1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsTo prove that student loans create an undue hardship, build evidence on three questions: whether the required payment prevents your household from maintaining a minimal standard of living now, whether that condition is likely to continue for a significant part of the repayment period, and whether you have made good-faith efforts to repay. The controlling legal test varies by federal circuit. A bankruptcy judge—not the Education Department or the Justice Department—makes the final decision.
The strongest case is a dated, consistent record linking your budget, health and employment prospects, loan history, and repayment efforts. General statements that a payment is unaffordable are rarely enough without documents that let the court verify the numbers and understand what is likely to happen next.

What “undue hardship” means in bankruptcy
Bankruptcy Code § 523(a)(8) preserves a route to discharge qualifying educational debt when repayment would impose an undue hardship. You normally request that relief in an adversary proceeding within your bankruptcy case. The creditor, often the United States for a federal loan, receives notice and can respond; the bankruptcy judge independently decides the legal and factual issues.
There is no nationwide evidentiary checklist. Many courts apply the three-part Brunner framework, while some use a totality-of-the-circumstances analysis. Department of Justice guidance for attorneys handling federal student-loan cases is designed to work in either type of jurisdiction, but it expressly says that it does not supersede controlling circuit law. Your lawyer must identify the standard and procedural rules that govern the court hearing your case.

The Brunner framework
- Present inability: based on current income and expenses, paying the loans would prevent a minimal standard of living for you and your dependents.
- Likely persistence: additional circumstances show that this condition is likely to continue for a significant portion of the repayment period.
- Good faith: your conduct toward repayment and your overall financial situation show a good-faith effort rather than an attempt to avoid a manageable obligation.
Totality-of-the-circumstances analysis
Courts using a totality test weigh the whole record, including past and present financial resources, reasonably necessary expenses, reliable future resources, health, employment prospects, and other case-specific facts. The labels differ, but the practical need is similar: present a credible record explaining what you can pay, what you cannot pay, why the gap exists, and why it is not reasonably expected to close.
Evidence of your current inability to maintain a minimal standard of living
Start with a dated household financial snapshot. Courts need actual figures, not rounded estimates or conclusions. Organize the information so that a reviewer can trace each amount to a record and see how the required student-loan payment changes the monthly result.
Income and household information
- Recent pay statements for every wage earner in the household.
- Benefit statements for unemployment, Social Security, disability, workers’ compensation, pensions, or other recurring benefits.
- Tax returns and other income records that show the longer-term trend, not only one unusually low or high month.
- Household size, dependent information, and caregiving responsibilities.
- Documentation of irregular or seasonal income, with an explanation of how you calculated a representative monthly amount.
Reconcile the figures with the income and expense schedules filed in bankruptcy. If your circumstances changed after those schedules were prepared—for example, a layoff, rent increase, medical event, or loss of benefits—identify the date and provide records showing the change.

Necessary expenses
Collect leases or mortgage statements, utility bills, insurance invoices, transportation costs, childcare records, medical bills, prescriptions, food and household receipts, and other recurring obligations. Separate ordinary necessary costs from discretionary spending and explain unusual but unavoidable expenses. A clear monthly budget should show gross and net income, each expense category, debt payments, and the amount remaining before and after the student-loan payment.

The Justice Department’s federal-loan review uses IRS Collection Financial Standards as a guide when evaluating expenses. Those standards are not a universal court formula, and a court is not automatically required to adopt the government’s calculation. They are a reference point in the federal administrative review; the judge applies the law of the controlling circuit and evaluates the evidence in your case.
Assets and debts
- Bank and investment statements, retirement accounts, real estate information, and vehicle records.
- Credit-card, medical, mortgage, auto, tax, support, and other debt statements.
- The student-loan account history showing the current balance, interest, payment amount, loan type, and status.
- Proof of any garnishment, offset, collection fee, or other action that affects available income.
Do not omit assets or liabilities because they seem unrelated. The court may consider whether an asset can reasonably support necessary expenses and whether another debt explains the household shortfall. Accuracy and consistency matter more than presenting the most dramatic possible budget.
Evidence that hardship is likely to continue
Future hardship requires a factual bridge from today’s numbers to a substantial part of the repayment period. Explain why a temporary deficit is expected to persist and connect that explanation to records about health, work, age, education, and family obligations.

- Being age 65 or older.
- A disability or chronic injury that affects income potential.
- Unemployment for at least five of the last ten years.
- Not obtaining the degree for which the loan was procured.
- At least ten years in repayment status other than in-school status.
These are indicators, not automatic discharges and not the exclusive ways to prove persistence. Evidence of likely improvement can rebut an indicator. The guidance also states that information from a treating physician may be submitted for a disability or chronic-injury showing but is not required for the presumption to apply; a formal medical opinion is not an absolute prerequisite.
Health and functional limitations
Use medical records, restrictions, treatment history, benefit determinations, and work-capacity information to explain how a condition affects hours, occupations, attendance, or advancement. A diagnosis alone may not show the financial effect. Describe the functional limits, expected duration, treatment outlook, and why available work would not eliminate the shortfall. If caregiving is part of the limitation, document the dependent’s needs and the alternatives you considered.
Employment and earning prospects
Provide a work history, qualifications, applications, interview results, job-search records, wage information for realistic jobs, and evidence of an earnings trend. Explain gaps caused by unemployment, illness, caregiving, relocation, or the failure to obtain the financed degree. A court can distinguish a documented lack of suitable work from a decision to reject reasonable employment, so be candid about both the efforts and the constraints.
Other predictable changes
Identify foreseeable changes such as a fixed benefit, a scheduled loss of support, continuing medical treatment, a dependent’s long-term needs, or a repayment term that extends for many years. Do not promise that circumstances will never improve. Instead, state what is reasonably reliable, what is uncertain, and why the existing evidence supports persistence for the period relevant under your circuit’s law.

Evidence of good-faith efforts to repay
Good faith is broader than a perfect payment record. Assemble an objective chronology showing what you did when payments became difficult and how you investigated available solutions.
- Payment history, including dates and explanations for missed or reduced payments.
- Letters, emails, call logs, and online messages with the servicer or the Education Department.
- Requests for deferment, forbearance, discharge, consolidation, or other account assistance.
- Inquiries about repayment plans and records of applications or eligibility determinations.
- Efforts to obtain work, increase income, reduce expenses, and address other debts.
- Any explanation for choosing not to enter an income-driven repayment plan, supported by account calculations or other facts.
The DOJ guidance says that neither past nonpayment nor failure to enroll in an income-driven plan is dispositive when other evidence supports good faith or a reasonable explanation. Do not assume that a particular number of payments, a specific plan enrollment, or a flawless history is an absolute legal prerequisite unless the law controlling your case says so. Explain the decisions you made and the information available to you at the time.
How to assemble a persuasive evidence record
- Create a master timeline. List loan disbursement, school attendance, graduation or withdrawal, repayment start, deferments, employment changes, medical events, communications, and bankruptcy dates.
- Build a monthly budget. Use current statements, identify each necessary expense, and calculate the result with and without the required loan payment.
- Reconcile every number. Make the budget agree with bank records, tax filings, pay statements, and bankruptcy schedules. Explain discrepancies instead of leaving them for the opposing party to find.
- Document the future. Pair health, employment, age, education, and caregiving evidence with a plain-language explanation of how each fact affects earning capacity or expenses.
- Collect repayment communications. Preserve confirmations, notices, applications, and notes of calls with dates, names, and the substance of the discussion.
- Separate federal and private-loan materials. Federal cases may use the government’s attestation and account review; a private creditor will have different records and arguments.
- Review local procedure. Confirm the adversary-proceeding rules, required pleadings, service requirements, and evidentiary deadlines for the bankruptcy court and circuit involved.
The Justice Department’s federal process contemplates an attestation containing detailed income, expenses, assets, and other circumstances, together with corroborating records. The agency’s resource page, updated March 17, 2026, lists the guidance, a May 2025 attestation form, and a sample scenario. The attestation is an organized evidence vehicle—not a substitute for truthful answers, supporting documents, applicable law, or the judge’s decision.
Federal loans, private loans, and the court’s role
Federal loans reviewed under the DOJ/Department of Education process
For a federal loan in a case where the United States is a defendant, government attorneys can review the attestation and Education account history, and available education history may be shared. They may stipulate to facts or recommend relief when the evidence fits the guidance. That recommendation does not itself discharge any debt. The bankruptcy judge must enter the legal decision.

Private education loans
Private education debt can fall within § 523(a)(8) if it meets the statute’s definition, but the federal attestation process does not automatically govern a private lender. The creditor’s account records, contract terms, payment history, and litigation position may differ. Your evidence should still address present finances, likely persistence, and good faith under the test used by your court.
Full versus partial relief
An adversary proceeding can seek a full discharge or, where the facts support it, partial relief. The court may evaluate whether a defined portion of the debt can be repaid without undue hardship while the remainder cannot. The appropriate request depends on the evidence, the loan structure, and controlling law; do not assume that proving hardship requires an all-or-nothing result.
What DOJ’s reported numbers do—and do not—show
In a July 17, 2024 announcement, the Justice Department reported that 98% of cases decided from November 2022 through March 2024 received full or partial debt relief. It also reported that 96% of filed cases voluntarily used the streamlined process, and that 588 new cases were filed from October 2023 through March 2024, a 36% increase from the preceding six-month period. These figures came from agency surveys of U.S. Attorneys’ Offices.
The figures describe the specified cases and reporting windows; they are not a personal probability of success, a guarantee for a new filing, or a current all-years rate. Case outcomes depend on the jurisdiction, loan type, evidence, opposing party, and judge. The announcement quoted Acting Associate Attorney General Benjamin C. Mizer saying, “The results are clear: this guidance has helped make the promise of a fresh start in bankruptcy a meaningful option for individuals weighed down by student loan debt.” Under Secretary of Education James Kvaal said the data should “puncture the myth that struggling borrowers cannot discharge their student loan debt through bankruptcy.” Those statements describe the program’s reported experience, not a ruling in an individual case.
Common evidentiary mistakes and how to correct them
- Relying on assertions: Replace “I cannot afford it” with a reconciled budget and records for every major figure.
- Showing only today’s shortfall: Add evidence explaining why health, work, age, education, or family circumstances make improvement unlikely.
- Ignoring changes after filing: Update schedules and explain later events with dated documentation.
- Treating government guidance as the legal test: Identify the controlling circuit standard and use the guidance as a federal review framework, not a substitute for case law.
- Assuming nonpayment ends the case: Give the context, communications, repayment inquiries, and reasonable explanations that show your conduct.
- Overstating a medical presumption: A qualifying condition may support the DOJ indicator without a formal doctor’s letter, but the underlying functional and financial effects still need credible evidence.
- Using statistics as odds: Attribute the 2024 numbers to DOJ and keep the reporting periods attached to them.
- Expecting an agency agreement to decide the case: A stipulation or recommendation can help establish facts, but only the bankruptcy court can grant the discharge.
A practical pre-filing checklist
- Identify whether each loan is federal or private and obtain a current account history.
- Confirm which legal test and local adversary-proceeding rules apply in your circuit.
- Gather at least several months of income, expense, bank, debt, and asset records, plus tax and benefit documentation.
- Prepare a household budget that isolates the required student-loan payment and explains every unusual expense.
- Document medical, employment, education, age, unemployment, and caregiving facts that affect future earning capacity or costs.
- Preserve servicer communications, payment history, repayment-plan inquiries, and requests for deferment or forbearance.
- Check that bankruptcy schedules, the attestation if used, and exhibits tell the same factual story.
- Have bankruptcy counsel evaluate whether full or partial relief is supported and how the evidence should be presented.
The most useful record is specific, dated, and internally consistent. It shows the court what your household can realistically pay now, why the hardship is expected to last, and how you responded to the debt before seeking relief.
