There is no single nationwide packet. In the United States, an heir usually starts with the brokerage, IRA custodian, bank, or transfer agent that holds the investment and requests its current death-claim or re-registration instructions. Common requirements are acceptable proof of death, the institution’s claim form, identification and taxpayer information, and—when the asset belongs to a probate estate—court papers proving who may act for the estate.
Start with the account’s legal registration
The documents depend less on the investment’s market value than on how the account is titled and who is legally entitled to request the transfer. A firm may use different packets for an individually owned brokerage account, a transfer-on-death (TOD) account, an inherited IRA, a trust account, or a paper stock certificate. State law and the institution’s own procedures also affect the result.

Before gathering paperwork, make a list for each holding: the institution or transfer agent, account number, registration name, account type, named beneficiary, and whether the asset is held electronically or as a paper certificate. Then ask that institution for its current forms, acceptable document formats, mailing or upload instructions, and signature requirements. Guidance published by FINRA and Investor.gov describes general processes, but older educational pages should not be treated as a promise that a firm’s forms or rules are unchanged.

Commonly requested documents
The following documents are frequently requested, but no item should be assumed to satisfy every firm or every state. Ask the institution whether it needs an original, a certified copy, a recent copy, a medallion guarantee, a court document with a visible seal, or another specific format.

- Claimant identification and personal information: A beneficiary, surviving owner, executor, administrator, or trustee may need government-issued identification, address and contact details, date of birth, and a Social Security number or other taxpayer information requested by the institution.
- Court appointment papers: If the investment is estate property, the person acting for the estate generally provides Letters Testamentary, Letters of Administration, or an equivalent appointment document. The firm may require a current document bearing an original or clearly visible court seal.
- Trust evidence: A trustee may need the trust agreement, a certification or abstract of trust, and proof of current trustee authority. Exact requirements depend on the trust, the account registration, and whether the deceased was the grantor, trustee, or beneficiary.
- Paper-security documents: A physical certificate may require the original certificate, a properly completed securities power or endorsement, and a signature guarantee from an eligible financial institution.
Choose the correct route for each type of ownership
| Registration or asset situation | Who usually starts the claim | Documents commonly requested | Probate implication |
|---|---|---|---|
| Named TOD or beneficiary registration | The named beneficiary | Death certificate, beneficiary claim or re-registration form, identification and taxpayer details | TOD is designed to pass the security outside probate, but the beneficiary still has to apply and complete the transfer process. |
| Individual account with no effective beneficiary | Executor or court-appointed administrator | Death certificate, institution’s estate packet, current Letters Testamentary or equivalent, claimant identification | The account is generally handled as probate estate property under the representative’s authority. |
| Joint account with survivorship features | Surviving owner | Death certificate, survivorship or account-transfer form, surviving owner’s identification; additional documents if the registration is unclear | The survivorship terms and state law determine whether the asset avoids probate. |
| Account held by a trust | Authorized trustee or successor trustee | Death certificate when a trustee or beneficiary has died, trust certification or relevant trust pages, proof of trustee authority, identification | The trust terms and registration control the transfer; a probate appointment may not be the document that gives the trustee authority. |
| Paper stock or bond certificate | Beneficiary, surviving owner, or estate representative, depending on registration | Original certificate, transfer form or securities power, death and authority documents, possible medallion signature guarantee | Probate status follows the registration; the paper format adds transfer formalities. |
| Inherited IRA | Each named beneficiary | IRA beneficiary claim form, death certificate, identification and requested Social Security or taxpayer information | The custodian’s beneficiary process governs the account setup; do not assume the IRA can be handled like an ordinary brokerage account. |
Transfer-on-death and other named-beneficiary accounts
Investor.gov describes TOD registration as a way to pass securities directly to another person or entity at death without going through probate. That does not mean the beneficiary receives the account automatically. The beneficiary normally contacts the custodian or transfer agent, submits its claim and re-registration paperwork, provides proof of death, and establishes an account in the required registration.
Check the beneficiary designation on file, including whether it is primary or contingent and whether multiple beneficiaries are listed. A will does not ordinarily replace a valid TOD designation for the security. If the named beneficiary died first, cannot be located, or the designation conflicts with the firm’s records, the institution may route the asset to the estate or request additional legal documentation.

When an executor or administrator must act
For an individually owned investment that has no controlling beneficiary or survivorship feature, the estate representative generally must prove court authority. The probate court issues Letters Testamentary or a similar appointment document authorizing the estate administrator to act for the deceased. The representative then uses the firm’s estate packet to collect the investment, pay lawful estate expenses and creditors, and distribute the remaining property under the will or applicable law.

Ask the probate clerk for the exact name and format of the appointment document used in the state where the estate is administered. A brokerage may reject an expired, incomplete, or uncertified letter, or require a newly issued copy even when another institution accepted an older one. If there are co-executors, the firm may require signatures from all of them or evidence that one has authority to act alone.

Inherited IRAs require a separate claim workflow
FINRA’s investor guidance says the process generally begins with each beneficiary completing the IRA provider’s beneficiary claim form. Be ready to provide a death certificate and identity information such as a Social Security number, along with any relationship or beneficiary verification the custodian requests.
Do not move the assets or elect a distribution method before the provider explains the available inherited-IRA registration choices. Beneficiary type, the owner’s age and required distributions, and the date of death can affect the tax treatment. A beneficiary is not required to transfer an inherited IRA to another firm simply because the original custodian’s process is inconvenient; obtain written instructions and compare the consequences before signing a transfer request.

Paper certificates and signature guarantees
Electronic brokerage holdings are usually transferred through the firm’s internal process. A paper certificate can require extra steps. The transfer agent may ask for the original certificate, a completed stock power or endorsement, and a signature guarantee on the signature that authorizes the transfer.
A medallion signature guarantee is different from an ordinary notary stamp. Investor.gov explains that it is obtained from a financial institution participating in a Medallion signature guarantee program. Ask the transfer agent which program and form it accepts before signing or mailing an original certificate. Do not send an altered certificate or an unrequested original document; use insured delivery and retain copies of everything submitted.

Documents that are not universal prerequisites
A will, a tax return, Form 706, Form 1041, an employer identification number, or a court filing may be relevant to estate administration without being required to open every investment claim. The institution may request a will to understand the estate’s instructions, but a will alone usually does not prove that the signer has authority to act for a probate estate. The appointment letter is the document that generally establishes that authority.
Tax filings are separate obligations. The IRS states that a final individual income-tax return may be required for the year of death, and prior unfiled returns may also be due if the filing rules are met. An estate may need Form 1041 and an EIN when its income and circumstances require them. Form 706 concerns federal estate-tax reporting and portability, not routine transfer of a brokerage account.
2026 estate-tax threshold: keep it separate from the claim packet
For a U.S. citizen or resident who dies in 2026, the IRS Form 706 instructions describe a $15,000,000 filing threshold based on the gross estate, adjusted taxable gifts, and the specific exemption. A portability election can create a filing requirement even when the estate would not otherwise exceed the threshold. This figure is a tax-filing rule for 2026 decedents, not a document that every heir must present to a brokerage. Check the Form 706 instructions for the date of death and consult a tax professional when the estate may approach the threshold or seek portability.
Step-by-step claim process
- Inventory the holdings. Locate statements, tax forms, online account records, transfer-agent notices, and paper certificates. Record registration, account number, beneficiary designation, and contact information for each institution.
- Notify the institution. Use the death-reporting number or secure message channel and ask for the current packet for that exact registration. Ask where documents must be sent and whether originals, certified copies, notarization, or medallion guarantees are required.
- Identify the authorized claimant. A named beneficiary, surviving joint owner, trustee, or court-appointed representative may each have a different form. Do not sign as executor until the court has issued the appointment document.
- Assemble account-specific documents. Match the death certificate, claim form, identification, authority papers, trust evidence, and certificate-transfer documents to the institution’s checklist. Keep a scan or photocopy of every page.
- Submit and track delivery. Use the firm’s stated upload, mail, or in-person method. Record the date, tracking number, representative’s name, and any missing-item notice.
- Review the proposed registration. Confirm the new owner, beneficiary designation, cost-basis information, withholding elections, and account type before accepting the transfer or requesting a distribution.
- Coordinate tax and estate records. Give statements and transfer confirmations to the executor, tax preparer, and other beneficiaries. Keep the institution’s final confirmation with the estate file.
Common delays and how to prevent them
- Wrong packet: An IRA beneficiary form cannot substitute for an estate claim form. State the registration and account type when requesting documents.
- Unacceptable death certificate: Ask in advance whether the firm requires a certified copy, a raised seal, a recent issue, or a particular translation.
- Outdated court letters: Obtain a current appointment document if the firm’s rules require it to be recent or visibly sealed.
- Missing signatures: Confirm whether all co-executors, trustees, or beneficiaries must sign and whether signatures must be notarized or guaranteed.
- Beneficiary mismatch: The name on the claim must match the institution’s registration and the claimant’s identification. Ask how to document a legal name change.
- Sending paper certificates too soon: Get written transfer instructions and signature-guarantee requirements before mailing an original.
- Mixing tax and transfer decisions: Claiming an asset and choosing when to sell or distribute it can have different tax effects. Obtain the custodian’s inherited-account instructions before taking action.
What to ask every brokerage or transfer agent
- What is the account’s exact registration and beneficiary designation?
- Which claim or re-registration form applies?
- What death-certificate format and number of copies are required?
- Does the firm require current Letters Testamentary, Letters of Administration, a trust certification, or another authority document?
- Are signatures notarized, medallion-guaranteed, or witnessed?
- Where should documents be uploaded or mailed, and will originals be returned?
- Will the transfer create a new inherited IRA, estate account, or taxable distribution?
- What additional documents are needed for multiple beneficiaries, minors, a deceased beneficiary, or a name discrepancy?
Bottom line
Most heirs should expect to provide a death certificate, the holding institution’s own claim or transfer form, and identity or taxpayer information. Add current court appointment papers when an executor or administrator must control probate property; add trust evidence when a trustee is acting; and expect extra certificate and signature-guarantee requirements for paper securities. TOD and beneficiary designations can bypass probate, but they still require a formal claim and re-registration. Because forms and acceptance rules vary, the institution holding each investment is the final authority on the packet it will accept.
