What Happens During an ITAT Hearing and How to Prepare

An Income Tax Appellate Tribunal (ITAT) hearing is an appellate tax proceeding in which a Tribunal bench considers the appeal, questions the parties or their authorised representatives, and decides the issues on the record and under the applicable directions. Your most important preparation is to follow the hearing notice, know the challenged orders and grounds, organise a compliant paper book, separate any proposed additional evidence, and ensure someone attends when the case is called.

What an ITAT hearing is

The ITAT hears appeals arising from income-tax proceedings. It fixes the hearing date and place, or gives other attendance instructions, and notifies the parties. The notice for your appeal controls the practical details: the listed case number, bench, date, location, reporting or appearance instructions, and any filing directions.

A hearing is not the same as an automatic decision in favour of the party that filed the appeal. The Tribunal considers the appeal in accordance with the grounds, the orders under challenge, the evidence properly before it, and the parties’ submissions. If the matter is adjourned, it is taken up later; an adjournment does not decide the appeal.

Who hears the appeal

The ITAT is constituted in benches. A typical bench has one judicial member and one accountant member. Section 255 of the Income-tax Act also permits statutory exceptions, including single-member disposal in specified circumstances and special benches for particular matters. Do not assume that every appeal will be heard by the same combination of members: check the listing and hearing notice for the bench assigned to your case.

What happens when your case is called

The bench identifies the matter

When the appeal is called, the appellant or its authorised representative should be ready to identify the appeal, the order being challenged, and the grounds that require determination. Keep the notice and your indexed record available so the correct matter can be confirmed quickly.

Submissions and questions

The official materials do not prescribe one universal script, speaking order, or time limit for every hearing. In practice, the parties or their authorised representatives present their positions and respond to questions from the bench, following the applicable directions and the bench’s control of the matter. Prepare to take the bench directly to the relevant grounds, findings in the assessment or appellate orders, and page numbers in the record.

Consideration of the record

The Tribunal’s questions may test how a submission fits the grounds of appeal, what the lower authority found, and where the supporting document appears. A concise page reference is more useful than handing over an unindexed bundle. Keep your argument tied to material already in the record unless you have made a separate application for additional evidence.

Adjournment or continuation

If the bench adjourns the appeal, the matter will be heard on a later date. Record the next date and any directions given. An adjournment is not an order allowing the appeal, dismissing it, or admitting documents that were not previously accepted.

Preparation checklist before the hearing

  1. Read the latest notice. Confirm the date, place or remote-attendance instruction, case number, appeal listed, bench details, and any directions about filing or appearance.
  2. Map the appeal record. Re-read the assessment order or other order under challenge, the earlier appellate record, your grounds of appeal, and the respondent’s position. Mark the findings the bench must decide.
  3. Build a page-reference plan. For every important proposition, note the document name and page range in the paper book or existing record.
  4. Complete filing and service steps. Check that the paper book, proof of service, and any separate application are ready within the deadlines stated in the applicable rules and case directions.
  5. Confirm attendance. Make sure the appellant or authorised representative will be available when the matter is called, and arrange a prompt response plan if an emergency prevents attendance.
  6. Check for updated directions. Bench practice and filing instructions can change. Verify the current notice, relevant rules, practice notes, and registry instructions rather than relying on an older hearing.

How to prepare an ITAT paper book

A paper book is the organised set of documents on which you intend to rely from material referred to in the assessment or appellate order. The Income Tax Department’s tutorial describes the following process:

  1. Select the record documents. Include the documents, statements, or papers referred to in the assessment or appellate order that support the grounds you will argue.
  2. Make a clear index. Identify every document and its page range so the bench can locate it without searching through loose papers.
  3. Paginate consecutively. Use stable page numbers that match the index and your oral references.
  4. Use legible copies. A page that cannot be read cannot usefully support a submission.
  5. Certify each paper. The tutorial requires each paper to be certified as a true copy.
  6. Prepare duplicate copies. The tutorial states that the paper book is submitted in duplicate.
  7. File on time. It states that the paper book should be filed at least one day before the hearing.
  8. Serve the other side. Provide a copy to the other party at least one week before the hearing and retain proof of that service.

The Tribunal may condone a delay in an appropriate case, but that possibility is not an automatic extension. Treat the stated filing and service periods as deadlines unless the Tribunal or the current case directions say otherwise.

Record documents, additional evidence and adjournments: keep them distinct

Situation What it means Preparation
Documents already referred to in the assessment or appellate order These are the materials on which you intend to rely in the ordinary paper book. Index, paginate, certify as true copies, file in duplicate, and serve the other side with proof of service.
Proposed additional evidence Material that was not part of the ordinary record and is being offered for consideration at the Tribunal stage. Keep it out of the ordinary paper book. File it separately with an application explaining the reasons for producing it; submission alone does not guarantee admission.
Adjournment request or adjourned listing The appeal is to be taken up later, not decided by the adjournment itself. Follow the bench’s case-specific directions and record the next date. An adjournment is not guaranteed.

How to handle additional evidence

Additional evidence should not be quietly inserted into the ordinary paper book. Rule 18 describes a separate paper book and an application stating why the evidence is being filed. Explain the reason for producing the material at the Tribunal stage and identify the documents clearly. The Tribunal decides whether the evidence will be admitted; filing it does not establish that it will be considered.

Keep the proposed evidence, its index, and the explanatory application together as a separate submission. Check whether the notice or bench has specified a format, timing, number of copies, or service requirement beyond the general rule, because case-specific directions govern.

What should you carry for an ITAT hearing?

There is no universal official carry-in list in the materials described here for identity documents, originals, or extra copies. The actual notice and the relevant bench or registry instructions control. For practical use, have the following working materials available unless the notice says otherwise:

  • the hearing notice and case details;
  • your indexed, paginated paper book and proof that it was served;
  • separate additional-evidence papers and the application explaining them, if applicable;
  • the order under challenge, grounds of appeal, and a short list of the findings you must address;
  • page references for every document you expect to cite; and
  • contact details for the appellant and authorised representative so an urgent attendance issue can be addressed.

These are preparation aids, not a substitute for checking the current notice. Ask the representative or registry about any uncertainty over originals, identification, electronic access, room arrangements, or permitted copies.

What happens if you do not attend?

If the appellant is called and neither the appellant nor an authorised representative appears, the Income Tax Department’s tutorial states that the ITAT may dispose of the appeal on the merits after hearing the respondent. Non-attendance therefore does not automatically win or lose the appeal, but it can leave the Tribunal to decide without your submissions.

The same guidance describes possible restoration of an ex parte order if the absent party later satisfies the Tribunal that sufficient cause prevented attendance. Restoration is not automatic: the party must make the appropriate case-specific request and explain the cause. If you realise that attendance will not be possible, seek prompt instructions from your representative and follow the bench’s procedure rather than waiting for the hearing to pass.

Working with an authorised representative

An authorised representative should know the record, grounds, orders under challenge, and page references before the listing. Give the representative the latest notice and every direction received from the bench or registry. Agree who will answer factual questions, who has authority to make procedural requests, and how an urgent absence will be reported.

A tax advocate or chartered accountant experienced in ITAT appeals may help with record preparation and oral submissions, but hiring a professional is not stated as a universal requirement. If you appoint one, verify the person’s authorisation, relevant appellate experience, location, and the terms of the engagement for your case.

Common preparation mistakes and the safer fix

Relying on an old notice

Risk: The hearing date, bench, location, or filing instruction may have changed.

Fix: Work from the latest notice and confirm current directions with the representative or registry.

Submitting an unindexed bundle

Risk: The bench cannot quickly locate the document supporting an argument.

Fix: Use an index, consecutive pagination, legible copies, and precise page references.

Putting new evidence into the ordinary paper book

Risk: Additional evidence has not been presented through the separate procedure described in Rule 18.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fix: File it separately with an application explaining why it is being produced, and do not assume admission.

Missing service proof

Risk: You cannot demonstrate that the other side received the paper book within the stated period.

Fix: Retain proof of service and keep it with the filing record.

Assuming an adjournment is assured

Risk: The appeal may still be taken up as listed.

Fix: Prepare to attend and seek any adjournment through the applicable case-specific process.

Failing to attend when called

Risk: The Tribunal may hear the respondent and decide the appeal on the merits.

Fix: Arrange attendance and, if an emergency occurs, seek immediate procedural guidance and preserve evidence of the reason.

What the available procedure does not establish

The general materials do not set one speaking script, universal oral-submission time limit, hearing format for every listed case, or mandatory list of identity documents and originals. They also do not provide a case-success rate, average hearing duration, or hearing-volume statistic. Those details should not be guessed; rely on the actual notice, current rules, and directions of the assigned bench.

A final pre-hearing review

  • Is the date, place or attendance method, case number, and bench confirmed from the latest notice?
  • Can you explain each ground of appeal and point to the finding or document that matters?
  • Is the paper book legible, indexed, paginated, certified, duplicated, filed on time, and served with proof?
  • Is any proposed additional evidence separated and accompanied by an explanation?
  • Will the appellant or authorised representative be present when the case is called?
  • Have you checked current bench-specific directions instead of relying on a general checklist?

The Bottom Line

Prepare for an ITAT hearing as a record-based appellate proceeding: follow the latest notice, organise a compliant paper book, handle additional evidence separately, and ensure attendance. The bench’s current directions govern where the general procedure leaves room for case-specific practice.
