The most persuasive explanation is an item-by-item account that links each piece of jewellery to a named family member, a credible acquisition route and contemporaneous records. Reconcile the search inventory (description, weight and any recorded value) with an ownership schedule. Then support each allocation with purchase bills and accounting entries, marriage or gift records, inheritance papers, and consistent family statements. Family status and community customs can provide context, but they do not replace evidence.
Keep the seizure question separate from the assessment question. Central Board of Direct Taxes (CBDT) Instruction No. 1916, dated 11 May 1994, gives officers guidance on quantities that ordinarily need not be seized in specified circumstances. It does not create a universal ownership limit or automatically prove the source of every ornament.

What the tax authorities’ jewellery guidance actually says
CBDT Instruction No. 1916 (11 May 1994) addresses seizure practice for a person who is not assessed to wealth tax. It says that specified quantities of gold jewellery need not be seized and allows an authorised officer to leave a larger quantity with the family after considering family status and community customs. It also requires a detailed inventory.

It should identify individual pieces rather than recording only a combined weight.

Tribunal discussions in 2024 and 2026 have treated these numbers as a reasonable benchmark when considering ordinary family possession, rather than a rigid rule that resolves every assessment. A quantity below a benchmark is not an automatic statutory exemption, and a quantity above it is not automatically unexplained. The inventory, family composition, acquisition history and records remain decisive.
Start with a complete, item-level inventory
Obtain or carefully review the search inventory before preparing explanations. For every necklace, chain, bangle, ring, earring, pendant, coin or other ornament, note the description, gross and net weight if shown, purity or hallmark information if recorded, valuation and the location where officers found it. Preserve the inventory exactly as issued; do not replace its descriptions with a simplified family list.
Reconcile the physical list
Create a working schedule with one row for each inventory entry. Give each row a unique reference number and record the corresponding family member, acquisition route, date or approximate period, source person or seller, document reference and present location of the document. If one inventory entry combines several pieces, explain how the family split that entry and identify the supporting photographs, bills or statements.

Resolve discrepancies immediately
Weights can differ because an inventory may use gross weight while a bill records net gold weight, or because stones and clasps are treated differently. Explain those differences rather than silently changing a number. If an item is described differently from a bill, use distinctive features, photographs, hallmark numbers or jeweller descriptions to show that they are the same piece. Mark any item for which no document survives and prepare a factual account of why.
Identify who owns each item
A family-wide claim that “all jewellery belongs to the household” is harder to test than a specific allocation. State which person claims each item and keep that allocation identical in statements, tax replies, wealth or asset schedules and supporting correspondence. Include the person’s relationship to the taxpayer, marital status where relevant, and whether the item was in that person’s possession or stored jointly when the search occurred.
Use an ownership schedule
The schedule should contain at least these columns:

- Inventory reference and exact description.
- Claimed owner and relationship to the searched person.
- How and when the owner acquired it.
- Seller, donor or predecessor from whom it came.
- Bill, account entry, marriage record, gift note, succession paper or other document reference.
- Statement or witness that explains the item.
- Any gap, contradiction or uncertainty requiring clarification.
Statements from family members are useful contextual evidence, but a statement made after the search is not independently conclusive. It is most credible when it matches the inventory, earlier family records and an acquisition event that can be independently checked.
Match the evidence to the acquisition route
Purchased jewellery
For a purchase, assemble the original bill or a verifiable copy showing the date, jeweller, description, weight and price. Link the payment to a bank record, cash-book entry or other payment evidence where available. Then locate the matching entry in the purchaser’s books of account, balance sheet or personal asset records. If the purchase was made by a family member who is not the taxpayer, show that person’s funds or financial records and explain why the item was kept at the searched premises.
Where a bill describes several pieces together, identify which inventory items it covers and reconcile total weight and value. A bill without a plausible payment trail or accounting treatment may need additional explanation; do not present the bill as proof of every element if it does not identify the owner or the item clearly.
Jewellery received at marriage
For marriage-related jewellery, identify the marriage date, the person who received the item, and whether it came from the bride’s or groom’s family or another named donor. Marriage invitations, registration records, photographs, contemporaneous family ledgers, lists prepared for the ceremony and correspondence can help establish the occasion. A clear account of customary gifts should specify who gave what, rather than relying only on a general statement that jewellery was received at marriage.
Customs vary by community and family. Explain the relevant custom and the family’s circumstances without claiming that a custom creates an automatic tax allowance. If an item was later remade, exchanged or combined with older pieces, preserve the jeweller’s remake or exchange documents and explain the change in weight or design.

For gifts at birthdays, religious events or other family occasions, identify the donor, recipient, date or event and the donor’s relationship and capacity to give the item. Gift deeds, jeweller bills in the donor’s name, contemporaneous notes, photographs or correspondence may support the account. The available evidence will differ by family and period; no single document is universally required by the material discussed in the tribunal decisions.

Inherited jewellery
An inheritance explanation should connect three facts: the predecessor owned the jewellery, the predecessor died or transferred it, and the claimed owner received it. Useful records can include the predecessor’s purchase bills, earlier asset or wealth records, a will, succession or probate papers, family settlement documents, partition records and statements from persons who handled the estate. Explain the chain of custody if the jewellery passed through more than one generation before reaching the person present during the search.
Present the three evidence layers together
No source category is universally ranked as sufficient on its own. A coherent file combines direct acquisition records, source-event records and contextual evidence.

The strongest presentation connects all three layers to the same inventory reference. Avoid submitting a stack of unrelated bills or generic affidavits that do not identify the pieces found.
Step-by-step response after a search
- Secure the official papers. Keep the search warrant, panchnama, inventory, valuation sheets and statements recorded during the search. Note who signed each document and preserve copies.
- Freeze the facts. Do not move, sell, melt or remake the jewellery while the description and ownership are being clarified. Photograph each piece against its inventory reference if lawful and practical.
- Build the item schedule. Reproduce every inventory entry and assign a claimed owner, acquisition route and document reference. Mark unknowns instead of guessing.
- Collect primary records. Retrieve purchase bills, payment records, books, balance sheets, marriage and gift material, succession papers and predecessor records. Ask jewellers for duplicate invoices or remake records only where they can be authenticated.
- Prepare consistent statements. Each owner should describe only what that person knows: when the item was received, from whom, where it was kept and what records exist. Reconcile differences before filing a response.
- Explain quantity and custom separately. Compare the family’s holdings with the Instruction No. 1916 benchmarks, identify the relevant family members and describe any customary or exceptional circumstances. Do not call the benchmark an exemption.
- Answer item-specific queries. If the assessing officer asks about weight, valuation, funds or a donor, respond by inventory reference and attach the matching record. Explain missing documents and the steps taken to verify the history.
- Obtain qualified review. An Indian tax lawyer or chartered accountant can check whether the schedule, statements and accounting treatment are consistent with the assessment record and procedural deadlines.
How to discuss quantities above or outside the benchmark
Begin with the family composition used in the explanation: how many married women, unmarried women and male members were ordinarily part of the household, and which person claims each item. Then show the total by owner and acquisition route. If the aggregate exceeds 500 grams per married lady, 250 grams per unmarried lady or 100 grams per male family member, explain the documented purchases, marriages, gifts, inheritances and family customs that account for the excess.
The officer may consider family status and community customs when deciding what not to seize, and the instruction permits exclusion of a larger quantity in appropriate circumstances. That discretion is not a guarantee that the same quantity will be accepted as explained income in assessment. Conversely, jewellery below the benchmark can still raise questions if ownership or source records conflict.

Correction: Map every inventory reference to one claimed owner or explain documented co-ownership, then reconcile the subtotals.

Weakness: Saying that all jewellery came from marriage or tradition without naming donors, occasions or recipients.
Correction: Prepare an event-specific account and attach whatever contemporaneous records, photographs, bills or family records survive.
Using the CBDT figures as a safe-harbour limit
Weakness: Arguing that jewellery under the figures must be accepted, or that jewellery over them must be treated as undisclosed.
Correction: Describe the figures as seizure guidance and use the actual acquisition evidence to address the assessment.
Contradictory statements
Weakness: Different family members give different owners, dates or donors for the same piece.

Correction: Reconcile the inventory and records first. Correct an honest mistake transparently; do not create a new explanation merely to fit a benchmark.
Unexplained valuation or weight changes
Weakness: A bill, remake receipt and inventory show different weights with no bridge between them.
Correction: Separate gold weight, stones and workmanship, and document exchange, remaking or additions with jeweller records.

What tribunal decisions do—and do not—establish
Tribunal decisions discussed in 2024 and 2026 illustrate that outcomes turn on the evidentiary record and surrounding circumstances. They treat Instruction No. 1916 as a practical benchmark in possession and seizure disputes, not as a universal statutory ceiling. Those decisions cannot predict the result for a different family without its inventory, composition, acquisition history, documents and procedural context.
Accordingly, an explanation should avoid promising that an officer will release every item or that an addition to income cannot be made. The defensible position is narrower: identify the item, identify the owner, prove or credibly document the acquisition route, and explain any remaining gap.
Practical file checklist
- Complete search inventory with description, weight and recorded valuation for every item.
- Owner-by-owner schedule matching each inventory reference.
- Purchase bills and payment evidence, with matching books or balance-sheet entries.
- Marriage records and a specific account of jewellery received at each occasion.
- Gift records or contemporaneous material identifying donor, recipient and event.
- Inheritance, will, succession, probate, partition or family-settlement records.
- Predecessor ownership evidence where inheritance is claimed.
- Family statements that match the schedule and other records.
- Photographs, hallmark details and jeweller remake or exchange records where identification is disputed.
- A written explanation of family status, community customs and any quantity outside the Instruction No. 1916 benchmark.
Because a search and assessment involve procedural deadlines and potentially significant tax exposure, have the completed file reviewed by a qualified Indian tax professional before submitting a formal response. The evidence must tell one consistent story from the inventory through the claimed owner and acquisition event to the supporting record.
