The classification depends on the loan program and the facts you certify—not simply on where you own property, receive mail, or spend occasional nights. A second home, an investment property, a planned move, or a home occupied by a family member can be treated differently under different rules.
How mortgage rules define a primary residence
Fannie Mae’s Selling Guide gives the conventional-loan definition directly: “A principal residence is a property that the borrower occupies as their primary residence.” That wording makes occupancy—the borrower actually living in the home as the main household residence—the central issue.

There is no single definition that controls every mortgage product. A conventional lender may apply its underwriting guide; a government-insured or specialized program can have its own occupancy conditions; and federal reporting or tax rules use related but not identical terminology. Your signed occupancy certification and the specific loan documents control your transaction.

One principal residence at a time
The Consumer Financial Protection Bureau’s official interpretation of Regulation C states: “For purposes of § 1003.4(a)(6), an applicant or borrower can have only one principal residence at a time.” This is a data-reporting rule, but it reflects the practical distinction lenders make between a main home and other properties. Owning two homes does not, by itself, make both primary residences.

Primary residence, second home and investment property
Occupancy and the purpose of the property separate the three broad categories. The following comparison uses the definitions in the CFPB Regulation C commentary and Fannie Mae’s occupancy guidance; an individual lender can impose additional eligibility or documentation requirements.
| Situation | Typical classification in the cited rules | What the classification does not establish |
|---|---|---|
| Borrower lives in the property as the main home | Principal or primary residence | It does not waive the lender’s income, credit, down-payment or property requirements. |
| Borrower uses a vacation home during part of the year, but it is not the main home | Second residence or second home | The CFPB reporting definition does not set every lender’s second-home underwriting terms. |
| Borrower will not occupy the property | Investment property | Rental income is not required for the property to be non-owner-occupied. |
| Property is being bought or built to become the main home | Can be treated as a principal residence for a specific Regulation C transaction when it will become the principal residence within one year or when construction is complete | This is not a universal move-in deadline for all mortgage programs. |
Under the CFPB’s Regulation C commentary, a second residence is occupied for part of the year but is not the borrower’s principal residence. An investment property is one the borrower will not occupy. Fannie Mae likewise describes an investment property as property owned but not occupied by the borrower.
What lenders look at when deciding occupancy
Underwriting normally compares your stated intent with the transaction’s facts. The relevant questions are practical rather than merely semantic:
- Will you occupy the home as your ongoing main residence?
- Is another property currently your main home?
- Will you occupy the new property at all, or is it intended for tenants or occasional visits?
- Are you buying or building the home as part of a documented move?
- Does a program-specific exception apply to a co-borrower or family housing arrangement?
Your loan application, occupancy affidavit, purchase contract, appraisal information and closing documents should tell a consistent story. If your circumstances change before or after closing, ask the lender or servicer how the change affects your obligations instead of assuming the original label remains correct.
Moving after closing: what the one-year language means
People often hear that a borrower must move in within a particular number of days. The official material cited here does not establish one universal move-in deadline or a minimum number of nights for every mortgage.

The CFPB’s Regulation C interpretation provides a narrower rule for reporting: a home bought or built to become the principal residence within one year, or when construction is complete, can be considered the principal residence for that transaction. That statement explains how a specific reportable transaction is categorized; it does not override a lender’s occupancy certification or create a blanket timetable for conventional, government or portfolio loans.
Before you sign
- Read the occupancy representation in the application and closing package, including any language about intended use.
- Tell the loan officer about a delayed move, sale of your current home, temporary work assignment, renovation, leaseback or other circumstance that affects when you can occupy.
- Ask the lender to state in writing which program rule applies and what documentation it requires.
- Keep records of the explanation and follow-up instructions with your closing documents.
Can you have two primary residences?
For the CFPB’s Regulation C reporting purpose, no: an applicant or borrower can have only one principal residence at a time. A household can own and use another property, but that property is generally a second residence if it is used part-time or an investment property if the borrower does not occupy it.

1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsSpecial circumstances—such as a job-related move, a new construction project or a transition between homes—can make the facts more complicated. The answer then depends on the transaction date, the borrower’s stated intent and the applicable program rule. Do not select “primary residence” for two simultaneous properties merely because both are important to your household.
What if a parent, child or other family member lives there?
A property occupied by a relative is not automatically the borrower’s primary residence. The default question remains whether the borrower occupies it as their own main home.
Fannie Mae lists limited exceptions. In a transaction with multiple borrowers, generally only one borrower needs to occupy and take title, subject to the guide’s conditions. Fannie Mae also identifies an exception for a parent or guardian providing housing for a qualifying disabled adult child. These are program-specific provisions, not a general rule that any family member’s occupancy satisfies a borrower’s requirement.

How to handle a family arrangement
- Tell the lender exactly who will live in the property and whether any borrower will occupy it.
- Ask whether the transaction is being underwritten under a non-occupying co-borrower or family-housing exception.
- Obtain the lender’s required documentation before making an offer or waiving contingencies.
- Do not describe a property as owner-occupied solely to obtain pricing or eligibility if the borrower will not meet the program’s occupancy rule.
Primary residence versus tax “main home”
Tax terminology is relevant but does not replace mortgage underwriting. The IRS says in Publication 530 (2025): “This is the home where you ordinarily live most of the time.” That is the federal tax concept of a main home.

Part-time use, rentals and mixed occupancy
Part-time or seasonal use
A cabin, beach property or other home used only during vacations is generally not the principal residence when another property is the borrower’s ongoing main home. The CFPB describes that situation as a second residence for its reporting framework.
Renting the property
A property can still be someone’s primary residence even if a portion is rented, but the cited sources do not create a universal rule for every accessory unit, roommate, short-term rental or leaseback. Conversely, a property does not become a primary residence simply because it produces little or no rent. The key facts are the borrower’s occupancy and the program’s definition.
Changing use after closing
Converting a home to a rental, moving out, or using it as a second home can affect duties under the note, security instrument, occupancy certification, insurance and servicing rules. The official sources here do not establish one automatic penalty or a universal waiting period. Review your documents and contact the servicer before making a planned change.

Reverse mortgages have continuing occupancy duties
For a Home Equity Conversion Mortgage (HECM), the CFPB explains that the borrower must continue meeting principal-residence occupancy responsibilities. Its guidance also addresses certain periods of absence. Those requirements are specific to HECM reverse mortgages and should not be generalized to every forward mortgage. Read the HECM documents and ask the servicer how an absence, hospitalization, move or co-borrower situation is treated.
Documents and questions to prepare for your lender
No single proof checklist applies to every lender, but organized information can prevent an occupancy misunderstanding. Be ready to explain:
- The address where you currently live and the date you expect to move.
- Whether you own, rent or plan to retain another property.
- Who will occupy the new home and whether anyone will be a non-occupying co-borrower.
- Whether the property is intended for a tenant, seasonal use, renovation or construction.
- Any family-housing arrangement, disability-related exception or planned transition between homes.
Ask the lender which occupancy category appears on the application, which rulebook governs it, what evidence is needed and what to do if your plans change. Confirm that the final closing documents match the explanation you gave during underwriting.
Common occupancy mistakes
Calling every owned home a primary residence
Ownership is not occupancy. A second property remains a second home or investment property under the relevant definition even if you pay its mortgage and taxes.
Assuming a tax definition controls the loan
The IRS “main home” concept and a lender’s principal-residence test overlap in ordinary language but serve different purposes. Use the mortgage program’s rule for the mortgage application.

Treating the Regulation C one-year rule as universal
The within-one-year or construction-completion language is tied to CFPB reporting treatment. It is not a guaranteed move-in window for every loan.
Relying on a relative’s occupancy without checking an exception
Family occupancy only helps when the applicable program expressly permits it and the transaction meets its conditions.
Failing to update the lender when plans change
A delayed move, new tenant, relocation or decision to retain the old home can change the facts on which the occupancy certification was based. Contact the lender or servicer before acting.
