Conduct that can cross the line from a tax dispute into a criminal case includes deliberate invoice fraud, wrongful input-tax credit, evasion, fraudulent refunds, withholding collected tax, and certain obstruction or evidence offences. Attempting or helping those offences can also attract prosecution.
Imprisonment is not automatic. An allegation, tax demand, summons or arrest is not a conviction. The department must follow the prosecution process, obtain the required sanction and prove the offence in court. Exact punishment bands and procedural classifications should be checked against the latest consolidated Act and commencement notifications because the legacy official rendering has been amended-sensitive.

Which GST conduct is criminal under section 132?
Section 132 identifies specific acts that may be prosecuted. The wording matters: several offences require an intention to evade tax, knowledge that a transaction is false or unlawful, fraudulent conduct, or another culpable mental state. A genuine accounting mistake or an arguable interpretation of GST law is not automatically a criminal offence.

Making a taxable supply without issuing the required invoice, with intent to evade tax, is a listed offence. The criminal risk is tied to deliberate non-invoicing that conceals the supply or suppresses the tax liability, rather than every invoice error.

Issuing invoices without a real supply
Issuing an invoice or bill when no goods or services were actually supplied is a central form of fake-invoice conduct. A person who creates paper transactions so another party can claim credit or create a false liability may face prosecution even if the underlying goods never moved.
Wrongful input-tax credit
Using an invoice or bill to claim input-tax credit when the statutory conditions are not met is covered. The risk is particularly serious where the claimant knows the document is false, the supply did not occur, or the credit is being used as part of a coordinated evasion arrangement.
Collecting GST and not paying it over
Section 132 lists collecting tax and failing to pay it to the Government for more than three months. This is different from a dispute about whether tax was correctly charged: the listed conduct concerns money collected as tax and then retained beyond the specified period.
Evasion and fraudulent refunds
Deliberately evading tax or fraudulently obtaining a refund can lead to a criminal complaint. False declarations, fabricated records, circular transactions and manipulated refund claims may be relevant evidence, but the department still has to establish the statutory offence and the accused person’s culpable involvement.
TDS, TCS and input-tax-credit distribution offences
The list also contains specified failures concerning tax deducted at source, tax collected at source and distribution of input-tax credit in breach of the Act. These provisions can affect deductors, collectors and entities distributing credit, not only the supplier that generated the original transaction.
Dealing with prohibited services
Receiving or dealing with services that a person knows, or reasonably believes, contravene the Act is separately listed. Knowledge or reasonable belief is important: the provision is not a blanket criminalisation of every transaction later challenged by the tax department.

Tampering with evidence and obstructing officials
Falsifying or destroying material evidence or documents can itself be prosecuted. So can obstructing an officer while the officer is performing statutory duties. These offences may arise during an investigation even when the underlying tax calculation is still disputed.

Failing to provide information required under the Act, or knowingly supplying information that is false without reasonable belief that it is true, is included in the offence list. A taxpayer should therefore treat statutory notices and information requests carefully and preserve records rather than improvise an explanation.
Attempt and abetment
Attempting or abetting the listed offences is also covered. A person need not complete the evasion or refund before criminal exposure arises if the evidence shows a substantial attempt or assistance. The conduct and the person’s role must still be proved in the individual case.
| Section 132 conduct | Typical factual issue the prosecution must establish |
|---|---|
| Supply without invoice | Was the omission deliberate and intended to evade tax? |

Why a GST mistake is not automatically a criminal case
GST administration includes audits, assessments, recovery proceedings and penalties that are civil in character. A mismatch, delayed return, classification disagreement or disputed credit may create a tax demand without proving criminal intent. The department’s own prosecution instruction says technical matters and cases based on a difference of opinion about legal interpretation should not normally be prosecuted.
For a criminal complaint, investigators are expected to collect evidence capable of proving the guilty mind, knowledge, fraudulent intention or other required mens rea beyond reasonable doubt. That is a much higher standard than the balance-of-probabilities approach commonly associated with a tax adjudication. The same documents can therefore produce a demand dispute without being sufficient for conviction.

How prosecution differs from a tax demand, arrest and conviction
These are separate stages:
- Investigation: Officers collect records, statements and transaction data and may issue summons or seek information.
- Adjudication: The department determines tax, interest and civil penalties through its tax process.
- Prosecution: A criminal complaint is filed in court after the statutory approval process. The prosecution must prove the offence beyond reasonable doubt.
- Arrest: Arrest powers under the Act are procedural powers used in specified circumstances. An arrest does not establish guilt.
- Conviction: Imprisonment follows only if a court convicts and imposes a custodial sentence.
Section 132 requires prior sanction for prosecution. A demand notice by itself is therefore not a criminal conviction or an automatic jail order.

What the ₹5 crore CBIC guideline means
CBIC Instruction 04/2022-23, issued on 1 September 2022, says prosecution should normally be launched when evaded tax, misused input-tax credit or fraudulently obtained refund connected with section 132(1) offences exceeds ₹5 crore, or ₹500 lakh. This is an administrative prosecution-launch guideline, not the statutory definition of an offence and not a sentencing threshold.
The instruction identifies exceptions. It allows prosecution in cases involving habitual evaders and in cases where an arrest was made under section 69. For the instruction, a habitual evader is defined by reference to at least two confirmed demand cases at the first adjudication level or above in the preceding two years, with aggregate amounts exceeding ₹500 lakh.
The instruction also says prosecution should not normally be launched for technical matters or a pure legal-interpretation disagreement. It calls for evidence strong enough to establish the required guilty mind, knowledge, fraudulent intention or mens rea. Because the instruction dates from 2022 and the material reviewed does not establish whether it has been superseded, anyone relying on the threshold should confirm the latest CBIC direction.

Can prosecution start before adjudication?
Yes, the CBIC instruction states that adjudication and prosecution may proceed independently. In grave cases, a complaint may be filed before adjudication where the evidence is strong, delay is anticipated, or the circumstances include an arrest. This does not remove the prosecution’s burden to prove the offence in court, and it does not convert an unadjudicated allegation into an established tax liability.

The competent Commissioner must grant the required sanction under section 132(6). For specified investigations conducted by the Directorate General of GST Intelligence, the instruction identifies the relevant senior DGGI authority for sanction. The complaint then proceeds through the criminal court process rather than the ordinary tax-demand appeal route.
How imprisonment and punishment should be described
The official CBIC-hosted Act page located for this subject contains a legacy rendering that describes maximum imprisonment tiers linked to monetary amounts: up to five years where the amount exceeds ₹5 crore, up to three years where it exceeds ₹2 crore, up to one year where it exceeds ₹1 crore, and a six-month category for specified offences. Because the current consolidated section 132 and all effective amendments were not verified, those figures and the associated rupee cut-offs should not be treated as confirmed current law without checking the latest official enactment and commencement notifications.
The same caution applies to statements that an offence is cognizable or non-bailable, or that another is non-cognizable and bailable. Procedural classifications and thresholds can change through amendment. An older CBIC FAQ repeats an earlier summary, but it should not be used as the sole authority for present-day arrest or bail advice.
In practical terms, the safe conclusion is that section 132 offences can carry imprisonment on conviction, but the exact maximum, fine, classification and bail position depend on the provision in force on the relevant date and the facts charged. A court decides sentence after considering the proven offence and applicable law.
When can a person be arrested?
Arrest and imprisonment are different legal events. Arrest may occur during an investigation under the statutory arrest power in section 69 when the legal conditions are met. It does not mean the person has been convicted, and it does not guarantee that a prosecution will end in imprisonment.

Whether an arrest is lawful, whether bail is available and what conditions apply depend on the offence charged, the amount and evidence alleged, the current classification in the Act and the orders of the competent court. Because those details are amendment-sensitive, a person who receives an arrest threat, summons or notice should obtain prompt advice from an Indian lawyer experienced in GST and criminal-tax proceedings.

Liability of companies, directors and employees
Section 137 addresses offences by companies. The company may be proceeded against, and persons responsible for the conduct of its business may also face prosecution. Directors or other officers can be exposed where the offence is attributable to their consent, connivance or neglect.
This does not make every director automatically criminally liable. CBIC’s instruction calls for prosecution to focus on people involved in day-to-day operations who actively participated in, or connived at, the offence. Job title alone is not a substitute for evidence of responsibility, knowledge or participation.
What evidence usually matters
The precise evidence varies by offence, but investigators may examine invoices, e-way bills, purchase and sales ledgers, bank records, electronic communications, return data, stock movement and statements of employees or counterparties. For a fake-invoice allegation, proof that no supply occurred and that the accused knew or helped create the paper trail may be central. For wrongful credit, the department may examine the chain of documents and the claimant’s role in verifying the transaction.
Destroying, altering or hiding records can create a separate section 132 issue. Preserving original books, responding accurately to lawful requests and documenting the basis for a disputed interpretation are safer than attempting to reconstruct a file after an inquiry begins.
What to do after receiving a GST summons or notice
- Read the document precisely. Note the issuing authority, statutory provision, date, attendance requirement and records requested.
- Preserve records. Keep invoices, ledgers, contracts, transport evidence, bank statements, returns and relevant electronic files in their original form.
- Do not guess. A knowingly false answer can create an independent information offence. If a fact is uncertain, verify it before responding.
- Get case-specific advice. A GST and criminal-tax lawyer can assess exposure, privilege, summons strategy, bail and the interaction between adjudication and prosecution.
- Track deadlines. Missing a lawful summons or filing deadline can worsen the procedural position even where the underlying tax issue is defensible.
The practical bottom line
Fake invoices, wrongful input-tax credit, deliberate non-invoicing, tax evasion, fraudulent refunds, retaining collected tax beyond three months, specified TDS or TCS failures, unlawful credit distribution, evidence tampering, obstruction, false information, attempt and abetment are the main section 132 categories that can lead to prosecution. A criminal case requires sanction and proof beyond reasonable doubt; imprisonment follows only after conviction. CBIC’s ₹5 crore figure is a 2022 guideline for when prosecution should normally be launched, not a universal legal safe harbour or the current punishment table. Verify the law in force and obtain individual advice before drawing conclusions about arrest, bail or sentencing.
