The strongest IRS penalty-waiver requests connect a specific event to a specific missed deadline and back that chronology with records. Explain what happened, when it happened, how it prevented timely filing or payment, and what you did to comply. Hospital, court, or doctor records; disaster documentation; IRS correspondence; system receipts; and other dated records can support the explanation, but no document guarantees abatement. The IRS evaluates the penalty and the complete facts.
Start with the penalty notice, tax period, and relief route. The notice tells you where to respond and whether a phone request is available. The IRS’s reasonable-cause guidance says to explain “What happened and when it happened,” how the situation prevented timely filing or payment, and what attempts you made to file or pay.

Start with the notice and identify the exact penalty
Read every page of the IRS notice before gathering documents. Confirm the taxpayer, tax year or quarter, return involved, penalty type, amount, and response deadline. A late-filing penalty, late-payment penalty, failure-to-deposit penalty, and accuracy-related penalty can have different standards and relief routes. If the notice is incorrect, follow its instructions to dispute the assessment rather than treating the matter as a reasonable-cause request.

Have the notice, the penalty amount, your explanation, and supporting records available. If the issue cannot be resolved by phone, the IRS says a written request using Form 843, Claim for Refund and Request for Abatement, may be available for the penalty involved. Follow the notice’s instructions because Form 843 is not required or appropriate for every situation. See the IRS overview of requesting penalty relief.

What makes evidence persuasive
Documents matter because they let an IRS reviewer verify dates and test the connection between the event and the missed obligation. Organize the request as a short, dated causal story:
- Obligation: State the return, payment, or deposit that was due and the exact due date, including any approved extension.
- Event: Describe the unusual circumstance, when it began, and when it ended or became manageable.
- Impact: Explain the practical way the event prevented filing, payment, record gathering, or electronic transmission.
- Care taken: Describe attempts to file or pay, requests for help or records, communications with the IRS, and the first date you were able to comply.
- Correction: State when the return, payment, or deposit was completed and what you changed to reduce the chance of another failure.
Attach records next to the part of the chronology they support. A document showing that an illness existed is weaker than a record showing the dates of hospitalization and why the taxpayer could not act during the filing window. The IRS states that there is no one-size-fits-all evidence list and that documentation alone does not guarantee abatement.
Evidence checklist by circumstance
| Situation | Records to consider | What your explanation must establish |
|---|---|---|
| Serious illness, incapacity, death, or unavoidable absence | Hospital or court records, a doctor’s letter, admission and discharge dates, death records, or evidence of an unavoidable absence. | Who was affected, the start and end dates, and how the condition prevented the taxpayer or an immediate family member from filing or paying. |
| Fire, natural disaster, or civil disturbance | Official disaster notices, insurance or emergency reports, property records, photographs, and correspondence showing the event’s dates. | How the event affected access to records, a residence, a business, transportation, communications, or funds during the relevant deadline. |
| Inability to obtain records | Written requests for records, replies, delivery dates, custodian correspondence, and notes showing follow-up efforts. | Which records were unavailable, why they were necessary, how long they were unavailable, and what you did after receiving them. |
| Electronic filing or payment system issue | System messages, rejection notices, screenshots, transmission timestamps, payment receipts, confirmation numbers, and proof of follow-up attempts. | When the system failed, what error occurred, why it prevented timely transmission, and how and when you tried an alternative or completed the filing. |
| Mail or IRS correspondence disruption | Returned mail, mailing receipts, IRS letters, responses, address records, and dated communications. | How the disruption affected notice, response, filing, or payment and what steps you took once you learned of the issue. |
| Other circumstances | Relevant letters and responses, receipts, forms, account statements, calendars, and other dated records. | A concise chronology showing reasonable care and a concrete connection to the missed deadline. |
These are examples, not a mandatory bundle. Include only records that clarify the event, dates, impact, or compliance efforts. Redact unrelated medical, financial, or personal information, but leave enough detail for the reviewer to verify the period involved.

Match the explanation to the penalty standard
Failure to file, pay, or deposit
For these penalties, the IRS generally asks whether you exercised ordinary business care and prudence but could not comply because of circumstances beyond your control. Its examples include fire, disaster or civil disturbance, inability to obtain records, death, serious illness or unavoidable absence, and system issues that delayed an otherwise timely electronic filing or payment. Your evidence should address the particular obligation named on the notice, not merely show that a difficult event occurred.
Accuracy-related penalties
Accuracy-related penalties involve a different analysis. The IRS may consider reasonable cause and good faith, efforts to report the correct tax, the complexity of the issue, your education or tax knowledge, and efforts to understand the obligation or seek advice. If an adviser was involved, explain whether you supplied complete information and whether the adviser had suitable competence and experience. Attach engagement records, questions and answers, information you supplied, and your own review steps when those facts are relevant. The IRS’s reasonable-cause page describes these factors.
Explanations that are usually too weak by themselves
The IRS cautions that relying on a tax professional, not knowing the law, making a mistake or oversight, or lacking funds generally does not independently establish reasonable cause for late filing or late payment. Do not present one of those facts as an automatic waiver basis.

Those facts can still appear as part of a fuller account when other evidence shows reasonable care. For example, explain the specific records you gave a preparer, the dates you sought assistance, the instructions you received, and the steps you took when you discovered the problem. For a cash shortage, document the event that caused the shortage, attempts to obtain financing or arrange payment, available funds, and any payment made; inability to pay alone is not a substitute for the required causal explanation.

Check for a better relief route before filing a reasonable-cause request
The IRS separates administrative relief, reasonable cause, and statutory exceptions. A different route may be simpler or may apply in addition to reasonable cause.
| Possible route | When it may fit | Evidence or condition to check |
|---|---|---|
| Administrative penalty relief | An IRS administrative program applies to the penalty and your compliance history. | Review current eligibility for the return and period, including prior timely filing and payment requirements. |
| Statutory exception | A rule specifically covers the event, such as timely mailing or transmission, disaster-area relief, combat-zone rules, or reliance on incorrect written IRS advice. | For incorrect written advice, provide the advice, explain how you relied on it, and include the penalty notice. Other exceptions have their own statutory criteria. |
| Reasonable cause | No specific exception controls, but circumstances beyond your control prevented compliance despite reasonable care. | Provide the dated causal narrative and records described above. |
Automatic Exemption from Penalty in 2026
IRS administrative guidance says the Automatic Exemption from Penalty (AEP) begins in summer 2026. As described by the IRS, it applies to eligible original returns beginning with tax year 2025 and to 2026 quarterly returns, with additional eligible periods thereafter. It covers selected failure-to-file, failure-to-pay, and failure-to-deposit penalties and depends on prior timely compliance. AEP is automatic when the return and account qualify; it is not a request to prove reasonable cause. The program transitions from First Time Abate, so check the current IRS rules for the exact period and penalty. AEP does not remove unpaid tax, interest, or penalties outside its scope. See IRS administrative penalty relief guidance.

How to write a reasonable-cause letter
- Identify the account: Put your name, address, taxpayer identification number or last four digits as appropriate, notice number, tax form, tax period, and penalty type at the top. Include a copy of the notice if the instructions request it.
- State the request plainly: Ask for abatement of the specified penalty under reasonable-cause standards. If you are also asserting a statutory exception or administrative relief, label that basis separately.
- Build a dated timeline: Use short paragraphs or a table with the event date, what occurred, and its effect on the filing or payment task. Avoid broad statements such as “I had a medical problem” without dates and impact.
- Describe compliance efforts: List calls, electronic attempts, mailed documents, requests for records, partial payments, and the date the obligation was finally completed. Include confirmation numbers and receipts where available.
- Index the attachments: Number each exhibit and refer to it in the timeline, such as “hospital discharge record, Exhibit 2.” Keep copies of everything sent.
- Sign and date the submission: Use the delivery method and address in the notice. Keep certified-mail or electronic delivery proof and a complete copy of the package.
Write in your own words and keep the request limited to the tax period at issue. A reviewer should be able to answer three questions without searching through unrelated material: what happened, why it blocked timely compliance, and what you did about it.
Submission, follow-up, and recordkeeping
Use the phone number, online option, or mailing address printed on the notice. If you call, have the notice, penalty details, dates, and documents in front of you; record the representative’s name or identification information and the date of the conversation. If written relief is required, use Form 843 only when the IRS instructions indicate it is the correct vehicle, and attach a focused explanation rather than a box of unorganized records.

If the IRS denies the request
Read the denial letter immediately. It explains whether the decision can be appealed and gives the controlling deadline. IRS Appeals says the general period for an eligible penalty appeal is 30 days from the rejection letter, but the letter’s specific date governs. Use the appeal procedure stated there and address the reasons for denial with additional facts or records rather than simply repeating the original request. The IRS describes penalty appeals at Penalty appeal.
If a penalty is abated, related interest is automatically reduced or removed under the IRS penalty-relief guidance. Any remaining tax, interest attributable to amounts not abated, or penalties outside the decision can still be due. No published IRS success-rate figure establishes a guaranteed outcome; the decision turns on the penalty, applicable rule, chronology, and evidence in the individual account.
