What Fair Lending Laws Protect Mortgage Applicants From Discrimination?

Two federal laws are the main protections: the Equal Credit Opportunity Act (ECOA), implemented by Regulation B, and the Fair Housing Act (FHA). ECOA applies broadly to credit transactions, while the FHA applies specifically to housing-related transactions, including most residential mortgage, refinance, home-equity and home-improvement lending. Their protected-class lists overlap but are not identical, and state or local laws may add protections.

Those laws can reach more than an approval decision. Depending on the facts, they may cover advertising, application handling, loan terms and costs, appraisals, servicing, modification assistance and collection. A suspected violation can be reported to the appropriate federal agency, but deadlines apply and the current Regulation B text should be checked because the CFPB reports significant amendments in 2026.

The two principal federal fair-lending laws

Mortgage discrimination is addressed through two overlapping statutes. The Equal Credit Opportunity Act (ECOA) is a credit law that reaches any aspect of a credit transaction. The Fair Housing Act (FHA) is a civil-rights law that covers transactions involving a dwelling and loans secured by residential real estate or used to purchase, build, improve, repair or maintain a home.

Law Basic scope Protected bases identified in federal consumer guidance Agencies and remedies
ECOA / Regulation B Any aspect of a credit transaction, including mortgage applications, underwriting, denials, refinancing, servicing and collection. Race, color, religion, national origin, sex, marital status, age (when the applicant can legally enter a contract), receipt of income from a public-assistance program, and good-faith exercise of a right under the Consumer Credit Protection Act. The CFPB and other financial regulators can investigate and enforce. Consumers can submit a CFPB complaint and may have private legal remedies under applicable law.
Fair Housing Act Housing-related credit, including loans secured by residential real estate and loans to purchase, construct, improve, repair or maintain a dwelling. Race, color, national origin, religion, sex, familial status and disability. HUD’s Office of Fair Housing and Equal Opportunity (FHEO) accepts complaints; the Department of Justice (DOJ) handles certain pattern-or-practice matters; private lawsuits may be available.

Neither list should be treated as a complete statement of every protection available in the United States. State and local fair-lending or fair-housing laws can add protected characteristics, procedures or remedies. For example, military or veteran status is not listed as an ECOA protected class in CFPB mortgage guidance, although a state law may protect it.

ECOA and Regulation B

ECOA prohibits a creditor from discriminating in any aspect of a credit transaction. In mortgage lending, that can include accepting or discouraging an application, deciding whether an applicant is creditworthy, setting terms, denying credit, handling a refinance, servicing an existing loan or pursuing collection. The CFPB’s consumer guidance identifies protection based on race, color, religion, national origin, sex, marital status, qualifying age, receipt of public-assistance income and good-faith exercise of a right under the Consumer Credit Protection Act.

Age protection has an important qualification: the applicant must be old enough under applicable law to enter a binding contract. ECOA does not require a creditor to ignore legitimate age-related facts that are relevant to repayment, such as the length of time an income source is expected to continue, but a lender cannot use age as a blanket reason to refuse an otherwise lawful application.

Fair Housing Act

The FHA applies when the credit is connected to a dwelling. HUD identifies discrimination because of race, color, national origin, religion, sex, familial status or disability. “The Fair Housing Act prohibits discrimination in loans that are secured by residential real estate or that are for the purchasing, constructing, improving, repairing or maintaining a dwelling,” according to HUD’s Office of Fair Housing and Equal Opportunity.

HUD’s mortgage guidance covers approval and denial decisions, loan terms and costs, advertising, mortgage-broker services, appraisals, servicing and help with a home-loan modification. The law therefore can matter after closing as well as during the initial application.

How the laws overlap—and where they differ

A single mortgage event can implicate both laws. A lender that offers a higher rate because of an applicant’s race, for example, may face an ECOA issue because the conduct occurred in a credit transaction and an FHA issue because the loan concerns a dwelling. The statutes nevertheless have different boundaries and protected-class lists.

  • Scope: ECOA is generally transaction-focused and applies to credit; the FHA is housing-focused and applies to dwelling-related transactions.
  • Protected bases: ECOA expressly includes marital status, qualifying age, public-assistance income and exercise of certain consumer-credit rights. The FHA expressly includes disability and familial status. Race, color, religion, national origin and sex appear in both federal frameworks.
  • Process stages: Both can reach mortgage decisions. HUD’s FHA guidance expressly lists advertising, broker services, appraisals, servicing and modification assistance in addition to approval, denial and loan terms.
  • Enforcement route: CFPB and other financial regulators enforce ECOA-related requirements; HUD/FHEO and DOJ enforce FHA matters. A mortgage complaint may involve more than one agency.

Because jurisdiction and deadlines vary, identify every potentially applicable federal, state and local law rather than assuming that one statute is the only option.

Conduct that may signal mortgage discrimination

A warning sign is not proof by itself. Investigators and courts examine the full record, the lender’s stated reasons, comparisons with similarly situated applicants and the requirements of the applicable law.

Application and underwriting behavior

  • Refusing credit when the applicant appears to meet the lender’s stated qualifications.
  • Discouraging someone from applying, steering the person away from a loan product or suggesting that a neighborhood makes approval unlikely.
  • Offering less favorable rates, fees, down-payment requirements or other terms to an applicant who is similarly qualified to someone outside a protected group.
  • Applying different documentation, verification or customer-service standards to comparable applicants.
  • Closing or changing an account because of a protected characteristic.

Income, disability and family-related issues

HUD gives as examples refusing to consider disability-related income such as Supplemental Security Income (SSI) or Social Security Disability Insurance (SSDI), or treating applicants differently in customer service. A lender may verify whether income is stable and likely to continue, but it cannot automatically disregard a lawful source because it is disability-related. Familial-status protections can also matter when a household includes children or when an applicant is pregnant.

Property, appraisal and neighborhood issues

HUD identifies charging a higher rate because a property is in a majority-minority neighborhood as an example of potentially discriminatory treatment. Appraisals, valuation reviews and the way a lender responds to neighborhood characteristics can therefore be relevant, even when the borrower’s personal information is not explicitly mentioned.

Redlining

Redlining means denying or limiting access to credit in areas because of the racial or ethnic composition of the neighborhood. On October 15, 2024, the CFPB and DOJ announced a complaint and proposed consent order alleging that Fairway redlined majority-Black and high-Black areas in the Birmingham, Alabama, metropolitan area and discouraged applicants. That announcement describes allegations in a particular enforcement matter; it is not a finding about every lender or every loan in those areas.

2026 Regulation B changes: verify the current rule

The CFPB’s Regulation B materials report a final rule issued April 22, 2026. The Bureau says the rule removes the “effects test” from the regulation, states that ECOA does not recognize disparate-impact liability, changes the discouragement provision, and restricts use of race, color, national origin or sex as common characteristics in certain Special Purpose Credit Programs while adding requirements for for-profit creditors.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The CFPB also says its Regulation B page was most recently amended July 21, 2026, and that an updated version will be published soon. Those changes make older summaries unreliable for precise questions about disparate impact, discouragement or Special Purpose Credit Programs. Read the final rule and the current regulatory text before relying on a legal conclusion. This article is general information, not advice about a particular application or jurisdiction.

Your appraisal-copy rights in many first-lien applications

For a credit application secured by a first lien on a dwelling, CFPB guidance describes a requirement that the creditor provide free copies of appraisals and other written valuations developed in connection with the application. The creditor must also notify the applicant in writing that copies will be provided promptly. Regulation B § 1002.14 contains the rule and its qualifications.

Coverage and timing are not identical for every mortgage transaction. Keep the lender’s written notice, the valuation itself and the dates you received them. If a lender refuses a copy or misses the required timing, ask which § 1002.14 exception it believes applies and preserve that response.

What to do if you suspect discrimination

  1. Preserve the record. Save the application, preapproval or denial, rate sheets, fee worksheets, appraisal and valuation documents, emails, text messages and portal messages. Write down dates, names, statements made, property address, loan amount, offered terms and the point at which treatment changed.
  2. Compare the treatment. If you know of a similarly situated applicant, note differences in rate, fees, requests for documents, processing time or outcome. Do not obtain another person’s confidential records improperly; use only information you can lawfully access.
  3. Ask the lender for an explanation. Request the adverse-action reasons and relevant documents in writing. A written response can clarify whether the issue is credit criteria, property valuation, documentation or something else.
  4. Report housing discrimination to HUD. HUD’s FHEO accepts reports online and by phone at 1-800-669-9777. HUD says an allegation under the Fair Housing Act generally must be filed within one year of the last alleged discriminatory act.
  5. Submit a CFPB complaint about lender conduct. CFPB consumer guidance says complaints can be submitted online or by calling (855) 411-CFPB (2372). The CFPB consumer mortgage page carrying that guidance was last reviewed October 12, 2023, so confirm current contact details when filing.
  6. Consider legal advice promptly. DOJ focuses its fair-lending enforcement on pattern-or-practice cases, while individuals may file a HUD complaint or bring their own lawsuit. HUD describes a two-year period for private FHA suits, subject to procedural qualifications. Filing deadlines depend on the route and facts, so do not wait for an agency response before asking a qualified housing or consumer-finance lawyer about preserving your rights.

Information agencies may need

CFPB asks complainants to have dates, amounts and relevant details available. A concise timeline is more useful than a folder of unlabelled files: identify the product, property, lender or broker, decision dates, terms offered, terms received, communications and the harm you believe resulted.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Common questions about mortgage fair-lending protection

Does a denial automatically mean discrimination?

No. A denial can result from lawful underwriting, inability to verify income, debt-to-income limits, collateral concerns or other legitimate criteria. Discrimination becomes a legal question when a protected characteristic appears connected to the decision or to materially different treatment, and the evidence must be evaluated under the applicable statute.

Can a lender consider a neighborhood?

Lenders may evaluate legitimate property and market risks, but using racial or ethnic composition to restrict access or impose worse terms can raise redlining or other fair-housing concerns. The surrounding facts, underwriting policy and comparative treatment matter.

Are state protections important if federal law applies?

Yes. State and local laws may protect additional characteristics, including categories not listed in the federal guidance, and may set different administrative procedures or deadlines. A local fair-housing agency or attorney can identify those rules.

Should I file with HUD, the CFPB or both?

The agencies serve different functions and their authority can overlap in mortgage cases. HUD is the principal federal intake route for FHA housing-discrimination allegations; the CFPB accepts complaints about consumer-finance conduct. Filing with one does not necessarily preserve every other deadline, so obtain legal advice quickly if the timing is close.

Bottom line for mortgage applicants

ECOA/Regulation B and the Fair Housing Act are the core federal safeguards against discrimination in mortgage lending. They can apply from advertising and application intake through underwriting, pricing, appraisal, servicing and modification assistance, but their protected classes and legal standards are not identical. Keep a detailed record, act before the relevant deadline and use current agency guidance—especially the CFPB’s 2026 Regulation B text—when deciding where and how to report.
