That is not a universal rate for every ENA transaction. The CGST and IGST levy provisions exclude un-denatured ENA or rectified spirit when it is used to manufacture alcoholic liquor for human consumption, subject to the statutory conditions and corresponding State and Union territory amendments.
“Who decides?” has several answers. The GST Council recommends rates and policy; Parliament and the relevant State and Union territory governments give those decisions legal effect through GST Acts and notifications; and the Supreme Court decides constitutional disputes about legislative authority. The Court’s 23 October 2024 judgment in State of Uttar Pradesh v. Lalta Prasad Vaish concerns that constitutional division of power, not the GST rate for every individual supply.

The answer depends on the product and its documented use
“Industrial alcohol” is a commercial description, not a single GST result. A supplier may be dealing with ENA, rectified spirit, denatured spirit or another alcohol preparation, and the tariff classification and end use can change the legal treatment. For the ENA and rectified-spirit issue addressed in the GST Council records, the central distinction is between industrial use and use in manufacturing alcoholic liquor for human consumption.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteFor industrial use, the Council records identify an 18% rate for the industrial-use tariff item HS 2207 10 12. For the human-consumption manufacturing use, the statutory levy provisions contain a purpose-based exclusion for un-denatured ENA or rectified spirit used to manufacture alcoholic liquor for human consumption. That wording is not a blanket exemption for every product described as ENA or industrial alcohol. A transaction must satisfy the product and use conditions in the legislation and be supported by facts and records.

Industrial-use ENA: where the 18% figure comes from
The 53rd GST Council meeting record distinguishes ENA intended for industrial use from ENA used in making potable liquor. It records the decision to notify an 18% rate for a new tariff line for ENA for industrial use, identified in the Council material as HS 2207 10 12. The 54th meeting record refers again to industrial-use spirits being notified under the relevant rate notification.
The 18% figure should therefore be read as the general rate identified for the industrial-use tariff line, not as an automatic answer for every consignment called industrial alcohol. Before charging it, a business still has to verify the current rate notification, the classification that actually fits the product and the transaction date. A Council minute records a recommendation or decision within the GST framework; it is not a replacement for the enacted Act and notification that govern an invoice.
ENA used to make potable liquor: a conditional exclusion
The CGST Act’s section 9 levy text, as displayed in the Central Board of Indirect Taxes and Customs (CBIC) Act database, excludes “un-denatured extra neutral alcohol or rectified spirit used for manufacture of alcoholic liquor, for human consumption.” The IGST Act’s section 5 contains the corresponding exclusion for inter-State supplies. The GST Council also agreed to corresponding amendments in the CGST, SGST, Union Territory GST and IGST laws.

- Un-denatured: the statutory language specifies the condition of the alcohol. Do not assume that a denatured product qualifies simply because it is later used in an industrial process, or that a product’s trade name proves its status.
- Extra neutral alcohol or rectified spirit: the exception is tied to the products described in the law, not to every alcohol-containing material.
- Used for manufacture: the intended or claimed use must correspond to the actual transaction and be capable of proof.
- Alcoholic liquor for human consumption: the destination product must fall within that description. Industrial solvents, chemicals, fuel-related uses and other non-potable applications do not meet this wording merely because the starting material is ENA.
Accordingly, it is wrong to write either “all ENA is exempt” or “all industrial alcohol is taxed at 18%.” The correct result follows from classification, denaturation, end use, place of supply and the law in force on the relevant date.
Industrial use and human-consumption use compared
| Question | ENA or rectified spirit for industrial use | Un-denatured ENA or rectified spirit used to manufacture alcoholic liquor for human consumption |
|---|---|---|
| General treatment identified in GST materials | 18% rate identified for the industrial-use tariff line HS 2207 10 12 | Excluded from the CGST and IGST levy provisions when the statutory use condition is met; corresponding SGST and UTGST amendments were agreed |
| Primary factual test | Whether the product is correctly classified under the industrial-use tariff item | Whether it is un-denatured and actually used to manufacture alcoholic liquor for human consumption |
| Authority to check | The current rate notification and applicable GST Act | The statutory exception, applicable amendments and evidence supporting the end use |
| Main mistake to avoid | Applying 18% or another rate without confirming classification and the notification in force on the supply date | Treating the exception as a blanket exemption for every ENA or every industrial-alcohol supply |
How to determine GST for a particular consignment
A defensible answer requires more than the product name on a purchase order. Work through the following sequence before preparing the invoice or return.

1. Identify the exact product
Obtain the technical specification, composition, grade and product description. Determine whether the material is ENA, rectified spirit, denatured spirit or another preparation. Retain the documents used to support the classification. A broad label such as “industrial alcohol” cannot by itself establish the relevant tariff line.
2. Confirm the tariff classification
Check whether the facts fit HS 2207 10 12, the industrial-use line identified in the GST Council records, or a different heading. Classification should be consistent across the contract, product literature, tax invoice, returns and customs or excise records where those records are relevant. If the classification is disputed, obtain transaction-specific professional advice rather than relying on a rate copied from an unrelated product.
3. Establish denaturation status
The human-consumption manufacturing exclusion refers to un-denatured ENA or rectified spirit. Record whether the product is denatured, how that status is established and whether the specification changed between manufacture and supply. Do not treat “industrial grade” as a synonym for “denatured,” or “potable grade” as proof of the statutory condition.
4. Document the actual end use
Collect the buyer’s purchase order, end-use declaration, manufacturing licence or other contemporaneous records that show what the recipient will do with the spirit. The legal wording concerns use in manufacturing alcoholic liquor for human consumption, so a generic statement that the material is for “industry” is inadequate. For an industrial supply, records should identify the non-potable process or product where that fact is material.
5. Determine whether the supply is intra-State or inter-State
The CGST and SGST framework applies to an intra-State supply, while the IGST Act governs an inter-State supply. The corresponding levy provisions contain the purpose-based exclusion, so the place-of-supply analysis must be completed rather than assuming that an exemption in one Act automatically answers every transaction.

6. Check the transaction date and notification
Tax treatment can depend on the law and rate notification in force when the supply occurred. Verify the notification applicable on that date, including any amendment or effective-date clause. A later Council decision or court judgment should not be applied mechanically to an earlier invoice without checking the legal instrument and any transitional rules.
7. Reconcile the invoice, return and evidence
The tax treatment shown on the invoice should match the classification, end-use evidence and return disclosure. Keep the documents together so that a reviewer can see why the industrial-use rate was charged or why the statutory exclusion was claimed. If the facts are mixed or the buyer’s use is uncertain, escalate the issue before filing rather than trying to repair an unsupported position later.
Who decides the tax treatment?
The GST Council: policy recommendations and recorded decisions
The GST Council is the forum that recommends GST rates and related policy under the GST framework. Its 53rd meeting record expressly distinguishes industrial-use ENA from ENA used to manufacture alcoholic liquor for human consumption and records the 18% industrial-use rate proposal. The 54th meeting record discusses amendments to the levy provisions and continuing work on earlier-period issues.
The Council’s own recorded decision states: “The Council approved the proposal to keep ENA for use in manufacture of alcoholic liquor for human consumption out of the ambit of GST, to place the intent of the Council before the Hon’ble Supreme Court and other Courts, to notify rate of 18% for new tariff line to be created on ENA for industrial use and to reduce the GST rate on molasses from 28% to 5%.” That is an institutional statement in the meeting minutes. It should not be presented as if the minutes themselves were the rate notification or the statutory text.
Parliament and State or Union territory governments: legal effect
The levy operates through the CGST, IGST, SGST and UTGST Acts and through government notifications issued under those laws. The 54th Council meeting minutes record agreement to amend the CGST, SGST, UTGST and IGST provisions so that the intended treatment of ENA used in making alcoholic liquor for human consumption is reflected in the legislation. For a live transaction, read the enacted provision and the notification in force, not only the Council summary.

Tax authorities and adjudicating bodies: application to facts
Once the legal text is in place, the supplier and recipient must apply it to their own classification, use and place-of-supply facts. Tax officers can examine the evidence and issue an assessment or other order. Appeals and other proceedings may determine how the rule applies to a particular taxpayer. A Council recommendation does not eliminate the need for that fact-specific analysis.
The Supreme Court: constitutional authority
In State of Uttar Pradesh v. Lalta Prasad Vaish, judgment dated 23 October 2024, the Supreme Court considered the constitutional allocation of authority over industrial alcohol and earlier decisions concerning the meaning of “intoxicating liquors.” The case matters because it addresses who may regulate and legislate in this field at the constitutional level.
It does not, by itself, set an 18% GST rate, classify every ENA supply, decide every historical assessment or make product evidence irrelevant. Those questions still require the applicable GST Act, rate notification and transaction facts. The constitutional ruling and the GST rate question are related contextually but are not interchangeable legal steps.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What is known about earlier periods?
GST Council agenda material records that a Committee of Officers studied taxation of ENA for the period from 1 July 2017 to 20 October 2023. The committee’s agenda recommended taking a view after the Supreme Court decision, and the 54th meeting minutes state that the Council asked the committee to examine lingering historical issues.
Those records show an institutional review, not a final settlement of every past-period liability. A business facing an old demand, refund question or classification dispute must check later binding legislation, notifications, court orders and the specific proceedings. It is unsafe to assume that all legacy disputes are resolved merely because the Council discussed the period.

Common mistakes and how to avoid them
“Industrial alcohol always means 18%.”
The 18% figure is tied to the industrial-use tariff line identified in the Council records. Confirm that the product and use fit that line and that the rate notification was in force on the transaction date.
“ENA is always outside GST.”
The exclusion is purpose-qualified. It concerns un-denatured ENA or rectified spirit used to manufacture alcoholic liquor for human consumption. An ENA supply to a chemical, solvent or other industrial process cannot be treated as excluded solely because the material is ENA.
“The Supreme Court judgment fixed the GST rate.”
The 23 October 2024 judgment addresses constitutional authority over industrial alcohol. It does not replace the rate notification or the statutory tests for a particular supply.
“The buyer’s stated intention is enough.”
Use should be supported by contemporaneous commercial and manufacturing records. If the recipient’s process changes, or the supplier cannot establish the claimed use, the original tax position may be difficult to defend.
“A Council minute is the same as enacted law.”
Minutes are valuable evidence of policy intent and the Council’s recommendation. The legally operative answer comes from the applicable GST Act and notification, including the effective date and any amendment that governs the transaction.
A compact compliance checklist
- Product description and technical specification retained.
- Correct tariff classification tested, including whether HS 2207 10 12 is appropriate.
- Denaturation status established and documented.
- Buyer’s actual end use identified as industrial or manufacture of alcoholic liquor for human consumption.
- Intra-State or inter-State character determined.
- GST Act provisions and rate notification checked for the transaction date.
- Invoice, return and supporting documents reconciled.
- Historical-period claims checked against later binding action and the relevant proceeding.
For a disputed assessment or a high-value supply, this general explanation cannot replace transaction-specific advice from an Indian indirect-tax professional who can review the classification, evidence and applicable orders.
