The correct papers depend on the current deed, how the deceased owner held title, whether a will was probated, whether another owner has survivorship rights, and the law of the state and county where the land sits.
Start by obtaining the recorded deed and a certified death certificate. Then identify the transfer route. Depending on the facts, the recording package may include certified letters testamentary or letters of administration, a probated will, a court order or certificate of transfer, an heirship or lack-of-probate affidavit, a survivorship affidavit, or a transfer-on-death deed confirmation. A death certificate proves the owner died; it does not by itself establish who is entitled to the property.

Why the deed determines the document list
“Title” is the ownership interest in the real estate. A deed is one instrument used to transfer or document that interest, but title can pass by other legal mechanisms. Texas State Law Library guidance, for example, explains that a deed is not always required for inherited title to pass. Additional filings may still be necessary to make the new ownership evidence part of the public land records.
Read the current deed exactly as recorded. It should show the legal description, the county, the named owner or owners, and wording that may indicate survivorship, a trust, or a transfer-on-death designation. A deed showing one owner usually points to a probate or heirship analysis. A deed naming joint owners with survivorship language can support a survivorship filing instead. A recorded transfer-on-death deed may require a beneficiary confirmation after death.

The same family circumstances can produce different paperwork in different states. Washington statutes, Ohio statutes and county standards, Nebraska register-of-deeds guidance, and South Dakota law illustrate separate procedures and eligibility limits. Use those examples to understand the possible routes, not as a nationwide form set.
Documents by transfer route
| How title may pass | Documents commonly used | Probate position | Typical filing destination |
|---|---|---|---|
| Probated will | Certified letters testamentary, the probated will when required, and a court order or certificate of transfer or distribution; an executor’s deed may be used where local procedure calls for one | Estate is being administered | Land-records office in the county where the property lies, with probate-court records supplied as required |
| Intestate estate | Certified letters of administration, an order or certificate of transfer or distribution, and an administrator’s deed when required | Estate is being administered without a will | County recorder, register of deeds, or comparable land-records office |
| Heirs take without a probate transfer | Heirship, succession, or lack-of-probate affidavit; certified death certificate; legal description; heir and relationship information; statements about probate or estate value where required | May avoid a probate transfer if the jurisdiction permits and eligibility rules are met | County land-records office; some procedures require filing in every county containing covered land |
| Survivorship interest | Survivorship affidavit or affidavit confirming the deceased joint tenant’s death, usually with a certified death certificate | Passes by operation of law rather than through a will distribution | County recorder or register of deeds, sometimes with an auditor or tax-office step |
| Recorded transfer-on-death deed | Beneficiary’s verified affidavit or confirmation and a certified copy of the death certificate | Passes under the recorded designation, subject to state requirements | County auditor and recorder or the equivalent offices specified locally |
| Court-ordered transfer | Certified copy of the order requiring the transfer, plus any local transfer, tax, or recording forms | Determined by the court order | Land-records office in the property’s county |
The table describes common document types, not guaranteed requirements. A county can require particular wording, notarization, tax declarations, signatures, or certified copies in addition to the core papers.
Probated will or intestate administration
When a personal representative is administering the estate, the representative must show the authority granted by the probate court. Certified letters testamentary establish an executor’s appointment under a will. Certified letters of administration establish an administrator’s appointment when there is no will or the will does not control the administration.

The land-record package may also include the will as admitted to probate, a court order, or a certificate of transfer or distribution identifying the property and the person or persons who receive it. Some states or transactions use an executor’s or administrator’s deed to place the transfer into the real-property records. Washington’s statutory documentation provisions specifically distinguish certified letters testamentary for a transfer under a probated will from letters of administration for intestate administration.

Heirship, succession, or lack-of-probate affidavit
Some jurisdictions permit heirs to document ownership without a conventional probate transfer. The affidavit generally identifies the deceased person, date and place of death, residence, legal heirs, family relationships, the property’s legal description, and facts showing why the estate qualifies for the simplified process. A certified death certificate is often attached.
Washington lists a certified death certificate and a signed lack-of-probate affidavit for specified operation-of-law or unprobated-will circumstances. Nebraska describes a qualifying affidavit filed with the register of deeds. Ohio’s descent-and-distribution procedure uses an affidavit identifying the death, residence, heirs, relationships, and inherited shares, or a probate-court certificate of transfer.
Do not assume an affidavit is available merely because every heir agrees. South Dakota’s statute illustrates that these procedures can have a waiting period, a value ceiling, required signatures from successors, and restrictions when a personal representative has been appointed. Another state may set entirely different conditions.
Survivorship rights
If the deed gives a surviving co-owner a right of survivorship, the survivor commonly records an affidavit confirming the death and attaches a certified death certificate. The affidavit connects the death to the exact deed and legal description so the public record reflects the survivor’s ownership.

County practice can add steps. Cuyahoga County standards, for example, describe an affidavit with a certified death certificate for a deceased joint tenant’s survivorship interest. The county may also require an auditor review, a particular form, notarized signatures, or tax-related information.
Transfer-on-death deed
A transfer-on-death deed names a beneficiary while allowing the owner to retain control during life. After death, the beneficiary generally files a post-death confirmation rather than signing a new deed from the deceased owner. Ohio Revised Code section 5302.222 provides an example: the beneficiary files a verified affidavit of confirmation through the county auditor and recorder with a certified copy of the owner’s death certificate. Washington’s documentation provisions also identify a certified death certificate for a transfer under a transfer-on-death deed.
Court-ordered transfer
When a judge directs the transfer, obtain a certified copy of the order, not merely an informal printout. The order should identify the property or legal description and the person entitled to receive it. Washington’s statute identifies a certified court order requiring the transfer in its specified documentation context. The county may still require a separate cover sheet, transfer declaration, tax form, or recording fee.
How to identify the correct route
- Get the current recorded deed. Request it from the county recorder, register of deeds, or equivalent office. Confirm the legal description and every name on the title.
- Read the vesting language. Look for sole ownership, joint ownership with survivorship, a trust, or a transfer-on-death designation. Do not rely on a tax bill or an old closing statement when the recorded deed is available.
- Locate estate records. Determine whether there is a will, an open probate case, an appointed executor or administrator, or a court order affecting the property.
- Check nonprobate eligibility. If no probate transfer is pending, ask whether the state permits an heirship, succession, or lack-of-probate affidavit and whether waiting-period, value, signature, or representative-appointment limits apply.
- Match the beneficiary or heir evidence to the deed. Names, marital status, legal descriptions, and ownership percentages must be consistent. Differences can trigger a title review or a corrective filing.
- Ask the county for its current packet. Confirm forms, certification rules, notarization, signatures, auditor or tax-office review, recording fees, transfer declarations, and treatment of delinquent taxes before anyone signs.
What to assemble before recording
- A certified copy of the death certificate, if the selected route calls for one. Order enough certified copies for each office that requires an original or certified copy.
- The current deed and the complete legal description. A street address alone may not satisfy a recording office.
- Certified letters testamentary or letters of administration when a personal representative is acting.
- The probated will, probate order, certificate of transfer or distribution, or certified court order when the procedure requires it.
- A completed heirship, succession, lack-of-probate, survivorship, or transfer-on-death confirmation affidavit, with notarization and witness signatures if local rules require them.
- Any county transfer declaration, tax form, auditor certification, or evidence addressing delinquent taxes. Ohio county standards show that some conveyances involve auditor review and delinquent-tax handling.
- Identification and contact information for every person who must sign. An incomplete signature set can prevent recording even when the inheritance itself is undisputed.
Where and how to file
Record the documents in the county where the land is located, not necessarily where the deceased lived or where probate was opened. Texas and Nebraska guidance direct filings to the local land-records office. If a parcel crosses county lines or the estate includes separate parcels, a filing may be needed in every county containing covered property; Nebraska’s procedure is an example of that approach.

The responsible office may be called the recorder, register of deeds, clerk, auditor, or land-records division. Some counties divide the work: an auditor reviews a transfer first, then the recorder accepts it. Ask whether documents must be presented together and whether the office accepts mail, in-person delivery, or electronic recording.
Recording makes the ownership evidence visible in the public chain of title. It does not cure a defective affidavit, an incorrect legal description, an omitted heir, or a conflict between the deed and the estate documents. Keep the recording receipt, instrument number, and stamped or certified copies for later sale, refinancing, insurance, or tax work.

The family has a death certificate but no ownership document
A death certificate proves death, not entitlement. Obtain the deed and determine whether the next document should be probate authority, an heirship affidavit, a survivorship filing, a transfer-on-death confirmation, or a court order.

Heirs disagree or one heir cannot be located
A simplified affidavit route may require signatures from all successors or may be unavailable when ownership is contested. An estate proceeding or court order may be necessary. Do not record a statement that omits a known heir.
The property is in more than one county
Confirm whether the same instrument must be recorded separately in every county. Use the identical legal description and certified attachments required by each office, and retain each recording number.
Taxes or liens appear during the transfer
Ask the county whether delinquent taxes, a transfer declaration, or a tax exemption form must be addressed before recording. Ohio county standards identify delinquent-tax handling for some conveyances. A recording office’s acceptance does not necessarily resolve liens or other title defects.

Multiple deaths, prior unrecorded deeds, trusts, name changes, or property outside the state can require professional review. A probate or real-estate attorney in the property’s jurisdiction can determine the lawful route and prepare a corrective or court filing when a standard form is insufficient.
When professional advice is warranted
Local legal advice is especially important when heirs disagree, the deed is missing or ambiguous, more than one estate is involved, a creditor or lien is present, the property is in another state, or a sale is planned before the record is corrected. County staff can explain filing mechanics and current forms, but they generally cannot decide who legally inherited the property or resolve competing claims.
The most reliable sequence is therefore: identify the deed’s vesting, establish the estate or nonprobate route, gather certified proof of death and authority or heirship, verify county-specific forms, and record in every county that holds the land. Because statutes and office procedures change, confirm the requirements in force when you file; the examples above demonstrate why a checklist from another state cannot be adopted wholesale.
