An executor is the person responsible for carrying out a deceased person’s will and settling the estate. In practical terms, that means securing property, obtaining court authority, identifying and valuing assets, paying valid debts and taxes, keeping accurate accounts, distributing what remains to the correct beneficiaries, and completing the closing process. If there is no will, a court appoints an administrator and state intestacy law determines who inherits.
This is general U.S. information. Probate forms, creditor-notice rules, filing deadlines, fiduciary compensation, and the level of court supervision vary by state, by the type of administration, and by the assets involved.

What an executor is—and what the job requires
An executor (also called a personal representative in many states) acts as a fiduciary. The estate, not the executor personally, owns estate property during administration. The representative must protect that property, follow the will and applicable law, treat beneficiaries evenhandedly, and keep records that explain every receipt, expense, and distribution.

The Federal Trade Commission likewise states that the executor named in a will is responsible for settling the deceased person’s debts. Those responsibilities do not make the executor personally liable for every debt; personal exposure can arise, however, if the representative misuses estate property, ignores legal priorities, distributes assets before reserving for taxes and claims, or violates a court order.

Executor, administrator, and beneficiary are different roles
- Executor: the person named in a valid will and appointed by the probate court.
- Administrator: the court-appointed representative when there is no will, the named executor cannot serve, or the will is not admitted.
- Beneficiary or heir: a person entitled to property under the will or intestacy law. A beneficiary can also be the executor, but the fiduciary duties still apply.
Step 1: Find the documents and secure the property
Start with preservation, not distributions. Locate the original will and any codicils, then gather the records needed to prove ownership, value, insurance coverage, and outstanding obligations.
Documents to locate
- Original will, codicils, trusts, and funeral or burial instructions.
- Several certified death certificates, which banks, insurers, and government agencies commonly require.
- Deeds, titles, leases, homeowners’ or renters’ insurance, vehicle records, and property-tax bills.
- Bank, brokerage, retirement, pension, annuity, and life-insurance statements.
- Credit-card, mortgage, medical, personal-loan, and utility records.
- Federal and state tax returns, payroll records, business books, and partnership or shareholder agreements.
- Passwords, password-manager instructions, domain names, cloud-storage records, social-media information, and other digital-account details, handled in accordance with account terms and state law.
Immediate protection measures
Arrange for someone to watch vacant property, stop mail from accumulating, preserve temperature-sensitive systems, and maintain necessary insurance. Secure vehicles, jewelry, firearms, collectibles, cash, documents, and electronics. Photograph rooms and high-value items before moving anything. Do not throw away papers or erase devices until their evidentiary and financial value has been evaluated.
Make a dated log of every person who has keys or access. If a home, business, or storage unit is shared with another person, document the condition and contents rather than attempting a private division.

The IRS says the first step is usually to apply for probate or administration. File the will and the petition for appointment in the court that has jurisdiction over the decedent’s residence or property, using that court’s forms and notice procedure. Some assets pass outside probate, but a court proceeding may still be needed to transfer real estate, resolve claims, or establish authority for financial institutions.
Supervised and independent administration
| Feature | Supervised probate | Independent probate |
|---|---|---|
| Court involvement | The court reviews more transactions, notices, accountings, or proposed distributions. | The representative can handle more tasks without advance approval, subject to statutory duties and possible court review. |
| Typical paperwork | More petitions, reports, approvals, and formal accountings. | Fewer routine approvals, but records and required notices remain essential. |
| When it may be used | Contested estates, significant creditor or beneficiary disputes, or a court-ordered process. | Eligible estates in states that permit streamlined administration and where interested parties agree or the will authorizes it. |
| What does not change | The fiduciary sequence remains: identify property, address claims and taxes, account for transactions, and distribute only when legally permitted. | |
Whether a proceeding is supervised or independent is a state-law question. Do not assume that a will’s instructions, a family agreement, or a small-estate affidavit eliminates every filing or notice requirement.

Step 3: Obtain formal authority and an estate EIN
After appointment, request certified letters testamentary, letters of administration, or the equivalent document issued by the probate court. Financial institutions and registries often require a certified copy before they will release information or retitle property.
IRS Publication 559 instructs the representative to obtain an employer identification number (EIN) for the estate and notify the IRS of the fiduciary relationship. Use the estate EIN—not the decedent’s Social Security number—for estate bank accounts, Form 1041 filings, and other estate transactions when required. Keep the appointment order and certified letters in a secure file; institutions may require recently issued copies.
Set up a clean operating system
- Open a bank account titled in the estate’s legal name and EIN.
- Route estate income into that account and pay estate expenses from it.
- Use a transaction ledger that identifies the date, payee, purpose, amount, check or transfer number, and supporting receipt.
- Store court papers, tax filings, appraisals, notices, and correspondence in a system that can be handed to a successor or reviewed by the court.
Step 4: Inventory, value, and safeguard assets
Prepare an inventory that separates what the decedent owned alone from property that passes by joint ownership, beneficiary designation, trust, or another nonprobate mechanism. A retirement account or life-insurance policy may go directly to its named beneficiary; that does not automatically make it available to pay estate bills.
Build the inventory
- List each asset, its owner, account or title number, location, estimated date-of-death value, and whether it is subject to a lien.
- Record jointly owned property and the survivorship language shown on the deed or account.
- Identify payable-on-death, transfer-on-death, retirement, and insurance beneficiaries, then obtain current beneficiary confirmations.
- Note digital assets, royalties, refunds, deposits, and potential claims that may not appear on a traditional statement.
Obtain defensible values
Use account statements for traded securities, payoff statements for debts, and qualified appraisals for real estate, businesses, art, collectibles, or other property whose value is uncertain. Preserve the appraiser’s report and the valuation date. The IRS identifies collection, appraisal, and an accounting of assets and debts as core representative responsibilities. A defensible valuation affects tax returns, creditor decisions, equalization among beneficiaries, and the amount that must be reserved.
Continue safeguarding the property while it is held. Keep buildings insured, arrange maintenance, protect vehicles from loss, and follow lease or business obligations. If an asset is deteriorating or expensive to maintain, obtain legal advice before selling it; a sale may require notice, an appraisal, or court approval.

Step 5: Identify debts and handle creditor claims
Create a list of every apparent obligation, including secured loans, credit cards, medical bills, utilities, taxes, employee wages, leases, and expenses of administration. Notify creditors in the manner and time period required by the state. Some jurisdictions require publication in a newspaper or an approved online notice; others require direct notice to known creditors.

- Match the claim to the decedent, account, and billing period.
- Check whether insurance, a co-signer, a joint owner, or collateral changes who owes the debt.
- Ask for supporting statements and confirm that interest and fees are authorized.
- Accept, negotiate, or reject the claim using the state’s procedure and deadline.
- Pay approved claims in the legally required priority from the estate account, not from a beneficiary’s personal funds.
The FTC advises people with questions about paying a decedent’s debts or state probate law to seek legal advice. Do not pay a family member’s demand simply because it appears urgent, and do not distribute the estate while a disputed or unknown claim could leave the estate short of funds.
Step 6: File the required tax returns and pay taxes
Tax work has separate federal and state layers. The decedent’s final individual return covers income through the date of death. The estate may then have its own income-tax filing, estate-tax filing, inheritance-tax filing, or fiduciary returns.
| Filing or payment | When it may apply | Key point |
|---|---|---|
| Final Form 1040 | When the decedent had a filing obligation for the year of death. | Report the decedent’s income through the date of death and claim allowable items under the applicable rules. |
| Form 1041, U.S. Income Tax Return for Estates and Trusts | A domestic estate generally files when gross income reaches $600 or more, subject to IRS rules and exceptions. | The threshold is stated in IRS materials for 2025; verify the current instructions for the tax year being filed. |
| Form 706, United States Estate (and Generation-Skipping Transfer) Tax Return | Filing rules may apply based on the gross estate, adjusted taxable gifts, and elections. | The IRS Form 706 instructions state a $15,000,000 gross-estate threshold for decedents dying in 2026. A portability election may be available regardless of estate size when the filing conditions are met. |
| State estate or inheritance return | Depends on the decedent’s state, property location, beneficiary relationship, and current exemption. | State thresholds and deadlines are not uniform; check the governing state’s instructions. |
Deadlines to put on the calendar
IRS Publication 559 lists Form 706 as generally due nine months after death when filing is required. An extension may extend the time to file, but it does not automatically extend the time to pay tax. The date of death, filing year, extensions, estimated payments, and state rules must be recorded separately.
Tax returns should be coordinated with the inventory and appraisals. A late-discovered account can change the estate’s income, valuation, and reserve. Ask a fiduciary CPA or estate-tax professional for help when the estate earns income, may owe estate tax, operates a business, includes nonresident beneficiaries, or requires multiple returns.

Step 7: Manage property and maintain a complete accounting
Administration can last long enough for property to gain or lose value, earn income, incur expenses, or require a sale. Review insurance, taxes, leases, investment statements, and maintenance needs at regular intervals.
What the accounting should show
- Beginning assets and the date each came under estate control.
- Income such as interest, dividends, rent, refunds, or business receipts.
- Every administration expense, debt payment, tax payment, and professional fee.
- Asset sales, sale costs, proceeds, and any appraisal or approval supporting the transaction.
- Distributions, the recipient, the date, the property or amount, and the receipt or release.
- Assets still held, reserves for unresolved liabilities, and the proposed final balance.
Provide accountings to beneficiaries or the court when required. Keep original receipts and electronic statements even if a bank portal later removes access. A separate estate account and contemporaneous records are stronger protection than trying to reconstruct transactions months later.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Step 8: Distribute assets only when the estate is ready
Before transferring anything, reconcile the will with beneficiary designations, joint ownership, later amendments, and applicable intestacy rules. Confirm that creditor periods have expired or claims are resolved, taxes are filed or adequately reserved, administration expenses are paid, and the court has issued any required approval.
Use a distribution plan
- Prepare a schedule showing each beneficiary, the governing provision, the asset or cash amount, and any adjustment for liens or expenses.
- Set aside a reserve for unresolved taxes, claims, and closing costs.
- Obtain beneficiary instructions for securities, real estate, and personal property transfers.
- Use deeds, account-transfer forms, vehicle titles, or other official instruments rather than informal handoffs.
- Obtain receipts, releases, or acknowledgments when appropriate under state law.
Do not favor the beneficiary who asks first, and do not treat a specific bequest as interchangeable with a residuary share without legal authority. If the estate cannot pay all valid debts, stop distributions and obtain advice about insolvency priorities.
Step 9: Close the estate and retain records
Closing is a legal step, not simply an empty bank account. Resolve outstanding claims, finish tax filings, obtain tax clearances or closing documentation when the jurisdiction uses them, complete the final accounting, and file the closing petition or equivalent document.

Follow the court’s order for final distributions and discharge. Keep the will, appointment papers, accountings, tax returns, appraisals, notices, releases, and proof of distributions for the period required by state law and tax rules. Do not close the estate account until checks have cleared and the court or governing procedure permits closure.
How the estate’s facts change the workload
| Factor | What becomes more difficult | Likely professional support |
|---|---|---|
| Supervised administration | More approvals, notices, and formal accountings. | Probate lawyer to manage filings and hearing dates. |
| Independent administration | Fewer routine approvals, but the representative carries more responsibility for correct decisions and records. | Lawyer for unusual transactions or disputed issues. |
| Testate estate | The will controls only if it is valid and admitted; conflicts may require construction or litigation. | Probate lawyer when provisions are ambiguous or challenged. |
| Intestate estate | State priority and heirship rules determine who inherits and who may serve. | Lawyer or heirship specialist when family relationships or locations are unclear. |
| Low liquidity | There may be property but not enough cash for taxes, debts, or expenses. | Lawyer and financial professional before borrowing or selling assets. |
| Many or unusual assets | Businesses, digital property, private investments, collectibles, and real estate require different valuation and transfer methods. | Appraiser, CPA, realtor, business adviser, or specialist counsel as appropriate. |
| Creditor disputes | Deadlines, proof, priority, and settlement decisions can create personal risk. | Probate lawyer before accepting, rejecting, or paying a contested claim. |
| Tax exposure | Multiple federal and state returns, valuations, elections, and reserves may interact. | Fiduciary CPA or estate-tax professional. |
| Multi-state property | Property outside the home state may require an ancillary proceeding and separate notices or taxes. | Lawyers licensed in the relevant jurisdictions. |
How long does settling an estate take?
There is no universal executor timetable. The IRS stated in 2026 that probate will generally open within 30 to 90 days after death, depending on state law, but opening the case is only the first administrative milestone. The total period depends on the court’s schedule, creditor-notice period, asset sales, tax filings, disputes, and whether property is located in more than one state.
Use a dependency-based calendar instead of promising a finish date: appointment must precede access to many accounts; the inventory and valuations inform creditor and tax decisions; claim and tax work must be sufficiently resolved before final distributions; and closing documents follow the final accounting. A lawyer can identify the controlling dates for the particular state and proceeding.

Compensation is not governed by one national rule. A will may set a method, state statutes may provide a percentage or hourly standard, and a court may approve or adjust a fee. Some people serve without compensation, while others seek payment for ordinary services and separate reimbursement for reasonable expenses. Review the will and local law before taking a fee, disclose it in the accounting, and obtain court approval when required.
When professional help is especially important
Consult a probate lawyer before acting on a contested will, disputed creditor claim, insolvent estate, real-estate or business asset, multi-state property, beneficiary conflict, or uncertainty about personal liability. Legal advice is also prudent when family members disagree about possession, the will’s meaning, or whether a transfer was valid.
Engage a fiduciary CPA or estate-tax professional when the estate earns income, may owe estate tax, operates a business, includes nonresident beneficiaries, or requires several federal or state returns. An appraiser may be necessary for real estate, a closely held business, art, jewelry, or collectibles. A realtor or other sale professional can help with disposition of property, but the executor still needs legal authority for the transaction.
Quick Recap
Common failure points and how to avoid them
- Acting before appointment: Signing contracts or moving funds without authority can create disputes. Preserve property and use the court process to establish authority.
- Mixing money: Paying estate bills from a personal account obscures ownership and reimbursement. Use the estate account and retain proof.
- Missing a hidden asset: Search tax returns, mail, employer records, digital accounts, and safe-deposit information before declaring the inventory complete.
- Ignoring nonprobate transfers: Joint ownership and beneficiary designations can change who receives an asset, but they do not automatically eliminate every tax or creditor question.
- Distributing too soon: Keep a documented reserve until creditor, tax, and closing obligations are addressed.
- Assuming federal rules answer state questions: Probate procedure, notice periods, compensation, inheritance taxes, and required clearances are jurisdiction-specific.
- Relying on stale tax figures: Federal thresholds and forms change. Verify the instructions for the decedent’s year of death before filing.
