Holding or using two Permanent Account Numbers (PANs) can create an identity and tax-record conflict. The Income Tax Department has acknowledged that duplicate PAN allotments occur, but the official material available here does not establish one current penalty amount or a complete, universal surrender procedure.
If you suspect you have two PANs, do not apply for another one or guess which record to cancel. Verify both records, identify whether the problem is duplicate allotment or an Aadhaar-linkage error, and use the Income Tax Department’s current correction route, including your jurisdictional Assessing Officer where instructed.

What “two PANs” can mean
A PAN is intended to identify one taxpayer in the Income Tax Department’s records. “Having two PANs” can describe several different situations:
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →- Two PAN numbers were allotted to the same individual.
- A person received a PAN and later applied again, perhaps believing the first card was lost or inactive.
- Aadhaar was linked to the wrong PAN, making two records appear connected to one person.
- One PAN record was duplicated or incorrectly associated in the Department’s database.
- Two different people were associated with the same PAN, which CBDT has also identified as a database problem.
These situations do not automatically have identical consequences. A duplicate allotment is a record-duplication issue; an incorrect Aadhaar link is a correction issue; and an inoperative PAN caused by Aadhaar non-compliance is a separate status under the linkage rules.

Has the Income Tax Department confirmed that duplicate PANs occur?
Yes. CBDT Circular No. 7 of 2022 acknowledges instances in which multiple PANs were allotted to one person and instances in which one PAN was allotted to more than one person. The circular describes a de-duplication objective for the PAN database. That acknowledgment matters because a second PAN is not proof, by itself, that the taxpayer deliberately created a false identity.
However, Circular No. 7 of 2022 does not, in the material reviewed for this article, set out a single current penalty that applies to every person who holds or uses two PANs. It also does not provide a complete decision tree for distinguishing an accidental duplicate from deliberate use intended to mislead. Those facts depend on the records and conduct in the individual case.
What can happen if you hold or use both PANs?
Your tax records may split across two identities
Income, tax deducted at source, advance-tax payments, refunds, notices and filed returns may be associated with different PANs. That can make the Department’s view of your income and tax credits incomplete or inconsistent. A return filed with one number may not automatically reconcile with tax deducted or reported under the other.

Banks, employers, brokers, registrars and other reporting entities use PAN details for reporting and withholding. If you give different PANs to different institutions, information can be divided between records. Correcting the resulting mismatch may require documentary evidence and communication with the Department and the reporting institution.

Future applications can be rejected or create another conflict
The Department’s Instant e-PAN FAQ says the service is for an individual who has not already been allotted a PAN. A person who already has a PAN is ineligible. Applying for another PAN through that service when you already have one can therefore create an avoidable problem rather than solve an existing duplicate.
Any deliberate misuse can be assessed on its own facts
Using one number to conceal income, evade reporting or mislead an authority is materially different from receiving a duplicate number through an administrative error. The official material reviewed here does not establish a universal penalty amount for either situation. Do not rely on an unverified fine figure circulated online; obtain fact-specific tax advice if both numbers have been used intentionally or in conflicting filings.
Duplicate PAN, incorrect Aadhaar link and inoperative PAN: the essential distinction
The following comparison prevents a common mistake: applying the consequences of one problem to another.
| Situation | What the official material establishes | Appropriate focus |
|---|---|---|
| Duplicate allotment | CBDT Circular No. 7 of 2022 acknowledges multiple PANs for one person and a de-duplication objective. The exact current penalty and complete surrender process are not stated in that material. | Verify both records and follow the Department’s current duplicate-record resolution instructions. |
| Incorrect Aadhaar linked to a PAN | The Income Tax Department’s Link Aadhaar help material says a taxpayer may need to contact the jurisdictional Assessing Officer and request delinking of Aadhaar from an incorrect PAN. | Confirm which PAN is correct before requesting delinking or linking changes. |
| PAN inoperative because Aadhaar was not intimated where required | CBDT Circular No. 3 of 2023 describes refund, interest and withholding consequences and says a ₹1,000 fee continues to apply to make the PAN operative by intimating Aadhaar. | Check whether the linkage requirement applies and use the current Aadhaar-intimation process. This is not the stated penalty for holding two PANs. |
What to do if you think you have two PANs
1. Stop creating another record
Do not submit a fresh PAN application simply because you cannot find a card, because a portal rejects a number, or because you believe an old PAN is inactive. First establish whether a PAN has already been allotted. Existing PAN holders are not eligible for Instant e-PAN.

2. Verify the numbers and the name details
Collect every PAN card, allotment message, e-PAN PDF and tax document in your possession. Compare the PAN number, name, date of birth and other identifying details. Check the number used on recent income-tax returns, Form 26AS or other tax-credit records, employer statements and financial accounts. Keep copies of the evidence rather than discarding an apparently duplicate card.
3. Check whether the issue is actually Aadhaar linkage
Use the Income Tax Department’s e-filing facilities to review PAN-Aadhaar linkage status. The Department’s help material treats linkage correction as a separate process and explains that Aadhaar may need to be delinked from an incorrect PAN. Do not request delinking merely because two PANs exist; first determine which record is accurate and which number appears in your tax history.
4. Identify the jurisdictional Assessing Officer when the help material directs you there
The Link Aadhaar manual says a taxpayer may need to contact the jurisdictional Assessing Officer to submit a request to delink Aadhaar from an incorrect PAN. Use the current e-filing instructions to identify the correct jurisdiction and the documents currently requested. Requirements can change, so rely on the live Department guidance rather than an old form, checklist or social-media post.
5. Ask the Department for the current duplicate-resolution route
The available official material confirms the de-duplication objective but does not establish a complete, current surrender procedure for every duplicate case. Ask the Income Tax Department which PAN should remain active in your record, how the duplicate should be marked or surrendered, and how returns, tax credits and outstanding proceedings will be mapped. Obtain an acknowledgement or reference number for every submission.

6. Reconcile past filings and third-party records
Prepare a timeline showing which PAN appeared on each return, employer certificate, investment account, bank record, property transaction and tax payment. If the Department or a reporting institution asks for clarification, provide the timeline and supporting documents. Where tax was deducted or paid under the other PAN, ask how the credit should be corrected before filing an amended or subsequent return.

The general linkage requirement described in the Department FAQ covers individuals who were allotted a PAN by 1 July 2017 and are eligible to obtain Aadhaar. The FAQ lists exceptions that include specified residents outside the general requirement, non-residents under the Income-tax Act, individuals aged 80 or more during the previous year, and people who are not Indian citizens. The Department also warns that later government notifications can modify the exceptions, so check current applicability rather than assuming an exemption.
Where the linkage requirement applies and Aadhaar has not been intimated, Circular No. 3 of 2023 describes a PAN becoming inoperative. Its listed effects include a hold on tax refunds, no interest on the refund for the specified period, and higher rates of tax deduction or collection. The circular says a ₹1,000 fee continues to apply to make the PAN operative by intimating Aadhaar.

Those consequences concern inoperative status under the Aadhaar rules. They should not be presented as the penalty for holding or using two PANs. A duplicate PAN can exist even when Aadhaar is correctly linked, and a single PAN can become inoperative without any duplicate record.

If you have already used both PANs
Do not erase the history or quietly switch numbers. Preserve returns, notices, payment challans, tax-credit statements, employer records and correspondence showing when each PAN was used. Make a written inventory of discrepancies: duplicate returns, missing tax credits, refunds issued or claimed, and transactions reported under different numbers.
Then raise the issue through the Department’s current official channel and explain whether the second PAN was accidental, issued without your knowledge, or used in a particular transaction. If the two numbers appear on conflicting returns or were used to obtain a tax advantage, consult a qualified tax professional before submitting a correction. The official sources available here do not establish a standard penalty or a guaranteed processing time, so a professional can help assess disclosure and filing choices without relying on an unsupported amount.
What not to do
- Do not apply for Instant e-PAN when a PAN has already been allotted to you.
- Do not assume that an inoperative PAN is the same thing as a duplicate PAN.
- Do not choose a PAN to retain solely because its card is newer or its number is easier to remember.
- Do not request Aadhaar delinking before confirming which PAN is correct.
- Do not quote or pay an online “duplicate PAN fine” unless the Department’s current instruction or a qualified adviser confirms that it applies to your facts.
- Do not omit a duplicate PAN from a response to a Department notice; explain the record conflict and provide supporting documents.
When to get professional help
Professional advice is especially valuable when both PANs appear on filed returns, one number is connected to substantial tax deducted at source, a refund is pending, a notice has been issued, or the duplicate was used in a transaction that changes tax liability. Ask the adviser to work from the Department’s current records and to document which correction or representation was made. For a simple suspected duplicate with no conflicting use, you can begin by verifying the records and contacting the Department through its current official process.
Bottom line
Two PANs should be treated as a record-correction problem requiring prompt verification, not as permission to keep using whichever number is convenient. The Department acknowledges that duplicate allotments occur, but the official material available here does not support a single current penalty figure or a universal surrender checklist. Separate duplicate allotment from Aadhaar-linkage errors and inoperative status, avoid applying for another PAN, and obtain the Department’s current instructions before deciding which record should remain in use.
