Co-signing makes you legally responsible for another person’s loan if that person does not pay. Depending on the contract and applicable state law, the lender may demand payment from you without first exhausting collection efforts against the primary borrower. The debt can appear on your credit reports, affect your ability to qualify for other credit, and expose you to collection activity. Co-signing alone usually gives you no ownership of the car, home, education, or other property purchased with the loan.
Rules differ by loan type, state, lender, and contract. Treat the signed agreement—not an informal promise between family members—as the controlling document.

What a co-signer actually agrees to
A co-signer signs a loan agreement to strengthen the borrower’s application, usually because the borrower has limited credit history, insufficient income, or a debt-to-income ratio that does not meet the lender’s standards. By signing, the co-signer guarantees or undertakes responsibility for repayment. If the borrower stops paying, the lender can generally pursue the co-signer for the amount allowed by the contract and law.
The Federal Trade Commission’s standard Notice to Cosigner warns: “The creditor can collect this debt from you without first trying to collect from the borrower.” That warning is not universal in every state or every contract; some states require a creditor to try the primary borrower first, and the agreement may contain additional procedures. The FTC notice itself does not create the liability. The signed loan documents do.

What may be included in the amount owed
Responsibility may extend beyond the scheduled principal and interest. Depending on the agreement and applicable law, the lender may seek:
- Unpaid principal and accrued interest
- Late charges allowed by the contract
- Collection costs or attorney fees allowed by law
- A remaining balance after collateral is repossessed and sold
The FTC cautions that a lender does not necessarily have to provide a single maximum-dollar figure when a prospective co-signer asks for one, although a lender may choose to do so. Read the agreement for caps, fee provisions, acceleration clauses, and language making the entire balance due after default.
Who is responsible when the borrower stops paying?
Both the borrower and co-signer can be responsible for the debt. A lender may contact either person, send collection notices, file a lawsuit, or use other remedies available under the contract and local law. The lender’s ability to proceed directly against a co-signer is often described as “joint and several” or “several” liability, but the exact wording matters.

Collection remedies are not automatic in every case. The FTC notice says a creditor may use the same collection methods against a co-signer as against the borrower, including suing or seeking wage garnishment. Whether a particular remedy is available depends on state and federal law, court procedures, exemptions, the type of debt, and the facts of the default. A demand letter is not the same as a court judgment, and a creditor generally must follow legal process before garnishing wages.

If the lender sues
Do not ignore a summons. The deadline to answer is set by the court and can be short. Filing an answer preserves defenses and prevents a default judgment; it does not admit that every amount demanded is correct. Gather the note, payment history, notices, proof of payments, and any communications about a promised release. A consumer-law attorney or legal-aid office can explain defenses, state limitations periods, and exemptions that apply where you live.
Does co-signing affect your credit?
Usually, yes. The lender may report the co-signed account as your debt. A payment made on time can add positive history, but a late payment, charge-off, or default can appear on your credit reports and lower your scores. The account can also increase your reported obligations when another lender calculates your debt-to-income ratio or evaluates your capacity to repay.
For private student loans, Consumer Financial Protection Bureau guidance specifically says missed payments may be reflected on both the borrower’s and co-signer’s credit reports. After default, the lender may refer the account to a collection agency or sue, subject to applicable law. Other loan types are also commonly reported, but reporting practices and the timing of updates depend on the creditor and the account.
How to monitor the account
- Ask the lender whether it will send you monthly statements, provide online access, or notify you after a missed payment or material change.
- Keep copies of the signed note, disclosures, payment schedule, insurance requirements, and every notice.
- Review your credit reports regularly for the account’s status, balance, payment history, and ownership information.
- Dispute inaccurate reporting with the credit bureau and furnish the supporting records to the lender.
Monitoring does not change your legal obligation, but it can give you time to address a missed payment before additional fees, credit damage, repossession, or litigation.

Co-signer, co-borrower, co-buyer, and co-applicant: the terms are not interchangeable
People often use these labels casually, but the documents and the benefits each person receives are more important than the label.
| Role | Typical relationship to the debt | Ownership or benefit |
|---|---|---|
| Co-signer | Promises to repay if the primary borrower does not; may be pursued for the debt. | Usually receives no loan proceeds and no ownership merely from signing. |
| Co-borrower | Applies for and owes the loan alongside another borrower. | May receive the loan’s benefit; ownership depends on the purchase documents and title. |
| Co-buyer | Purchases property with another person and may also sign the financing. | Often has a purchase or title interest, but the documents control. |
| Co-applicant | Applies jointly; may become a borrower if the lender approves the application that way. | Depends on the loan and purchase agreements. |
Check the signature block, definitions, promissory note, security agreement, and title or deed. A person can be both a co-borrower and an owner, while another signer can be liable for repayment without owning the asset.
Does a co-signer own the car, home, or other property?
Not automatically. Co-signing is a credit obligation, not a transfer of title. If you co-sign an auto loan and your name is not on the vehicle title or purchase contract, you generally do not acquire the right to possess or sell the car simply because you may have to pay the loan.

What happens with an auto loan?
For an auto loan, the co-signer shares responsibility for repayment and can suffer the same credit consequences as the borrower. If payments are missed, the lender may declare a default and repossess the vehicle under the contract and state law. The lender can then sell the vehicle and apply the proceeds to the balance.
If the sale does not cover the payoff, a deficiency may remain. Depending on state law and the contract, the lender may sue the borrower, the co-signer, or both for that balance. State rules can limit deficiency claims or require specific notices, so the result is not the same everywhere.
If an auto borrower misses a payment
- Contact the lender promptly and ask for the exact delinquent amount, due date, and reinstatement requirements.
- Request written confirmation of any payment arrangement and ask whether repossession activity is paused.
- Determine whether making a payment protects the vehicle and whether the borrower will reimburse you.
- If repossession occurs, obtain the redemption or reinstatement deadline and the post-sale accounting.
- Challenge calculation or notice errors in writing and seek legal advice before signing a deficiency agreement.
What is different about private student loans?
For private student loans, CFPB guidance describes the co-signer as having equal legal responsibility for repayment. A missed payment can affect both credit reports, and the lender may use a collection agency or file suit after default. Private lenders set their own co-signer-release policies, so there is no universal right to be removed after a certain number of payments.
Review the lender’s published release criteria before signing. Requirements may include a specified number of consecutive, on-time payments, a borrower credit review, income verification, and a satisfactory debt-to-income ratio. Meeting a stated threshold may permit an application, not guarantee approval. Some contracts require the borrower to submit a release request; others require the lender’s review at a particular point in the repayment schedule.

How to evaluate a co-signing request before signing
Use the following checklist and answer it with documents, not assurances.
- Affordability: Could you make every monthly payment, or potentially pay the full balance, if the borrower stopped paying tomorrow?
- Maximum exposure: What principal, interest, late fees, collection costs, acceleration charges, and legal fees can the contract impose?
- Term and payment structure: What is the interest rate, payment amount, maturity date, variable-rate formula, and total number of payments?
- Access to information: Will you receive statements, online account access, missed-payment alerts, and notices of changes?
- Collateral: What asset secures the loan, who owns it, and what happens after repossession or sale?
- Release: Is there a written release provision, and what payment history, credit, income, or other criteria apply?
- State protections: Which state’s law governs, and what does the state banking agency or attorney general say about co-signer rights?
- Relationship risk: What is your plan if the borrower loses a job, refuses to communicate, or disputes responsibility?
Obtain a complete copy of the application, note, disclosures, security agreement, insurance requirements, and any separate co-signer notice before signing. Never rely on a verbal promise that you will be removed later unless the lender confirms the process in writing.
Can you be removed as a co-signer?
Release is not automatic. The borrower and lender may both need to agree, and the lender may require a new underwriting decision. Some agreements include a release option after a defined payment history; others permit refinancing into a new loan without you. A borrower’s improved credit or a run of on-time payments does not by itself end your liability.

- Find the release clause and list every eligibility requirement.
- Ask the lender for its current application, documentation, and processing timeline.
- Have the borrower submit the required income, credit, and payment-history information.
- Obtain written confirmation that the lender approved the release and the effective date.
- Check your credit reports and keep the approval, payoff, or amended agreement permanently.
If the lender will not release you, the borrower may need to refinance, pay off the loan, sell the collateral, or qualify under another permitted option. Until the lender provides a written release or the debt is paid in full, assume you remain liable.
What to do when the borrower is already behind
- Verify the status: Contact the lender through a known official channel and request the current balance, delinquency, fees, and next enforcement date.
- Protect communication: Ask for statements and notices in writing, and save call notes with dates, names, and promised actions.
- Assess payment options: Compare bringing the account current, a documented hardship arrangement, refinancing, or selling collateral. Do not promise more than you can afford.
- Coordinate with the borrower: Put reimbursement agreements, possession arrangements, or sale plans in writing. A private promise does not bind the lender.
- Address credit errors: Review both the payment history and balance; dispute inaccurate information promptly.
- Get legal help for escalation: Consult a qualified attorney or legal-aid provider if you receive a lawsuit, garnishment notice, repossession notice, or settlement proposal.
Federal notices and limits of general guidance
For certain covered consumer-credit transactions, FTC guidance describes a Notice to Cosigner requirement under the Credit Practices Rule. The FTC rule guidance does not cover every transaction, and transactions involving the purchase of real estate are excluded from that notice framework. Banks and other financial institutions may be subject to related rules administered by their own regulators.
The FTC consumer guidance was listed as published April 2, 2024. CFPB consumer pages used for auto and private-student-loan guidance show review dates from 2023 to 2024. Laws, lender policies, and contract forms can change. Confirm the current rule for your state, the type of loan, and the institution involved before signing or responding to a default.
The decision in one sentence
Co-sign only when you can withstand the possibility of paying the entire permitted debt, losing borrowing capacity, and suffering credit or collection consequences without receiving ownership of the financed property. If that risk would threaten your finances, declining is safer than relying on the borrower’s promise to pay.
