Missing the statutory deadline to reinvest a property gain, or to use money placed in the Capital Gains Account Scheme (CGAS), can make some or all of the capital gain taxable. The result is not identical for every NRI: it depends on the exemption section, transfer date, replacement-property activity, CGAS deposit and withdrawal dates, the tax year in which a condition is breached, and whether the return was filed and verified.
A late or updated income-tax return is a separate issue. Filing one may provide a reporting route, but it does not by itself cure a missed investment or use condition.

Why the deadline matters
Capital-gains relief for reinvesting proceeds is conditional. An exemption claimed under a provision such as the former Sections 54, 54B or 54F structure depends on satisfying the purchase, construction, use and holding conditions attached to that provision. If the required event does not occur within the applicable statutory period, the amount that was intended to be exempt may become taxable, either immediately through a denied claim or later when a condition is breached.

There is no single “NRI reinvestment deadline.” The relevant clock is determined by the section claimed and the facts of the sale. A defensible answer requires the transfer date, the kind of property sold, the capital gain, the exemption section, purchase or construction dates for the replacement asset, CGAS deposit and utilisation dates, and the return and tax-payment history.

The four situations that are often confused
| Situation | What the outcome turns on | How to think about it |
|---|---|---|
| No eligible replacement asset acquired within the applicable period | The exemption section, the statutory purchase or construction condition, and the transfer and acquisition dates | The intended exemption may be unavailable for the amount that did not satisfy the condition. The available guidance does not establish one automatic result for every section or sale. |
| Gain deposited in CGAS on time but left unused | Whether the deposit qualified, when it was made, the prescribed use period and the year that period expires | For the official transition example, the unutilised amount becomes taxable when the prescribed period expires. |
| Replacement house sold during a lock-in period | The condition breached by the later sale and the tax year of that breach | This is different from leaving CGAS funds unused. The transition FAQ treats the earlier exempt amount as income in the year of violation for specified old-Act exemptions. |
| Investment made on time but return filed late or left unverified | Return-filing and verification rules for the relevant tax year | The investment clock and the filing clock are separate. A belated or updated return is not proof that the investment condition was met. |
What happens when CGAS money is not used
The clearest official rule concerns a defined transition case. The Income Tax Department states: “If an assessee deposited unutilised capital gains in the Capital Gains Account Scheme under the Income Tax Act, 1961 before 1 April 2026, such deposit continues to be governed by the conditions of the old Act.”
In the Department’s example, an assessee transfers property in June 2024, deposits the unutilised gain in CGAS, and still has money unused when the prescribed three-year use period ends in June 2027. The remaining amount is taxed in Tax Year 2027–28. Because that tax year begins after 1 April 2026, the Income-tax Act, 2025 governs the later-year consequence, while the old exemption structure determines the trigger and amount.
The practical sequence is:
- Identify the transfer date and the exemption provision used.
- Confirm that the CGAS deposit was made in the manner and by the time required for that provision.
- Calculate the end of the prescribed utilisation period; in the official example, the period is three years.
- Determine the balance still unutilised on that date.
- Report the consequence in the tax year in which the period expires, applying the transition rule that governs that year.
This example is deliberately narrow. It should not be expanded into a claim that every CGAS balance, every sale, or every exemption is taxed on the same date. A professional reviewing the case must match the account type, deposit documentation, withdrawals and section-specific conditions to the relevant year.

How the 1 April 2026 transition affects an old claim
The change in law does not erase the conditions attached to an earlier claim. For qualifying CGAS deposits made under the Income-tax Act, 1961 before 1 April 2026, the old Act’s conditions continue to govern the deposit. If the prescribed period expires in a later tax year, the new Act can govern the way that later-year income is dealt with.
The transition FAQ also addresses a different kind of failure. Where an exemption under old-Act Sections 54, 54B or 54F is subject to a condition that is breached on or after 1 April 2026, Section 536(2)(h) of the Income-tax Act, 2025 treats the amount previously exempted as income in the year of the violation. The Department’s example concerns selling the replacement house inside its lock-in period. That is not the same event as leaving a CGAS balance unused, so the two consequences should not be combined.
For a sale, deposit or later breach close to the transition date, record the dates precisely. “Before 1 April 2026” and “on or after 1 April 2026” can place the same economic transaction under different consequence rules.

Can an NRI still claim Section 54 after missing the deadline?
There is no reliable blanket answer of “yes” or “no” without the section, dates and documents. Section 54 relief is conditional; missing the applicable purchase, construction or utilisation condition can leave the relevant gain taxable. A later purchase does not automatically prove that the original statutory timing requirement was satisfied, and a late return does not rewrite the acquisition date.

Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Start by separating three questions:
- Was the replacement asset acquired or constructed within the period required by the section?
- If the gain was not immediately used, was the eligible amount deposited in CGAS in time and in the required form?
- Has a later event, such as sale of the replacement house during a lock-in period, breached a separate condition?
If the answer to the first question is no and there was no qualifying CGAS route, the intended exemption may fail for the amount that did not meet the condition. If the second answer is yes but the balance remained unused, the expiry-year rule described above becomes relevant. If the third answer is yes, the tax year of that later violation may control the inclusion of the previously exempt amount.
Why filing deadlines are a separate problem
An NRI can meet an investment condition and still have a return problem, or miss the investment condition while filing a return on time. These are separate clocks.

The Income Tax Department’s return FAQs describe belated-return and updated-return routes, with time limits and conditions that depend on the tax year and the governing Act. An updated return cannot reduce total tax liability or increase a refund. Therefore, it is not a mechanism for converting an otherwise taxable gain into an exempt one, and the official guidance does not say that filing late cures a missed investment condition.
Where an investment was made on time, preserve proof of the purchase or construction date, payment trail, CGAS account and withdrawals, and return verification. Where the investment was late or never made, a belated or updated return may still be relevant for reporting and payment, but it should not be presented as evidence that the exemption conditions were fulfilled.

NRI status creates additional residence, withholding and reporting questions; it does not automatically excuse a property seller from filing. The Department’s historical guidance on former Section 115G is narrow. It described filing relief in limited circumstances for an NRI whose income consisted only of specified investment income or long-term capital gains and whose tax was deducted at source. That rule is not a blanket filing exemption for every NRI who sells Indian property.

A property sale can involve capital gains, interest, rental income, other Indian-source income, withholding credits and a tax balance. Determine the filing position from the complete income profile and the law for the relevant tax year rather than from NRI status alone.
What to do after discovering a missed deadline
- Freeze the timeline. Write down the sale deed date, receipt dates, the date the gain was deposited into CGAS, every withdrawal or transfer, the replacement-property agreement and registration dates, and any later sale of that property.
- Identify the exact exemption. Note whether the original claim referred to Section 54, 54B, 54F or another provision. Do not substitute one section’s timing rule for another’s.
- Reconcile the money. Match the capital-gain computation to the CGAS opening balance, interest, withdrawals and closing balance. The amount left unused at the end of the prescribed period is the critical figure in the official CGAS example.
- Pin the transition date. Check whether the deposit or the later breach occurred before 1 April 2026 or on or after that date. That determines which transition consequence must be considered.
- Check the return record. Keep the original return acknowledgment, verification status, any belated or updated return acknowledgment, tax deducted at source certificates and challans. Filing status does not establish investment compliance, but it affects how the resulting income and tax are reported.
- Calculate before filing a correction. Quantify the gain, the amount previously claimed as exempt, the amount potentially taxable and interest or other consequences under the applicable year’s rules. Do not assume that an updated return can create a refund or lower an already determined liability.
- Obtain a case-specific review. Give an Indian tax professional the sale deed, cost and improvement records, CGAS statements, reinvestment invoices and registration documents, and all return acknowledgments. Ask for a written conclusion identifying the section, deadline, breach year and reporting route.
Records that determine the answer
- Sale deed and transfer date, including evidence of when consideration was received.
- Original purchase deed, improvement invoices and the capital-gain working paper.
- The exemption section cited in the return and the amount claimed.
- CGAS account-opening form, deposit receipt, account statements, withdrawal applications and proof of payments for the replacement asset.
- Agreement, registration and possession records for the replacement property.
- Documents showing any subsequent sale or transfer of that property.
- Income-tax return acknowledgments, verification records, tax-deduction certificates and payment challans.
Questions a professional should answer in writing
- Which tax year includes the original transfer and which tax year includes any later breach?
- Was the deposit eligible under the section claimed, and was it made before the applicable deadline?
- What amount remained unutilised when the prescribed period expired?
- Does the 1 April 2026 transition alter the year or mechanism of taxation?
- Is the consequence a denied exemption in the transfer year, income inclusion in a later violation year, or another statutory adjustment?
- Which return—original, belated or updated—can report the result, and what tax must be paid?
Bottom line for an NRI seller
Missing a reinvestment or use deadline can expose the unqualified portion of the capital gain to tax, but the amount and year depend on the exemption section and the exact timeline. For the official transition example, a qualifying pre-1 April 2026 CGAS deposit that remains unused after its prescribed three-year period is taxed in the year that period expires. A later lock-in breach is a separate event, and a late or updated return does not cure either failure. Assemble the dates and records first, then have the applicable Indian tax rules reviewed for that specific sale.
