whether the representation affected approval, pricing or other terms. |
| What documents and communications corroborate the story? | Applications, riders, emails, leases, listings, move records and payment information may be compared. |
Other federal or state charges might be considered in a particular scheme, but no single list applies to every case. Tax, insurance, mail, wire, conspiracy, or state-fraud theories require separate analysis of the jurisdiction and evidence. The federal statute cited above should not be treated as a forecast that any one of those charges will be filed.

Intentional misrepresentation versus a genuine change of plans
You intended to occupy the property when you applied
Suppose you honestly planned to move into the home, signed a primary-residence certification, and then your employer canceled a relocation or a family emergency changed your plans. That timeline is materially different from buying the property as a rental while representing from the outset that you would live there. A later change does not erase the need to read the loan documents, but it may be significant evidence about intent.
You planned to rent it from the beginning
If you never intended to occupy the property and used a primary-residence or second-home designation to obtain terms reserved for those uses, the statement is more likely to be viewed as deliberate and material. The government could use contemporaneous evidence such as an existing lease, advertisements, property-management arrangements, another established residence, or messages describing the purchase as an investment. None of those facts is conclusive alone; their meaning depends on the complete record.
Your use changed after closing
“What if my plans changed after closing?” Start with the date and terms of the occupancy promise. Some documents require occupancy within a stated period or for a stated duration; others address notice, leasing, insurance, or default consequences. A lease signed months later may be consistent with an unforeseen change, or it may be evidence that the original promise was never genuine. The distinction is factual and document-specific.

- A lender could ask for an explanation or supporting documents.
- It could review whether the loan terms, insurance, or eligibility depended on the occupancy representation.
- Depending on the contract and facts, it might assert a default, seek repayment, accelerate the debt, or begin foreclosure proceedings.
- An insurer, guarantor, or government program could evaluate eligibility or coverage under its own rules.
- The matter could be referred to law-enforcement agencies, although referral and prosecution are not inevitable.
These are possibilities, not automatic consequences. A payment that is current does not guarantee that a lender will ignore a disputed certification, and a past inconsistency does not prove that acceleration or foreclosure is authorized. Only the governing documents, applicable law, and the lender’s actual action can answer that question for a particular loan.
What federal cases show about occupancy allegations
California conviction reported by the Justice Department
A 2016 release from the U.S. Attorney’s Office for the Central District of California described a jury conviction for false statements to banks. The defendant represented in mortgage applications and occupancy certifications that condominiums would be primary residences even though, according to the government’s case, she never intended to live in them. The loans later defaulted, the properties went into foreclosure, and lenders incurred losses in that case.
Those events describe the history of that prosecution; they do not establish that every inaccurate occupancy statement leads to default, foreclosure, or a conviction. The release quoted Eileen M. Decker, then U.S. Attorney for the Central District of California: “The Department of Justice will continue to hold accountable those who would commit mortgage fraud and place U.S. financial institutions at risk.”
Eastern District of Virginia indictment filed in 2025
An indictment filed on October 9, 2025, in the Eastern District of Virginia alleged that a borrower signed a second-home rider while using the property as a rental investment property. It further alleged that the claimed occupancy produced more favorable loan terms. An indictment is an accusation, not proof; it does not establish that the defendant committed the conduct or that the alleged terms difference is typical of the market.

New Jersey convictions reported in 2026
The Justice Department reported that two defendants were convicted in January 2026 of mortgage-fraud-related offenses involving false statements in documents connected with a short sale. The release said that one borrower falsely represented an intention to occupy the property as a primary residence. The release listed maximum potential penalties for the counts, but those ceilings are not individualized likely sentences and should not be read as a sentencing forecast for another borrower.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Is it mortgage fraud if you rent out a home you said you would live in?
It can be, if the evidence shows that you knowingly made the occupancy statement to influence the lender and that the representation was material to the transaction. Renting the home is an important fact, but it does not answer the intent question by itself. A borrower who moved in as promised and later became a landlord presents a different factual pattern from a borrower who arranged a tenant before closing and never planned to occupy the property.
Review the exact wording of every certification. “Primary residence,” “second home,” and “investment property” are not interchangeable, and a lender may rely on a separate occupancy affidavit even when the application uses a shorter label. Do not rewrite history in a later explanation; preserve the timeline and obtain advice before making additional statements if the issue is disputed.
What to do if you discover a problem
- Stop guessing about the documents. Gather the complete application, amendments, closing disclosure, promissory note, mortgage or deed of trust, occupancy rider, certifications, loan-program notices, insurance correspondence, and any later lender communications.
- Build a dated timeline. Record when you decided to buy, where you lived, when you expected to move, when circumstances changed, and when any lease, listing, or property-management agreement began.
- Preserve original evidence. Keep emails, texts, relocation letters, medical or family records, travel and move records, and rental documents in their original form. Do not delete or alter messages.
- Separate facts from conclusions. Write down what happened and what you believed at each stage; avoid labeling yourself a “fraud” or asserting a legal defense before counsel reviews the file.
- Consult a qualified attorney. A lawyer experienced in mortgage or white-collar matters can assess federal exposure, state law, contract remedies, privilege, and how to respond to a lender, investigator, insurer, or prosecutor. This is general prudential guidance, not a guarantee of a particular outcome.
- Meet ongoing obligations. Continue to follow the loan and insurance documents unless counsel advises otherwise. Do not submit a new certification that repeats an inaccurate statement.
Questions that commonly change the analysis
Does a single wrong box on an application always lead to prosecution?
No. The federal statute requires knowing conduct and a purpose to influence a covered institution. Prosecutorial decisions also depend on evidence, materiality, the broader transaction, and enforcement priorities. An inconsistency alone does not establish guilt.

Can the lender demand the entire balance immediately?
That depends on the note, mortgage, occupancy rider, applicable servicing and program rules, state law, and the lender’s determination. The general possibility of acceleration should not be presented as an inevitable result of a disputed occupancy statement.
Does refinancing or selling the property eliminate the issue?
Not necessarily. A later transaction may change the lender involved, but it does not retroactively determine what you intended when you signed the original documents. Keep the original file and obtain advice before making representations in a refinance or sale.
Are these rules the same in every state?
No. The federal statute applies nationally within its terms, while contract remedies, foreclosure procedure, disclosure duties, limitation periods, and state offenses vary. The examples above are federal cases and should not be treated as a state-by-state rulebook.
Bottom line
Knowingly misrepresenting occupancy to obtain mortgage financing can expose a borrower to serious consequences, including prosecution under 18 U.S.C. § 1014 with a statutory maximum of up to $1 million and 30 years in prison. Those maximums are not automatic, and an honest mistake or genuine post-closing change is not the same as intentional deception. The decisive questions are what you intended when you signed, whether the statement was material and made to influence a covered lender, what the loan documents provide, and what the evidence can prove.
